Military Trail, Palm Beach Gardens, Florida, and opened with the tRledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor DeLonga, Councilman Feeney, and Councilman Wiley. Councilman Kiedis was absent due to illness. Attorney Brant was also present. MINUTES: The minutes of the Workshop Meeting of May 23, 1974, were unanimously approved as amended. -- MNOUNNCEMENTS: Mayor Martino made the following announcements: A Recreation Advisory Board meeting will be held Tuesday, June 11, 19740 at 8 :00 P.M.. A meeting of the Planning and Zoning Commission will take place Tuesday, June 11, 1974, at 8:00 P.M.. A Volunteer Firemen's Meeting will convene at 7:30 P.M. on Tuesday, June 11, 1974. A Beautification and Environmental Committee meeting will be held Wednesdays June 12, 19749 at 7 :30 P.M. The M -1 Zoning Committee meeting will convene at 7 :30 P.M. on `. Wednesday, June 12, 1974. One bid was received from Hamilton Electric, Incorporated, 516 Monceaux Road, West Palm Beach. Mr. Howard Kuhns, an Electrical, Engineer, was requested to read the bid and advise on same. The bid was received in three parts as follows: Part #1 - $14,200 - Including all work called for in specifica- tions. Part #2 - $ 20800 - Manual Transfer Switches Part #3 - $ 19200 - Remote Door Control The installation of emergency electrical wiring would take 90 days from the date of signing the contract for a total of $18,200 to be expended. A motion was made, seconded, and unanimously carried that the Public Works' Director, Leonard Devine, and Howard Kuhns, an advisor on the project, review the bid and report back to the City Council at their Workshop Meeting of .June 13, 1974 with recommendations. FIRE HOSE: gigs were received as duly advertised on May 16th and 17th, 1974, and opened by the Acting City Manager for 1000 feet of ..s 3" fire hose. A motion was made, seconded, and unanimously carried that the Fire Chief, Edgard Arrants, and Acting City Manager, Alice Jean Kerslake, review the bids and report back to the City Council at their Workshop Meeting of June 13, 19749 with recommendations. PETITIONS AMID COMMUNICATIOINS: Mayor Martino acknowledged receipt of communications from: DEPT. OF POLLU- Warren G. Strahm, Regional Administrator of the Department of T ON CONTROL Pollution Control, dated May 24, 1974, in response to Mayor Martin's letter of May 17, 1974, requesting assistance by asked �- responding to questions /enabling the City to re-evaluate the Building Moratorium position. FLA..-RECREATION. A Resolution signed by Gordon J. Sprague, President of the ASSOCIATION: Florida Recreation and Parks Association, expressing their gratitude for the City of Palm Beach Gardens hosting a conference May S, 6, and 7, 19740 at the Colonnades Beach Hotel, and commending Woodrow Dukes, Director, and the Recreation and Parks Department for their contribution. DEPT. OF Edward J. Trombetta of the Department of Community Affairs Cam_ IT_ Y_ in response to the City's application for *7011 Local Assistance. The communication indicated the City of Palm Beach Gardens will not be granted monies this year. RESOLUTIONS: A motion was unanimously passed to modify the agenda to place RESOLUTION[ #210 the discussion of Resolution #21, 1974, appointing an alternate I_ X374_ member to the Board of Zoning Appeals and to the PLInning and Zoning Commission, subsequent to discussion and adoption of Ordinance 9, 1974, providing for the appointment of alternate members to said boards. ORDINANCES: Ordinance #12, 1974, Issuance of Notices to Appeal., was read in ORDINANCE #12i full on first reading by the City Clerk. Second reading and a 1974 public hearing will be held at the Regular Meeting of June 20, 1974. REGULAR MEETINGS, JUNE 69 1974 PAGE 5 ORDINANCE #10. I$'T� Mayor Martino stated that Ordinance #10, 1973, had been duly advertised for public hearing and second reading by FIRE CODE title only on May 20, 1974. ORS Prior to the City Clerk reading Ordinance #100 1973, which provides for the adoption of a fire district within the City and a fire code for the City, by title only for second reading, Councilman Wiley reported during the public hearing time period that the Fire Code Ordinance Committee agreed at their meeting of May 30, 1974, to recommend to the City Council some modifi- cations to the first reading copy. Fire Chief Arrants expressed comments regarding the Early Warning Detection Systems is Private Dwellings for the benefit of those present. Councilman Wiley reviewed the recommended modifications to the first reading copy of the Fire Code with those present. A motion was made, seconded, and unanimously adopted to accept all modifications made to Ordinance #10, 1972, the Fire Code Ordinance, as stated by Councilman Wiley. The City Clerk read the amendments which were made between the first and second reading to the Fire Code, Ordinance #10, 1973. A motion was made, seconded, and unanimously passed that Ordinance 10, 19731, be adopted, as amended. REGULAR