HomeMy WebLinkAboutMinutes Council 082175Ra,ULAR MEETING CITY OF PALM BEACH GARDENS AUGUST 21, 1975 The P.egular Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Martino at 8:00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, vice Mayor DeLonga, Councilman Wiley, Councilman Kiedis and Councilman Feeney. MINUTES: The minutes of the Regular Meeting of August 7, 1975 were unanimously approved by the Council. The Minutes of the Budget Workshop Meetings held August 13th, August 14th and August 18, 1975 were approved as presented. 4 P K ANNOUNCEMENTS: Mayor Martino made the following announcements: A Budget Workshop N.eeting would be held Monday, August 25, 1975 at 7 :30 P.M. A Planning and Zoning Commission Aleeting would be held Tuesday, August 26, 1975 at 7:30 P.M. The Beautification and Environmental Committee would hold a meeting on Wednesday, August 27, 1975 at 7 :30 P.M. A Bicentennial Committee Meeting would be held :dednesday, September 3, 1975 at 8:00 P.M. Youth Athletic Association Meeting would be held Wednesday, September 3, 1975 at 8 :00 P.M. The First Reading of the Budget would be held at the Regular Meeting of the City Council on Thursday, September 4, 1975 at 8 :OC Regular Meeting, August 21, 1975 Page 2 SEALED BIDS: Sealed bids were received and opened by the City Clerk for a -!� TON PICK -UP !� Ton Pick -Up Truck, duly advertised on July 28, 1975. The following bids were received: General GMC Truck Sales and Service, Inc., West Palm Beach - 1976 GMC TC10703 - $3,444.00 Garrison Datsun- Lotus, North Palm Beach - 1975 41 ton pick -up truck - $3,100.00 The bids were referred to the City Manager and the Public Works Director for review and recommendation. AWARDING BIDS At the recommendation of the City Manager and the Fire Chief# FOR 4 PLECTRON by unanimous motion,the City Council awarded the bid for 4 Plectron Pagersto Central Florida Fire Equipment Company in the amount of $1,336.00 to be taken from Account 12 -228. PRESENTATION OF Mr. Jim Titael, Baseball Director, Palm Beach Gardens Youth TROPHIES - MR. TITZEL: Athletic Association, presented to the City two trophies won by the Gold Coast Team, boys in the 16 -18 age group. Mayor Martino accepted the trophies which will be placed in the Trophy Case at City Hall. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged communications from: PUBLIC SERVICE 1. William DeMilly, Public Service Commission advising of the COMMISSION: receipt of Resolution #30, 1975 relative to eliminating the tariff for fire hydrant rental. PUBLIC HEARING - 2. Public Hearing to be held on August 27, 1975 at 7 :30 P.M. 1 -95: at the Jupiter Middle School, 501 Tony Penna Drive regarding the progress of I -95 in this area. Regular Meeting, August 21, 1975 Page 3 CITY OF BOYNTON 3. City of Boynton Beach Resolution requesting the Public BEACH: Service Commission to explain the electric power rates and charges. ..� OPDINANCES: Mayor Martino declared the Public Hearing open on consideration of a request for annexation of a parcel of land in Section 5- 42 -43, duly advertised July 31, 1975. Mr. George Blanck, owner of the parcel of land in question addressed the Council, pointing out the location of the property and advising he was also the owner of the property contiguous to this parcel, that was formerly annexed into the City and zoned R -3C. Mr. Fred Cunningham, a member of the Planning and Zoning Commission verified that it was the recommendation of that Board the land be annexed into the City. The Public Hearing was declared closed by Mayor Martino. ORDINANCE #16, Ordinance #16, 1975 - annexation of a parcel of land in Section 5 -42 -43 was read on second reading, by title only, by the City Clerk. Ordinance #16, 1975 was adopted by a vote of 4 to 1. Mayor Martino, Vice Mayor DeLonga, Councilman JJiley and Councilman Kiedis voted aye; Councilman Feeney voted nay, stating for the record it was his philosophy that no parcel of land should be annexed into the City with a higher classification than what it is presently zoned. ORDINANCE #140 Mayor Martino declared the Public Hearing open for consideration 1975= of Ordinance #14, 1975, the annexation of a parcel of land located in Section 24- 42 -42, which had been tabled from the Regular Meeting of the City Council held July 17, 1975. Mr. t�lalter Colbath, representing the client, stated that the Regular Meeting, August 21, 1975 Page 4 ownership of the property in question had changed hands since the last meeting was held. The new owner was North Palm Beach County Properties, Inc., consisting of Nancy Brown, 5046 interest, Lee B. Winkler, 251 interest and Bert Reynolds, 25% interest. Mr. Colbath further advised he and the adjacent property owners had met and discussed an agreeable buffer zone between the residential property and the proposed commercial property, and had not as yet reached an agreement. He asked the Council at this time to table any discussion to enable him to meet with Attorney Brant and the residents to come up with a