HomeMy WebLinkAboutMinutes Council 070176ROLL CALL: MINUTES: `'' ANNOUNCEMENTS: REGULAR MEETING CITY OF PALM BEACH GARDENS JULY 1, 1976 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Martino at 8:00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor Feeney, Councilman Kiedis, Councilman Laurie and Councilman Rossow. Attorney Brant was in attendance following the Zoning Board of Appeals Meeting. The Minutes of the Regular Meeting of June 17, 1976 were unanimously approved by the Council. Mayor Martino made the following announcements: Sunday, July 4th ^ Bicentennial Parade at 1 :00 P.M. starting at the Palm Beach Gardens Elementary School, followed by a Bicentennial Program at 2 :00 P.M. at the City Hall. Sunday, July 4th ^ Fireworks at Lake Catherine at dusk. Monday, July 5th - City's Recreation Department Program at 10 :00 AM at Plant Drive Park and Playground. Thursday, July 8th - Zoning Board of Appeals Meeting. PRESENTATION OF AWARDS BY MAYOR MARTINO: Mayor Martino, on behalf of the City, presented City patches and Certificates of Award to the members of the Palm Beach Gardens ASA Girls Softball Team, ages 9 -12 years old, who had won the `✓ Sub - district tournament and were going on to compete in the State tournament. Mayor Martino congratulated them on their success and for bringing distinction to the City. Congratulations were also Regular Meeting, July 1, 1976 Page 2 given to Manager Rod Thatcher and coaches Len Dutil and Sandy Morgan. Len Dutil presented Mayor Martino with the trophy they had received, which will be placed in the trophy case at City Hall. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged receipt of communications from: DR. ANNE SMITH: 1. Dr. Anne Smith, Principal of Palm Beach Gardens High School, who is leaving the area, thanking the City for the plaque that was presented to her by the City Council. JOHN E. DUVALL: 2. John E. Duvall, Palm Beach County Metropolitan Criminal Justice Planning Unit, advising that the City did not receive LEAA funding. P &Z COMMISSION: 3. Memorandum from the Planning and Zoning Commission recommending, as a result of their Public Hearing held June 22, 1976, that all non - residential uses in Section 6,6A,6B, 6C and 6D of Article v of Appendix A, Zoning be transferred to the conditional uses in said sections. ASSOCIATED 4. Councilman Laurie acknowledged receipt of an invitation from GENERAL CONTRACTORS: e Associated General Contractors to attend the Ribbon Cutting Ceremony for the opening of I -95 south to Miami. RESOLUTIONS: Resolution #29, 1976 Reappointing Charles Jacobs and Lou Oxnevad RESOLUTION #29, to the Planning and Zoning Commission was read by the City Clerk and unanimously adopted by the Council. ORDINANCES: Ordinance #12, 1976 Revisions to the Landscape Ordinance was read ORDINANCE #12, its full, on first reading, by the City Clerk. Art Nelson and the members of the Committee of Adjustment will be invited to attend the Council Meeting on July 15, 1976 for their N Regular Meeting, July 1, 1976 Page 3 input when Ordinance #120 1976 will be workshopped. Councilman Rossow expressed concern that the Ordinance lacked a grandfather clause and commented that the existing businesses should be grandfathered; also regarding the penalty clause, to ask for Attorney Brant's comments as to the net effect in terms of all other legislation on the books. Vice Mayor Feeney suggested reviewing the regulation requiring landscaping of interior parking and the landscaping of all perimeter modifying areas, and perhaps•aie0in these requirements for existing businesses. The Council requested thaithe tape containing the reading of the ordinance on first reading be kept for two years. HETZEL PAGEANT: Reverend John L. Frerking, Faith Lutheran Church, President and on the Board of Directors of a group representing a cross section of people in the Community to assist in the promotion and presentation of the Hetzel Brothers Christmas and Easter Pageants, addressed the Council explaining the plans the Board has for landscaping the property, updating and making safe the electrical installations, future plans for building and providing for ,Liability insurance. A question and answer period followed and the Council concurred the pageants were a worthwhile endeavor and would be allowed, on a yearly basis, to remain in that location providing no permanent structures were made. It was suggested that any additions be made portable and stored along with the figures between pageants. Mayor Martino will attend the next meeting of the Pageant Board to be held July 14, 1976 at 7:30 P.M. at the Church parish. ZONING BOARD OF Mr. Walter Wiley, Chairman of the Zoning Board of Appeals spoke APPEALS MUETlit . from the audience and reported on the outcome of the meeting of i Regular Meeting, July 1, 1976 Page 4 that Board held earlier this evening, on a request from Tanglewood Properties, Inc. for a variance to a sign located at Tanglewood Shopping Plaza. Mr. Wiley stated that after a