HomeMy WebLinkAboutMinutes Council 052374WORKSHOP MEETING CITY OF PALM BEACH GARDENS MAY 23, 1974 The Workshop Meeting of the City Council of Palm Beach Gardens, was called to order by Mayor Martino at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the flag. ROLL CALL: Roll was called by the City Clerk and present were: Councilman Feeney, Councilman Kiedis, Councilman Wiley, Vice Mayor DeLonga and Mayor Martino. MINUTES: The minutes of the Regular Meeting of May 16, 1974, as amended, were unanimously approved by the Council. OUTSTANDING Mayor Martino presented Leonard Devine, Public Works Director, EMPLOYEE AWARD: with the Outstanding Employee Award stating he has always given above and beyond the call of duty in the way of timer service and labor, and reserves recognition for his dedication and loyalty to the City. ANNOUNCEMENTS: Mayor Martino made the following announcements: I 1. There would be a joint meeting of the Council and the Planning and Zoning Commission on Tuesday, -May 28, 1974 at 7:30 P.M. 2. The Zoning Board of Appeals would hold a meeting on Thursday, May 300, 1974 at 7 :30 ?.M. for the Purpose of hearing a variance request for the construction of a swimming pool. 3. All administrative offices would be closed Monday, May 27, 1974 in observance of Memorial Day. Workshop Meeting, May 23, 1974 Page 2 EXPANSION OF Mr. Jack Silverstein, Administrator for the Palm Beach Gardens - - - -Y H P T :' Community Hospital, addressed the Council explaining their proposed plans for an expansion program to include 95 additional beds and an emergency room service. He asked the Council for assistance and endorsement when the plans are submitted to the Palm Beach Health Planning Council for their approval. Dr. Anspach, a member of the Board of Directors of the Hospital and on the staff of the Hospital,explained that they now have a Neurosurgeon, whose presence is a necessity in an emergency room, and they also have the elaborate x-ray equipment for these procedures. The Council concurred to endorse the expansion program, and Councilman Feeney will coordinate what is needed with Mr. Silverstein. �-� PETITIONS AND C0j- -F4UNICAT I ONS : INSURANCE Mr. Robert Diamond, the City's insurance agent of record, addressed COVER GG 'FOFi �* ' the Council offering a plan, at no cost to the City, through payroll deduc tion., which gives the employee an opportunity to inventory his insurance and offers the opportunity for additional insurance. Mr. Plunkett, a representative of Travelers Insurance Company further explained the plan that it was a means of providing the employees counselling, pointing up what is provided by the City under the fringe benefits to coordinate with their personal needs. The Council concurred with the intent and a meeting will be scheduled with Mr. Diamond and Mr. Plunkett to meet with the employees to discuss the plan. CLOSING OF HOLLY The Council discussed the question, as posed by Mrs. Pat DRIVE DURING SUMMER: Workshop Meeting, May 23, 1974 Page 3 Barberio, whether to close the north side of Holly Drive to traffic for the duration of the Summer Recreation Program. Mr. & Mrs. Lou oxnevad spoke from the aidience requesting that the street be left open during the summer, stating it caused a traffic hazard at the intersection of Holly Drive and Military Trail. MOTION: Motion was made by Councilman Wiley, seconded by Councilman Kiedis that at the close of the public school year this summer, the north side of Holly Drive remain open to vehicular traffic and the signs stored for subsequent Council action next year. Vote an motion - Councilman Wiley and Councilman Kiedis voted aye, Councilman Feeney, Vice Mayor DeLonga and Mayor Martino voted nay. Motion defeated by a vote of three nays and 2 ayes. Motion was made by Councilman Wiley, seconded by Councilman Kiedis that Holly Drive be closed on the north side up to the west end of the High School where there is a crossover at the median strip, and that a barricade be placed at that point. This would put the confusion away from the intersection of Military Trail. Vote on motion - Councilman Feeney, Councilman Kiedis and Councilman Wiley voted aye, Mayor Martino and Vice Mayor DeLonga voted nay. Motion carried by a vote of three ayes and 2 nays. LETTER TO DPC: Mayor Martino reported a verbal response to the letter written to the Department of Pollution Control addressing the moratorium situation had been received and a written letter was forthcoming. r- Workshop Meeting, May 23, 1974 Page 4 COMMISSIONER Mayor Martino acknowledged receipt of a letter from County CULPEPPER : Commissioner Robert Culpepper requesting the need for 600 palm trees, 3' or under to be sent to the Agriculzturai Research Center at Fort Lauderdale to be used in the experiments on lethal yellowing, which will be forwarded to the Beautification and Environmental Committee. RESOLUTIONS: The City Attorney was requested to prepare a Resolution for the PALM BEACH Council's review for the meeting of June 13, 1974 redesignating COUNTY CURMUNITY ACTION COUNCIL;­the Palm Beach County Community Action Councils Inc. as a public agency **thin the Palm Beach County Government. ORDINANCES: Ordinance #6, 1974 - revision to Ordinance #22, 1973 the Budget ORDINANCE #6 Ordinance will be placed on the agenda of the June 6, 1974 meeting for a public hearing and second reading. ORDINANCE #79 Ordinance #7, 1974 Amendment to Ordinance #5, 1973, the Sign Code will be placed