CITY OF PALM REACH GARDENS
MAY 22, 1975
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Martino at 8:00 P.M. in the Assembly
Room, 10500 North Military Trail, and opened with the Pledge of
Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino,
Councilman Kiedis and Councilman Feeney. Vice Mayor DeLonga
was attending the Zoning Board of Appeals Meeting and Councilman
Wiley was detained. Both Council members arrived subsequently.
Attorney Baldwin attended the Zoning Board of Appeals Meeting
and came to the Council Meeting after the adjour --- nt of the Board
Meeting.
MINUTES: The Minutes of the Regular Meeting of May 15, 1975, as amended,
were unanimously approved by the L'ouncil.
Councilman Kiedis, who was not present at the May 15th meeting,
voiced an objection to the extension of time for the use of a
trailer at the First Church of God, and questioned the reference
in the minutes to the Swale areas, and the determination of those
cases completed before the adoption of the present code. The
City Manager advised he will make the determinations of what cases
are grandfathered prior to the adoption of the code in 1966.
ANNOUNCEMENTS: Mayor Martino announced that a Planning and Zoning Commission
Meeting would be held Tuesday, May 27, 1975 at 7 :30 P.M. and the
Administrative offices would be closed Monday, May 26, 1975 for
Memorial Day.
Mayor Martino deviated from the agenda until a full council was
present.

PETITIONS AND COMMUNICATIONS:
Mayor Martino acknowledged receipt of communications from:
U REP. HEALEY: 1. Rep. E. J. Healey offering assistance re Resolution #16, 1975
Financial Disclosure.
BEN SIMPSON, 2. Ben Simpson, District Engineer, DOT forwarding Resolution #17,
1975 re clover leaf at 1-95 and PGA Blvd. to the Deputy District
Engineer.
TOWN OF LAKE 3. Town of Lake Park recommending to the Palm Beach County Board
• of Commissioners the appointment of the Area Planning Board as the
agency for the Community Development Block Grant Program.
TOWN OF LAKE 4. Town of Lake Park requesting the Palm Beach County Board of
PARK:
Commissioners to schedule meetings with the Tri..City group.
CHARLES S. Charlie Hyman, Director, County Engineering Department, enclosing
`-' executed copies of Traffic Control Agreements, for Intersection of
PGA Blvd. and Prosperity Farms Road, Intersection of Northlake Blvd.
and MacArthur Blvd. and Intersection of RCA Blvd. and Alt. AIA.
The City Manager stated these agreements provide that the County
assume all installation, operational and maintenance responsibilities,
which is a great cost savings to the City each month.
Mayor Martino thanked the City Manager for his efforts in this
matter.
ANNEXATION Mayor Martino announced a request for annexation of a parcel of
REQUEST:
land on the south side of Northlake Blvd. would be heard at a
Public Hearing by the Planning and Zoning Commission on June 10,
1975.

PRESENTATION OF PLAQUES TO SAM BROWN AND AL POLLARD FOR SF-RI710E ON THE MERIT
-TL�M BOARD:
Mayor Martino presented plaques to Sam Brown and Al Pollard for
serving on the Merit System Board since 1971, and speaking on behalf
of the City Council thanked them zor volunteering their services for
the betterment of the City. He further stated the City was fortunate
to have people of their caliber volunteer to accomplish the necessary
tasks that make the City the success it is today; the success of
the City is attributed in many ways by everyone working as a team
from the City Council, to the Advisory Boards, to the City employees
and including the citizenry.
Individual members of the Council thanked Mr. Brown and Mr.
Pollard for their efforts and the City Manager thanked them for
their efforts in revising the Rules and Regulations of the Merit
System.
� COM ENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
TIM OfHARA: Mayor Martino recognized in the audience Tim O'Hara, a new
LEONARD DEV INE :
reporter from the Post Times stating the City appreciated the
efforts of the press.
Leonard Devine, Director, Public Works Department, addressed the
Council and reported on a recent convention he had attended in
Miami as the State Director of the American Public Works Association.
He spoke briefly on the following subjects of interest that were
presented at the meeting: Maintenance and Operation of Public
Buildings, Tree Ordinances, Solid Waste and Labor Relations.
ITEMS BY CITY MANAGER:
The City Manager made reference to a communication from Councilman
Kiedis, and asked for direction from the Council relative to

