CITY OF PALM BEACH GARDENS
JANUARY 9P 1975
The Workshop Meeting of the City Council of Palm Beach Gardens,
Florida, was called to order by Mayor Martino at 8 :00 P.M. in
the Assembly Rooms 10500 North Military Trail# Palm Beach Gardensp
and opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor
Martino, Vice Mayor DeLonga,, Councilman Wiley, Councilman Kiedis
and Councilman Feeney. Attorney Brant was present.
MINUTES: The Minutes of the Regular Meeting of January 2. 1975, as amendedp
were unanimously approved by the Council.
ANNOUNCEMENTS: Mayor Martino made the following announcements:
A Planning and Zoning Commission Meeting would be held Tuesday,
January 14, 1975 at 7:00 P.M.
A Volunteer Firemen's Meeting would be held Tuesdays January 14,
1975 at 7 :30 P.M.
A Recreation Advisory Board Meeting would be held Tuesday]
January 14, 1975 at 8 :00 P.M.
The voter registration books would close on Fridays January 31,
1975 at 4 :30 P.M. The General Election would be held Tuesday,
March 18, 1975.
Mayor Martino commented that any interested citizen seeking election
as a Councilman should file as it was a worthwhile endeavor.
U.S. MARINE Capt. James Grosshans, U.S. Marine Corps, who asked to address

the Council for permission to band a U.S. Marine Corps helicopter
in connection with a parachute jump at the N.E. corner of PGA Blvd.
and Alt. AlAq did not appear at the meeting and the subject was
tabled.

Mayor Martino acknowledged receipt of communications from:

SEYMOUR FINE: 2. Seymour Fine complimenting and thanking the Police Department
for their work on a vandalism problem at one of his construction
sites.
REP. DON 3. Don Haaelton, State Representative advising of a meeting to

voicing objection to the abolishment of police forces under 10 men.
6. Councilman Wiley :Wade reference to an editorial regarding the
purchase of the West Palm Beach auditorium and stadium with funds
from the Beach Bond Referendum.
Attorney Brant will prepare a resolution for the Council's
consideration expressing the intent of the referendum was for
beach acquisition.
Ordinance #2, 1974 the Appearance Code was discussed by the Council.
They concurred to continue discussion after hearing a presentation
by Mr. Blakely and Mr. Matson, members of the North Palm Beach
Appearance Boards who will be invited to attend the meeting of
January 23, 1975 to explain the function of the Appearance Board

Councilman Kiedis will coordinate the proposed ordinance adding
Article III entitled the Appearance Code, and read on first
reading January 17, 1974; and the modification entitled Site Review
and Appearance Code as presented by the Planning and Zoning
Commission for the Council's consideration at the Workshop Meeting
on January 23, 1975.
SECONDHAND A proposed ordinance relating to secondhand dealers as recommended
DEALERS
ORDINANCE: by the City Manager and the Chief of Police was discussed. The
City Manager emphasized the need to protect the legitimate
secondhand dealer by keeping the unwanted, illegitimate dealers
out of the City.
The following changes were made to the ordinance;
Section 1790 (4) insert the word "two" in the blank in the last
sentence. Insert the word "last" in place of "first" in the last
sentence. Delete Section 17-94.
Ordinance #1, 1975 - Secondhand Dealers will be read on first
reading January 16, 1975, with a public hearing and second reading
on February 6, 1975.
NOISE The first draft of the Noise Ordinance which will be Ordinance #2,
GRIND INAN CE
1975 was discussed by the Council and will be placed on first
reading at the Regular Meeting, January 16, 1975.
Mr. Schwartz, Fire Chief of Juno, spoke from the audience,
complaining about the noise coming from the PDQ Store located
at PGA Blvd. and U.S. #1, which is open 24 hours a day, and
attracts young adults until the early hours of the morning.

appraise him of the situation.

