PALN HIACH GARDINS JANUAP Y 29, 1976 The `,eccjular ,,jeetinc; of the City council of i'alm Beach Gardens, was called to order by Payor Martino at 8:oU P.M. in the Assembly Room, 10500 N. military Trail, Palm Beach Gardens, i lorida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor rartino, Councilman ktiiley, Councilman Kiedis and Councilman Feeney. Vice Mayor DeLonga was absent because he was out of Towrn on business. Attorney Brant was in attendance. MINUTES: The Minutes of the [torkshop :Meeting of January 22, 1976 were unanimously adopted by the Council. ANNOUNCEMENTS: Mayor nartino made the following announcements: A General Election of the City would be held on ,arch 16, 1976. A candidate may file between February 20 and �ebruaay 29, 1976. riJay, Jauary 30, 1976 is the last day to register to vote. ACCEPTANCE OF APPEARANCE FLAN: Mayor Martino presented letters of appreciation to the members of the Appearance Plan Committee and thanked them for working so diligently in preparing an Appearance Plan that will benefit the residents of the City. Mr. Sy Fine, Mr. Hilmy Adeeb and Mr. Art Nelson were present to receive their letters. Other members or the committee not present were Lou Oxnevad, James Blakely and Robert Sellers. A letter of appreciation will be given to Mrs. Fred Rudolph whose husband also served on the Committee and has s since passed away. P.egular Meeting, January 29, 1976 Page 2 AWARDING OF A motion was made, seconded and unanimously adopted to accept the BIDS: recommendation of the City Manager and award the bid for the construction of four (4) tennis courts to McIntosh Paving for the low bid amount of $25,508.00 funds to be taken from the Capital Improvement General Fund. City Manager ,john Orr advised the amount for curbing had been subtracted from all bids and the final bid tab is as follows: F.C.Feise Company - X31,105.00 McIntosh Paving - ,25,508.00 Asphalt Paving - . 30, 144.00 Rubin Construction - '�26,698.bO George Risolo _ X269723.00 Mondell Paving - X270103.63 Simgo Corp. - $26,225.00 Charles Whiteside - $25,543.75 TENNIS COURT Councilman viley suggested that the difference between the amount LIGHTS: budgeted for the construction of the tennis courts and the amount of the bid be used toward providing lights for the courts. The City Manager will determine the cost for lighting the courts. PETITIONS AND COMMUNICATIONS : Mayor Martino acknowledged receipt of communications from: PBG COMMUNITY 1. David W. Regular Meeting, January 29, 1976 to U.S. 1 in Jupiter. Wage 3 C0AMISSIONER 3. County Commissioner Culpepper informing that the construction �. CULPEPPER : of the bicycle paths on Military Trail and MacArthur Blvd. have been completed. NORTHERN PALM 4. Northern Palm Beach County Chamber of Commerce Resolution BEACH COUNTY relative to the northern terminus of I -95. COMMERCE: RESOLUTIONS: Resolution #4, 1976 Adopting the Storm Drainage Report for the RESOLUTION #4, City of Ealm Beach Gardens was read in full by the City Clerk and unanimously adopted by the City Council. RESOLUTION #5, Resolution 7#5, 1976 appointing Steve Henning as Assistant Director of Recreation was read in full by the City Cleric and unanimously adopted by the City Council. RESOLUTION #69 Resolution #6, 1976 Adopting the Appearance Plan for the City 1970 : was read in full by the City Clerk and unanimously adopted by the City Council. ORDINANCES: Ordinance #1, 1976 Annexing lands in Section 5-42 -43 was read in ORDINANCE 11, full by the City Clerk on first reading. 1976: A Public Hearing and Second Reading will be held on February 19, 2/5/76 1976. Councilman Feeney and Councilman Kiedis objected to reading the correction ordinance on first reading without the presence of members of the P&Z Commission, or the benefit of a workshop. ORDINANCE 4+26, The Public Hearing was declared opened by Mayor Martino on consideration of Ordinance #26, 1976, The Charter. Mayor Martino reviewed the amendments made to the Charter as proposed by the Charter Review Committee and the two proposals that will appear at the General election on March 16, 1976 on the referendum election ballot. i Regular Meeting, January 29, 1976 Page 4 Councilman viley recommended changing the date of the election, for economic reasons, to the second Tuesday of March to coincide with the County elections; and that a chndidate shall file during the last 15 calendar days of February. Attorney Brant suggested that