recordable form in writing.,declaring his clients intent to provide a buffer zone on the south and east sides of the property. A discussion followed between members of the audience living on Dania Drive- Mr. Paulsson, Sr., Mr. Paul, Paulsson and Mr. Fucci, the Council and Mr. Colbath. ORDINANCE #14, By unanimous vote of the Council, the Public Hearing on HEARING RECESSED: consideration of Ordinance #14, 1975 was recessed to the Regular Meeting to be held on September 18, 1975. This will allow the petitioner and the residents living adjacent to the property time to further discuss and resolve their problems. ORDINANCE #15, Ordinance #15, 1975- requirements for roof covering materials was discussed by the Council and they concurred to include a sentence stating that tar and gravel roof coverings shall not be permitted on any structures erected within a newly developed R -1 single family residential zoning district. A Public Hearing and second reading of Ordinance #15, 1975 will be held at the Regular Meeting on September 4, 1975. Regular Meeting, August 21, 1975 Page 5 ORDINANCE #10, After discussion,minor changes were made by the Council to 1975: Ordinance #10, 1975 .- amending the Landscape Ordinance. �. First reading of Ordinance #10, 1975 will be held at the Regular Meeting on September 4, 1975 and a Public Hearing and second reading will be held on September 18, 1975. Councilman Wiley will provide a drawing, to be an exhibit to the ordinance, clarifying the landscaping of a pole sign. ORDINANCE #12, Ordinance #12, 1975 screen enclosures was discussed by the T9TT.-- Council, with minor changes made. First reading of Ordinance #12, 1975 will be held at the Regular Meeting on September 4, 1975 and a Public Hearing and second reading held on September 18, 1975. ORDINANCE #19, Ordinance #19, 1975- Terraces was workshopped and minor changes made by the Council. First reading of Ordinance #19, 1975 will be held at the Regular Meeting on September 4, 1975 and a Public Hearing and second reading held on September 18, 1975. ORDINANCE #9, Ordinance #9, 1975 - revisions to the Fire Code was discussed by the Council after City Manager, John Orr, reviewed his recommendations made in memo dated June 18, X975. The Building Inspector and the Fare Chief will attend a Council meeting to further discuss this ordinance and clarify their recommendations. ORDINANCE #171, Ordinance #17, 1975 Interim Services and Facilities Fee was 1975; tabled to enable the City Attorney to obtain copies of ordinances �✓ relating to this subject from Boynton Beach and Naples and to obtain a copy of the circuit court ruling in the case against Regular Meeting, August 21, 1975 Boynton Beach. Page 6 ORDINANCE #21, Discussion was held on Ordinance #21, 1975 - limitation of time `.- 1975: a contractor can use a home as a model structure and revised with the addition of a sentence to read "no sign denoting a model home may be placed on the premises prior to the issuance of a C.O. by the Building Inspector." First reading of Ordinance #21, 1975 will be held at the Regular Meeting on September 4, 1975 and a Public Hearing and second reading will be held on September 18, 1975. REPORTS: Mayor Martino reported he had attended the Planning and Zoning PLANNING AND Commission Meeting held August 12, 1975 and the minutes of that ZONING COMMISSION STING: meeting were available in the information folder. ITEM'S BY THE CITY MANAGER: SIGN CODE: City Manager John Orr, reported he had advised Mr. Pappalardo of the opinion of the City Attorney that the meat market sign, located at the Tanglewood Plaza, was grandfathered. Mr. Orr related that Mr. Pappalardo would like the Council to provide a variance section in the Sign Code. The Council agreed that Mayor Martino and Attorney Brant review the variance procedure that was studied during discussions on the Sign Code ordinance. APPRAISAL- 9% By unanimous motion, the City Council authorized the City Manager to obtain a second appraisal on the 912 acres adjacent to the City Hall. ITEMS BY MAYOR AND COUNCIL. LOCAL COMPREHEN- Mayor Martino acknowledged receipt of a communication from the SIVE PLANNING ACT: Department of Administration relative to the Local Comprehensive Regular Meeting, August 21, 1975 Pag e 7 Planning Act of 1975 which must contain, among other things, a traffic circulation plan. Mayor Martino suggested reconsidering 1-1 the need for a traffic study. Councilman Wiley presented newspaper articles relative to the traffic hazard at the intersection of 1_95 and PGA Blvd., and requested they be placed in a frame and hung in the Assembly Room for the perusal of the public, and requested continued harassment of the state officials for their consideration of a clover leaf at that intersection. Vice Mayor DeLonga reported he had received complaints,at the peak hours, of the conjestion at the intersection of Northlake Blvd. and MacArthur Blvd., due to the construction of Narthlake Blvd. at that point. The City Manager will investigate.
