HomeMy WebLinkAboutMinutes Council 092575WORKSHOP MEETING CITY OF PALM BEACH GARDENS SEPTEMBER 25, 1975 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 10500 N. Military Trail and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor DeLonga, Councilman Wiley, Councilman Kiedis and Councilman Feeney. Attorney Brant was in attendance. city Manager, John L. Orr, was detained because of sickness in his family MINUTES: The Minutes of the Regular Meeting of September 18, 1975, as amended, were unanimously adopted by the Council. ANNOUNCEMENTS: Mayor Martino made the following announcements: ti A Bicentennial Committee Meeting would be held Wednesday, October 1, 1975 at 8 :00 P.M. A Youth Athletic Association Meeting would be held Wednesday, October 1, 1975 at 8 :00 P.M. Jr. Trail Riders Meeting to be held Wednesday, October 1, 1975 at 8 :00 P.M. The Woman's Club will sponsor Bingo every Monday night in the Assembly Room. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: FOOTBRIDGE Frank Hart who lives at 9506 Birmingham Drive addressed the Council ACROSS EARMAN IVER: on behalf of the residents in the area between the Earman River Canal and Northlake Blvd., west of 1_95 to Military Trail to question the Council regarding tentative or firm plans they may Workshop Meeting, September 25, 1975 Page 2 have for removal or relocation of the Keating Drive footbridge. He presented the Council with a petition signed by 544 residents I--- the area. The petition read "We, the citizens of the Town Hall, Crestdale Homes area of the City of Palm Beach Gardens and /or Palm Beach County petition the City of Palm Beach Gardens to abandon plans to remove or relocate the footbridge across the canal at the north end of Keating Drive." Approximately 40 residents of the area were present at the meeting, and 12 of these people addressed the Council emphasizing the fact they did not want the bridge removed, and urged the Council to purchase the lot adjoining the bridge to afford access to it. Mayor Martino read from the minutes of the September I1, 1975 meeting, the discussion by the Council on the footbridge whereby the Council concurred that the footbridge would not be removed until a safe solution for the chi.ldrens safety was found. He assured the audience the Council would adhere to that decision, and that the City Manager had been instructed to investigate the alternates with the County and the Dept. of Transportation; make a determination what use could be made or the easement, and the cost if the lot could be purchased, and reiterated that the City was moving in a progressive direction. After a lengthy discussion was held, Mayor Martino advised this item would be placed on future agendas until it is resolved. ITEMS BY CITY MANAGIW : LIGHTING City Manager, John L. Orr, presented the Council with a drawing PROGRAM -RAM PLAT 1: - prepared by the Florida Power and Light Company, setting forth a lighting program for Plat 1 with 25 additional lights for that area, the total impact for the year being $ 1600.00. The City M Workshop Meeting, Septetuber 25, 1975 Page 3 Manager advised the Florida Power and Light Company will provide a letter of standard easement to be given to those residents where necessary. City Manager, John L. Orr advised a meeting has been scheduled for October 8, 1975 from 7 -9 P.M. with the City Council and the Department Heads to hear a representative from the State make a presentation regarding Collective Bargaining. ORDINANCE #10, The order of the agenda was revised to enable Mr. Sate Carsillo to present the recommendations of the Beautification and Environmental Committee regarding Ordinance #10, 1975 the revisions to the Landscape Ordinance, and the input from Art Nelson, an Architect. Councilman Wiley will rewrite paragraph A -1 to include verbage that will describe examples #1 and #2 relative to landscaping required for pole and ground signs, which the B&B Committee agreed to, and will be incorporated into the ordinance by Attorney Brant for a public hearing and second reading, as advertised, on October 2, 1975. The additional suggestions made by Art Nelson and the B &E Committee as modifications to Ordinance #1, 1975 the Landscape Ordinance will be considered and incorporated into another ordinance for consideration by the Council at a future date. Mr. Carsillo also relayed from the B &E Committee the fact that the shrubs and plants around the City Hall complex are not being properly watered, and questioned if any information had been received about the white amore fish that have been used effectively to clean out the algae in the canals. Workshop Meeting, September 25, 1975 Page 4 Mr. Carsillo, speaking as a resident, suggested the Council look in the direction of putting in wells in respect to the recent increase in the water rates. ITEMS BY MAYOR AND COUNCIL: MAYOR MARTINO: Mayor Martino requested that curbing radius on Holly Drive be considered as a project with funds to be taken from the Federal Revenue Account. The Council will add to the list dated September 25, 1975 as compiled by the City Manager of the projects that need immediate attention and priorities will be set. VICE MAYOR At the request of Vice Mayor DeLonga concerning the abandonment DE LOMA : of a sidewalk easement at the rear of his and adjacent homes on Dahlia Avenue, the Council directed the City Attorney to prepare EASEMENT an advertisement and resolution effecting this, which will be ABANDONMENT: considered at the meeting of October 2, 1975. Vice Mayor DeLonga will obtain and submit to the City Manager, letters of concurrance from adjacent home owners prior to the advertisement date. APPOINTMENTS The Council discussed the method of appointing members to the TO ADV Y various advisory boards and adopted the following policy: 1. Notice given to all interested parties 2. Invite them to attend future meetings of that particular Board. 