HomeMy WebLinkAboutMinutes Council 041579REGULAR MEETING CITY OF PALM BEECH GARDENS APRIL 15, 1976 The Regular Meeting of the City Council of Palm Beach Gardens, was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor Feeney, Councilman Kiedis and Councilman Laurie. Councilman Rossow was detained and arrived late. Attorney Brant was in attendance. MINUTES: The Minutes of the Workshop Meeting of April 81 1976 were ANNOUNCEMENTS: unanimously approved by the Council. Mayor Martino announced that the Easter Egg Hunt sponsored by the Recreation Department would be held on Saturday, April 17, 1976 at 9 :00 I.M. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: Mr. Frank Brandow, owner of Palm Mower Shop, a business located in the City, advised the Council his place of business had been robbed and asked the cooperation of the Police Department in patrolling that area more frequently. The City Manager was asked to make an information report to the Council on the incident. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged receipt of communications from: PHILIP ASHLER: 1. Philip F. Ashler, Insurance Commissioner relative to the classification of youthful operators for automobile insurance. 2. Representative Tom Lewis, Senator Philip D. Lewis and Senator Donnell C. Childers acknowledging receipt of the resolution Regular Meeting, April 15, 1976 Page 2 relative to Motor Vehicle Insurance for unmarried male persons between the ages of 18 and 25. AREA PLANNING 3. Area waste L+'ater Treatment Management Meeting to be held on BOARD: April 29, 1976 at the Area Planning Board, ?,Test Palm Beach at 1:30 P.M. Frank Brandow will attend the meeting,with the Mayor and City Manager,as a representative of the citizen portion of the City. RESOLUTIONS: Resolution #17, 1976 reappointing Dave Runkel to the Merit System RESOLLWVION #17, Board was read in full by the City Clerk and unanimously adopted =976.. by the Council. RESOLUTION #18, Resolution #18, 1976 urging the State Legislature to oppose the 976: removal of local agency control of building codes was read in full by the Catty Clerk and unanimously adopted by the Council. The City Clerk was instructed to send copies to the Town of Lake Park, the Village of North Palm Beach, the Legislative Delegation and Mr. Lawder of the Home Builders Association. RESOLUTION #19? Resolution #19, 1976 appointing members to the Committee of Adjustment will be held in abeyance and the persons who indicated an interest in serving on the committee will be invited to attend the Workshop Meeting on April 22, 1976. RESOLUTION #20, Resolution #20, 1976 requesting the enactment of legislation to 1976: make abandonment of municipal courts optional, and indicating that this City, for the time being would like to retain control of its Municipal court, was read in full by the City Clerk and unanimously adopted by the Council.. The City Clerk was instructed to send copies to the Town of Lake Park and the village of North Palm Beach. RESOLUTION ##21, Resolution #21, 1976 adopting the range and minimum and maximum Regular Meeting, April 15, 1976 Page 3 salaries was read in full by the City Clerk and unanimously adopted by the Council. RESOLUTION #22, Resolution #229 1976 Mutual Aid Agreement between the City and other Fire Control Districts and Municipalities was read in full by the City Clerk and unanimously adopted by the Council. ORDINANCES: Mayor Martino declared the Public Hearing open on consideration of ORDINANCE #49 Ordinance #4, 1976 adopting the Appearance Plan for the City, as T97-6—.-- duly advertised on March 30, 1976. There was no conversation from the audience or the Council. Mayor Martino declared the ?public Hearing closed, and thanked the Appearance Plan Committee again for their efforts in preparing the Plan which will benefit the City in the future. Ordinance #4, 1976 was read by title only, on second reading, by the City Clerk and unanimously adopted by the Council. ORDINANCE #5? Ordinance #5, 1976 annexation of certain lands within Section 4 -42_43 was read by title only, on first reading, by the City Clerk. A Public Hearing and second reading will be held on May 6, 1976. ORDINANCE #6# Ordinance #6, 1976 rezoning of certain lands within Section 442_43 1976: was read by title only, on first reading, by the City Clerk. A le ublic Hearing and second reading will be held May 6, 1976. REPORTS: Councilman Kiedis reported that the softball team members were PLANT DRIVE abusing the Plant Drive Field, and the Council concurred with FIELD: his suggestion that "no beer drinking" at Plant Drive Field be enforced. MERIT SYSTEM Councilman Laurie reported he had attended the Merit System Board BOARD: Regular Meeting, April 15, 1976 Page 4 Meeting held April 12, 1976: discussion was held on the merit system rules and regulations and the report presented by Councilman Wiley. P &Z COMMISSION Vice Mayor Feeney reported he had attended the Planning and Zoning -TING: M WE Commission Meeting held April. 