CITY OF PALM BEACH GARDENS
APRIL 30 1975
The Regular Meeting of the City Council of Palm Beach Gardens was
called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room,
10500 North Military Trail, Palm Beach Gardens and opened with the
Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino,
Vase Mayor DeLonga, Councilman Wiley, Councilman Kiedis and
Councilman Feeney. Attorney Brant was in attendance.
MINUTES: The Minutes of the Workshop Meeting of March 27, 1975 were
unanimously approved by the Council.
ANNOUNCEISNTS: Mayor Martino made the following announcements:
Planning and Zoning Commission Meeting would be held Tuesday,
April 8, 1975 at 7 :30 P.M.
Recreation Advisory Board Meeting would be held Tuesday, April 8,
1975 at 8 :00 P.M.
Volunteer Firemen's Meeting would be held Tuesday, April 81 1975 at
7:30 P.M.
Parents Meeting at PcAlm Beach Gardens High School Auditorium: would
be held Tuesday, April 8, 1975 at 7 :00 P.M.
Beautification and Environmental Committee Meeting would be held
Wednesday, April 99 1975 at 7:30 P.M.
An Administrative Meeting would be held directly following the
Regular Meeting of April 3, 1975.

PBG HOSPITAL: Sam Carsillo, a

of the audience, asked the status of
the
emergency room
at the
Palm $each Gardens Community Hospital
and

was advised by Councilman Feeney a meeting was scheduled for April 7,
1475 at 6 :00 P.M. at the hospital regarding this subject.
Mr. Carsillo expressed concern about the number of dogs in the City
that are not kept on a leash, and the fact that the newsboys do not
have lights on their bicycles when they make early morning deliveries
in the dark. The City Manager will follow up on these items.
PETITIONS AND COMMUNICATIONS:
Mayor Martino acknowledged receipt of a communication from Rep. Tom
REP. TOM LEWIS: Lewis regarding the need for a walk over the railroad tracks at
Lighthouse Drive and Alt. AlA for the safety of the school children,
and whose area of responsibility it was to provide same.
The Council indicated they were aware of the problem and the City
Manager advised he had requested permission from the Railroad, which
must be obtained before any plaza can be initiated by the City.
ORDINANCES: Mayor Martino declared the Public Heaxi.ng, as duly advertised, open on
ORDINANCE #71 consideration of Ordinance #7, 1975, the Tree Preservation Ordinance.
Discussion was held by the Council and by members of the audience:
Mrs. Mullin, Don Kitchings, Chairman of the B &E Committee, Mr.
Carsillo and John Girardeau.
Mayor Martino acknowledged receipt of a letter from Mrs. Robert E.
Shepard who was in favor of the Ordinance.
The area of concern by the Council was whether to include the
applicability to cover developed single - family and two family lots in
the Ordinance. It was brought out in the discussion that there exists
deed restrictions covering the destruction of trees; however these
restrictions are not enforced.

of a list of restrictive trees to be added to those exempt from the
terms of the Ordinance as it is proposed.
Mayor Martino read a communication related by telephone to the City
Clerk from Mrs. Barbara James, Fuschia Circle, who expressed concern
about the Tree Ordinance, stating she had purchased and paid for
the trees in her yard and does not feel the City has any right to
regulate whether she can cut them down! that it is an encroachment
on her rights.
The Mayor will incorporate the comments of the Council, include the
text of the deed restrictions, the list of exempt trees., etc. for the
Council's consideration at the next two workshop meetings.

PT]BL HEARING: 1975, the Tree Preservation Ordinance, was recessed until the
\../ Regular Meeting to be held May 1, 1975 at 8:00 P.M.
REPORTS: Mayor Martino reported he had attended the first meeting of the
APPEARANCE Appearance Plan Committee held Tuesday, April 19 1975. Robert
PLAN COMMITTEE:
Sellers was appointed Chairman, Art Nelson, Vice Chairman and Mrs.
Sessa the recording secretary. April 15, 1975 at 6:00 P.M. the
Committee will meet to tour the major arterial roads of the City
prior to their meeting scheduled for 8 :00 P.M. The members will
also review the existing plans of North Palm Beach, Boynton Beach
and Boca Raton prior to the meeting.
BICENTENNIAL Councilman Kiedis reported he had attended the Bicentennial
COMMITTEE
PMbTIN(U: Committee Meeting held Wednesday, April 29 1975. The Committee has
announced plans for methods to raise funds by having a golf
�-� tournament, movies at Howell Watkins Jr. High and Palm Beach Gardens
High Schools, and a flea market. The Flag Contest has been