Sam Carsillo, a resident of the City, spoke from the audience,
referring to the noise from the whistles from the trains that use
the FEC Railroad tracks adjacent to Alt. AIA.
The City Manager will obtain the cost of meters to measure noise
so that a noise ordinance could be enforced.
REPORTS: Mayor Martino reported he had attended the opening of the Lake
LAKE PARK Park Bicentennial office. Senator Lewis was the main speaker and

PALM BEACH Mayor Martino reported he had attended the second meeting of the

BICENTENNIAL Palm Beach Gardens Bicentennial Committee on January 8, 1975.

Sam Laurie was named Chairman, and plans were announced that a
City Flag Contest would be held. Mayor Martino mentioned he had
invited the Committee to participate in the Cityts 4th of July
Celebration.
A folder will be placed on the bookcase in the City C lerkts office
to contain any pertinent Bicentennial literature for the Council's
review.
B &E COMMITTEE Councilman Kiedis reported he had attended the meeting of the
MEETING:
Beautification and Environmental Committee held January 8, 1975.
A majority of the meeting was spent establishing priorities for 1975.
The City Manager advised Councilman Kiedis and the B &E Committee
the cost to refurbish the waterfalls and the retaining wall on
the east side of the City Hail would be accomplished in February.
The City Manager will follow up on comments made by Councilman
Kiedis and the BOE Committee regarding the enforcement of the
Landscape Ordinance and the Sigh Ordinance.

PBG COW4UNITY Councilman Feeney reported he and Mr. Carl Casseill, President of

the First National Bank of Palm Beach Gardens, had been appointed
as lay representatives to the Palm Beach Gardens Community
Hospital Board.
ITEMS FOR DISCUSSION:
FEES FOR A discussion was held on the recommendation by the Recreation
TENNIS
MEMBERSHIPS: Advisory Board at their meeting held December 10, 1974,
establishing the fees for tennis memberships.
Attorney Brant was directed to prepare a reDlution for the
January 16, 1975 meeting setting forth this rate structure.
ELECTION LAWS: The City Attorney clarified several areas of the Election Code
as posed by the City Manager, and was directed by the City Council
to prepare an ordinance adopting the State Election Laws and
�. encompassing those portions of the City Code as applicable.
The Council concurred that the amount of compensation be increased
to $ 30.00 for each inspector and $35.00 for each clerk per election.
ITEMS BY CITY MANAGER;
PALM BEACH
IBRARY SYSTEM:
The City Manager John Orr reported he had advised the Palm Beach
Library System that the City contributes to the Community School
Program and should be excluded from the County Library Taxing
District, as the citizens are able to use the School Library.
INTER -LOCAL The City Manager John Orr reported he had attended the meeting of
• the Board of County Co —i ssioners regarding the Inter -Local
Agreement to implement the Community Development Act; and said
agreement was modified and will be considered by the Commissioners
at a future date.

FIRE TANKER- The Council concurred with the recommendation of the City Manager

not to buy the used fire tanker from Juno Fire Department because
of the high liability insurance rate and with the intent to better
use the money toward a new vehicle in the next fiscal year.
Tom Vreeland, a member of the Fire Department, spoke from the
audience, commenting that it was an excellent buy and could be
used in the brush areas and at the Meadows Trailer Park.
PRIORITY ITEMS The City Manager John Orr stated priorities should be set for

REFERENDUM The Council, agreed an item for immediate attention, as recommended

COMPETITIVE by the City Manager, was to modify Section 6.3 of the Charter by

increasing the amount needed before going out for bid.
The City Attorney was instructed to prepare a draft of an Ordinance,
as a referendum vote on the March ballot, modifying the Charter to
change the amount from $1000 to $2500 for contracts to be let on
competitive bidding, and on amounts from $500 to $2500 to receive
3 competitive quotations.
ITEMS BY MAYOR AND COUNCIL:
FIRE RATING Councilman Wiley suggested and the Council concurred that the

City Manager write to the Insurance Commissioner to inform the
local insurance agencies to assist the citizens of the City so they
are aware that a rebate is in order on their insurance premiums due
to the lower fire rating classification from Class 9 to Class S.
The City Manager advised Vice Mayor DeLonga the drainage project
on Riverside Drive near the Elementary School was completed.