B.ETING, JUNE 69 1974 PAGE 6 ORDINANCE #8, Mayor Martino informed those present that Ordinance #8, 19749 had been duly advertised for public hearing and second reading `1974 AMENDMENTS by title only on May 20, 1974. TO 1 N Mr. Rudolph Arsenicos, a local architect and a member of the Joint Cooperative Commission, which consists of delegates of nine various organizati ans, spoke from the audience expressing his opposition to vertical compartmentation; which is called out in the Ordinance as mm- ndatory for every building in excess of 75 feet, to be option- ally designed as vertical or bDDrizontal compartments. He also expressed that sprinkler systems and compartmentation both together should not be made mandatory. Mr. Arsenicos will Make available to the City of Palm Beach Gardens the West Palm Beach 1974 Amendments to the 1973 edition of the Southern Standard Building Code, enabling the City to consider a building code to be basically uniform with the rest of the county. The City Clerk read Ordinance #8, 1974, in full with modifications for second reading. A motion was made, seconded, and unanimously passed that Ordinance #89 1974, be adopted, as amended. ORDINANCE #69 Mayor Martino pronounced that Ordinance #6, 1974, had been duly 1974 . advertised for public hearing and second reading by title only REVISION TO on May 14, 3974. 22t 1973, BUDGET The City Clerk read Ordinance #6, 1974, Revision to Ordinance #22, 1973, the Budget Ordinance, by title only for second reading. A motion was made, seconded, and unanimously passed that Ordinance #0, 1974, be adopted. REGULAR MEETING, JUNE 6, 1974 PAGE 7 ORDINANCE #7 Martino stated that Ordinance #7, 19741 had been duly -" advertised for public hearing and second reading by title only AMENDMENT TO on May 27, 1974. ORDINANCE # 5 r 1973t. SIGN CODE The City Clerk read Ordinance #70 1974, Amendment to Ordinance #59 19731 the Sign Code, by title only for second reading. A motion was made, seconded, and unanimously passed that Ordinance #70 1974, be adopted. ORDINANCE #9-c Mayor Martino pronounced that Ordinance #9, 1974, had been duly advertised for public hearing and second reading by title only on May 20, 1974. ALTERNATE Subsequent to a public hearing, the City Clerk read Ordinance #9, ADVISORY BOARDS 1974, providing for the appointment of alternate members to the Zoning Board of Appeals and Planning and Zoning Commission, by title only for second reading. A motion was made,, seconded, and unanimously passed that Ordinance #91, 1974, be adopted. RESOLUTION #21.1 Councilman Wiley made a motion that Samuel Laurie be appointed as an alternate member of the Zoning Board of Appeals, Leland Coons be appointed as an alternate member of the Planning and Zoning Commission, and a modification be made to Section 3 of that Resolution. Vice Mayor DeLonga seconded the motion. Vote on motion; Councilman Wiley and Vice Mayor DeLonga voted aye; Councilman Feeney and Mayor Martino voted nay. Councilman Wiley made a motion that Samuel, Laurie be appointed as an alternate member of the Zoning Board of Appeals, the current Section 2 paragraph, appointing an alternate member to the Planning REGULAR METING, JUNE 60 1974 PILE 8 and Zoning Commission be deleted, and the text of Section 39 with a modification, be revised to be the text of Section 2. The City Clerk read Resolution #21, 1974, appointing an alternate member to the Zoning Board of Appeals, as modified. A motion was made, seconded, and unanimously passed that Resolution #219 1974, be adopted, as modified. REPORTS: Councilman Wiley explained the lack of clarity in the City Code COUNCILMAN Book regarding setback requirements for built -in swimming pools: W_I_LEY taking public walkways into consideration. Councilman Wiley recommended and the other Council members concurred that he work with Attorney Brant in drafting a modification to the Ordinance regarding setback requirements for swimming pools enabling guidelines for the Zoning Board of Appeals to follow. VICE MAYOR Vice Mayor D eLonga informed those present that the Community School DELOWA Activity Program will be discussed at the Workshop Meeting of June 13, 1974; and Mike Robbins, Dr. Anne Smith, and Dick Ferrara will be present. CONTRACT FOR Vice Mayor DeLonga reported that he had experienced several discus- VU `NH B" ! a M , TENNIS PRO sions with Ruth Barnett in regard to the City's Tennis Program this slier, and she has, at his request, prepared a sample contract in the form of a Resolution for the City. The contract will be referred to the City Attorney, and he will prepare a Resolution for discussion at the Workshop Meeting of June 13, 1974. REGULAR MEETING, JUNE 69 1974 PAGE 9 1-1s. Barnett had also submitted a Calendar of Events for the Tennis Program in the City of Palm Beach Gardens this summer, which she has agreed to conduct. This matter will also be discussed at the Workshop Meeting of June 13, 1974. POLICE DEPART. Vide Mayor DeLonga questioned Police