CITY OF PALM BEACH GARDENS
DECEMBER 22, 1977
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Feeney at 8:00 P.M. in the
Assembly Room, 10500 North Military Trail, Palm Beach Gardens,
Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: CouncilmanE
Kiedis, Councilman Martino, Councilman Wiley, Vice Mayor Laurie
and Mayor Feeney. Attorney Brant was in attendance. City
Manager John Orr was absent.
MINUTES: The Minutes of the Special Meeting of December 13, 1977 were
unanimously approved by the Council as written.
The Minutes of the Regular Meeting of December 15, 1977 were
unanimously approved by the Council as written.
COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
SAM CARSILLO: Sam Carsillo spoke from the audience and suggested that a
temporary traffic light be installed at Burns Road and Alt. AIA,
and made the suggestion that the power lines be run in back of
the hospital, due to the excessive cost of placing them under-
ground, in order to construct a helicopter pad at the hospital.
PETITIONS AND COMMUNICATIONS:
ORDINANCE Councilman Martino advised he had received a call from Attorney
17? DeSantis asking that the Council reconsider Ordinance #17, 1977
relative to conditional uses permitted within a C -2 General
Zoning District, since he and his client, due to circumstances
beyond their control, were unable to attend the meeting on
December 15, 1977 when the ordinance was on the agenda for

consideration. The Council concurred to reconsider the
COMMISSIONER
ordinance at the Regular Meeting on January 5, 1978, if one
of the Council members moves to reconsider the ordinance, since
the vote to adopt the ordinance was defeated by 4 nay votes.
Mayor Feeney acknowledged receipt of a letter written to Peggy
Evatt, County Commissioner from David DeBacker, Administrator
of the Palm Beach Gardens Community Hospital re the need for
a traffic light at Alt. AlA and Burns Road; and a copy of
a letter to Mr. Webb, Florida East Coast Railroad from
Commissioner Evatt pertaining to the same subject.
RESOLUTION Consideration of a Resolution re amending the current statutory

PR V S OR licensing tax provision pertaining to mobile homes without

wheels will be held at the Regular Meeting on January 5, 1978.
Sam Carsillo asked that Government subsidized homes be included
in the resolution, but the Council concurred to consider that
subject in a separate resolution.
ORDINANCES: Consideration of an ordinance regarding conditional uses
CONDITIONAL in M--IA Light Industrial District, and an ordinance amending
Section 15 -36 of Chapter 15 Licenses and License taxes will
be held at a future date, at the request of Mr. Chan Clark,
Camdaras, Inc., who was unable to attend this meeting.
REFERENDUM Consideration of an ordinance regarding a Referendum Election
- changing the election filing dates was held.
EL CT N The Ordinance, as drafted by Attorney Brant, and amended by

the Council, will be read on first reading at the Regular
Meeting on January 5, 1978 and a Public Hearing and Second
Reading of the Ordinance will be held on January 19, 1978.

ITEMS FOR DISCUSSION:
GARDEN LAKES A continuation of the review process of the proposed PUD-
�, PUD_ Garden Lakes project as proposed by Mr. Otto DiVosta was held
between the Council and Attorney Raymond Royce and other staff
members representing Mr. DiVosta.
Discussion centered around the provisions made for recreational
purposes and the percentage of area for recreation, and if
any areas were to be dedicated for public use.
It was suggested by the Council, in addition to providing lights
for the tennis and basketball courts, that lights be provided
on the jogging course.
Reference was made by Councilman Martino that 4 acres of the
11.2 acres proposed for recreation is water, which does not
meet the 10% guideline of gross area for parks and recreation,
'1-1 and proposed that Mr. DiVosta dedicate the 3 acres of land
located in the northeast corner of the property to the City for
a park. A poll was taken of the Council, and they agreed
unanimously with Councilman Martino's remarks that 3 acres be
dedicated to the City.
Attorney Royce pointed out that they felt the 4 acres of water
made up for the shyness of recreational areas in that water
provides passive recreation space, plus a bicycle path would
encircle the water area. He further added that the title
for the 3 acres in question is being retained by the developer.
Attorney Royce suggested leasing the 3 acre parcel to the City
for $1 a year, on a year by year basis until I -95 is
constructed through that area, and so that the developer would
have control over a facility being constructed that might
adversly affect the rest of the project.

In answer to the concern of Councilman Wiley over the
architectural design of the buildings being identical, Mr.
Ted Davis reiterated his presentation made at the Special
Meeting on December 13, 1977, explaining the use of foliage,
moundings and elevated clusters.
Specific items were discussed that are pertinent factors for
the ordinance and will be included in the ordinance.
Mr. DiVosta agreed to have a punch out area to the West, similar
to one that will be provided on the East to Military Trail, for
the use of emergency vehicles. This will not be a pavedarea
nor an entrance, but contain shrubbery that will not impede
an emergency vehicle from entering.
The maintenance of the drainage and canal system will be the
responsibility of the Northern Palm Beach County Water Control
District. Attorney Brant will consult with Howard Searcy on
this data, since he is the engineer for the City and on the
Board of the Northern Palm Beach County Water Control District.
The exchange of dedicated easements in the lakes will be
between the developer and the Water Control District.
Mr. DiVosta agreed to provide curbs and grass on the median
strips on Military Trail and PGA Blvd., if the State Road
Department permits it, and the City or the State will maintain
same.
A rough diagram of the access points in relationship to the
streets and cuts will be provided by Mr. DiVosta for the
Council's perusal.
In answer to a question posed by Councilman Martino, Mr. DiVosta
stated he does not want, nor does he plan on putting sidewalks
along Military Trail. The City Manager was directed to

determine if the County plans on putting sidewalks in that area.
A five minute recess was called by Mayor Feeney at 10:30 P.M.
The meeting reconvened at 10:35 P.M.
Attorney Brant called attention to the State Statute relative
to the notice requirements concerning ordinances which rezone
private real property, in that a public hearing must be held
30 days before the adoption of an ordinance and that the
petitioner must have 30 days notice of the public hearing.
Attorney Royce stated that the Statute is designed to protect
the land owner, and they were willing to waive the notice, and
any complaints in the future. This information he will
provide in writing.
Mr. DiVosta stated his main concern was to have his construction
work continue from Sandalwood Phase 11 to this project, to
eliminate laying off any men between jobs, and if the public
hearing dates could be met, he would dedicate the 3 acres
in the northeast corner of the parcel of land to the City, with
the stipulation that the uses would be restricted to passive
recreation, such as picnic areas and open space.
The Council unanimously agreed, and authorized the City Attorney
to prepare an ordinance establishing a Planned Unit Development
on land located on the northwest corner of PGA Blvd. and
North Military Trail located in Section 1 -42 -42 for first
reading on Thursday, January 5, 1977.
The Council agreed that Mr. DiVosta could build his construction
area and minor preparation work on the site.
ADJOURNMENT_ Due to the lateness of the hour, consideration was not
given to the remainder of the agenda, and the meeting adjourned
at 10:55 P.M.
