HomeMy WebLinkAboutMinutes Council 121974POLL CALL: MINUTES_ ANNOUNCEMENTS: BIDS AWARDED: FIRE UNIT: ?IRE TANKER: REGULAR NEETIM CITY OF PALM BEACH GARDENS DECEMBER 19, 1974 The Regular Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by PLayor Martino at 8 :00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, and opened with the Pledge of Allegiance to the Flag. Roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor DeLonaa, Councilman Kiedis and Councilman Feeney. Councilman Wiley arrived later in the meeting. Attorney Brant was present. The Minutes of the Workshop Meeting of December 12, 1974, as amended, were unanimously approved by the Council. Mayor Martino announced that the Jupiter Christmas Parade would be held Sunday, December 22, 1974 at 2 :00 P.M. and the City would participate with their float. Mayor hkartino announced that the City's float had won the second place award at the Christmas In Dixie Parade and thanked Woody Dukes and his staff for a job well done. At the recommendation of the City Manager and the Fire Chief. by a unanimous vote of the Council. the bid for the 4 wheAl drive Fire Unit was awarded to R. Fuhrman Company, Kissi=ee, e i� Florida for the low bid amount of $15,018.35, as per specifications The bids were duly advertised and opened at the Regular Meeting, December 5, 1974. Monies to be taken from the Federal Revenue Account. Vice Mayor DeLonga requested that the discussion on the purchase of a fire tanker from Juno Beach Fire Department be tabled to Regular Meeting, December 19, 1974 allow Juno Beach to revaluate the situation. PETITIONS AND COMMUNICATIONS: SHERALEE BRYANT: RESOLUTIONS: RESOLUTION #54 RESOLUTION #55? ORDINANCES: ORDINANCLi #219 Page 2 Mayor Martino acknowledged receipt of a thank you card from Sheralee Bryant in appreciation for the plaque she received from the City for being a wanner in the Beauty Pageant. Mayor Martino wished the citizens of Palm Beach Gardens and the employees of the City a Merry Christmas and Happy New Year. Resolution #54, 1974 providing an orderly system and timetable for the reporting of the final tax roll to the Municipalities by the County Tax Assessor was read in full,with a modification in the title and in Section 1, by the City Clerk and unanimously adopted by the City Council. Resolution #55, 1974 opposing the proposal by the State to abolish police forces of certain municipalities was read in full by the City Clerk and unanimously adopted by the City Council. Copies of Resolutions #54 and #55 will be forwarded to all neighboring municipalities, the Palm Beach County League of Municipalities and the Legislative Delegation, in addition to those specified. Mayor Martino declared the Public Hearing open on consideration of Ordinance #21, 1974 authorizing the issuance of building permits without authorized sewage disposal facilities meeting the standards of the Palm Beach County Health Department, as duly advertised November 20, 1974. Mr. Edgecomb spoke from the audience asking for clarification whether he would need the stamp of approval on his set of plans Regular Meeting, December 19, 1974 Page 3 from the Palm Beach County Health Department and the Utility Company before a building permit is issued. He was advised that approval must be received from the Utility Company relative to potable water supply, and the City would advise the Palm Beach County Health Department. The Public Hearing was declared closed by Mayor Martino. Ordinance #21, 1974 was read on second reading by title only with the amendments, by the City Clerk and was adopted as modified unanimously by the Council. ORDINANCE #22, Mayor Martino declared the Public Hearing open on consideration of Ordinance #22, 1974 amending Section 12A.2 of Article V. Zoning, of the Palm Beach Gardens Code by adding Educational. Institutions as a conditional permitted use, as duly advertised. No member of the audience or the Council, spoke for or against the ordinance. The Public Hearing was declared closed by Mayor Martino. Ordinance #22, 1974 was read by title only on second reading by the City Council and unanimously adopted by the Council. ORDINANCE #23, Mayor Martino declared the Public Hearing open on consideration of Ordinance #23, 1974 revising charges for Cable Television Services, as duly advertised. Mr. Edgecomb spoke from the audience expressing concern over the increase in the reconnection fee, and asked for clarification