Chief Pecht if some PERSONNEL bEPUTIZED of his department's personnel had been deputized as requested previously by the City Council; and Chief Pecht informed him the Detectives, Sergeants, and Lieutenants had been. PAYMENT FOR A motion was made, seconded, and unanimously carried that the SLICES OF LAND USE City Clerk be authorized to pay the City's contracted Land CONSULTANT Use Consultant, ftr. Marvin C. Hill, Jr., no more than the balance of 90% of his 90-day study fee, based on the recommendation of the Planning and Zoning Commission members, which will be forth- coming. The remainder 10% of his fee is to be paid subsequent to future authorization of the City Council. CONSIDERATION A motion was made, seconded, and unanimously carried that the LAM USE CON- City Council request the Planning and Zoning Commission to make SULTANT'S RFCOMMErIDATIONS a formal presentation to the City Council, and that the City Attorney be authorized to prepare the necessary Ordinances to adopt the guidelines and plans in conformance to the Land Use Consultantts recommendations to the City. SERVICES FOR A motion was made, seconded, and unanimously adopted that the OF CITY NEWSLETTER Acting City Manager, Alice Jean Kerslake, be authorized to engage the services of Edith Judge for the purpose of editing and compiling the month of Judy's City Newsletter to be mailed the last week of June, with expenses not exceeding $50.00. REGULAR MEETING, JUNE 6, 1974 PAGE 10 CITY MANAGER It was the consensus of the City Council that Applicants #2, #4, APPLI THROUGH #8 and #8 be considered for the position of City Manager, and that interviews be enabled with same. Discussions pertaining to Applicants #1, #3, #5, #6, and #7 are to be dispensed. ITEMS BY ACTING CITY MANAGER: PURCHASE OF A motion was made, seconded, and unanimously carried that the FILING CABINET Acting City Manager be authorized to spend $84.10 from the Contingency Fund of the City for the purchase of a filing cabinet for the Police Department. BALANCE OF FEE A motion was made, seconded, and unanimously adopted that the FOR LXGHTHOUSE D IVE PROJECT Acting City Manager be authorized to expend $700 for the balance of the fee for the Lighthouse Drive Project, which consists of the compacting of the shell rock ($500) and the trimming of the asphalt ($200), plus the cost of the safety barriers, to be taken out ON the Federal Revenue Sharing Account. ITEMS BY MAYOR AND COUNCIL: MAYOR MARTINO It was determined that the City Payroll Checks will be distributed to the City Employees Wednesday, July 3, 1974, for the week ending July 3, 1974, taking into consideration the employees have Independence Day off. COUNCILMAN Council—an Feeney reported that the Concession Stand located at the Plant Drive Field had been broken into on numerous occasions recently, and recommended that something constructive be done to avoid the matter. The Acting City Manager was requested to take action in securing the building. A motion was made,, seconded,, and unanimously adopted that the City Council authorize the City Attorney to review the Landscape Ordinances of the various surrounding municipalities, and to prepare a modification Ordinance, amending Ordinance #1,'19749 the Landscape Ordinance,, to include requirements for landscaping within the entire parcelsaof land. PAY SCALES Councilman Wiley reported that the criteria for a recommendation FM �S regarding pay scales and any adjustments necessary for the City Employees is near completion; and it will be submitted to the u other Council. Members for their review and comments and subsequently referred to the Merit Board Members for their review and recom- mendations to the City Council for their consideration. MAYOR MARTINO Mayor Martino reported that he had requested Attorney Brant's opinion on use of public facilities by private individuals and USE OF PUBLIC rA=TIES groups doing business on a profit basis on the premises of the City Hall Complex. Attorney Brant submitted a communication stating that public facilities should not be leased to private enterprises. It was the consensus of the Council Members that Sam Brown, who conducts the Sam Brown School of Real Estate, will be permitted to continue his present session until it expires in the Assembly Room of the City Hall Complex; however, subsequent to any further sessions, which requires new registration, he will have to move REGULAR MEETING, JUNE b, 1974 PAG E 12 his operation. Mayor Martino was requested to inform Mr. Brown of this action. CLOSING OF Vice Mayor DeLonga made a motion that the north side of Holly NORTH SIDE OF HOLY DRIVE Drive be closed starting Friday, June 7, 1974, up to approximately the access road to the tennis courts located at the Palm Beach Gardens' High School; and from that point on westerly, the north ana south side of Holly Drive will be open to traffic. Vote on motion: Mayor Martino, Vice Mayor DeLonga, and Councilman Feeney voted aye; Councilman Wiley voted nay.
