HomeMy WebLinkAboutMinutes Council 120574REGULAR MEETING CITY OF PALM BEACH GARDENS DECEMBER 5, 1974 The Regular Meeting of the City Council. of Palm Beach Gardens, Florida, was called to order by Mayor Martino at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino, slice Mayor DeLonga, Councilman Wiley, Councilman Kiedis, and Councilman Feeney. Attorney Brant was present. MINUTES: The Minutes of the Regular Meeting of November 21, 1974, were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Martino made the following announcements: 1. The Boynton Beach Christmas Parade would be held Sunday, December 8, 1974 at 2 :00 P.M. 2. The Jr. Police Meeting would be held Monday, December 9, 1974 at 7:30 P.M. 3. Volunteer Firemen's Meeting would be held Tuesday, December 10, 1974 at 7;30 P.M. 4. Planning and Zoning Commission Meeting would be held Tuesday, December 10, 1974 at 7:00 P.M. 5. Recreation Advisory Board Meeting would be held Tuesday, December 10, 1974 at 8:00 P.M. 6. American Society Mechanical Engineers Meeting would be held Tuesday, December 10, 1974 in the evening in the Recreation Room. 7. Beautification and Environmental. Committee Meeting would be held Wednesday, December 11, 1974 at 7 :30 P.M. 8. Christmas Tree Lighting Ceremony would be held Friday, Regular Meeting, December 5, 1974 Page 2 December 13, 1974 at 7:15 P.M. 9. Christmas in Dixie Parade would be held Sunday, December 15, ..� 1974 at 2 :00 P.M. AWARDS TO Mayor Martino presented awards to the winners of the Miss Palm BEAUTY PAGEANT WINN R : Beach Gardens, Miss Jr. Palm Beach Gardens and the Junior Orange Bowl Queen contests that was held November 12, 1974, and thanked the girls for their interest and participation. BID OPENINGS: Bids for 1 -4 wheel drive Fire Unit for the Fire Department were opened and read by the City Clerk as .follows: Central Florida Fire Equipment Company, Orlando, Florida - unable to submit a quotation. Seagrave -FWD Fire Apparatus, Tampa, Florida - unable to submit a quotation. 1%-- Jack Cocke and Company, Inc., Mobile, Alabama. - l Jaco Deluxe "Mini-Pumper" complete with all equipment as specified mounted on 1975 Ford F -250 Cab and Chassis - $169335.00 Saulsbury Fire Equipment Corporation, Tully, New York - I, Saulsbury Mini- Pumper per specifications - $219250.00 R. Fuhrmann Company, Kissimmee, Florida - Total price Chassis - $5,150.00 Total price on body and accessories - $159018.35 Total price of chassis - $5,150.00 Total of complete unit - $209168.35. Mr. Fuhrmann addressed the Council prior to the opening of the bids stating he had,in error,added the price of the chassis in twice and asked that the total price be decreased by $50150.00 which is the price of the chassis. Regular Meeting, December 5, 1974 Page 3 Attorney Brant advised this procedure was in order, as Mr. Fuhrmann had declared his Mistake prior to theopening of the bids. The total of complete unit by R. Fuhrmann Company, Kissimmee, Florida ^ $15,018.35 Emergency One, Inc., Ocala, Florida _ as per specifications $239425.00 296 discount for cash delivery. The bids were referred to the City Manager and the Fire Chief for their evaluation with a recommendation to be presented at the Regular meeting, December 19, 1974. The meeting was recessed for a brief time to take pictures of the Beauty queens. PETITIONS AND COMMUNICATIONS: Mayor Martino acknowledged receipt of communications from: FRANK KOHL: 1. Frank Kohl, President, Christmas in Dixie, Inc. enclosing the formation and unit number for the City units in the Christmas In Dixie Parade. CITY Of BOCA 2. City of Boca Raton attaching a copy Of a resolutjon� requesting RATON: continuation of the annual pre-legislative meetings with the Palm Beach County Municipal League,directed to the Palm Beach County Legislative Delegation. GLAIR ANDERSEN: 3. Clair Andersen,, member of Planning and Zoning Commission, extending an invitation to the Mayor to address the Citizens Task Force Group on December 10, 1974 regarding the endeavors of the City in the adoption of the Land Use Plan. ORDINAW -ES: A Public Hearing, as duly advertised on November 15, 1974, was Regular Meeting, December S, 1974 Page 4 ORDINANCE #20, declared open by Mayor Martino, on consideration of Ordinance #20, 1974 modification to conditional uses in M -1 Zoning by increasing the number of sgiva.re feet allowed for sales area for surplus bakery goods. There was no discussion by the Council or by any member of the audience. Councilman Wiley stated for the record that the Planning and Zoning Commission had held