on the agenda of the June 6s 1974 meeting for a public hearing and second reading. ORDINANCE #80 Ordinance #8, 1974 adopting by reference the 1974 Amendments to 1974: the 1973 edition of the Southern Standard Building Code will be placed on the agenda of the June 6s 1974 meeting for a public hearing and second reading. ORDINANCE #10, Ordinance #10, 1973 the Fire Code will be placed on the agenda of re o e: the June 6, 1974 meeting for a public hearing and second reading. Councilman Wiley explained the changes :wade to the original draft as presented by the Fire Code Committee. A meeting of the Fire Code Committee was scheduled for Thursday, May 30s 1974 at 8 :00 P.M. for a final review of Ordinance #100 1973 and consideration of the recommendation concerning the Fire Workshop Meeting, May 230 1974 Page 5 Code as presented by the Building Inspector Jack Hanson to the Council. ORDINANCE #90 Ordinance #9, 1974 providing alternates to be appointed to the • Zoning Board of Appeals and the Planning and Zoning Commission will be placed on the agenda of the June 6, 1974 meeting for a public hearing and second reading. RESOLUTION The City Attorney was requested to prepare a resolution for the PPOINTING AN ERneeting of June 6, 1974 appointing an alternate member to the TO F&Z OARD OF ZONING Zoning Board of Appeals and the Planning and Zoning Commission. APPEALS s The names of Chuck Sanders, Lee Coons and Dave Runkel were suggested as nominees, and the Council concurred the members should be persons serving on an advisory board that are already familiar with the City procedures. ORDINANCE #12, Ordinance #12, 1974 _ issuance of notices to appear, which was prepared by the City Attorney at the request of the Police Chief, will be placed on first reading at the meeting of June 6, 1974 a nd advertised for a public hearing and second reading at the Regular Meeting June 20, 1974. ORDINANCE #10, By unanimous vote of the Council, Ordinance #10, 1974 amending 1974: Ordinance #14, 1970 the Building Permit Moratorium and Ordinance ORDINANCE #11� i� #11, 1974 repealing Ordinance #14, 1970 the Building Permit Moratorium, will be advertised for a public hearing and second reading at the meeting of June 20, 1974. REPORTS: Vice Mayor DeL.onga reported he was serving on the School Committee COMMUNITY for the Palm Beach Gardens High School and that Dick Ferrara, PROGRAM: who will be the Director of the Community School program and Mike Robbins would like to address the Council at the Workshop Workshop Meeting, May 23, 1974 Page 6 Meeting of June 13, 1974 to present the agreement between the Council and the School Board. If the Council concurs with the contents of the Agreement, it will be signed by the Council at the Regular Meeting June 201, 1974. The Council agreed to the above. Vice Mayor DeLonga suggested that the Council come to the meeting prepared to discuss the nature of the agreement as to priority uses of the recreational facilities, that the residents be insured of enrollment in the classes, and the constituency of the Advisory Board for the Community School program. The members of the Recreation Advisory Board, the Youth Athletic Association and the Jaycees will be invited to attend the meeting. LIGHTING The City Manager reported on the lighting program for the City PROGRAM: and recommended the program be initiated immediately starting with Plat 19 which will need 10 -12 lights. The City Manager � will present cost estimates for the Council's consideration at the Regular Meeting, June 60 1974. FLOOD INSURANCE: The City Manager reported he had sent the data requested from the Federal Agency regarding Federal subsidized flood insurance to the City Engineer for his review and determination if there is a need. ITEMS FOR DISCUSSION: REVIEW AND 1• Councilman Wiley reported he had upgraded the pay scale for PROP E- City employees adding 10 additional steps by a numerical CLASSIFICATION E. determination, and needed more time to reconcile the additional information he had obtained. Councilman Wiley and the City Manager will meet Monday, May 27, 1974 to complete the recommendation which will be given to the Council. Workshop Meeting,, May 23, 1974 Page 7 SHER IFFIs 2. Vice Mayor DeLonga requested directmon be given to the City DEPUTY AGREEMENT: manager and the City Attorney whether the Council wishes to pursue certain police personnel being deputized to act in the immediate County areas adjacent to the City limits, and the subsequent signing of an agreement with the Sheriff's Department. He suggested only those areas of noise, speeding and an emergency situation be 4on6idered. Chief Pecht was generally in agreement using only the Sergeants and Detectives in that capacity. The Council directed the Chief of Police to determine from the AA- 4uistrative Department of the Sheriff's Department whether they would agree to such an agreements and directed the City Attorney to prepare the necessary papers if such an agreement is feasible. TRASH STORAGE 3. Vice Mayor DeL.onga brogght to the Council's attention AND REM i Chapter 120 Sections 12 -4 and 12-9 of the Palm Beach Gardens Code entitled trash storage and removal,, and proposed that the City use a common sense approach regarding the enforcement of that part of the Code. He asked for relief for the residents who place their grass clippings on vacant lots in their neighborhood. The City Attorney determined that the enforcement of this Chapter of the Code lies