the purchasing of Australian Pines for planting around the tennis
courts.
SCREENING TENNIS The City Manager was authorized to place an order for 250
COURTS - AUSTRALIAN
PINES:
Australian Pines, in conjunction with the list of items to be
purchased by the Beautification and Environmental Committee from
the State, for screening around the tennis courts and at the
ball fields located at Plant Drive and Lake Catherine.
NEWSLETTER: The City Manager announced the Newsletter had been mailed to the
residents this date.
POLICE CARS: The City Manager reported one new Chevy Nova Police Car had arrived
and the remaining three would be delivered by Friday, May 309 1975.
Mayor Martino explained the Chevy Novas were purchased in the
interest of saving tax money, and will be observed as to their
performance by our City, as well as, our neighboring municipalities.
Our City is probably the first municipality to use a smaller police
car such as the Nova in Palm Beach County.
ITEMS BY MAYOR AND COUNCIL:
COUNCILMAN Councilman Feeney asked that the side street vis,ability in
relation to the stop signs and stop bars be checked.
In reply to the request by Councilman Feeney, the City Manager will
prepare a cost estimate for an irrigation system for the 10 acres
abutting the City Complex.
Councilman Feeney requested that signs be placed on the concession
stands at Plant Drive and Lake Catherine indicating the use of and
location of the trash barrels.
Leonard Devine, Director, Public Works Dept. indicated the announc-
ing booth at Plant Drive was being painted green to reduce the glare.

COUNCILMAN Councilman Kiedis related the following items that needed

attention and completion: waterfalls at MacArthur Blvd., holes
�. on the outfield Plant Drive park; backstop at the southwest corner
RESOLUTIONS:
of the Howell Watkins fields; extension of the sidewalk on
Lighthouse Drive from the North Palm Beach City limits; glass
covers for the lights at Plant Drive.
The Council concurred that the Mayor had been authorized to sign
RESOLUTION #20, Resolution #20, 1975 extending the use of a trailer at the First
Church of God, at the Regular Meeting held May 15, 1975 and therefor
ORDINANCES:
there was no need for this item to be on the agenda.
Discussion was held on Ordinance #7, 1975 the Tree Preservation
ORDINANCE #7, Ordinance; a new draft prepared by Mayor Martino encompassing the
philosophy of past discussions was presented. Mayor Martino
explained the changes he had made.
Councilman Kiedis objected to Section 31.14 (a) permit fees.
Councilman Wiley suggested deleting the word "developed" in Section
31.14 (a). Both objections were overruled by the Council.
Section 31.11 (a) (2) the first sentence was deleted by unanimous
concurrence of the Council.
Section 31.16 (a) was deleted by unanimous concurrence of the Council,
Section 31.16 _ the list of trees exempt from the terms of the
ordinance was given to Don Kitchings, Chairman, Beautification and
Environmental Committee to authenticate and obtain common: names.
Section 31.17 - shall read "There is hereby created a five (5) person
tree protection appeals committee to consist of the members of the
Zoning Board of Appeals."
Section 31.18 (a) "Each appeal shall be accompanied by a fee of

twenty -five dollars ($25.00) to cover the cost of the appeal
proceedings" was striken by a vote of:Councilman Wiley, Councilman
Kiedis and Vice Mayor DeLonga voted aye, Mayor Martino and
Councilman Feeney voted nay.
Section 31.15 Tree Bank as written in the draft of March 20, 1975
will be included in the ordinance by a vote of :Vice Mayor DeLonga,
Councilman Wiley and Councilman Kiedis voted aye, Mayor Martino
and Councilman Feeney voted nay.
A Public Hearing and Second reading on Ordinance #7, 1975 will be
held at the Regular Meeting, June 5, 1975.
ORDINANC B #9, By a unanimous vote of the Council, Ordinance #9, 1975 Modifications
to the Fire Code was tabled.
The City Attorney was directed to redraft Ordinance #9, 1975 to
include his recommendations made at another time.
REPORTS: Vice Mayor DeLonga reported he had attended the Zoning Board of
ZONING BOARD OF Appeals Meeting held this evening, in place of Councilman Wiley,

who had another commitment. The three petitions for variances
were granted by the Board.
MERIT SYSTEM In reference to a list of interested applicants to fill the
BOARD:
vacancy on the Merit System Board, Councilman Wiley proposed that
an alternate member be designated to that board.
A copy of the background and resume of each interested applicant
will be supplied to the Council as a guide in making a selection
at the Regular Meeting June 5, 1975.
Councilman Wiley informed the Council the Palm Beach Gardens
Woman's Club will sponsor a Community Theatre and plan to hold

a performance on December 5th and 6th at the Palm Beach Gardens
High School. He indicated he had committed the participation
of the Council in this event.
The Council unanimously concurred there would not be a meeting
of the City Council on Thursday, May 29, 1975.
Councilman Kiedis announced the Bicentennial Committee would
sponsor a Golf Tournament at Frenchman's Creek on July 12, 1975.
ADJOURNMEM: No further business, the meeting adjourned at 10 :45 P.M.