a Public Hearing on October 22, 1974 on the above and recommended to the Council that it be adopted. The Public Hearing was declared closed. Ordinance #20, 1974 was read on second reading, by title only, by the City Clerk, and unanimously adopted by the Council. ORDINANCE #210 A Public Hearing, as duly advertised on November 20, 1974, was 1974: declared open by Mayor Martino, on consideration of Ordinance #212 1974 authorizing the issuance of building permits without authorized sewage disposal facilities meeting the standards of the Palm Beach County Health Department. Mr. Joseph Amato spoke from the audience and questioned whether his permit in force at the present time, with construction underway, would fall under the dry permit theory as proposed by this ordinance. He was advised by Attorney Brant that it would not. He has the option to connect to a septic tank or wait and connect to the new sewer plant when completed before he can obtain a certificate of occupancy. Councilman Wiley commented that this ord$nance will provide that applications for subsequent building permits will not be required to go through the septic tank qualification tests, but once the Regular Meeting, December 5, 1974 Page 5 permit is obtained, and construction has been completed, a CO will not be granted until additional hook -ups are allowed through the completion of the new sewer system. Motion was made, seconded and unanimously carried that the Public Hearing advertised regarding Ordinance #219 1974 be recessed to the Regular Meeting of the City Council on December 19, 1974 for a continuation of the Public Hearing and second reading. Ordinance #210 1974 will be workshopped at the meeting of December 129 1974. ORDINANCE #239 Ordinance #230 1974 revising charges for Cable Television Services • was read in full on first reading by the City Clerk inserting the figure $70.00 in the blank under "maximum monthly service rates, residential, if paid in advance, maximum annual rater. Ordinance #23, 1974 will be wo7rkshopped at the City Council meeting on December 12, 1974, and the Public Hearing and second reading will be held at the Regular Meeting, December 19, 1974. REPORTS: Mayor Martino reported he was not in attendance for the full PLANNING AND meeting of the Planning and Zoning Commission held November 26, ZONING COMMISSION MEETING: 1974, and a copy of the minutes were distributed to the Council. Councilman Kiedis commented on a report in the minutes, that seemed ironic to him, that due to the funding required, the State did not pass a law requiring all new drivers of semi- trucks to take a special test on a driving range. PBGYAA: Councilman Feeney reported the Palm Beach Gardens Youth Athletic Association had completed their football program for the year. He advised that Vice Mayor DeL,onga had welcomed the willowgrove, Pennsylvania team at the opening of the Thanksgiving Bowl football Regular Meeting, December S, 1974 games. Page 6 \ PLANNING AND The City Manager referred to an item discussed at the Planning and ZONING COMMISSION NEOTFING: "Zoning Commission meeting relative to permitting a drivers' license bureau as a conditional use in the A -1 Zoning district on PGA Blvd. He expressed concern about the number of non- exempt pieces of property, i.e. schools, churches, YMCA etc. in the City that require police and fire protection, yet the City does not receive land use any revenues. He suggested the Council consider a/ limit to the tax A -i zoning that can be used for non - revenue Facilities. ITEMS FOR DISCUSSION: NOISE ORDINANCE: The City Manager presented the Council with copies of a model noise ordinance made as a result of a study prepared by Dr. Dunn of Florida Atlantic University for the Tri -City group, and a copy of a proposed noise ordinance as prepared by Attorney Brant. He asked the Council for direction and recommended, as a start, taking the initiate and pass an ordinance independently from the Tri -City group. A committee was selected consisting of Vice Mayor DeLonga, Councilman in consultation with Chief of Police & Feeney and the City Manager /to prepare a noise ordinance combining Attorney. the best of the two for consideration of the Council at the first workshop meeting in January. SECONDHAND The City Manager informed the Council that at present the City DEALERS: has no control over secondhand dealers as to what items they have, who they obtain thew from Iand how same is disposed. He presented the Council with a copy of a restrictive ordinance in effect in Lake Park, stating the