HomeMy WebLinkAboutMinutes Council 041874REGULAR MEETING CITY OF PALM BEACH GARDLNS APRIL 189 1974 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 10500 N. t- filitary Trail, Palm Beach Gardens, Florida and openers with the Pledge of Allegiance to the Flag. POLL CALL: Roll was called by the City Clerk and present were: Councilman Feeney, Councilman Kiedis, Councilman Wiley, Vice Mayor DeLonga and Mayor Martino. Attorney Brant was present. MINUTES: The minutes of the workshop Meeting of April 11, 1974 were unanimously approved as amended. ANNOUNCEMENTS: Mayor Martino announced that a Meeting of the Junior Police would be held Monday, April 22, 1974 and a Planning and Zoning Commission Meeting would be held Tuesday, April 239 1974 at 8:00 P.M. with the City Councilmen and Mr. Hill, Planning Consultant in attendance. RESOLUTIONS: Resolution #10, 1974 appointing a member to the Beautification RESOLUTION #10: and Environmental Committee, was tabled by a unanimous vote of the Council, until a recommendation is received from the Beautification and Environmental Co =ittee for a replacement. RESOLUTION #11: Resolution #11, 1974 appointing a member to the Recreation Advisory Board and inserting the name of Kenneth Staggs, was read in Full by the City Clerk, and unanimously adopted by the Counci 1. _ RESOLUTION ##12: Resolution #12, 1974 appointing a 2nd Assistant Fire Chief, was read in full by the City Clerk, and unanimously adopted by the Council. Regular Meeting, April 189 1974 Page 2 RESOLUTION #13: Resoltuion #130 1974 accepting for maintenance the drainage and paved roadway portion of the public right -of -way in Phase V of Tanglewood, and confirming the acceptance within Phases I through IV, excluding paved portions located therein as laid out for and used for parking, was read in full by the City Clerk and unanimously adopted by the Council. RESOLUTION #14: Resolution #14, 1974 requesting the County Commission and the Legislative Delegation to acquire additional adequate public beaches and access to them was read in full by the City Clerk and unanimously adopted by the Council. PETITIONS AND COMMUNICATIONS: DAVID RUNKEL: Mayor D_artino acknowledged receipt of a communicathn from David Runkel regarding the Sign Ordinance which was forwarded to the Sign Ordinance Committee for review. JOHN TMXR: The City Manager acknowledged receipt of a communication from John Tower, Senate Flanking, Housing and Urban Affairs Committee regarding modernization and reform of the financial system to provide federal insurance for the deposits of governmental bodies in financial institutions. The City Manager indicated he would recommend at a future date the consideration of a resolution regarding the above. REPORTS: Mayor Martino reported on the joint meeting of the Planning and a . PLANNING AND Zoning Commission and the City Council held Tuesday, April 166 ZONING COMMISSION MEETING: 1974, and read the recommendation from the P&Z Board regarding the M -1 zoning on Burns Road. Mr. Charles Jacobs, a member of the P&Z Board, explained the reasons behind the recommendation from the Board as: 1. natural Regular Meeting, April 18, 1974 Page 3 or physical boundaries are used to define a zoning area and I -95 was considered by the Board as a physical boundary. 2. the businesses within the area while they do deal in retail sales, do not tend to draw traffic (Dandy bread was the only retail business that they could not accept as being allowed in an industrial and manufacturing research zone) 3. It would be doing an injustice to Klock Co. and Molecular Research if they were to allow more retail sales in that area. rir. Jachbe concurred with the Council that the boundary on the south extend to Ruby Street. X -1 ZONING ON Motion was made by Councilman Kiedis, seconded by Councilman Wiley H- and _ t unanimously carried that a committee, as outlined by the P&Z Board consisting of the City manager, the City Attorney and the Mayor, be formed to draft an ordinance, less the boundary requirements that have been spelled out,for presentation to the Council. Mayor Martino continued with hia report of the PU Meeting which included a discussion on the work of the Planning Consultant. The annexation subject was broached which concluded that the Board would consider a recommendation by fir. Hill, Planning Consultant, for the boundaries of the City. Vice Mayor DeLonga pointers out to the group of people in the audience interested in annexation the areas he would like to have annexed into the City to control the activities along the boundaries of the City. He further stated the Council was taking no action at this time and the matter had been referred to the Planning and Zoning Commission for their consideration. Regular Meeting, April 18, 1974 Page 4 In answer to a specific question by Jerry Purvis, a member of the audience, who lives on Mary Circle, the City Attorney stated that 1--- a referendum vote of the people in that area (using merry Circle as an example) and in the City would be held simultaneously, with a majority vote of both areas needed for approval. ILLEGAL The City Manager recommended to the Council, regarding the DISTRIBUTION OF MW&TISING illegal distribution of advertising literature, that the City • Attorney be authorized to draft a letter to the responsible parties advising of the ordinance, that they are operating i Ilegially and if they do not cease that the City Attorney would seek an injunction through the courts. Motion made by Councilman Wiley, seconded by Vice Mayor DeLonga authorizing the City Attorney to draft a letter to the party in question, who is illegially distributing advertising material in the City, and if within 2 weeks period the action of distributing that material does not cease, he would proceed forthwith to get an injunction through the County courts+ and that the Police be given the latitude to prosecute in the Municipal Court. Vote on motion - Vice Mayor DeLonga voted aye, Councilman Wiley, Councilman Feeney, Councilman Kiedi,s and Mayor Martino voted nay. Harriet Bellefond, co- publisher of the Golden Palm Shoppers Guide and Vice - President and Treasurer of Golden Palm Publishing Corp. addressed the Council stating they were engaged in a legal, clean industry and providing a service to the Community. She