HomeMy WebLinkAboutMinutes Council 041075WORKSHOP MEETING CITY OF PALM BEACH GARDENS APRIL I09 3975 The workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 10500 North Military Trail, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Boll was called by the City Clerk and present were: Mayor Plartino, Vice Mayor DeLonga, Councilman Wiley, Councilman Kiedis and Councilman Feeney. Attorney Brant was in attendance. MINUTES: The Minutes of the Regular Meeting of April 3, 1975 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Martino made the .following announcements: 1. An Appearance Plan Committee Meeting would be held Tuesday April. 15, 1975 at 7:30 P.M. Mayor Martino will take the place of Councilman Kiedis, as liason to the C ommittee,at that meeting. 2. Palm Beach Gardens Youth Athletic Association Board Meeting would be held Wednesday, April 160 1975 at 8 :00 P.M. ITEMS BY THE CITY MANAGER: RESURFACING The City Manager John Orr, recommended that approval be given to BURNS ROAD: resurfacing Burns Road from Alt. AIA to Prosperity Farms Road at a cost of $30,346.00 to be taken from Federal Revenue Funds, in addition to the resurfacing of Lighthouse Drive as previously approved by the Council. The Council will consider this recommendation of the City Manager after an update has been made of the Federal Revenue Sharing Account. Workshop greeting, April 10, 1975 Page 2 MATCHING FUNDS The Council concurred with the recommendation of the City Manager TRAFFIC CONTROL STODY: to pursue matching funds from the State for a traffic control study which would amount to approximately 30% or $6,000.00 for the City's share. WINDSCREEN- The Council will consider the request of the Tennis Committee to TENNIS COURTS: use the Calophyllum plant as a windscreen to enclose the south and east sides of the tennis courts, as it is more effective as a shield than the Australian pines. INTERLOCAL A Special. Meeting will be convened at the close of the Workshop AGREEMENT- COMMUNITY fleeting for the purpose of authorizing the Mayor and City Manager DEVELOPMENT ACT: to sign a revised Inter -Local Agreement with the County regarding the implementation of the Community Development Act of 1974. DEPARTMENTAL At the recommendation of the City Attorney, the Council, at the NAME CHANGE: present time, denied the request of the Building Official for a departmental and occupational title change of the Building Department, Building Official and Building Inspector to Building and Zoning Department, Building and Zoning Official and Building and Zoning Inspector. ITEMS BY MAYOR AND COUNCIL: BRANCH Mayor Martino announced he and the City Manager had attended the LIBRARY F� COY: meeting of the County Commission held Tuesday, April 8, 1975, and the City had been granted a branch library facility to be located in the Tanglewood Plaza. ,Mayor Martino expressed gratitude to Miss Florence Billers, Library Director, Mrs. Pipes, Chairman, Palm Beach County Library Advisory Board and Commissioner Culpepper for their endeavors in obtaining this facility for the City. The Council gave a ,ote of thanks to Councilman Ciley who had Workshop Meeting, April 10, 1975 STORM GRATES: VICE MAYOR COUNCILMAN W Y: Page 3 initiated and worked diligently in prior years toward obtaining a library in the City, to realize a tax savings for the citizens. Mayor Martino requested that the City Manager investigate the securing of the storm grates in the City due to a recent accident involving a child. Vice Mayor DeLonga presented a rough draft of a format for tabulation of the drily status of the police cars. Vice Mayor DeLonga questioned the availability of water in the area, due to the report by the Palm Beach County Utilities that no new connections are being made. The City Manager will verify this. The Council concurred with the suggestion of Councilman Wiley that a resolution be sent to the State Department of Transportation with a copy to the County Commission, as a follow up to the letter sent by the City Manager, requesting attention to the intersection of I -95 and PGA Blvd., and that a clover leaf terminus be considered for construction as soon as possible. The City Manager explained the reason for his letter to the Dept. of Transportation, requesting notification of the pre-work construction conference pertaining to PGA Blvd., was to enable the City to consider the installation of underground piping for an irrigation system for the median strip. Councilman Feeney clarified for Councilman Wiley, 1 by 10 compressed wood would be installed over the top of the existing bleachers in lieu of using underside of bleachers as was previously planned. Councilman Wiley made reference to the weekly report of the Public Works Department: the item median strip on Holly Drive. The City Manager advised an overlay of top soil would cover the sand with a Workshop Meeting, April 109 1975 concrete curb radius made at each end. Page 4 Councilman Wiley made reference to several items in the minutes of the Tennis Committee Meeting and the Council concurred the Committee should be advised of their scope of responsibility and proceed with their plans and present them through the normal chain of command to the Recreation Advisory Board. COUNCILMAN Councilman Feeney requested that the opening of the restrooms at FEENE_Y : Plant Drive on the wehk -ends be placed as an item on the Police Department check list. Councilman Feeney requested that the bulletin board located at the tennis courts on the north side of the complex be rearranged and the appearance improved. COUNCILMAN Councilman Kiedis pointed out that the Beautification and Environ- mental Committee were holding work parties that perhaps was above and beyond their function and should be performed by the Department of Public Works. At the suggestion of Councilman Kiedis, the City Manager will place ropes at the out of play line at Plant Drive for a greater degree of security for the children. LETTER- A copy of a letter to be sent to the Legislative Delegation urging ME_D ICAL LIABILITY