HomeMy WebLinkAboutMinutes Council 011774RBGULAR MEETING CITY OF PALM BEACH GARDENS JANUARY 170 1974 The Regular Neeting of the City Council of Palm Beach Gardens was called to order by Mayor Kiedis at 8 :00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, slorida and opened with the pledge of Allegiance to the Flag. ROLL CALLS Roll was called by the City Clerk and present were: Councilman Wiley, Councilman DeLonga, Councilman Martino, vice Mayor Dunbar and Mayor Kiedis. Attorney Brant was present. MINUTES: The minutes of the Workshop Meeting of January 102 1974 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Kiedis made the following announcements: Explorers Presidents Association Meeting would be held Sunaay, January 20, 1974 from 12 :30 - 4:00 P,N. Jr. Police Meeting would be held Monday, January 21, 1974 at 7 :30 P.M. Planning and Zoning Commission Meeting would be held Tuesday, January 22, 1974 at 8 :00 P.M. PROCLAMATION: Mayor Kiedis read a Proclamation citing the North Palm Beach - Palm Beach Gardens Jaycees declaring January 20 -26, 1974 as Jaycee Week. BID OPENINGS: Sealed bids were opened by the City Manager,who verified they had been duly advertised, for a Rodent Control Contract. The following bids were received: Atlantic Fxterminating Company, 105 South Dixie Highway, Lake Worth - $150.00 per month.` Palm Beach Exterminating Company, P.O. Box 2781, West Palm Beach - $1300.00 for one year. Bruce Terminix Service, Inc. 416 Southern Boulevard, West Palm Beach Regular Meeting, January 17, 1974 Page 2 865 bait packets for a total cost of $1297.50 per month; rodent packets around homes if calls received at rate of $4.00 per month. Nozzle Nolen, 5400 Broadway, West Palm Beach .- 400 bait stations - $280.00 per month, 300 bait stations - $225.00 per month and 200 bait stations .- $160.00 per month. The bids were referred to the City Manager for his review and recommendation. Council —n Wiley asutioned that the lowest bid might not be the most effective, and that rats were prevalent in the Gardenia Canal area. RESOLUTIONS: Resolution #1, 1974 - Creating an employment classification for RESOLUTION Building Inspectdw II and designating the existing classification 1974: as Building Inspectdr I was read in full by the City Clerk and unanimously adopted as amended,to add Grade 27 in Section 1, by the City Council. "-- ORDINANCES: Ordinance #28, 1973 Annexation of lands in Section 4 -4243 (Oakbrook ORDINANCE Square Associates) was read by the City Clerk, by title only, on #28,__ 1973: second reading and unanimously adopted by the Council. ORDINANCE Ordinance #2, 1974 _ Appearance Board Ordinance was read by the City #'2, 1974: Clerk in full on first reading. ORDINANCE Ordinance #10, 1973 - Fire Code Ordinance, which was read on first ff ;Wp 1973` • reading May 17, 1973 and subsequently completely rewritten, was read by the City Clerk in €ull,as rewritten, on first reading. ORDINANCE Ordinance #1, 1974 - Landscape Ordinance was read by the City Clerk #1t l994: in full on first reading. Copies of Ordinance #10, 1973 and Ordinances #1 and #29 1974 will be given to the Planning and Zoning Commission and the Beautification and Envir anmental Committee for their review wifi comments and Regular Meeting, January 17, 1974 Page 3 recommendations to be given to the Council. PETITIONS AND COMMMICATIONS: Mayor Kiedis acknowledged receipt of communications from: DR. SMITHS 1. Dr. Smith, Principal of Palm Beach Gardens High School, expressing appreciation to the Council for the shell rock the City placed on the school *s parking lot. JOE DE LONG: 2. Mayor Joe DeLong of Boynton Beach thanking Mayor Kiedis for his congratulatory letter an his appointment as Mayor of Boynton Beach. The Council directed the City Manager to determine from David Runkel Of Community Federal Bank, regarding his request to be plAced on the January 24th agenda, if his presentation is relative to the Sign Ordinance and not directed to the bank +s problem with its proposed sign. REPORTS: The City Manager advised the Council on the following: FIRE HYDRANT 1. Explained the report from the Fire Chief regarding the fire hydrants stating the Fire Department checks the flow in gallons per minute, a static pressure is made before flow and a residual pressure is taken during flow and this is done by area. The Chief feels the flow is acceptable for fire protection. EMERGENCY 2. The City now has a legible diagram of the wiring for the G N�RATOR s emergency generator and after testing it for load capacity it will be installed. FIRST 3. The First Federal Savings and Loan Batik at PGA Blvd. and 'FEDERAL BANK; Prosperity Farms Road have been issued a permit for alterations to the bank. PUBLIC WORKS 4. Presented the Public Works Department Weekly Report and a report on Road priorities. The City Manager and the Council complimented i Regular Meeting, January l7, 1974 Page 4 Mr. Devine, the Director of Public Works for a very comprehensive and excellent report on road priorities. The report will be discussed at a future workshop meeting. BUILDING 5. The City Manager introduced Mr. James Jackson, a resident of the INSR I I City, who has been hired as Building Inspector I FIRST AID Councilman Wiley reported that the Fare Department has arranged with the InterCity Amhulance squad for one of their volunteers to conduct a First Aid Course at the Fire Station every Tuesday for 13 weeks at 7t00 P.M. for a two hour session. The course is open to interested citizens. Councilman Wiley reported that Clair Andersen, Chairman of the Planning and Zoning Co—i ssion had advised him that the Site Plan for Oakbrook Shopping Center would be approved at their meeting on Tuesday, January 22, 1974. DAM AT PGA Councilman Wk9ey reported a very cordial meeting was held with the ?bLF COURSE s City Manager and Carl. McKinney to discuss the situation of the dam at the PGA Golf course. Howard Searcy, Engineer, will pro**de insight on ideas of how the situation can be corrected. ARBOR DAY A ProcIMmation was read by Councilman Wiley proclaiming January 18, PROCLAMATION: 1974 as Arbor Day in Florida. He prefaced the reading of the proclamation by explaining that St. Marks Episcopal Church two years ago had purchased from the National. Forestry Service 100 small seedlings, which they decided to plant on Arbor Day. Governor Askew has declared January 18, 1974 as Arbor Day this year and to commemorate this the Church members will plant the 100 trees on Saturday morning, January 199 1974 at 9:00 A.M. Regular Meeting, January 17, 1974 Page 5 ITEMS FOR DISCUSSION: SITE FCR Discussion was held on the site for the handball courts. Three site RARWME COURM''' proposals were submitted by the Recreation Advisory Board as follows 1. Slope area north side of City Hall (side by side) 2. Northern extremity of City Complex property in front of existing new tennis courts. 