"?. in the Assembly room, 10500 N. 11iliLary Trail, Palm Beach Gardens, and opened with the -ledge of Allegiance to the F lag . ROLL CALL: Roll was called by the City Clerk and present were: Councilman Dunbar, Councilman DeLonga, Councilman T,4artino, Vice Mayor Kiedis and Mayor Wiley. Attorney 1,,'illiam Brant was present. County Commissioner Robert Culpepper, at the invitation of the Council, also attended the meeting. (MINUTES: The Minutes of the P egular Neeting of April 5, 1973 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Miley announced that a Public Hearing would be held by the City Council on April 19, 1973 for consideration of Ordinance #9, 1973 providing for annexation of lands in Section 4- 42-43. P3ayor Wiley also announced he had sent letters to the area businessmen who had signed a petition requesting they be represented on a committee to discuss the Sign Ordinance, advising them another committee would not be appointed, however any recommendations from a group or individual should be submitted to the Council before 1Hay 1, 1973. COUNTY County Commissioner Robert Culpepper, in answer to questions from the COMMISSIONER ROBERT Council, gave his opinion and reported on the following subjects: J�` -EPPER : 1. Fire Districts and annexation of unincorporated areas into Municipalities: r•1r. Culpepper stated there are 12 fire control districts serving the unincorporated areas and the municipalities have to be extremely careful through their annexation procedures not only that they don't damage the tax base for a particular fire control district, but also that they don't go in violation of the special legislative acts that created these fire control districts. He also Workshop Meeting, April 12, 1973 Page 2 emphasized that the Cities must be certain they have the manpower to serve the additional area they might annex. 2. Town Hall Home Area: The question was posed that in the Town Hall home area where half the street Lies within the City and half in the County, could City police protection and powers be supplied to the area in the County. Mr. Culpepper agreed it would be a fine idea,if it could be worked out legally as to the problem of insurance etc., whereby the police officers could be deputized by the Sheriff's Department enabling them to work in the City or outside the City. The Council authorized the City Attorney to meet with Mr. Small, the County Attorney, to begin preliminary negotiaions on an agreement. 3. The Sign Ordinance: Mr. Culpepper stated the County, after a year of study by a 17 member advisory board, had adopted a Sign Ordinance, copies of which he would make available to the Council. Ile also agreed to cooperate with the City in areas in the County adjacent to the City, as an example the north side of PGA Boulevard where the billboards are located, and make every effort to ascertain if their Sign Ordinance is compatible and complimentary to the City. 4. Annexation: Mr. Culpepperts philosophy on annexation was that consideration be taken not only for the people within the municipality but for the people outside in the unincorporated areas. He used Jupiter as an example where a referendum vote of the people was held on the same day, same time, at two separate voting places, one for those people living in the area that was to be annexed and one for those people living in the municipality. People in other areas were heard but not given a vote. He advised making it known to everyone those areas that were to be considered for annexation by a series of information meetings with the people. Mr. Culpepper assured the Council he would relay the message to the people concerned ,that the City of Palm Beach Gardens is not initiating time. annexation of any land at this April 12 1973 Page 3 Workshop Meeting, p , 5. County Annex building: It was reported by Mr. Culpepper that the 10 acres on the South side of PGA Blvd. between Prosperity Farms Road and AIA is now under the ownership of the County and a County Annex building will be constructedy completion date to be a year from July. The building will be used for administrative functions including the tax assessor, tax collector, supervisor of registration, veterans service etc. and a court room. 6. 4- Laning PGA BlYd.: Plans are in the final design stage for 4- laning PGA Blvd. from A1t.AIA, including the railroad tracks, to Military Trail, construction to start in September at an estimated cost of $500,000 for the project. In answer to Mayor Vsiley's question of why the County does not assume the burden of the cost for improvements to the railroad crossing as opposed to the City, Mr. Culpepper stated the improvement to the railroad crossing is included in the overall upgrading as well as the signalization upgrading. u 7. Military Trail from Northlake Blvd. South is under design now for 4- laning. It is not anticipated at the present time to 4 -lane Military Trail from Northlake Blvd. to PGA Blvd., but it will be in the design portion next year. The County is now acquiring the property for the road set backs. The County Engineering Dept. has been asked, in the coming budget session, for a cost break down for continuation of Military Trail to PGA Blvd. up to Hood Road and Donald Ross Road. Alt. AIA is to be resurfaced and strong consideration will be given to 4- laving it from Northlake Blvd. north. 