INS.: enactment of emergency legislation to guarantee uninterrupted medical liability insurance and prevent raising costs for insurance was read by the Mayor. The Council approved the letter, as modified, and a copy will be sent to the American Medical Association and Mr. Lopez, Executive Vice President of the Florida Chapter of the American Medical Assocation. ORDINANCE #7, A workshop discussion was held on Ordinance #7, 1975, the Tree 1975: Preservation Ordinance. workshop Meeting, April 100 1975 Page 5 A copy of a resolution adopted by the Beautification and Environmental Committee at their meeting held "pril 9, 1975 urging ._. the Council to adopt Ordinance #7, 1975 was read by Mayor Martino. A copy of the deed restrictions for residential lots, in particular, Article 6- Trees and Soil was read and discussed by the Council. Clair Andersen, a member of the Planning and Zoning Commission addressed the Council and stated the ordinance would adversely effect what little freedom people have; and that a better effort on the part of the City Council and the B &E Committee would be to undertake some agressive, positive program for plantings in the City. Don Kitchings, Chairman of the B &E Committee agreed with some of Ntr. Andersen's points but felt it was extremely important to save the trees and some control was needed. Councilman Feeney and Councilman D eLonga both indicated they would not vote in favor of the ordinance as written. Mayor {Martino felt the ordinance had merit and had definite interest in pursuing same. Discussion was tabled on the ordinance at this point. ORDINANCE #8, Discussion was held on Ordinance #8, 19751, the Site Review and Appearance Code. The City Attorney will rewrite Section 6 -14 to modify the first sentence to read "the applicant or any Department Head through the office of the City Manager" Section 6 -10 3. was modified to read "all zoning districts except single family residential districts" Clair Andersen, member of the Planning and Zoning Commission, r Workshop Meeting, April 10, 1975 Page 6 suggested a public hearing be required on a site plan review, with a tee attached. The Council agreed a notice should be posted in three conspicuous places in the City 10 days prior to a site and appearance plan review by the Planning and Zoning Commissions and a sign be placed on the property giving the date and time of this public hearing. Attorney Brant was instructed to reconstruct Section 6-.13 to include the above. A Public Hearing and second reading on Ordinance #80 1975 will be held April 17, 1975. PETITIONS AND COMMUNICATIONS: FINANCIAL The Council concurred with the suggestion of Councilman Wiley and DISCLOSURE: instructed the City Attorney to prepare a resolution directed to the Legislative Delegation concerning the proposal by Governor Askew relative to financial disclosure.by public officials. Mayor Martino acknowledged receipt of communications from: GENE C,APUTO: 1. Gene Caputo, Area Planning Board, that they are in receipt of the Goals and Objectives for the Comprehensive Plan, Phase I, as completed by Marvin Hill, Planning Consultant for the City. CITY OF 2. City of Naples with attached resolution to the Florida Public NA-PETS: Service Commission to reconsider recent electric power rate increase. RAY LEONE: 3. Ray Leone, Research Analyst for Palm Beach County, regarding a nutrition program for senior citizens. Mayor Martino advised he will contact Cdr. Leone. REP. JACK 4. Rep. Jack Poorbaugh supporting PBG Resolution #15, 1975 relative MIMMR: to funding Palm Beach Junior College for year round courses. Workshop Meeting, April 10, 1975 Page 7 WARREN STRAHM: 6. Warren Strahp, Regional Administrator, Dept. of Pollution Control to Donald Shepherd, Engineer, acknowledging a certificate of partial, completion for the Pala Beach Gardens Sewage Treatment FZant and that they will allocate 50,000 GPD for connections in Palm Beach Gardens, when the additional flow is determined. ITEMS FOR DISCUSSION: Motion made by Vice Mayor DeLonga, seconded by Councilman Kiedis to table the two items for discussion: 1. correspondence from ,Tack Hanson, Building Official and Ed Arrants, Fire Chief re proposed ordinance changes to the Fire Code and 2. Discussion on Ordinance #1, 1974, the Landscape Ordinance. Vote on motion to table - Vice Mayor DeLonga, Councilman Kiedis and Councilman Feeney voted aye; Mayor Martino and Councilman Wiley voted nay. 1- REPORTS: Mayor Martino reported he had attended the Planning and Zoning PLANNING AND Commission meeting on Tuesday, "$ril 89 1975. Approval of the ZONING COMMISSION MEETING: inal landscaping plans were given to Mr. C. F. Edgecombe for a duplex located at 10145 Ironwood Road; and it was determined the site plans including the ingress and egress had been approved for the Community Federal Savings and Loan Association as developed. B &E COMMITTEE, Councilman Kiedis reported he had attended the Beautification and MEETING: Environmental Committee Meeting held Wednesday, April 9, 1975. It was noted the trees planted by the Board around the City needed a watering program; an irrigation system was needed for the reserve punts located at the Public Works yard; asked for consideration of the suggestion of reflective paint for street markers; will deter- mine the cost of experimental grass to cover the slopes at the City Complex; consideration of obtaining trees for citizens to plant as a Bicentennial, project; asked that the waterfall area i Workshop Meeting, April 10, 1975 Page 8 on the west side of MacArthur Blvd. be restored by 1976 and asked about the Legality of the car parked in the Publix Parking lot advertising a barber shop. RECREATION Councilman Feeney reported he had attended the Recreation Advisory ADVISORY BOARD MEETING: Board meeting held Tuesday, April 8, 1975. Mayor Martino, also in attendance, had advised the Board of the status of the purchase of lands for recreational purposes„ and a request was made that the bleachers be moved to the midget field at Howell Watkins Junior High School.
