HomeMy WebLinkAboutMinutes Council 060376REGULAR MEETING CITY Or PALM BEACH GARDENS JUNE 3, 1976 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Plartino at 8:00 P.P.T. in the Assembly Room, 10500 N. Pilitary Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Plan. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor Feeney, Councilman Kiedis, Councilman Laurie and Councilman Possow. Attorney Brant was in attendance. MINUTES: The Minutes of the Workshop Meeting of May 27, 1976 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Martino made the following announcements: Committee of Adjustment Meeting would be held Monday, June 7, 1976 at 7 :30 ".M. Planning and Zoning Commission Meeting would be held Tuesday, June 80 1976 at 7 :30 P.M. Wolunteer firemen's Meeting would be held Tuesday, June 8, 1976 at 7:30 P.M. Recreation Advisory Board Meeting would be held Tuesday, June 8, 1976 at 8:00 P.M. Beautiiication and Environmental Committee Meeting would be held 1,ednesday, June 9, 1976 at 7 :30 P.M. INTRODUCTION: Mayor Martino introduced Sheri B ergbaum, reporter for the Post Newspaper. RESOLUTIONS: Resolution #25, 1976 appointing members to the Zoning Board of RESOLUTION #25, Appeals and inserting the name Dr. James Smith in Section 1 and 1976: Regular meeting, June 3, 1976 Page 2 the name Don Kiselewski in Section 2 was read by the City Clerk and unanimously adopted by the Council. RESOLUTION #26, Resolution #26, 1976 appointing a member to the Beautification and • Environmental Committee and inserting the name George O. Bayer in Section 12 was read by the City Clerk and unanimously adopted by the Council. RESOLUTION #27, Resolution #27, 1976 reappointing Arthur Nelson and Hilmy Adeeb to the Site Plan and Appearance Review Committee was read in iul.l by the City Clerk and unanimously adopted by the Council. RESOLUTION #28, Resolution #28, 1976 extending the time for use of a mobile home trailer at the First Church of God at 3937 Holly Drive was read by the City Clerk and unanimously adopted by the Council. It was noted that Rev. Powell indicated construction would be completed on the Church by the end of August, and at that time the trailer would be removed. ORDINANCES: Mayor Martino declared the Public Hearing open on consideration ORDINANCE #8, of Ordinance #8,1976 increasing the costs Lor filing of an 1� — annexation petition as duly advertised on May 18, 1976. There was no conversation lrom anyone in the audience or from the Council. Mayor Martino declared the Public Hearing closed. Ordinance 416, 1976 was read by title only, on second reading, by the City Clerk and unanimously adopted by the Council. ORDINANCE #100 Mayor Martino declared the Public Hearing open on consideration 1976: of Ordinance #10, 1976 Interim Services and Facilities Fee as �-- duly advertised on May 18, 1976. There was no conversation from anyone in the audience or from the Council. REPORTS: Vice Mayor Feeney reported he had attended the Special Meeting of PLANNING AND the Planning and Zoning Commission held June 1, 1976. Discussion NVING CMMSSION evolved around the removal of all structures except residential out of all R -3 distracts, and placing them under a conditional use; and discussion with Marvin Hill relative to the PUD ordinance developed by Clair Andersen. BICENTENNIAL Councilman Kiedis reported he had attended the Bicentennial COMMITTEE T NG : Committee Meeting held June 2, 1976 and that Committee was finalizing all the plans for the July 4th celebration. The Committee has contributed 8200 for the purdase of a loud speaking system. ITEMS POR DISCUSSION: SPECIFICATIONS: Ed Arrants, Fire Chief, made a presentation and expressed the need FIRE VEHICLE: to the Council for the proposed specifications for a 1000 gallon per minute triple combination pumper. Discussion followed and questions posed by the Council were answered by Chief Arrants and rireman Dick Cameron. The color of the vehicle listed as lime /yellow was discussed vs the traditional red and Chief Arrants explained that the use of lime /yellow had been researched by many larger departments and proven the best for safety reasons. Minor changes were made to the specifications and four items on the list of equipment to be included will be considered as separate items for bid. Regular Meeting, June 3, 1976 Page 4 A motion was made, seconded and unanimously adopted instructing the City Manager to go out for bids for one 1000 gallon per minute triple combination pumper for the Pire Department (bids to be revised as per changes made by the Council) bids returnable in 45 days. ITEMS BY THE CITY MANAGER: City Manager John L. Orr advised the Council of the following: PSC - HEARING BY 1. He had attended the Public Hearing by the Public Service SEACOAST GAS CORP.: Commission relative to the application of Seacoast Gas Corp. held at the Holiday Inn on June 2, 1976, and made a presentation on behalf of the City. The PSC will issue new rate schedules after the facts have been compiled. LIBRARY: 2. Read a letter addressed to Attorney Brant from Susan Hunter, Assistant County Attorney relative to the proposed land for a library complex building to be erected by Palm Beach County, on land owned by the City at the corner of Military Trail and Burns Road. AUTHORIZATICtd: 3. At the recommendation of the City Manager, a motion was made, PAY COUNTY FOR BICYCLE PATHS; seconded and unanimously adopted authorizing the City Manager to pay the County for the City's share of the installation of the bicycle paths along Holly Drive and MacArthur Blvd. in the amount of $14,275.14 to be taken from the t-eder al Revenue Account, and ,;)31634 which is 5010 of the City's share for MacArthur Blvd. to be taken from the Contingency Account. R -3 PERMITTED 4. In reference to the recommendation of the Planning and Zoning USES: Commission relative to the R..3 permitted uses, a motion was made, seconded and unanimously adopted authorizing the City Clerk to Regular Meeting, June 3, 1976 Page 5 advertise for a Public Hearing by the Council removing all structures except residential from all R -3 districts and placing them under conditional uses, public hearing to be held July 15, 1976. SIGN CODE 5. Discussion was held on the request by Mr. Pappalardo for a VARIANCE: variance to the Sign Code and whether the Zoning Board of Appeals had the jurisdiction over the request as presented. The City Manager and the City Attorney have advised Mr. Pappalardo o:' the comments from the Zoning Board of Appeals. ITEMS BY 14AYOR AND COUNC IL: `DICE MAYOR Vice Mayor Feeney referenced the report of the Fire Department FEENEY: which indicated a problem with house numbers in the City not being consistent. The City Manager will investigate the problem. COUNCILMAN Councilman Laurie referenced the report of the Public Works relative LAURIE: to the driveway elevations at Sandlewood homes and was advised by the City Manager it was at the expense of the developer. The City Manager advised Councilman Laurie in answer to his questions; that the request for appraisals had been sent out; the lights were on at the Public Works yard because the mosquito sprayer is being used at night; the irrigation project would be considered soon; and the draft of the revisions to the Landscape Ordinance would be given to the Council next week. COUNCILMAN Motion was made, seconded and unanimously adopted authorizing the KIEDIS: City Manager to proceed with the recommendation of the Director of AUTHORIZATION TO PROCEED WITH Public Works to provide an irrigation system to the City Complex IRRIGATION SYSTEM TO CITY from the Thompson River, as the work schedule of the Public Corks COMPLEX: allows, monies to come from the Federal Revenue Account. Regular Meeting, June 3, 1976 ADJOURNMENT: rage 6 Councilman Kiedis requested that the Council consider in the near future, placing the jurisdiction of the maintenance men working at the various parks under the Recreation Department. The City Manager advised that the Building Department have issued letters to the violators of the Landscape Ordinance with the request that they comply.