Article XV, The Recall , Section 15 -1 be amended to read "The Mayor, any councilman or any other elected official may be recalled and removed from his or her respective office as provided under the General Statutes of Florida." MOTION: Motion was made, seconded and unanimously carried that Ordinance #26, 1975 be read by title only, by the City Clerk on second reading with the following amendments: Article IV, Section 4 -1 first paragraph to read "General elections shall be held on the second Tuesday of ,~larch of each year; Any candidate seeking election as councilman shall file with the city clerk a written notice to such effect during the last 15 calendar days of February in the year of the election ....... ; "Article XV, Section 15 -1 to read "The rayor, any councilman or any other elected official may be recalled and removed from his or her respective office as provided under the General Statutes of Florida "and to delete Section 15 -2, Section 15 -3, Section 15 -4 and Section 15 -5. Motion was made, seconded and unanimously carried that Ordinance #260 1975 be adopted as amended. The City .Manager and Mayor will schedule workshop meetings for discussion on the Charter in February and copies will be sent to service organizations in the area with the notation that Council membws will address any group if they are interested, and relate the intent of the proposed amendments to the Charter. Regular Fleeting, January 29, 1976 Page 5 REPORTS: Mayor Martino reported he had attended the meeting of the Planning PLANNING AND and Zoning Commission held January 27, 1976 and the item for �. ZONING 00MMISSION: consideration was the proposed contract with Marvin Hill for future services. PSG COVJv1_NITY Councilman Feeney reported he had attended the Palm Beach Gardens HOSPITAL: Community Hospital Board of Directors meeting held January 23, 1976 where the announcement was made that groundbreaking ceremonies were being planned for the week of March 15, 1976. Councilman 1`eeney stated he had advised the group they must present their plans for site plan approval before construction can commence. ITE:'v]S BY CITY MANAGER: City Manager John L. Orr advised of the following: GAS RATS. 1. A copy of the proposed rate increase by the Seacoast Gas Company INCREASE: to the P.S.C. had been received indicating an increase in natural gas rates from ;2.50 minimum to ;,7.00 minimum. 2. "Pavement Narrows" signs have been ordered. 3. Technical data on Slurry Seal was not available. -4�. Sprigs will bc, obtained from Jnm for plant Drive. ITEMS BY INAY'OR AND COUNCIL: Mayor .I.ar tino: The City Manager will set up the administrative procedure for purchasing stock trees from the State Forestry Division to re -sell to the residents of the City, for their personal use in the City. LETTER TO P.S.C.: Mayor P- ,artino advised he had re- drafted the letter to the P.S.C. re general investigation into water and sewer rate structure, which the Council will sign before mailing. SCHOOL BOUNDARY Mayor Martino referred to a letter from Mr. Pappalardo with an i Regular Meeting, January 29, 1976 Page 6 attached notice of boundary changes as proposed by the School Board for the school children living in Palm Beach Gardens. The meeting will be held on February 2, 1976 at 7:00 P.M. at Jefferson Davis Middle School and the Council concurred that the Mayor should attend this meeting expressing the objections or the Council. COUNCILMAN Councilman Feeney suggested a statement of policy be adopted FE ENEY : regarding annexation that any parcel that is annexed in to the City be taken in no higher than the present zoning or as R -1 automatically for six months to a year. Councilman Feeney suggested that consideration should be given to elected Councilmen representing certain districts, so that the entire City is always represented on the Council. Councilman Feeney announced that his name would appear on the ballot for re- .election. COUNCILMAN Councilman Wiley suggested tbt the list of priority items be WILEY : placed in order as to budgeted items and capital improvement items, estimated costs on all items be made by the City Manager and items less than $1000 put on the public works weekly report with a time break down. At the suggestion of Councilman Wiley the recommendation from the Merit System Board regarding sick leave policy will be placed on the agenda of the Regular Meeting on February 5, 1976 as an item for discussion.