8. Extension of.Congress Avenue: Discussion and consideration is being given by the County Engineering Dept. and the Dept. of Transportation to continue Congress Ave. North to Northlake Blvd. and branch off in the general area of Pars: Avenue in Lake Park, go in a northeasterly direction to intersect with Prosperity Farms Road. Money is budgeted to 4 -lane Northlake Blvd. The Federal, Government will pay at their expense for the overpass of I -95 or Military Trail if they are extended north. workshop fleeting, April. 12, 1973 Page 4 9, Double yellow lines on PGA Blvd.: If the Public works Director does not receive an answer from the County to the City's request for double yellow lines on PGA Blvd. at the intersection of Hickory Drive and the Avemue of the PGA, Mr. Culpepper will pursue same. Councilman Martino read a letter addressed to him from the Department of Transportation that the resurfacing of Alt. AlA has been programmed for the fiscal year 1973 -74 which begins July 1, 1973. 10. Legislative Bill: Mr. Culpepper stated there is a Legislative Bill to be introduced by Senator Lewis that the State assume the responsibility of purchasing the right-of-ways for primary roads. This is now the responsibility of the County and if passed, would relieve a lot of money to the County. 11. Left turn signal,at PGA Blvd.: Mr. Culpepper will talk to Charlie Hyman of the County Engineering Department about the feasibility of changing the timing of the left turn signal at AIA and PGA Blvd. to operate all day time hours in order to relieve the bottleneck of traffic. 12. Sewage Treatment Plant. The board of County Commissioners has offered help and assistance to the Area Planning Board in the program to build a new sewage treatment plant. A meeting has been scheduled for the immediate future with the County Attorney and the owner of the Utility Plant to determine if the County can or should participate to speed up the construction of a new plant which would allow a lower rate structure to the users in the service area. The County Engineer and Attorney are making an indepth report to present to the Area Planning Board on April 192 1973. Mayor Wiley asked Mr, Culpepper in thak discussionsto determine why a TOP has not been issued to the Palm Beach County Utility Company. 13. Traffic Court procedures: In answer to Councilman DeLonga's concern about the court proceedings at the County Traffic Court, 'r. Workshop Meeting, April 12, 1973 Page 5 Mr. Culpepper advised they are working on methods of improving it and are in the process of programming the computer to offer a method to pay fines without appearing and categorizing those who plead guilty and those who plead not guilty. REPORTS: Councilman Martino reported on his meeting with the school principals MEETING WITH on March 23, 1973- Dr. Ed Eissey, Palm Beach Gardens High School; SCHOOL TqFIR[ TPALS: Mar. Fizer, Palm Beach Gardens Elementary School; and Mr. George Pilicy, Howell Watkins Junior High together with Mr. Gerald Sleeter, a member of the Recreation Advisory Board. Some of the subjects discussed and recommendations made were as follows: 1. City /School relationship- If the school or the City has a specific request it should be handled through the City Manager and the Principal. If subordinate personnel are needed they should be appointed by the City Manager or the Principal. 2. In the area of communication the City Council should appoint a Council representative to handle policy problems. 3. Sharing facilities - All the principals felt major strides had been made this year. Gerald Sleeter recommended to the Principals that the Recreation Advisory Board would like them to explore the idea of placing kiddie type equipment on school property at Howell Watkins and the Elementary School to have a neighborhood pars: concept. The Principals were very receptive to this idea. 4. Traffic responsibilities - bicycle, foot and vehicular - The Principals felt all the responsibility lies with the City and requested if the crossing guards have any problems that they be advised so that any action necessary could be taken. 5. Sidewalks - Encouraged the City Council to go ahead with impxovement; to Lighthouse Drive and sidewalks on Holly Drive to the Elementary School. Mr. Pilicy recommended a shell crock path along MacArthur Blvd. from Northlake Blvd. to the Howell Watkins School. Dr. Eissey indicated U workshop Meeting# April 12, 1973' Page 6 a parking problem and needs relief for vehicles to be allowed to park along the street that circles the football field or the area in front of the school. Councilman Martino recommended that Chief Pecht meet with Dr. Eissey to resolve this problem. All the Principals gave high praise for both the Police Department and the School guards. Open discussion was held on the white-black ratio, enrollment, busing, double sessions and plans for expansion. The Council authorized the Public Works Director to contract the School Board Director of Maintenance Planning regarding the donation to the City and removal by the City of dirt located near the football field on Lilac. Thrive. The High School is interested in a joint venture with the Beautification and Environmental Committee of shrubbing the perimeter of the football field. Councilman Martino reported the Driver Education facility located behind the school property was advanced to the School by the State because of their high scholastic rating in the State. CITY MANAGER Mayor Wiley reported that 97 applications for City Manager have been APPLICATM: received and the Screening Committee had given the Council 13 recommendations. The Council have ranked the top 7 and are arranging for interviews with the top 3 for the week of April. 