HomeMy WebLinkAboutMinutes Council 121875REGULAR MEETING CITY OF PALM BEACH GARDENS DECEMBER 18, 1975 The Regular Meeting of the City Council of Pala Beach Gardens Was called to order by Mayor Martino at 8:00 P.M. in the Assembly Roam, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor DeLonga, Councilman Kiedis and Councilman Feeney. Councilman Wiley arrived later in the meeting. Attorney Brant was in attendance. MINUTES: The Minutes of the Wbrkshop Meeting of December 11, 1975 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Martino made the following announcements: The AdRinistrative offices would be closed on Friday, December 18, 1975 because of the Christmas holiday. Zoning Board of Appeals Meeting would be held Thursday, January 8, 1976 at 7 :30 P.M. The City Council will judge the Christmas decorations at the Meadows Trailer Park on Monday, December 22, 1975. Mayor Martino recognized Mr. Frank Gerjj and his son in the audience. Young Mr. Gerry was attending the meeting as a requisite to earning his Boy Scout Eagle Badge. PETITIONS AND CNICATIONS: Receipt of communications from the following were acknowledged by Mayor Martino: L RICHARD Richard J. Vymlatil, Branch Executive, YMCA expressing thanks for the MMEIL : use of the football field at Plant Drive. FAIRWAY Fairway Hones application for a PUD. HOMES : Regixlar Meeting, December 18, 1975 Page 2 BEN Ben A. Coachman, PIIIa Beach County Shrine Club requesting to appear at a 766ACHMAN : council meeting to obtain a permit for a carnival location in the City. Vice Mayor DeLonga expressed an objection because of the difficulty experienced in previous years. The Council concurred to invite Mr. Coachman to attend the meeting of January 8, 1976 to explain their request. WILLIAM idlliam G. 'Wallace, Jr., Vice President of Gee and Jenson, Engineers, WA JR. requesting to appear before the Council to explain the objective of the study they are doing for the Florida Department of Transportation relative to the proposed improvement of A1t.AlA from Northlake Blvd. to U.S. #1 in Jupiter. The Gouncil concurred to invite Mr. Wallace to make his presentation at the Workshop Meeting of January 8, 1975. J. P. BROWN: J. P. Brown, Varsity Tennis Coach, Pal:ln Beach Gardens High School requesting permission to use the four tennis courts at the City Complex, as per schedule attached to letter, by their varsity tennis team. The Council expressed no objection and directed the City Manager to respond in the affirmative. LAWTON CHILES: Vice Mayor DeLonga acknowledged receipt of a letter from Senator Lawton Chiles regarding the termination of I -95 at PGA Blvd. in the City and offering his help. ORDINANCES: Mayor Martino declared the Public Hearing open on consideration of Ordinance #24, 1975 - side and rear yard setbacks in ccmmerci.al zones, as duly advertised on November 26, 1975. No comments were made by the Council or the audience. Mayor Martino declared the Public Hearing closed. Regular Meeting, December 181 1975 Page 3 Ordinance #24, 1975 was read by title only, on second reading by the City Clerk, with a modification to add the words "or road right of way" --- after the word easement in the fourth line from the bottom of Section.l, and unanimously adopted by the Council. 0RDINANCE #25, Mayor Martino declared the Public Hearing open on consideration of Ordinance #25, 1975 rezoning lands in Section 12- 42 -42, a parcel of land on the southside of PGA Blvd. from Military Trail west to Hickory Drive from C -1 to R -3C and Lots 4 and 5, Block 2 PGA from R-3 to C -l. Mr. Harold Vick, 10902 Larch Court and Mr. John Gallagher, 10876 Magnolia spoke from the audience strongly objecting to the rezoning of Lots 4 and 5, PGA Plat #2, from R -3 to C -1 due to the fact that their homes were in close proxmity, and felt there was no urgency in rezoning these lots until a definite need was requested by the property owner, A lengthy discussion was held by the Council which resulted in a motion made by Councilman Kiedis, seconded by Vice Mayor DeLonga and unanimously approved by the Council to table discussion on Ordinance #25, 1975 to the Regular Meeting to be held January 15, 1976. A representative of the Planning and Zoning Commission and a representative from the developer and owner will be asked to attend the meeting. ORDINANCE #26, Ordinance #26, 1975 adopting amendments to the entire Charter of the City, as prepared by Attorney Brant, was modified by the Council to delete Proposition Three providing that no person shall serve more than three successive terns of office. Councilman Feeney was the only member of the