CITY OF PALM BEACH GARDENS
JANUARY 16, 1975
The Regular Meeting of the City Council of Palm Beach Gardens,
Florida, was called to order by Mayor Martino at 8:00 P.M. in
the Assembly Room, 10500 North Military Trail, Palm Beach Gardens,
and opened with the Pledge of Allegiance to the Flag.
Roll was called by the City Clerk and present were: Mayor Martino,
Vice Mayor DeLonga, Councilman Wiley, Councilman Kiedis and
Councilman Feeney. Attorney Brant was present. The City Manager
John Orr was absent attending a meeting in Orlando.
The Minutes of the Workshop Meeting of January 9, 1975 were
unanimously approved by the Council.
Mayor Martino made the following announcements:
A Tri -City Meeting would be held Monday, January 20, 1975 at 8 :00 PM
at the Lake Park Town Hall.
A Public Forum, Legislative Delegation would be held Friday,
January 17, 1985 at 7 :30 PM at the North Pala Beach Village Hall.
Awarding of trophies, winners of floats, Christmas In Dixie Parade
will be held on January 22, 1975 at 7:00 P.M. at the Lake Park
Town Hall. The City's float won second place in Municipality
category and Councilman Wiley,s Indian Guide Troup won second place
in their category.
Bids were received as duly advertised on December 27 and 28, 1974
for 4 new 1975 Police Cars (Chevrolet Novas, with Special Police
�' Package) and were opened and read by the City Clerk as follows:

The bids were referred to the City Manager and the Director of
Public Works for evaluation and a recommendation to the City
Council.
Because of the low trade in allowance, the City Manager was
directed to explore an alternate means to dispose of the used
cars to realize more money from the trade -ins.
PETITIONS AND COMMUNICATIONS:
REP. TOM LEWIS: Mayor Martino acknowledged receipt of a communication from
State Representative Tom Lewis - an invitation to attend a
lecture by Dr. Harry Merritt to be held at the Colonnades Beach
Hotel. on January 21,, 1975 at 7 :30 P.M. re; Carrying capacity and
Land Use Planning.

RESOLUTIONS:
Discussion was held on

read Resolution
#1, 1975 - membership for playing on tennis courts, in full and
inserting the following fees: Residents - single membership under
18 years of age $6.00, Single membership over 18 years of age
$12.00, Family membership $24.00; Non - residents - Single membership
$48„00, Family membership $72.00 and daily fee for non - member $1.00
per person per day. Vote on motion - mayor Martino, Vice Mayor
DeLonga, Councilman Kiedis and Councilman: Feeney voted aye;
Councilman Wiley voted nay. Motion carried by a vote of 4 ayes and
1 nay.
The City Clerk read Resolution 1, 1975 in full inserting the above
mentioned rates.
Resolution #1, 1975 was adopted by a motion made by Vice Mayor
DeLonga, seconded by Councilman Kiedis. Vote on motion to adopt -
Mayor Martino, Vice Mayor DeLonga, Councilman Kiedis and Councilman
Feeney voted aye; Councilman Wiley voted nay.
ORDINANCES: Ordinance #2, 1975 Secondhand Dealers was read in full by the
ORDINANCE #1, City Clerk on first reading. A Public Hearing and Second Reading
will be held at the Regular Meeting, February 6, 1975.
ORDINANCE #2 Ordinance #2, 1975- Noise Ordinance was read in full by the City
Clerk on first reading. Ordinance #2, 1975 will be workshopped
at the Workshop Meeting of January 23, 2975.
ORDINANCE #39 All the members of the Council concurred that due to the
Statutory and City Code requirements for published notice prior
to the referendum election to be held March 18, 1975, an
emergency existed whereby Ordinance #3, 1975 had to be passed