3. then a vacancy occurs, comments from the Advisory Board will be welcome. 4. Council will appoint new members. WATER AND Discussion was held regarding the petition for reconsideration SEWER RATES: �-' filed by the City of Palm Beach Gardens, the Village of North Palm Beach and the Town of Lake Park regarding the application Workshop Meeting, September 25, 1975 Page 5 of Palm Beach County Utilities Company and North Palm Beach Utilities, Inc. for an increase in rates in Palm Beach County. The Council agreed to the proposal set forth by Attorney Brant to modify the petition for reconsideration based on a mutual agreement with the Attorney for the Utility Company and the City, to include in the original order from the Public Service Commission a method of monitoring the water plant facility by the P.S.C. and a time date certain for assuring the City of the completion and upgrading of the water plant, thereby providing the City with an improvement in the quality of the water and adequate pressure. The Council will further pursue with the Governor and the Legislative Delegation by resolutions and letters questioning the effectiveness and efficiency of the P.S.C. and the fact that the rate differential of residential, versus multiple family dwellings is based on the policy that the multiple family rate is based on 2/3 of the residential rate. RESOLUTION #33� The Cbuncil did not :Hake any changes to Resolution #33, 1975 1975: authorizing the use of a mobile home trailer at Electro Oxide Corp. as written and it will be an item on the agenda of the Regular Meeting to be held October 2, 1975. ORDINANCE #90 Consideration of Ordinance #9, 1975 - Revisions to the Fire Code was tabled for workshop at the Regular Meeting to be held October 2, 1975. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged receipt of communications from: .—I P& Z COMMISSION: 1. The City Attorney was instructed to prepare an ordinance for first reading for consideration of the Council on the above. DAVID W. MONKS: 2. David W. Monks, Administrator, Palm Beach Gardens Community Hospital assuring the Council that their plans for expansion are continuing with ground breaking in March or April 1976. NAVY WEEK: 3. U.G. Hum1, Lieutenant Commander, U.S. Naval Reserve requesting the City prepare a Proclamation declaring Navy Week - October 6 -11. The City Clerk was instructed to prepare this proclamation for reading at the Regular Meeting, October 2, 1975. DAVID H. 4. David H. Bludworth, State Attorney advising of a seminar on BLUDWORTH: October 2, 1975 from 7 :15 to 10 P.M. at the auditorium of the Palm Beach County Junior College relative to the Florida Sunshine Law. HOME BUILDERS 5. Lewis W. Lawder, Executive Vice President, Home Builders and ASSOC.: Contractors Association of Palm Beach County asking to be advised 'wheh Ordinance #17, 1975 - Interim Services and Facilities Fee is discussed by the Council. GEORGE STERLING: 6. George J. Sterling, Jr., Florida Dept. of Transportation, regarding comments relative to I -95 which will be given consideration in the ultimate location and design. SENATOR 7. W. Bud Weaver, Chairman, Palm Beach County Commission confirming the offer of the use of land for the erection of a permanent �4 library facility on City Hall property. ITEMS FOR DISCUSSION: CHARTER Discussion on the draft of the proposed Charter revisions was REVISIONS: deferred until a later date due to the lateness of the hour. Mayor Martino provided the Council, with a copy of the Charter .indicating where the committee had made the changes. REPORTS: Mayor Martino reported he had attended the Planning and Zoning P &Z COMMISSION Commission meeting held September 23, 1975. Mr. Marvin Hill, Land MEET ING : Planner was in attendance and presented a copy of recommended revisions to the City's zoning code, copies of which were given to the Council. B &E COMMITTEE Councilman Kiedis reported he had attended the Beautification and MEETING: Environmental Committee Meeting held September 24, 1975. The meeting was spent reviewing the Landscape Ordinance with the recommendations made as presented by Sam Carsill.o. NOISE ORD.: Councilman Wiley requested that consideration be given to the proposed Noise Ordinance in the near future. VENDORS USING At the recomendation of Councilman 4iley, the City Attorney was M_D_TOR VEHICLES: directed to prepare an ordinance regulating the hours for vendors using motor vehicles.
