HomeMy WebLinkAboutMinutes Council 071874S=KSHOP MEETING CITY Or PALM BEACH GARDENS JULY 18, 1974 The Workshop ,eeting of the City Council of Palm Beach Gardens, Florida was called to order by Mayor Martino at 8 :00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, and opened with the Pledge of Allegiance to the Flag. POLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor DeLonaa, Councilman Feeney and Councilman Kiedis. Councilman Wiley was absent since he was on vacation. Attorney Brant was present. MINUTES: The minutes of the Regular Meeting of July 11, 1974, as amended, were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Martino made the following announcements: The voter registration books for the Primary Elections (Sept. 10 and Oct.l) would be closed on July 27, 1974 and fbr the General Election (Nov. 5) on September 21, 1974. Those voters who register between July 27th and September 21st may vote in the General Election but not in the Primaries. Football registration would be held Saturday, July 20th and July 27th from 1 -4 F.M. in the Recreation Room on the ground floor, City Comple. The Recreation Jamboree would be held ti•:ednesdays July 24, 1974 at 7 :30 P.M. in the Palm Beach Gardens High School gym. A Planning and Zoning Commission Meeting would be held Tuesday, July 23, 1974 at 7;,00 P.M. PETITIONS AND COMKJNICATIONS: Mayor Martino acknowledged receipt of the following communications: AREA PLANNING 1. Area Planning Board explaining the Palm Beach County Comprehensiv BOARD: Land Use Act, what it entails and what the responsibilities of the Workshop Meeting, July 18, 1974 City are. Page 2 Attorney Brant will review and interpret the Act and report to the Council. COMMISSIONER 2. Commissioner Culpepper acknowledging receipt of the Resolution CULPEPPER from the City regarding billboards on County property. HOME BUILDERS :3. Home Builders and Contractors Association of Palm Beach County ASSOC.: requesting the Council consider issuing residential permits on a dry basis. ORDINANCES: A Public Hearing and Second Reading on Ordinance #14, 1974 - ORDINANCE #14p providing for guidelines for Zoning Board of Appeals regarding 19 setbacks for swimming pools will be held August 19 1974. Vice Mayor DeLonga commented that certain members of the Zoning Board of Appeals had expressed concern about placing a limit on a variance they may grant. REPORTS: Councilman Kiedis reported the broker he had spoken to will pursue ACQUISITION OF the possibility of the acquisition of land east of Keating Drive LAND FOR RE ON to be used for a recreation area. ITEMS FOR DISCUSSION: PALM BEACH 1. mr. Thomas Gilchrist, Jr. Vice President of Palm Beach Cable TV CAB TV: addressed the Council regarding a request to increase their rates in the City from $4.95 to $ 6.50 per installation, pointing out the rates had not been increased in seven years and the going rate throughout the State was $6.50 and $7.00. The subscriptions in Palm Beach Gardens had increased 15% in 1973 for a total of $5!584.00, which is the 6% the Company pays to the City as per the franchise. Mr. Gilchrist explained the Company will offer Channel 51 in the near future and hope to be able to offer Channel. 6, but stated local programming would not be profitable at this time. r workshop Meeting, July 182 1374 Page 3 A further discussion on this subject will be scheduled for a workshop Meeting and final disposition at a Regular Meeting when �. Mr. Gilchrist will be invited to attend. The City Manager was directed to give a copy of the book presented to the Council by Mr. Gilchrist to Paul Bremer,Auditor, for his review and comments. RECOMMENDATIONS 2, Mr. Charles Jacobs, member of the Planning and Zoning Commission, FROM Paz g •t at the request of the Mayor, explained the reasons for the recommendations by the P&Z Commission in their memo dated June 13, 1974 as follows: Item 1 - Recommended annexation of property located in the southwest one- quaxter of Section 18, Township 42 South, Range 43 East to R -3C, High Density Residential, which Mr. Jacobs explained is a misnomer as it is medium density of 5 -10 units per acre and similar to the 1--� County Zoning. Item 2 - Recommended annexation of property located in Section 13, Township 42 South, Range 42 East and a smalltract located in the Southeast corner of Section 14, Township 42 South, Range 42 East be zoned R -1A, which is on the lower side of medium density with 6 units per acre. 