extended and posters will be made by the Recreation Department for
more publicity. The next meeting of the Committee will be held
May 7, 1975, which will attended by Mayor Martino as Council liason.
ITEMS FOR DISCUSSION:
ROAD PRIORITIES The City Manager reviewed and explained the memo submitted by

road priorities for resurfacing, together with the costs.
Discussion followed as to which roads should have first priority,
since the City Manager indicated the amount budgeted for this project
was $27,000.00 and the total amount for all the streets listed would
amount to $113,760.00
The Council concurred with Councilman Wiley's suggestion that the
slurry seal process not be used on the City streets in the future.
Councilman Wiley pointed out the drain grates on Lighthouse Drive
needed to be raised and corrections made to the sidewalks.
The City Manager will determine cost and report same to Council.
A motion was made by Vice Mayor DeLonga, seconded by Councilman
Feeney authorizing the City Manager to expend $12,196.00 from the
Federal Revenue Sharing Account for a 1 inch dverlay of asphalt on
Lighthouse Drive from Alt. AlA to the Thompson River Bridge, and to
provide a plan and request for any additional funding necessary for
the drain grate problem.
Vote on motion .. Mayor Martino, Vice Mayor DeLonga, Councilman Kiedis
and Councilman Feeney voted aye; Councilman Wiley voted nay.
The Council unanimously authorized the Mayor and City Clerk to sign
the easement deed with Florida Power and Light Company for the

location of an underground cable on the south side of Johnson Dairy
Road from Military Trail to a service connection.
The City Manager advised the two native pine trees on the corner of
Military Trail and Burns Road will be bypassed and not removed.
PROPOSED CHANGE The City Manager explained the proposed change that he is recommending

SYSTEM: in the telephone system for a cost savings of 276.55 per month.
Under this change the Public Works Department and the Fire Department
would have their own system with direct lines.
The Council expressed interest in the new system and directed the
City Manager to arrange for the Southern Bell Telephore representative
to make a presentation on the new system to the Council.
A-95 COM_M_UNITY Discussion was held on the A_95 Community Development Blotk Grant
BLOCK GRANT ACT
R VIEW: Act application as submitted by Frank Brutt, Area Planning Board.
The City Manager pointed out on the maps submitted by the Area
Planning Board the areas that would receive funding under the
initial phase, and Councilman Kiedis explained the need and reasons
for the application to be approved by the participating municipalities.
Motion was made and unanimously approved by the Council that the
City Manager direct a letter to Mr. Brutt stating the City of Palm
Beach Gardens has no objection to the proposed plan and approves
same. A second letter to be directed to Mr. Brutt indicating
concern about item 13 and 14 listing the large amount for planning
and administrative costs.
ITEMS BY CITY MANAGER:
The City Manager asked that a policy be made by the Council, due to
�.� the complaints received by the Police Department, on the hours of
play on the tennis courts located on the north side of the City
Complex.

The Council directed the City Manager to place a sign on the
tennis courts located on the north side of the City Complex
directing the people to use the tennis courts located on the west
side of the City Complex from the hours of 1 -6 A.M. due to the
proximity of the apartment complex to the north.
BRANCH LIBRARY The City Manager advised a location had been found for the branch

library facility, which is subject to approval by the Board of
County Commissioners at their meeting to be held Tuesday, April 8,
1975.
ITEMS BY THE MAYOR AMID CO[]NCIL:
VICE MAYOR Vice Mayor DeLonga expressed disappointment that an Easter Egg Hunt

was not conducted this year in the City for the children.
COUNCILMAN Councilman Wiley advised he has been designated to oversee the

"I—/ activities for the laying of a masonic cornerstone for the new

North County Courthouse Complex.
Councilman Wiley requested that more items including the activities
of the City Council, the resolutions and ordinances that have been
adopted or are planned for future discussion, notice of public
hearings etc. be included in future newsletters and to be printed
to concur with significant events.
Councilman Wiley requested that before the next visit by Mr.
Marshall that the Council decide what their long term objective is
and plan a program to establish better communications between the
administration of the City and the administration of Pratt and
Whitney Aircraft.
The City Manager advised the light bulbs at Plant Drive Park have
been replaced and will be aimed to suit the multiple use of the

fields, and that broken glass shields will be replaced.
ADJOURNMENT: No further business, the meeting adjourned at 10 :45 P.M.