of same. Motion was made, seconded and unanimously carried to modify on page 2, under reconnection to substitute the word subscriber in Regular Meeting, December 19, 1974 place of ownership. Page 4 A discussion by the Council and Mr. Gilchrist, Vice President of Cable TV followed. Councilman Wiley urged the Cable TV Company to reduce the inequity between the rate for single family residents and apartment and condominium groups. A motion was made by Councilman Wiley, seconded by Vice Mayor DeLonga to revise the figure of single multiple dwellings to 8 or more units. Vote on motion - Mayor Martino and Councilman Wiley voted aye; Vice Mayor DeLonga, Councilman Kiedis and Councilman Feeney voted nay. The motion was defeated by a vote of 2 ayes and 3 nays. Councilman Wiley urged the Cable TV Company to express to the ' Federal Communications Commission objectionto the unjust rule of blacking out the football games televised in Miami. Ordinance #23, 1974 was read by title only with modifications on second reading by the City Clerk and unanimously adopted by the City Council. Before the adoption of the ordinance, Councilman Wiley clarified for the record that the rates are the maximum rates, and it is not the City Council that has raised them, it is the Cable Company. ORDINANCE #240 Ordinance #24, 1974 riremen's Retirement Trust Fund was read in 1974: full on first reading by the City Clerk. r A Public Hearing and second reading will be held at the Regular Meeting, January 2, 1975. Liam Regular Meeting, December 19, 1974 Page 5 REPORTS: Mayor Martino thanked Woody Dukes, Director of Recreation and CHRISTMAS TREE Parks and his staff for making plans and preparing for the LIGHTING CEREMONY: Christmas Tree Lighting Ceremony. BICENTENNIAL The City Manager reported on the meeting of the Bicentennial COMMITTEE: Committee held December 169 1974 and stated the next meeting would be held January 8, 1974. The Council members will take turns attending these meeting ITEMS BY THE CITY MANAGER: BIDS FOR NEW At the recommendation of the City Manager, a :potion was made, POLICE CARS: COMPREHENSIVE LAND USE PLAN; NEWSLETTER: seconded and unanimously carried authorizing the City Manager to go out for bids for 4 new police cars with a trade -in of 3 police cars. The bid will specify the Nova Chevrolet and will be returnable at the Regular Meeting, January 16, 1975. Funds will be taken from the Federal Revenue Sharing Account. The City Manager reported the monies for the payment to Marvin Hall for providing a Comprehensive Land Use Plan cannot be taken from the Federal Revenue Sharing Fund, but will be taken from the Contingency Account. The City Manager reported a newsletter would not be published this month because of the time limit and the expense involved. CHRISTMAS PARTY: The City Manager reported the Employees Christmas Party would be held December 24, 1974 from 11:00 A.M. to 5 :00 P.M. at the Fare Station, and an invitation had been extended to the members of the Advisory Boards. COUNC I LMAN TVY ICY COUNCILMAN FE FNFY: ADJOURNMENT: Page 6 on schedule, the lights on Flax Court would be in operation on this date, and the Florida Power and Light Company had been given the lighting schedule but would not indicate as to when the project would be started. Mayor Matino scheduled for the Workshop Meeting of January 9l 1975 consideration on the proposed ordinance dealing with second-hand dealers. Mayor Martino advised he had signed the contract with the School Board regarding the Community School Program. Councilman Feeney, in perusing the Land Use Plan,expressed concern about no height limit being specified in certain R -3 zoning categories. The Council concurred this would be corrected as a comprehensive plan is made and the Planning and Zoning Commission reviews same and makes recommendations. Councilman Wiley was advised by the City Manager that the balance of the funds in the Central Fire Station Bond Issue Account had been depleted since the report by the Auditor. The City Manager stated he was correcting the duplication of payment to vendors as reported by the Auditor. Councilman Feeney was advised by the City Manager that the contents that will be placed in the storage building at Plant Drive and owned by the Palm Beach Gardens Youth Athletic Association., cannot be insured by the City. Councilman Feeney will so advise PBGYAA. No further business, the meeting adjourned at 10 :3Q P.`. -1.