determination was made that the Board did have juri.sdicition to hear the petition, based on the unique conditions that exist, permission was given for a sign identical to the Abbey Road sign on the existing pole containing the names of Tanglewood Meat Market and Fidelity Federal Savings. Mr. Wiley asked that the Council consider reviewing the rear yard setback measurement for swimming pools from the mn- abutting line of the 5t walkway to include the measurement for screen enclosures. ORDINANCE #13, Ordinance #13, 1976 repealing all non-residential uses permitted 1976: in Section 6, 6A, 6B, 6C and 6D of Article V. of Appendix A, Zoning of the Palm Beach Gardens Code and adopting same as ccnditional uses in said sections, was read by title only, on first reading by the City Clerk. A Public Hearing and second reading will be held on July 15, 1976. REPORTS: Councilman Kiedis reported he had attended the Bicentennial BICENTENNIAL Committee Meeting held June 29, 1976 and that everything was in COMMITTEE MEETING: readiness for the July 4th program. P &Z COMMISSION Vice Mayor Feeney reported he had attended the Planning and Zoning IMNG Commission Meeting held June 22, 1976; said minutes are available in the Councilts information folder. B &E COMMITTEE Mayor Martino reported he had attended the Beautification and MEETING: Environmental Committee Meeting held June 30, 1976. Dr. Stanley Dunn was present and gave a talk and showed movies relative to sound barriers. Regular Meeting, July 1, 1976 Page 5 The City will investigate the possibility of receiving funds from the Department of Environmental Regulation for providing sound barriers. ITEMS FOR DISCUSSION: MUNICIPAL COURTS Discussion was held on the change over of Municipal Courts to •County Courts. City Manager John L. Orr reviewed the letter dated January 23, 1974 from Robert L. Horey, Administrator, Fifteenth Judicial Circuit of Florida containing a proposal for the provision of court services throughout the County. The City Manager will prepare a letter to Judge Sholts containing comments, concerns and recommendations from the Council which will be considered at the July 15th meeting. ITEMS BY CITY MANAGER; TRAFFIC CONTROL The following items were brought to the attention of the Council by City Manager John L. Orr and acted upon: 1. Motion was made, seconded and unanimously carried authorizing t he City Manager to negotiate and sign traffic control agreements with Palm Beach County for the maintenance of the devices located at PGA Blvd. and I -95 and at PGA Blvd. and Military Trail.. PURCHASE OF ICE 2. Motion was made, seconded and unanimously carried authorizing MACHINE: the City Manager to purchase an ice machine for the Public Works Department under the State contract price of $884.43, monies to be taken from the Contingency Fund. AUTHORIZATION TO 3. Motion was made, seconded and unanimously carried authorizing PAY . the City Manager to pay $250.00 to Brown and Orr, Appraisers for an appraisal on the 12 acres of land on the south side of Burns Road between the Westminster Presbyterian Church property and the Regular Meeting, July 1, 1976 Page 6 MRI property; monies to be taken from the Contingency Fund. `� Discussion on the consideration of the purchase of the above mentioned property will be an item on a future agenda. ITEW BY MAYOR AND COUNCIL: COUNCILMAN The City Manager advised Councilman Laurie that he was working LAURIE: on the tennis court light project and the landscape plan for the City Complex, and listed the items that were requested under the LEAH program 'that was denied. COUNCILMAN Councilman Kiedis advised he had received preliminary plans to KIEDIS : irrigate the football and baseball fields on the 10 acres for a cost of $4700 from Hector Turf and Garden: Inc., Miami, Florida, VICE MAYOR Vice Mayor Feeney brought the following items to the attention of FEENEY: of the Council; would like to determine the future status of the Plant Drive Lease which expires in 1977 before considering the purchase of new acreage; expressed the need for a municipal swimming pool and suggested having a referendum vote of the people to determine the want for such a facility; recommended reviewing the set back regulations on primary streets„ which will be given to the Planning and Zoning Commission for their recommendation; the City Manager will determine the traffic regulation concerning the location of stop signs and stop lines, in view of the fact that some are located too far back for safe visibility; the City Manager advised that a traffic light has been requested for the intersection of Burns Road and Alt. AlA from the Dept. of Transportation; a copy of an ordinance from California regarding L a growth cap will be obtained; expressed concern over a hybrid no fault insurance law in Florida and the City Manager advised Regular Meeting, July 1, 1976 Page 7 the canal cleaning is on a regular maintenance program, AD- 70URNMENT : No further business the meeting adjourned at 11:95 P.M.
