HomeMy WebLinkAboutMinutes Council 100975WORKSHOP MEETING CITY OF PALM BEACH GARDENS OCTOBER 9, 1975 The Workshop Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 14500 North Military Trail, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the Secretary and present were: Mayor Martino, Vice Mayor DeLonga, Councilman Wiley, Council- man Kiedis, and Councilman Feeney. Attorney Brant was in attendance. MINUTES: The minutes of the Regular Meeting of October 2, 1975, were unanimously approved by the Council, as amended. ANNOUNCEMENTS: Mayor Martino made the following announcements: 1. An "Open House'T would be held at the Cityr s Fire Station from 1:00 P.M. to 5 :00 P.M. on Saturday, October 11, 1975. 2. A Merit System Board Meeting would convene at 7 :30 P.M. on Monday, October 13, 1975. 3. A Planning and Zoning Commission Meeting would be held Tuesday, October 14, 19750 at 7:30 P.M.. 4. A meeting of the Recreation Advisory Board would convene �-- at 8 :00 P.M. on Tuesday, October 14, 1975. City Council's Wbrkshop Meeting, 10/9/75 -2 5. A Volunteer Firemen's Meeting would be held Tuesday, October 14, 1975, at 8:00 P.M.. 6. A Woman's Club Meeting would be held Wednesday, October 15, 1975, at the City Hall Complex. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: B. L. HILTON Mr. B. L. Hilton of 4434 Bamboo Drive addressed the Council FRANCHISE questioning the "Franchise Charge" indicated on the Florida CHARGES Power and Light Company's invoices. The members of the Council expressed appreciation for Mr. Hilton's comments and explained the "franchise taxes" that are paid by utility companies as a source of revenue to the City, as outlined in the City's General Budget. In answer to Mr. Hilton's question, Attorney Brant advised that utility easements may not be donated to the City, in lieu of paying franchise charges to utility companies. ITEMS BY THE CITY MANAGER: JOHN L._ORR The City Manager, John L. Orr, submitted an "Emergency EMERGENCY OPERAT- Operating Plan" he prepared to the members of the Council for ING PLAN their perusal and recommendations. The plan will be discussed at a future meeting of the City Council. C . .r PROJECTS Discussion took place relative to the list of items compiled � — by the City Manager, to be considered for projects within the City, with monies to be taken from the Federal Revenue Account. City Council's Workshop Meeting, 10/9/75 _g The members of the Council concurred with Councilman Wiley's recommendation that each Councilman add to the list dated September 25, 1975; indicate his priorities by number; and submit same to the City Manager, enabling him to establish a master list, to be further discussed at a future Council meeting. ITEMS BY THE MAYOR AND COUNCIL: MAYOR MARTINO In answer to Mayor Martino's question, the City Manager advised 91�j ACRES COUNCILMAN WILEY MODULAR RESI- DENTIAL HOME COUNCILMAN FEENEY POLICE OFFICERS AT PBGHS FOOT- BALL GAMES that two appraisals for the 91� acres of land located adjacent to the City Hall property, have been ascertained and are available for the Council's review. Discussion relative to the Council's consideration of pur- chasing the parcel will take place at the City Council Regular Meeting of October 16, 1975. In answer to Councilman Wiley's inquiry, the City Manager advised that a modular residential home, which meets all of the City's Building Codes and state regulations, is being assembled on Holly Drive in the City. Councilman Feeney requested that, if possible, City police officers be designated to patrol the area of the Palm Beach Gardens' High School during their football games on Friday nights; and also, assist with the traffic control. City Council's Workshop Meeting, 10/9/75 -4 COTINCILMAN Councilman Kiedis reported that residents of the City have K CIS questioned that in view of the fact the as mobile home owners q Ys , MOBILE HOME OWNERS pay the franchise charges on their electricity bills, why they are not provided street lights within the mobile home park and the City's services of trash and garbage pick -ups. In answer, Attorney Brant advised that the streets are not dedicated; and their aren't any public right -of -ways or public easements within the park. RESOLUTIONS: Resolution #38, 1975, urging the members of the U. S. House RESOLUTION #38i of Representatives and Senate to continue the Revenue Sharing 975 Act on a permanent basis, will be considered for adoption at RF"ENUE SHARING s. the City Council Regular Meeting of October 16, 1975. ORDINANCES: A communication was acknowledged from Seymour A. Fine of ORDINANCE #21t Fine Builders, Incorporated, outlining recommendations relative to Ordinance #21, 1975, model home structures, which was MODEL HOMES submitted per the request of the Council. A workshop session was held on Ordinance #21, 1975, prividing for what existing structures may be used as model homes and for a prescribed time period. The City Attorney was directed to reconstruct Ordinance #219 1975, by incorporating the recommendations outlined in Mr. Fine's communication, and the items tentatively approved by the City Council, with the time frame to be a separate paragraph. City Council Workshop Meeting, 10/9/75 -5 A Public Hearing and Second Reading will be held on Ordinance #219 1975, at the City Council Regular Meeting of October 16, 1975. ORDINANCE #221 A workshop session was held on Ordinance #22, 1975, providing - for procedures for variances to the Sign Code. SIGN CODE The City Attorney was directed to rewrite Ordinance #22, 19750 by incorporating the items tentatively approved by the City Council, to include requirements for legal notifications and filing fees for the variances. A Public Hearing and Second Reading will be held on Ordinance #22, 1975, at the City Council Regular Meeting of October 16, 1975. ORDINANCE #9? It was the concensus of the Council to cancel the workshop session on Ordinance #9, 1975, amending the City's existing FIRE CODE Fire Code, and schedule the Ordinance to be read on first reading at the City Council Regular Meeting of October 16, 1975. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged receipt of communications from: STATE REP. 1. State Representative Jack Poorbaugh, advising of hearings JACK POORBAUGH pertinent to legislation to take place January 9, 1976, at 10 :00 A.M. in the Martin County Council Chambers. U S. SENATOR 2. U. S. Senator Dick Stone, relative to the extension of M- . STONE I -95 northernly, City Council's Workshop Meeting, 10/9/75 -6 SCIENCE MUSEUM 3, Ralph O. Ewers, Director of the Science Museum of Palm O 'ALM BEACH Co Y Beach County, requesting a donation from the City in the amount of $500 to support their institution. Mayor Martino offered that in view of the fact that such monies were not a part of the City's 1976 Fiscal Yearts Budget, the monies could not be donated; and a letter of response would be written. ST4,TE ATTORNEY Councilman Wiley acknowledged receipt of a Communication, BLUDWORTH together with attachments, from State Attorney David Bludworth, as requested, in regard to the Florida State Sunshine Law. The data will be placed in the information folder in the City Clerk's Office for the Council's perusal. ITEMS FOR DISCUSSION; ASSISTANT FIRE Ph,�CING OF PLANT DRIVE PARK FOR LITTER The City Manager was requested to prepare a summary sheet outlining the responsibilities of the position of Assistant Fire Marshal. The City Attorney was directed to prepare a Resolution appointing William F. O'Brien and Raymond Lambert as Assistant Fire Marshals of the City, per the recommendation of the City's Fire Chief; said Resolution to be considered for adoption at the City Council Regular Meeting of October 16, 1975. The City Manager advised the Council of the extensive manpower required of the City personnel to maintain the cleanliness of Plant Drive Park subsequnt to PBGYAA football games on Saturdays and Sundays. City Council's Workshop Meeting, 141/9/75 -7 The Council recommended that the President and Director of Football of the PBGYAA be contacted by the City requesting that every attempt be wade of the Association to police the grounds for litter. USAGE OF PLANT The members of the Council concurred with Councilman Wiley's DRIVE FIELD BY YMCA recommendation that the City permit the YMCA to utilize the Plant Drive Football Field on Tuesday, October 21, 1975, and Tuesday, November 4, 1975, from 6 :30 P.M. until 8:30 P.M., as requested in the communication dated October 9, 1975, from C. Richard Willits, Jr., the Gra -Y Director. Mr. Willits was advised by the Council that as a policy of the City, Plant Drive Fields are reserved for activities of the City's Recreation Department and the PBGYAA. CITY POLICY The Council reaffirmed the policy of the City that any major PLANT DRIVE organized activity requested to take place at Plant Drive Fields, FIELDS other than the City's Recreation Department and the PBGYAA must be authorized by the City Council. APPRAISALS The City Manager advised that the two appraisals for each of FOOTBRIDGE LANDS Lots 11 and 12, Block 68, Plat 6 of the City of Palm Beach Gardens are expected to be available for the City Council's review the week of October 12, 1975. City Council's workshop Meeting, 10,19/75 The City Manager also advised that the two appraisals for three feet along the westerly side of Lot 11 and five feet along the easterly side of Lot 12, authorized at the City Council meeting of October 2, 1975, will not be ascertained due to the monies required for said appraisals. Mr. Richard Fox, a member of the audience, offered that he had spoken to Mr. Mark Garnett of Bankers Life and Casualty Company, and Mr. Garnett advised that the County's registered plot plan of the City of Palm Beach Gardens indicates that there was a twelve -foot center right -of -way easement from the canal to Gardenia Drive at the location of the footbridge crossing the Barman River donated to the City by Mr. John D. MacArthur. The Council expressed appreciation for Mr. Fox's comments, and advised that the official plot plans on record at the City do not indicate such an easement; however, the City's Attorney was directed to research same. REPORTS: Vice Mayor DeLonga reported on the Palm Beach Gardens' High VICE MAYOR School Committee's meeting of Monday, October 5, 1975. The DELONGA P Committee appointed three teacher representatives; and dis- F3GHS COM . MEETING cussed various aspects of the Community School relationship, the speeding of school buses, and possible solutions to -- alleviating the problem of theft of bicycles at the High School. City Council's Workshop Meeting, 10/9/75 -9 _H('"'FCOMING Mayor Martino announced that the "Homecoming Parade" of the E� rATS OF FbLitib High School would take place through the City from 1:30 to COUNC ILMAN KIEDIS B & E COM . MEETING A )URNMENT: 2 :30 P.M. on Friday, October 10, 1975; and the homecoming football game would take place that evening. Councilman Kiedis reported that he attended the Beautification and Environmental Committee Meeting of October 8, 1975; and the Committee discussed planting Acacia Trees along MacArthur Boulevard, and their plans to select a tree to be planted in the honor of the Bicentennial Year. Also, the Committee expressed some concern over the lack of maintenance of the shrubbery recently planted around the City. h no fur r bu iness, the meeting adjourned at 11:00 P.M..