'Item 3 - Recommended not annexing the parcel of land located in Section 2, Range 42 East, Township 42 South because of the knowledge that the land owner does not want the land to be annexed into the City and would fight the City in court if necessary; and because of the fact the County would consider this a land grant and also would not approve it. Mayor Martino reiterated the Council's policy that the City does not actively seek annexations into the City, but have accepted annexations Workhsop Meeting, July 18, 1974 Page 4 on a voluntary basis by request; however, the Council is interested in its natural boundaries and the effect the surrounding areas may have on its citizens. The City Attorney was directed tolake into consideration the recommendations from the P&Z Commission, the location of the properties and the opinions of the Board members, if needed, and advise the Council the best course of action to take if they do decide to proceed with annexation proceedings. Item 5 Mr. Jacobs advised that the Planning and Zoning Commission is preparing their recommendations for a "Land Use Plan" to be published in booklet form as an official document to be adopted by the Council, which will comply with the Palm Beach County Comprehensive Land Use Act. He stated the Board recommends the hiring of a full time City Planner to implement this land use plan and update the zoning ordinance. The City Manager stated their was a gray area in the Act whether the Cities present Land Use Plan meets the intent of the Act and also if a consultant is required, this item would have to be included in the budget. Determination will be made on this when interpretation of the Act is received from the Attorney. PLANS FOR 3. The Council concurred with the City Manager's recommendation HOLLY DRIVE that the City Lngineer review the specifications and plans for the sidewalks on Holly Drive to assure that they are complete and in detail, for the reason that it will be a valid and permanent structure and should look as presentable as possible. Woody Dukes, Director of Recreation and Parks, invited the Council r Workshop Meetings July 18, 1974 Page 5 to attend the Jamboree Wind -up Program on Wednesday, July 24, 1974 at 7 :30 P.M. in the Palm Beach Gardens High School gym. VACANCY ON 4. The .Beautification and Environmental Committee will be asked to B &E COMMITTEE: 1 submit recommendations to fill the vacancy on that Board, due to the resignation of Mr. Hoover, for the Council to take under advisement. A Resolution will be prepared by the City Clerk for the Regular Meeting August 15, 1974 following the B&E Committee Meeting August l4, 1974. ITEMS BY THE CITY MANAGER: ARTICLES FOR 1. The City Manager requested and the Council concurred to consider POLICE DEPT.: at the Regular Meeting, July 25, 1974 authorization to purchase uniforms and other articles for the Police Department in the amount of $400.00 to be taken from the Contingency Fund. HORSESHOE 2. The City Manager reported the horseshoe courts had been completed. )Z� RL INVOICE FROM 3. The City Manager requested consideration of the invoice from PBC UTILITY COMPANY FOR the Palau Beach County Utility Company in the amount of $11,295.00 IYDRANTS: for use of fire hydrants for the year 1973. He reported the Fire Chief had found 11 hydrants not in service and had asked for clarification if those located in Tanglewood and Hilltop Gardens were considered on private property. The Attorney's opinion was they were not on private property. The City Attorney, the City Manager and the Mayor will determine the nllimher of hydrants in question and arrange a meeting with the owner of the Utility Company to resolve the problem. GARBAGE SERVICE -4. The City Manager advised the Council they have until August 2, CO MY .� SNNITATION: 1974 to reject or accept the 90 day option from County Sanitation for garbage service in the City and the new rate to be $2.00, an increase of fifty cents. Workshop Meeting, July 18, 1974 Page 6 The City Attorney gave the opinion: that County Sanitation by their letter dated June 6 , 1974 had exercised the 30 day cancellation clause, and the City would have to show due cause to cancel the contract. Discussion on the garbage contract will be placed on the agenda of the Regular Meeting, July 25, 1974. The City Manager will arrange for a demonstration of a center loader truck for garbage collection, for Thursday, July 25, 1974 at City Hall at 7:15 P.M., and will obtain recommendations from other municipalities regarding collection systems. ITEMS BY THE MAYOR AND COUNCIL: I 1 .u. Mayor Martino requested that the median strip on MacArthur Blvd. be mowed. Councilman Kiedis was informed in answer to his question regarding Ordinance ##21, 1974 .• parking spaces in Shopping Centers, that a Public Hearing would be held by the Planning and Zoning Commission on proposed changes to this Ordinance on August 13, 1974. The City Manager will discuss with Leonard Devine, Director of Public Works, Lee Coons and Lou Oxnevad consideration of an irrigation system for the City Hall Complex. No further business, the meeting adjourned at 10:30 P.M.