and adopted on first and Final reading at this meeting.
Mayor Ptartino declared a Public Hearing on Ordinance #3, 1975.
Councilman Wiley clarified that the intent of the ordinance was to
change the existing code by opening up the range from $1000 to
$2500 on competitive bidding on a public call for bids, thus giving
the City Manager mare latitude in obtaining better competitive
bids and attracting better prices.
There was no discussion from any member of the audience.
Mayor Martino declared the Public Hearing closed.
Ordinance #3, 1975 providing for a referendum ballot at the
General Election to be held March 18, 1975 regarding competitive
bidding was read in full by the City Clerk on emergency first and
final reading and was unanimously adopted by the Council.
REPORTS: Mayor Martino reported he had attended the Planning and Zoning
PLANNING AND Commission Meeting held Tuesday, January 14, 1975, and they were
ONING COMMISSION:
1 11 working toward rezoning a parcel of commercial property on the
south side of PGA Blvd., west of Military Trail to a residential
area, and are awaiting a legal description of the property to
advertise same for a public hearing. A request was received by
the Board to locate a Karate School in the M -lA zoning district.
Attorney Brant will provide in writing to the PU Commission his
recommendation that a Karate School is an educational institution
and permission would be required to be granted from that Board for
a conditional use in the M -lA Zoning.
RECREATION Mayor Martino reported he had attended the Recreation Advisory

of the Howell Watkins tennis and basketball facilities with an
agreement similar to one with the High School; election of officers
was held; and a recommendation made to the City Council to pursue
the purchase of the Rybovich property for recreational purposes
with the County.
Councilman Kiedis who also attended the Recreation Advisory Board
Meeting mentioned that the Board had expressed disappointment in
the failure of the High School to resurface their tennis courts.
Councilman Feeney related that the Palm Beach Junior College was
interested in conducting a tennis program as part of the PE
requirement and were looking for a place to hold same in this area.
The Council concurred this would be a consideration for a ,point
venture between the School Board, the Jr. College and the City
to pursue the Howell Watkins facilities with a possible cost
savings to all.
ITEMS FOR DISCUSSION:
RYBOVICH Mayor Martino reiterated that the Council had taken a tour of the
PROPERTY:
Rybovich property consisting of 26.5 acres located on the
Intracoastal Waterway, with 1500 ft. along Monet Road and lying
east of Prosperity Farms Road, that could be purchased for
recreational purposes.
The Council agreed with the recommendation of the Recreation
Advisory Board, to advise the County Commission the property is
available, and ask them to consider purchase of same with the
beach bond referendum funds; inasmuch as there are no County
recreational facilities in this area and it would benefit the
land locked community of Palm Beach Gardens as well as North Palm
Beach and Lake Park.

Mayor Martino will have this item placed on the agenda for
discussion at the Tri -City Meeting to be held January 209 1975 and
`..� will advise Mr. Rybovicho Mr. Angel Naya and the County Commission
of the City's intent.
Councilman Wiley proposed if the County wasn't interested in
purchasing the lands the City should pursue sane on its own.
ITEMS BY CITY MANAGER:
LIBRARY TAXING Councilman Wiley and Attorney Brant reported on their findings
DISTRICT:
regarding the City being excluded from the County Library Taxing
District# and the Council agreed to invite a member of the bounty
Advisory Board to the meeting of January 23, 1975 to present
the facts before making an evaluation.
ITEMS BY MAYOR AND COUNCIL:
PALM BEACH Mayon: Martino presented and the Council approved a list of Stems

�_U=ATIVE that he will present to the Palm Beach County Legislative
DELEGATION FORUM:
Delegation for their consideration and support at the forum to
be held January 17, 1975 at the Village Hall, North Palm Beach.
COUNCILMAN Councilman Wiley commented on an article in the newspaper naming
:
the self-service postal, units and listing the one located in the
City as adjacent to the Torn Hall, Lake Park# Florida 33403,
which besides being the incorrect City is the incorrect zip code
for the City.
The Mayor will write to the postal authorities about this
inaccuracy and expressing the Council's annoyance.
VICE MAYOR Vice Mayor DeLonga referred to a recent event where Senator Lawton
DE GA :
Chiles was protesting the recent awarding of a contract# which
Vice Mayor DeLonga felt was ironic since the awarding of this
contract to Pratt and Whitney would stablize the economy of this
area.

ENCLOSE POLICE At the suggestion of Vice Mayor DeLongal, the City Manager was

AREA: asked to explore enclosing the Police dispatchers area with a
glass partition to allow more security and to eliminate outside
interference.
POLICEMEN IN The City Manager was asked to explore with the Chief of Police
CARS:
the possibility of placing two policemen in police carst particularly
during the night hours. The Council, agreed it would be a big
step financially, but due to the recent disturbances involving
policemen in the Countyx felt consideration should be given to
this matter. They agreed also attention should be given to
encourage more members to join the Police Reserves.