23, 1973. Letter from the Department of Pollution Control, State of Florida, TROL: biav sing of a public hearing at 10:00 A.M. April 17, 1973 in Tallahassee, Florida to consider a permit to construct a deep disposal test well for the West Palm Beach sewage facilities. HILLTOP 2. Dunkle, Clerk, Board of County Commissioners P C : enclosing a copy of Resolution #R -73 -156 requesting the Legislative Delegation to withhold support of pre -filed House Bill #227, which bill would defer the effective date of January 1, 1973 requiring sewage treatment plants to meet a minimum of 905 BOD removal. REVENUE 5. Correspondence from Director of Uffice of Revenue Sharing enclosing SHARING: a check in the amount of $14,885.00 for payment for the first half of the third entitlement period. FRANK KOHL: 6. Letter from Frank Kohl, City Managers Boynton Beach enclosing a s copy of Resolution 73 -Z relating to the Florida State Comprehensive Planning Act of 1972, its companion legislation and regional government. JENI FW1ILTON:7. Letter from J eni Hamilton, Chairman of the Beautification and Environmental Committee stating her reasons for not establishing a separate environmental committee. W.L. MAC 8. Letter from W.L. Mac McLendon, Field Representative to MC LENDON : Congressman Skip Bafalis enclosing a copy of a letter to him from Arnold Ramos, District Engineer, stating the State would have no objection to landscaping the right -of -way of Holly Drive under 1-95, inasmuch as they do not own the right -of -way and would have no control over landscaping that area. DEPARTMLNT 9. Correspondence from the Department of the Army, Jacksonville, Fla. UP THE ARMY: advising of a meeting to be held at 7:30 P.M. on April 27, 1973 on improvements for Flood Control and Water Control measures. The Public Works Director was instructed to attend this meeting. FLORIDA 10. Invitation from the Florida Nurserymen and Growers Association to attend a seminar on May 18, 1973 from 2 -4 P.M. at the Breakers Hotel. This invitation will be forwarded to Mrs. Oxnevad and Firs. Hamilton of the Beautificatioln and Environmental Committee. Workshop Meeting, April 12, 1973 ITEMS FOR DISCUSSION: Page 8 HOME FEDERAL A letter was acknowledged from the Home Federal Savings and Loan SAVINGS & LOAM ssociation regarding an application with the Federal Home Loan Bank Board for a branch office to be located on the East side of U.S. #1 north of the Monastiery, asking the City for a letter indicating that a building permit would be issued if their application from the Board was approved. Mayor o,*iley stated he had talked to Fred Trapnell, Manager, North Palm Beach Utilities, who reported the North Palm Beach facility expansion is underway and will be on the line by early fall. Howevej he did not feel right now they could start accepting applicationsfor building permits until a very comprehensive review of permits outstanding was made. Mr. Trapnell gave no hope whatsoever to Palm Beach Garden *, certainly not on a wholesale basis. Mayor Wiley said he would like to see the Council remove the present resolution supporting the moratorium `� on the North Palm Beach facility and leave it to the discretion of the Utility Company. The City Clerk was instructed to obtain copies of the North Palm Beach Resolution and the Resolution passed by the Council for their study and disposition will be made at the next regular meeting. KEATING Two residents from Keating Drive came before the Council asking for DRIVE RESIDENTS: relief to their problem of motorcycles .racing through their neighborhood and continuing on through areas in the County out of reach of the jurisdiction of the City police. They also requested additional lighting for their street. The Acting City Manager will discuss this with the Chief of Police. ITEMS BY THE ACTING CITY MANAGER: Acting City Manager .lames D eLonga reported the self-service postal unit will be open to the public on Monday, April 160 1973, the fences have been installed at the T -ball fields, the backstops are up on the ti..I Workshop Meeting, April 12, 1973 Page 9 north side of the Howell Watkins field and the animal pens have been moves to another location at the Public Works Can -plex. STORAGE Mr. DeLonga presented a request from the Vehicular Maintenance Director BUILDING FOR TIRES: to build a storage building to hold all the vehicular tires on hand. A cost estimate will be obtained. ITEMS BY THE MAYOR AND COUNCIL: VICE MAYOR KIEDIS : ORDINANCES: Vice Mayor Kiedis suggested the piles of dead trees behind Publix be burned and the area raked. He also recommended that one of the custodians be added to the staff of the Recreation Department to assist in working on the football and baseball fields and the other custodian who is presently working at the City Hall be under the direction of the City Manager. Ordinance #9, 1973, providing for annexation of certain lands in ORDINANCE #9: Section 4 -42_43 will be placed on second reading at the Regular Meeting on April 19, 1973. The City Attorney informed the Council that the Resolution he was asked to prepare transferring funds from the Revenue Sharing Account should be an Ordinance and he will prepare same for the next Regular Meeting. ORDINANCE #5: Ordinance #5, 1973 the Sign Ordinance was discussed by the Council. The Council concurrOd with the chs<ts showing the maximum allowable sign area, frontage street facade in the Ioest Palm Beach Code and indicated additional discussion should be held on definitions, area size, amortization And pole and ground signs. It was decided to discuss each item separately starting with definitions which will be placed on the agenda of the April 190 1973 meeting. ADJOURNMENT.
