CITY OF PALM BEACH GARDENS
OCTOBER 230 1975
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Martino at 8:00 P.M. in the Assembly
Room, 10500 N. Military Trail, Palm Beach Gardens, Florida and
opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were Mayor Martino,
Vice Mayor DeLonga and Councilman Kiedis. Councilman Feeney and
Councilman Wiley were absent. Attorney Brant was in attendance.
MINUTES: The Minutes of the Regular Meeting of October 16, 1975 were
unanimously approved by the Council.
ANNOUNCEMENTS: Mayor Martino made the following announcements:
A Planning and Zoning Commission Meeting would be held Tuesday,
October 28, 1975 at 7 :30 P.M.
There would not be a City Council Meeting on October 30, 1975.
An Administrative Meeting would follow the adjournment of the
Workshop Meeting this date - October 23, 1975.
ITEMS BY THE CITY MANAGER:
AMERICAN ASSOC. 1. At the recommendation of the City Manager, the Council agreed

to consider joining the American Association of Small Cities, for
Cities with a population of less than 30,000, after additional
information is requested as to their goals, objectives and cost.
2. City Manager John L. Orr advised that Palm Beach Cable TV
had been denied their request by the FCC to carry Channel 6.
3. City Manager John L. Orr advised that a corrected legal
description had been received for the property on the south side

of PGA Boulevard which will be considered for rezoning from C -1
to R -3C, at a Public Hearing by the Planning and Zoning Commission
on November 11, 1975.
APPRAISAL ON 4. City Manager, John L. Orr, advised that two appraisals had been

of Lot 11 averages within $500 of the quoted price and the 2
appraisals of Lot 12 averages within $500 of the quoted price; that
he had negotiated for the sale of Lot 12 which would allow the
City adequate access to the Earman River for proper maintenance and
provide a public walkway to be maintained through the area. The
selling price is $159180 with the terms as follows: $500.00
deposit, $3295 at the closing, both is be taken from the Contingency
Fund, with a mortgage of $ 11,385, at 73r&% interest for 3 years,
$4357.88 per installment which includes principal and interest.
The City Attorney was directed to prepare a Resolution to accompany
the contract which will signed by the Mayor at the Regular Meeting
to be held November 6, 1975.
SOLID WASTE 5. Receipt was acknowledged by the City Manager of a communication

from Timothy F. Hunt, Jr., Acting Director, Solid Waste Authority,
advising that a meeting of the Palm Beach County Solid Waste
Authority would be held October 28, 1975 at 7 :00 P.M. in the West
Palm Beach City Hall.
RESOLUTION TO 6. City Manager, John L. Orr, recommended that the Council

OF CITIES RE consider a resolution similar to the one received from the Town
YARD TRASH:
of Palm Beach, which was sent to the Florida League of Cities,
urging the support of corrective legislation which would eliminate
the requirement that yard trash collected by municipalities be

disposed of in the same manner as household garbage and other
solid waste.
The City Manager was directed to prepare a resolution to parallel
these comments for the Council's consideration at the Regular
Meeting on November 6, 1975.

Vice Mayor DeLonga commented that he had received numerous
complaints relative to the noise from the train whistles in the
late evening hours and asked that the City Manager contact the
local officials to seek a solution to remedy this.
In answer to a question posed by Vice Mayor D eLonga, the City
Manager reported construction had started on the widening of
PGA Blvd. west of Military Trail.
Councilman Kiedis recommended that a bulletin board be placed in
the vicinity of the Lil General Store or Cumberland Farms Store
located on Northlake Blvd. for the convenience of the residents
in that area.
Councilman Kiedis made the suggestion to paint a double stripe
on the road at sharp curves for safety reasons.
No additional comments were made on Ordinance #9, 1975 amending
the Fire Code and a Public Hearing and second reading will be held
on November 6, 1975.
Discussion was held on Ordinance #21, 1975 - limitation of time a
contractor can use a home as a model structure.
The Council concurred to delete Sec. 6 -9 (a) and (b) the requirement
that the landscaping and parking plan should be approved by the
Planning and Zoning Commission, and that the requirement that the sod

in the Swale area be temporarily waived. Sec. 6 -10 shall be
modified to define the size of the sign to read no larger than
� 20 square feet.
The Council concurred to workshop Section 6 -11 - time restrictions,
when a full Council is present.
The Public Hearing scheduled for November 60 1975 on consideration
of Ordinance #21, 1975 will be held and recessed if necessary for
further discussion.
PETITIONS AND COMMUNICATIONS:
The following communications were acknowledged by Mayor Martino:
BICENTENNIAL 1. Congressman Skip Bafalis that the City of Palm Beach Gardens

had been recognized as an official "Bicentennial Community" by the
American Revolution Bicentennial Administration.
FLORIDA PEACE 2. Florida Peace Officers' Association advising of a Special