139 1976; copies of the minutes are in the council information folder. S &E COMMITTEE Councilman Rossow reported he had attended the Beautification and MEETING: Environmental Committee Meeting held April 14, 1976; copies of the minutes are in the council information folder. Councilman Rossow commended Sam Carsillo, Chairman of the Board for planting 150 plants and stated he would assist him in planning for additional trees in the Town Hall home area. CHAMBER OF Mayor Martino reported he and other members of the Council had COMMERCE MEETING: attended the Chamber of Commerce breakfast held at the Sweden House on April 14, 1976. ITEMS FOR DISCUSSION: COLLECTIVE Discussion on the appointment of a negotiating committee representing BARGAINING: the City relative to Collective Bargaining was held in abeyance until an answer has been received from PERC relative to the election. ORDINANCE #7? Ordinance #7, 1976 enacting a moratorium for a period of three 1976: months on the issuance of building permits for the construction of Town Houses, Group Housing and Cluster Development buildings was introduced on an emergency basis due to the lack of a definition, requirements as to access and title to parking facilities, setback requirements etc. in the Palm Beach Gardens Code. City Manager John L. Orr advised that to his knowledge there are no major developments being contemplated at this time, and that i Regular Meeting, April 15, 1976 Page 5 the Planning and Zoning Commission is studying and will make recommendations to amend the Code requirements relative to Town Houses, Group Housing and Cluster Development buildings. Mayor Martino stated for the record that he was not in favor of placing Ordinance #7, 1976 on first reading. Ordinance #7, 1976 was read in full by the City Clerk on first reading on an emergency basis. Ordinance V. 1976 was read by title only by the City Clerk on second reading on an emergency basis and was unanimously adopted by the Council. ORDINANCE #8f Ordinance #8, 1976 increasing the costs for .filing of an 1976: annexation petition will be read on first reading on May 6, 1976 and a Public Hearing and second reading will be held on May 20, 1976. ITEMS BY THE CITY MANAGER: RESOLUTION #23, Resolution #23, 1976 changes in the Merit System Rules and Regulations will be workshopped at the meeting of April 22, 1976. The City Manager advised he will be out of the City on April 22, 23 and 24 to attend a meeting in Orlando. ITEMS BY THE MAYOR AND COUNCIL: Mayor Martino; The Council unanimously concurred not to hold a meeting on April 299 1976, which is the fifth Thursday in the month. Ordinance #17, 1975 Interim Services and Facilities Fee will be re- written by the City Attorney and workshopped at the meeting of April 22, 1976. .� Councilman Discussion will be held and a policy set regarding persons serving Laurie: on more than one Advisory Board at the Workshop Meeting of April 22, 1976. i Regular Meeting, April 15, 1976 Page 6 Councilman Councilman Kiedis asked that top dressing be placed on the Plant Kiedis: Drive fields and the City Manager will obtain the cost to replace the tennis court lights. Councilman Kiedis requested that persons be directed to park elsewhere at Plant Drive instead of in the spaces marked "no parking ". Discussion on Resolution #10, 1976 Agreement with the Tennis Pro will be held at the Workshop Meeting of April 22, 1976. In answer to a question posed by Councilman Kiedis, the City Manager advised that the City Hall and Public Works Complex does not conform to the Landscape Ordinance. Vice Mayor Vice Mayor Feeney questioned if it was feasible for the Public eeney: Works Department to clear the 9�g acres that the City recently p urchased.