council to favor a limitation on the number of terms of office and felt a time frape should be included. Councilman Wiley suggested and the Council concurred thgb at some future Regular Meeting, December 1$, 1975 Page 4 F time, at a less controversy time, this proposition could be presented to the electors. Ordinance #26, 1975 - Palm Beach Gardens Chanter Revision was read in fall by the City Claris on first reading on tape; said tape played at this time for the benefit of the public. RESOLUTION #52, Resolution #52, 1975 revisions to the Merit System Rules and Regulations with regard to overtime and holiday compensation was explained by Councilman Wiley who is the liaism councilman to the Merit Systems Board. Resolution #52, 1975 was read in fall by the City Clerk and unanimously adopted by the Council. RESOLUTION #53 Resolution #53, 1975 adopting the Merit System Rules and Regulations REPORTS: 4 E REVIEW & APPEARANCE r- t:, I iVG was also explained by Councilman Wiley for clarification. Resolution #53, 1975 was read in full by the City Clerk and unanimously adopted by the Council. The City Manager and the Council publicly thanked Councilman Wiley for his efforts and time spent in updating the Merit System Rules and Regulations. Councilman Wiley acknowledged receipt of letters from Senator Lawton, Chiles and Representative Bill. James which he will place in the information folder. Councilman Wr ley advised he had drafted a letter to the Post and Times reiterating the statements made in his letter to Governor Askew regarding financial disclosure. Mayor Martino reported he had attended the special meeting of the Site Review and Appearance Plan Committee held December 9, 1975 to consider the site plans for the Northlake Shopping Plaza. Discussion was tabled to the meeting of Decmber 23, 1975 when additional information requested. Regular Meeting, December 18, 1975 Page 5 by the Commission will be made available. BATON Councilman Ki.edis made reference to a letter from Cynthia %kr. Bailey, TWIRLING LESSONS: Baton Twirling instructor requesting continued use of the Recreation Room on Thursday afternoons from 3 :30 to 7 :30 P.M. for baton twirling lessons. The Council expressed no objection and concurred this was a function of the Recreation Department and scheduling for the use of the Recreation Room was under their jurisdiction. It was noted that the Recreation Department needs people to staff the Recreation Room at night. B&E Councilman Kiedis reported he had attended the meeting of the Beautification COMMITTEE MEETING: and Environmental Committee held December 3, 1975. The committee expressed concern over the lack of care given to the plantings around the City Hall. ITEMS BY CITY MANAGER: ORD.23, 1975: 1. At the recommendation of the City Manager, by unanimous motion of the Council, Ordinance #23, 1975 rezoning of lands in Section 12 -42 -42 was removed from the table and defeated, in as much as all the language contained in that ordinance is now contained in Ordinance #25, 1975. AMM FISH: 2. The City Manager advised that Mr. Paul Shafland of the Fish and Game Commission had visited the City on this date relative to the trial location for the use of the Amur fish in the canals and within the next 6 months would consider the use of the canals near Meridian Park for their experiment. 91� ACRES- 3. The Council concurred with the suggestion of the City Manager and directed the City Attorney to prepare an ordinance to abandon certain sideyard easements for their consideration at the meeting of January 15, 1975. ITEMS BY MAYOR AND COUNCIL: COUNCIU4AN Councilman Kiedis was advised by the City Manager that the lights at KIEDIS: the waterfall would be working and the grass project at Plant Drive had been started. The Council agreed to place on an agenda the first of the year consideration of the Tree Ordinance and the revisions to the Landscape Ordinance. Councilman Kiedis was advised by the City Manager that the P&Z Commission was considering a Governmental zoning classification for the City Hall Complex. VICE MAYOR Vice Mayor DeLonga advised that the emergency generator had performed to perfection. COUNCII,W At the suggestion of Councilman Iiley, and the concurrence of the Council, WILE the City Attorney was authorized to prepare an ordinance for consideration in January, relative to street vendors, in particular, the ice cream vendors. The vendors will be notified of the time the discussion will be held. Mayor Martino requested that the lines at the basketball courts at the high school be painted. No further business, the meeting adjourned at 11:15 P.M.