`f Meeting on October 30, 1975 at 9:00 A.M. in Tampa relative to
Municipal Retirement Systems, Pension Conference.
SOLID WASTE 3. Solid Waste Authority advising of meeting of Palm Beach County

West Palm Beach City Hall.
PROCEDURES- 4. Memo from the Site Plan and Appearance Review Committee

WPPEARANCE recommending the adoption of procedures for Site Plan and Appearance
Review as adopted by that committee on October 14, 1975.
ROBERT CULPEPPER:5. County Commissioner Robert F. Culpepper advising that after
November 1, 1975 he will be in residence on a part time basis
at the Northeast County Complex located on PGA Blvd.
COUNTY 6. John C. Sansbury, County Administrator, advising that due to

BRANCH LIBRARY: to budget limitations, the County was unable to appropriate funds
this year to build a branch library in Palm Beach Gardens, but will
~° contact the City Attorney to secure the agreements for this
accomplishment in the 1976 -77 fiscal year.
PALM BEACH 7. Palm Beach County Planning Commission notification of a public
COUNTY PLANNING
COMMISSION: hearing on November 6, 1975 regarding a parcel of land located in
Section 17 -42 -43 on the east side of AlA north of Honey Road which
is within 15 mile of City property. This notice has been forwarded
to the Planning and Zoning Commission for their comments.
OPEN HOUSE- 8. Invitation to the Open House of the new Northeast Palm Beach
NORTH COUNTY
COUOTROUIS County Courthouse Complex on PGA Blvd. to be held November 7, 1975
at 10:30 A.M.
WHITE AMUR FISH: Councilman Kiedis reported he had received a brochure and written
to a firm relative to the white amur fish, that live on vegetation
and could be used in the canals.
ITEMS FOR DISCUSSION.*
CLOSING OF BARS Discussion was held on the pros and cons of closing the bars and

stores that sell alcoholic beverages at 3 :00 A.M. in view of the
recent change of hours made by the County Commission, the City of
West Palm Beach and Riviera Beach.
Action on this subject was deferred until a full Council was present.
The City Attorney was directed to prepare a resolution for the
consideration of the Council on the above subject for the workshop
meeting of November 13, 1975.
PROCEDURES FOR The City Manager, John L. Orr, presented a copy of Procedures for

perusal by the Council. He commented thatf if adopted, these
procedures would put the onus on the petitioner. The Planning

and Zoning Commission will consider these recommendation for
adoption at their meeting of October 28, 1975.
PROCEDURES FOR The City Attorney was directed to prepare a resolution for adopting

Council's consideration at the November 5th meeting, time permitting.
EMPLOYEES The City Manager, John L. Orr, recommended that,due to the mandatory
RETIREMENT PLAN:
retirement date of an employee of the City at 55 years of age, and
the contract for the retirement plan between the City and the
employees states an employee must serve 10 years with the City,
the 10 years of service requirement be deleted, with no cost to
the employees or the City. The City Manager related that the
present requirement could jeopardize an employee from receiving
the full vested pension if he was not allowed to complete the
10 years of service prior to reaching, the age of 65.
The Council agreed with the City Manager's comments and directed
the City Attorney to prepare a resolution for their consideration
at a future date.
REPORTS: Councilman Kiedis reported he had attended the Appearance Plan
APPEARANCE PLAN Committee Meeting held October 21, 1975. The objectives were

reviewed, modified and are being retyped. Copies will be given
to the Planning and Zoning Commission and the City Council when
completed.
Vice Mayor DeLonga asked that the Administrative meeting be held
in obeyance until a full Council was present.
The City Manager stated the Administrative meeting was necessary
and the Council agreed to hold same.