3. East of existing tennis courts (back to back) - northern most court. The Councilm amde a visit to the three sites and requested that Sites #1 and #3 be staked out for further inspection. Councilman Martino explained the possibility if the courts were to be located at the slope area and placed side by side, the walls could be utilized for a pro shop and rest rooms. It was the concensus of the Council that the existing long range plan for the City Complex area be updated to ascertain space for future parking facilities, pzo shop# zest zoos, etc. before a site for the handball courts is determined. The City Manager will present the cost of the courts. INTERCITY Motion was made, seconded and unanimously carried by the Council AMBULANCE "HOTLINE": to pay for the installation and monthly rate for the InterCity Ambulance "hot line" telephone charges in the amount of $39.31 for current charges to date and $11.35 per month thereafter - funds to be taken from the Telephone Utility Account - General Government. AUDITORS Discussion was held on the increase in the fee from $3000.00 to $4000.00 FEES: as submitted by Callaway, Carpenter and May: Auditors, for the 1973 audit. The City Manager explained the increase in cost was due to added work including establishment of new funds with separate accounting, Federal Revenue Trust Fund Account, new State laws that have been put into effects etc. Motion was made and seconded that the City :Manager be authorized to Regular Meeting, January 17, 1974 Page 6 complete payment of the bill as presented by the Auditors for 1973, and the City Manager will obtain in writing from the Auditors what 1,1 their charges will be for 1974 and what services will be provided. Vote on motion ^ Mayor Kiedis, Vice Mayor Dunbar, Councilman Martino and Councilman DeLonga voted aye, Councilman Wiley voted nay, because he felt that the budget had been auditied, the auditor knew what amount was budgeted for his services, there is no contract and the City is not legally obligated to pay anything over $3000.00. Motion passed by a vote of 4 ayes and 1 nay. ITEMS BY THE MAYOR AMID COUNCIL: COUNCILMAN Councilman DeLonga requested that the City Manager determine why the foul odor from the Sewer Plant had been going on for such a long time; requested that a copy of the Noise Ordinance be obtained from the w County,, and requested that the wire device on the west side of the Fire Station be removed. VICE MAYOR The City Manager explained the emergency generator was waiting for a load test before installation. Vice Mayor Dunbar confirmed he had talked with an interested citizen and with Edith Judge regarding a bicycle program and plans were yet to be made. MAYOR KIEDIS: Mayor Kiedis advised that Mr. Gibson, Project Director of Oakbrook Square Shopping Development, will donate small trees from the site that can be used for around the tennis courts. Mayor Kiedis said he attended the ground breaking ceremonies for the Publix Market at that location, and had brought to the attention of the President of Publix the unsightly appearance in the rear of the Publix market in Palm Beach Gardens. v Mayor Kiedis cautioned about putting enough top dressing on the holes before planting the grass at Plant Drive. f Regular Meeting, January 179 1974 Page 7 COUNCILMAN Councilman Martino asked for clarification regarding reimbursement MOTINO S to witnesses appearing at court= and was advised by Attorney Brant I--° witnesses who are subpoened are reimbursed a witness fee plus mileage. The City Manager will discuss with the Chief of Police and return with a recommendation to the Council regarding the rate given to off -duty Police officers for attending court. Councilman Martino advised the Council he was going to write another letter to the Department of Transportation regarding AlA. In reply to Councilman Martino's inquiry about the schedule for planting the trees around the tennis courts, the City Manager advised as soon as some trees have been acquired they will be planted. Councilman Martino commented that Mr. Devine's street survey report is an exR±Ile of the planning work that he is capable of doing, and the Council agreed discussion on the report would be an agenda item in two weeks. The City Attorney recommended and the Council agreed that wm,loyees wishing to buy vehicles scheduled for trade -in purchase 1 them from the dealer rather than direct foam the City. The City Manager was directed to contact the County regarding the poor condition of the sidewalk on Northlake Boulevard, as it is understood that the widening of this street is not scheduled for this year. The Council agreed that the City could smooth out the pot holes with fill if permission is received from the County. i MKIM-WA Regular Meeting, January 17, 1974 Page 8 The City Manager presented a request from the Fire Department for a donation of $600,00 toward their awards dinner and the Council agreed the request was out of order. The Council expressed no objection to the request for a building permit from Mr. Donald Dorn, 10468 Dahlia Avenue and from Fine Builders for Mr. Davidson;, 14205 Seagrape Way. Both permits meet the criteria as established by the Council. The City Manager advised Council he will be asking approval for monies from the C4ntAitngency Fund to purchase a desk and chair for the new building inspector as it is not a budgeted item.
