CITY OF PALM BEACH GARDENS
AUGUST It 1974
The Regular meeting of the City Council of Palm Beach Gardens,
Florida, was called to order by Mayor Martino at 8 :00 P.M. in the
Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, and
opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were= Mayor Martino,
Vice Mayor DeLonga, Councilman Wiley, Councilman Ki,edis and
Councilman Feeney. Attorney Brant was present.
MINUTES: The minutes of the Regular Meeting of July 25, 1974, as amended,
were unanimously approved by the Council.
PETITIONS AND COMMUN1CATIa4S:
Mayor Martino acknowledged receipt of communications from:
SENATOR LEWIS: 1. Senator Phil Lewis* letter to Thomas O'Malley, Insurance
Commissioner, regarding the premium cost for automobile insurance
coverage for teenagers.
FRANK GARGIULO: 2. Frank Gargiulo, Palia Beach County Health Department expressing
regrets that he could not attend Public Hearing on Ordinance #11,
1974 repealing the building permit moratorium ordinance.
FRED TRAPNELL: 3. Fred Trapnell, Palm beach County Utilities Company, stating he
was unable to attend the Public Hearing on Ordinance #11, 1974
repealing the building permit moratorium ordinance.

JACK KETTER: 5. Jack Ketter, President of the Marquis Corporation, stating they
opposed annexation of their property located in the Southwest
corner of Section 13- 42 -42.
ORDINANCES: Mayor Martino opened the Public Hearing, as duly advertised, on
ORDINANCE #111, consideration of Ordinance #11, 1974 - repealing Ordinance #140
1974;
19709 of the City known as the Building Permit Moratorium Ordinance,
by reiterating the history and recent events surrounding the
moratorium situation.
The City Attorney clarified that Ordinance #20, 1973 provides that
certification of approved potable water supply and waste water
disposal must be made by the State or County agency before a
building permit can be issued.
Eight persons spoke from the audience urging the Council to repeal
the moratorium by adopting Ordinance #11, 1974, because of the
eminent completion of the new plant; the health and welfare of
the citizens would not be sacrificed, and it would relieve the
economic strain.
Several contractors stated that sewer connections,to their new
houses under construction and ready for a CO, had been authorized
and inspected by the Utility Company, however, Mr. Trapnell had
refused to put such approval in writing in order to obtain a CO from
the City.
The Mayor pointed out to the contractors that relief could not be
given by the City but must come from the DPC and /or Mr. Trapnell,
President of the Utility Company.
The Council concurred that adequate safeguards were on the books
by the adoption of Ordinance #200 1973•

The Public Hearinlg was declared closed.
A motion was made by Councilman Wiley} seconded by Councilmn Kiedis
and unanimously carried, that in the second Whereas, line 3 the
following verbage be deleted; "on or about July 1, 1974 ".
Ordinance #11, 1974 was read on second reading by the City Clerk
by title only with the amendment, and was unanimously adopted by
the Council.
The meeting recessed for 15 minutes and continued at 9;15 P.M.
ORDINANCE #14? Mayor Martino declared a Public Hearing, as duly advertised, on

consideration of Ordinance #14, 1974 providing for guidelines for
the Zoning Board of Appeals regarding setbacks for swimming pools.
Philip Bowdre, Chairman, Zoning Board of Appeals and George Kelch,
a member of the Board addressed the Council objecting to Section 2
which read "Provided,, however, no variance in excess of four (4)
feet shall be grunted for a rear yard or, in excess of four (4) feet
for a side yard; no variance in excess of two feet shall be made
for the location of a swimming pool to any building foundation.rr
They felt this suction was usurping the powers of the Board in
arbitrarily detet ining a particular distance for granting a
variance; that the Board should be able to judge each case on its
own merit to grant or not to grant a variance. They agreed the
rest of the ordinance was very good and that the Board was looking
for this kind of guidance.
The Council assured Mr. Bowdre and Mr. Kelch that they did not
question the wisdon of the Board but had attempted to provide
guidelines and agreed specific n-mhers were not necessary.
A motion was made, seconded and unanimously carried that in Section
2 the following 4erbage be deleted: "Provided, however, no variance in
excess of four (41) feet shall be granted for a rear yard or, in

excess of four (4I) feet for a side yard; no variance in excess of
2 feet shall be shade for the location of a swimming pool to any
building foundation."
Ordinance #14, 1974 was read on second reading by the City Clerk
by title only with the amendment and was unanimously adopted by
the Council.
ITEMS FOR DISCUSSICKs
LAND USE PLAN- Nancy Laurie, vide Chairman of the Planning and Zoning Commission
PLANNING AND
ZO ING COMMISSIONadd -reseed the Council advising that the Board was in the process
of compiling a Land Use Plan with maps and graphs attached, which
they will recommend for adoption as an official document. She
referred to the letter dated July 19, 1974 from Marvin Hill,
Planning Consultant to Clair Andersen, former Chairman of the P&Z Bd.,
which stated that the land use plan is the first phase in compliance
with the new Palm Beach County Comprehensive Act which has a deadline
date of October, 1975. Ms. Laurie conveyed the message from Mr.
Andersen that he will continue to carry out the responsibility of
preparing the plan with Mr. Hill and his recommendation would be
that Mr. Hill be further employed to complete the comprehensive
plan, in lieu of hiring a full time planner.
Favorable comments were made by the Council regarding the efforts
of the Planning and Zoning Commission in compiling this plan.
A motion was shade, seconded and unanimously carried that the City
Attorney be authorized to prepare a resolution adopting the land
use plan, pending the recommendation from the Planning and Zoning
Commission.
COMMUNITY The Community Surrvey results were explained, in parts by Mayor

be used as a guide to determine priorities on capital improvement
items for the budget.

response was recelived.
ITEMS BY THE CITY MANAGER:
AIR CONDITIONING The City Manager asked direction regarding the upgrading of the
POLICE DEPT.:
._ _ air conditioning ,in the Police Depprtment.
The Council agreeJd to proceed as per their directive at the
Regular Meeting, May lb, 1974, to award the work to Globe Air
Conditioning for their estimate of $1500 to be taken from the
Contingency Fund.
The City Manager advised, in his capacity as Building Official,
he was requesting the stamp of approval, in writing, from the
Utility Company Verifying an inspection of the sewer connection
before a CO is issued.
ITEMS BY THE MAYOR AND COUNCIL:
COUNCILMAN The City Attorney, in answer to a question from Council—n Kiedis,

informed the Council that the project of land purchase on Keating
Drive is underway, and that he has been unable to contact Tony
Silva, Bankers Life and Casualty Co., on the proposed purchase of
2 parcels of land located on the Northeast and Southeast corners
of Lighthouse Drive and Holly Drive.
VICE MAYOR Vice Mayor DeLon�a reported additional modifications by the engineers

to the on -site trleatment plant at the Longwood Condominium, to
alleviate the noise,, would be completed within a week.
ADJOURNMENT: No further business, the meeting adjourned at 10:15 P.M.