provided a copy of a ruling made by the Supreme Court which was given to the City Attorney. Mrs. Bellefond agreed to Mayor Martino's proposal that she run an article in her newspaper asking residents to notify her if they do not wish delivery of her newspaper. A similar notice will be placed in the City's newsletter and list of names given to Mrs. Regular Meeting, April 18, 19 74 Bellefond. Page S Mrs. Bellefond also agreed to meet with the City Attorney to resolve the situation. DRINKING WATER IN The City Manager reported he had contacted Mr. Trapnell of the THE-C�TY Utility Company and the County Health Department regarding the concern about the drinking water in the City. Mr. Jim 'Alliams, a representative of the County Health Department, addressed the Council stating he was aware of the taste and odor problem of the water, that he had contacted the operator of the plant, had inspected the plant and it was a problem of inadequate chemical supply (critical shortage of lime). The water was not low on chlorine as previously reported and was not a bacteriological problem. He assured the Council inspections would be made by his Department on a regular basis instead of on a complaint basis as is now in their practice, and that there is a check and balance /that the operators are certified by the State Board of Health. He indicated a new well #4 would be put on the line in the near future and a new storage tank is proposed. Jack Hanson reported Mr. Trapnell had this date applied for a permit for 2 one million gallon storage holding facilities for water, one located on the plant site and one at the PCA facility site. These holding tanks will maintain the reserve of treated potable water that can be induced in the system, maintained at ground level with 50-80 pound pressure. The City Manager indicated the installation of these tanks will not alleviate the situation regarding fire hydrants. ITEMS FOR DISCIES ION: PTRR Ed Arrants, Fire Chief, addressed the Council urging the adoption �f Regular Meeting, April 18, 1974 Page 6 of the Fire Code Ordinance as presented to the Council and read on first reading January 17, 1974, stating it would be a tool to use as a guide in the fire prevention program. Mr. Jacobs, a member of the P&Z Board, stated he would like the opportunity to point out some inadequieies in the proposed Ordinance Jack Hanson, Building Inspector, presented the Council with a list of items that would become effective and enforceable once the Ordinance was adopted. Councilman Wiley proposed and the Council concurred, that since the Fire Code is his assignment as a project to handle as a Council representative, that a meeting be held to review the Ordinance, on Tuesday, April 30, 1974 with Ed Arrants, Jack Hanson, Mr. Jacobs and Attorney Brant present and return to the Council with a compilation of ideas. RECREATION ADVISORY A joint meeting of the Tennis Committee and the Recreation BOARD AND TENNIS COMMITTEE: Advisory aoard with the Council will be held April 259 1974 at the Workshop Meeting of the City Council to aliscuss items of mutual interest. ITEMS BY CITY MANAGER: COST OF LIVING: The City Manager will submit a detailed report at the workshop Meeting of April 25, 1974 on a proposal for consideration for a cost of living increase including as requested by Councilman Wiley, a report of the availability of funds and as requested by Vice Mayor DeLonga, the cost of increase given in 1972 and 1973 taking into consideration the package the Council adopted regarding medical benefits etc. computed on a per cent basis. AIR CONDITIONING At the request of the City Manager a motion was made., seconded Regular Meeting, April 18, 1974 Page 7 and unanimously adopted authorizing the City Manager to prepare bid specifications to obtain the necessary air conditioning equipment to upgrade the system in the Police Department. The City Manager reported that the: 1. Traffic light would be installed by the County at PGA Blvd. and U,S.l. The Council requested the City Manager to notify the County of the faulty timing of the lights at Lighthouse Drive and AIA and Ellison Wilson Road and PGA Blvd. 2. Advised of a meeting this date that the County Engineer had indicated at this time they were not certain when Northlake Blvd. would be widened, but they were considering the installation of a traffic light at the K -mart store on Northlake Blvd. 3. Lighthouse Drive sidewalk project would bejin the week of April 22, 1974. 4. Presented Public Works Weekly Report - was requeested to add potholes at intersection of Lighthouse Drive and Alt. AIA. ITEMS BY MAYO AND CO[T1CIL: COUNCILMAN FEENEY: Councilman Feeney relayed a request from the Palm Beach Gardens Youth Athletic Association for permission from the Council to install an exhaust fan at the concession stand and a steel door with a vent and use of the storage building located at the Public lxorks yard if available. The Council concurred and the City manager will determine where to locate the building and so advise the Council before locating it. COUNCILPMN, WILEY: Councilman Wiley pointed out several items in the newsletter to the City Manager *s attention for deletion or correction and suggested the collation of the survey by a civic group. The City Manager will determine if the survey can be collated by computer. The City Manager verified that the request by Councilman Kiedis to have the ball fields at the Elementary School smoothed and acraped, had been completed. VICE MAYOR Vice Mayor DeLonga suggested and the Council concurred that a DELONGA : letter of thanks for his cooperation be sent to Larry Snyder$ the person who found the Hetzel Brothers figurines; and a letter of thanks be sent to the Youth Conservation group that cleaned the canals in the City as a civic project. CITY ATTORNEY The Council concurred that the City Attorney attend the joint ATTEND NG : meeting of the Planning and Zoning Commission and the Council on Tuesday, April 23, 1974. .ferry Brox -ming, a member of the audience, asked if the Council had acknowledged receipt of the letter from Mr. Strom to Mr. Trapnell. Councilman Wiley read the letter which indicated that if the Utility Company would will out the enclosed forms, the application for TOP under good faith connections would be taken under consideration.