with the Public Works Department and should be addressed to them. The Council concurred that the provisions of the Code should be enforced; they should be enforced by the Director of Public Works, and the residents should not put dndue amount of trash on vacant lots but on their own property relative to the collection date of trash. The Council conauriced that this particular section Of the Code be reviewed by the Ordinance Review Board. Workshop Meeting, May 230 1974 Page 8 COUNCIL 4. Councilman Wiley requested and the Council concurred that POLICIES: each m-=her prepare a list of policies that have been adopted or that he may want to adopt, which will be an agenda item for the Aa- inistrative Meeting to be held May 28, 1974 after the joint meeting with the Planning and Zoning Co-- 4.ssion. The list will be collated and given to the new City Manager and any new Council member in the future. Mayor Martino advised he would prepare an agenda for the Administrative meeting and asked the City Attorney to be in attendance. HOLLY DRIVE 5. The City Manager reported an estimate had been rbeeived from PROJECT State Paving, the current contractor for the Lighthouse Drive TIMATES project, in the amount of $9,400 for 1,000 yards of concrete sidewalk on the north side of Holly Drive from Lighthouse Drive to the east side of Ironwood Road. This item would be a bid item. State Paving could start within 15 days with the completion date within 30 days. Motion made, seconded and unanimously adopted that Jack Hanson, the Building Inslpector, and Leonard Devine, the Public works Director, prepare the bid specifications for the sidewalks on Holly Drive from Lighthouse Drive to the east side of Ironwood Road, on the east side of the road only, for approval by the Council. RAMPS ON The City Manager reported that the cost for ramps across the THOMPSON RIVER C - Thompson River and MacArthur Blvd. bridges on Lighthouse Drive BLVD . BRIDGES would be in the amount of $642.009 which the Council by unanimous motion, authorized for construction Workshop Meeting, May 23, 1974 Page 9 The City Manager reported the projects to cut the asphalt in the amount of $200.00, and to dig three inches deep for the �-✓ colpacted shell rock in the amount of $500.00 on the Lighthouse Drive project, had been completed and the cost already incurred. The City Mager recommended that the Council, before giving authorization for final payment to State Paving, have the Public Works Director, the Building Inspector and the Mayor inspect the job. ITEMS BY THE CITY MANAGER: SCHOOL MILLAGE: 1. At the request of the City Manager, the Council directed the City Attorney to prepare a resolution encouraging the State Legislative delegation not to change the current State law imposing a maximum school millage. ADDITIONAL 2. The City Manager alerted the Council to a request he had BANKS rN_'cxTY: received from a bank asking the City to take the position that additional banks were not needed in the area. ITEMS BY MAYOR AND COUNCIL: COUNCILMAN Councilman Wiley asked the Mayor to write a letter to Mr. W Y: MacArthur regarding the additional billboards that have been BILLBOARDS ON erected on the north side of PGA Blvd. on property adjacent to FGA BLVD.; the City, stating they are a blight to the area and asking for his cooperation. The Council concurred. SIGNS LOCATED Councilman Wiley asked the City Manager to investigate the RY- Y legality and status of the two signs reading PGA Golf Club located at Military Trail and Holly Drive. b Workshop Meeting, May 23, 1974 Page 10 SEWER PLANT The City lftnager will obtain from the City Engineer the site plan TRANSMISSION LINES: of the new sewer plant showing where the transmission lines will be placed, to determine if any permits are needed by the Utility Company from the City. LAW RE: OVER- The City Attorney will review the new law regarding overtime pay TIME AM COMPENSATORY and compensatory time and make recommendations to the Council TIME for any changes to the Merit System. Councilman Wiley recommended that the fans be placed in the Recreation Rooms before the room is panelled. STORAGE TANK The Catty Manager advised Councilman Wiley the storage tank for EMERGENCY UENEHMM: the emergency generator will be placed underground. SHRINE TEMPLE: The Council concurred to the draft of the letter to AAOMNS, which will be written by the Mayor encouraging the location of a Shrine Temple in the northern palm beach area. MARVIN,HILL: The City Manager advised the contract with Mr. Marvin Hill, the Planning Consultant, will be reviewed to determine if all phases have been complied with, before the final payment is given to Mx. Hill. Councilman Wiley remarked that the letter to all Department Heads from the City Manager regarding the revised City policy relative to Council,representative to the Police Department was unnecessary. VICE MAYOR Vice Mayor DeLonga advised that Sam Carsillo, a young resident of D : the City, has undertaken a crusade to help the teenage drivers regarding the high automobile insurance premiums paid by ur_tn�s!rried males in particular, stating that many safe driving teenagers are being unduly penalized because of the irresponsible teenage drivers. Vice Mayor DeLonlga advised he was still receiving conplaints from residents regarding handbills and newspapezu being tossed in their yards, and asked the Council to consider drafting an ordjnnnce that material has to be b—And delivered to the door.