intent of that ordinance could be made '%-� workable in the City, and it would provide the legitimate secondhand dealers with security and would be a deterrent to Regular Meeting, December 5, 1974 illegitimate secondhand dealers. Pag e 7 The Council agreed and directed the City Attorney and the City Manager to prepare an ordinance dealing with secondhand dealers for their consideration. ITEMS BY CITY MANAGER: RESTROOM AND The City Manager presented plans and elevation drawings for the TENNIS PRO SHOW FACILITIES: restroom and tennis pro shop facilities for the approval of the Council, and answered any questions posed by the Council. Councilman Wiley suggested the following items be considered: asphalt shingles, wired for a /c, outside walkway or patio, vent on top of roof, aluminum doors, outside drinking fountain between restrooms, why two wash basins in women's arestrooms, light in storage area, location of telephone for underground wires, spot sights outside building, and light coat of stucco before striking. The Council generally agreed with Councilman Wiley's check list. Councilman Ki.edis and Councilman Feeney expressed concern about the number of windows for security purposes. A Motion was made, seconded and unanimously carried that the City Manager be authorized to utilize the remaining of the funds that had been allocated for this project in the amount of $6500.00. Councilman Wiley stated he had voted against the initial motion to construct this building, but in the spirit of trying to be constructive, since the project was underway, he would agree with the majority and vote for the motion, as a vote of confidence for the work that the City Manager and Building Inspector had performed. The City Attorney was directed to prepare a land -lord /tenant agreement before occupancy by the tennis pro, and also an Regular Meeting, December 5, 1974 Page 8 agreement with the PBGYAA when they donate the storage building to the City, which will be housed with their equipment. v MONIES TO MARVIN The City Manager advised Marvin Hill, Urban Space Design, had HILL FROM NANCY: submitted a bill in the amount of $1,000 for services performed in November on his contract re the Comprehensive Land Use Plan. Mr. Orr stated this amount is to be taken from the contingency fund as the use of the money does not fall under the guidelines of the Federal. Revenue Sharing funds. Motion made, seconded and unanimously carried that the City Manager be authorized to pay the first payment to Marvin HiU, Urban Space Design out of the contingency fund, which was allocated in the budget. The City Manager will obtain a definitive answer from the Federal agency determining if a portion of the fee can be taken from the Federal Revenue Sharing funds. FIRE TANKER: A recommendation will be obtained from the Fire Chief regarding the purchase of a used tanker from the Juno Fire Department, which the City Manager reported would cost $1,500.00 WORKSHOP IN At the request of the City manager, a motion was made, seconded ORLANDO 9 and unanimously carried that the City Manager be authorized to attend the worksihop meeting in Orlando, January 16.-17 regarding the Fair Labor Standard Act; and that the City reimburse him for all expenses, funds to be taken from the contingency account. ITEMS BY MAYOR AND COUNCIL: STREET LIGHTS: Mayor Martino requested that the City Manager again contact Florida Power and Light Company regarding the street lights in the City, in particular Flax Court and Plat 1. 1 Regular Meeting, December 5, 1974 Page 9 JAYCEES The Council unanimously granted permission for the NPB-PBG CHRISTMAS TREE SALE: Jaycees to sell Christmas trees on the vacant lot at the corner of Lighthouse Drive and Gardens East Drive and that any fees be waived. VICE MAYOR Vice Mayor DeLonga requested that the Building Department DELONGA: investigate the signs that are located at the Turnpike Interchange for their legality. COUNCILMAN Councilman Feeney advised the Palm Beach Gardens Youth Athletic FEENEY.* Association was keeping a cumulative total, of the expenses incurred in constructing the storage building. Councilman Feeney asked that the lights at Plant Drive be replaced before the opening of the baseball season in March, and was advised by the City Manager this item has been programmed by the Public Works Department. It was suggested that Mrs. Charles Kurz be invited to the Christmas Tree Lighting Ceremony and provided transportation if needed, as a courtesy for the work and interest shown by her late husband in this event.
