Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Councilman Wiley, Councilman DeLonga, Councilman Martino, Vice Dtayor Dunbar and Mayor Kiedis. Attorney Brant and the City Manager were present. MINUTES_ The minutes of the Workshop Meeting of December 13, 1973 and the Special Meeting of December 13, 1973 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Kiedis announced that the City Council Meeting of Thursday, December 27, 1973 would be cancelled due to the holiday and the City ( Hall Administrative offices would be closed on Monday, December 21, 1973. PUBLIC A Public Hearing was held on the petition from Oakbrook Square hEAR ING : Associates for annexation of a parcel of land in Section 4 -42 -43 into the City. Mayor Kiedis verified that all the requirements of the Palm Beach Gardens Code and State Statutes had been met, and that a Public Hearing held by the Planning and Zoning Commission on November 270 1973 resulted in a recommendation from the Planning and Zoning Commission to the Council that the parcel be annexed with Zoning Classification C -2. No one was present at the hearing for or against the petition. Mr. David Gibson, representative of Oakbrook Square Associates had previously notified the Council that he would be unable to attend as he was going to Canada for the holidays. r )ecember 20 1973 Page 2 \ Regular i�ieeting, s ORDINANCE Ordinance #28, 1973 - Annexation of lands in Section 4 -42 -43 was read #280 1.97_3: in full by the City Clerk on first reading. Second reading will be held at the Regular Meeting, January 17, 1974. RESOLUTIONS: Resolution #60, 1973 appointing Joseph Crocker, Sr. as first Assistant RESOLUTION Tire Chief and Stephen Goione as Second Assistant Fire Chief was read #60F 19T.-T.- in full by the City Clerk and unanimously adopted by the Council. RESOLUTION As per an invitation to persons interested in serving on the Recreation #61, 1973: Advisory Board, Mr. Dick Feeney, addressed the Council stating he had lived in the City for five years and would like to make a contribution to the City by serving on that Board. Mr. Meyer Kesner also addressed the Council stating he was a retired Government employee and retired from the Air Force, was available and interested in serving on the Planning and Zoning Commission. At present he teaches one night a week at the Junior College. Councilman DeLonga thanked him for his interest and advised that the Planning and Zoning Commission might at a later date be enlarged to seven members. Resolution #61, 1973 - Appointing Richard Feeney as a member of the Recreation Advisory Board was read in full by the City Clerk and unanimously adopted by the Council. RESOLUTION Resolution #58, 1973 amending the Merit System Rules and Regulations #58, 1971.-- regarding h6liday pay and overtime pay for City Employees was discussed by the Council. Modifications were made to clarify the Resolution by Councilman DeLonga who moved that Ordinance #58, 1973 be read in full with modifications, seconded by Vice Mayor Dunbar. Vote on motion - Mayor Kiedis, Vice Mayor Dunbar, Councilman DeLonga and Councilman Martino voted aye; Councilman Wiley voted nay. v Resolution #58, 1973 was read in full with modifications, by the City Clerk and Councilman DeLonga moved that Resolution #58, 1973 be Regular Meeting, December 20, 1973 Page 3 adopted as read, seconded by Vice Mayor Dunbar. During discussion on the motion, Councilman Wiley explained his proposed modification to Paragraph 4 (b) Holidays and to strike Paragraph 8 (a) and (b) and renumber (c) (d) and (e) to (a) (b) and (c). Councilman DeLonga modified his motion to adopt Resolution #58, 1973 as read, to include Councilman Wiley's modifications, seconded by Vice Mayor Dunbar and unanimously adopted by the Council. ORDINANCE Ordinance #5, 1973, the Sign Ordinance was read in full by the City #5, 1973: Clerk including the changes as proposed by Attorney Brant and Councilman ;dartino, on first reading. The Council concurred the Sign Ordinance would be workshopped with a one hour time limit at the Regular Meeting, January 3, 1974; a Public Hearing would be held on Ordinance #5, 1973 at the Workshop Meeting, January 10, 1974 and read on secnnd reading at the Regular Meeting, January 17, 1974. PETITIONS AND COMMUNICATIONS: Mayor Kiedis acknowledged receipt of communications from: SENATOR 1. Senator Phil Lewis regarding the Page Communications System, LEWIS: together with a copy of a letter from Donald R. Allen, Director of the Division of Communications. The City Manager will arrange for Sheriff Heidtman and tir. Allen to make their presentations regarding the Page Communications System at the next Tri -City Meeting to be held at North Palm Beach. The Council also advised the City Manager to request as an agenda item "Community School Concept." JACK 2. Jack Poorhaugh advising of a hearing pertinent to legislation to be POORBAUGH: considered in the 1974 Session of the Legislature in Stuart on February 15, 1974. Regular Meeting, December 20, 1973 Page 4 MRS. MILTON 3. Mrs. Milton Herbert suggesting that the City pick up old HERBERT: newspapers for recycling. The City Manager will pursue this to determine if it is feasible from an economic and practical standpoint to pick up the disgarded newspapers. TARRY 4, Larry Robbins, City Manager,Village of North Palm Beach enclosing ROBBINS : a copy of a Resolution regarding the Meridian Park Drainage Canal authorizing the reshaping of the ditch to eliminate drainage into that ditch. The Council directed the City Manager to reiterate their feelings that the City does not wish to participate in such an endeavor and so advise Mr. Robbins. HILLTOP GARDENS The City Manager ackno*ledged receipt of a letter from a resident TRAILER PA99T. of Hilltop Gardens Trailer Park requesting a street light, which he will pursue. CHRISTMAS TREE Councilman Wiley thanked woody Dukes, the Recreation Department, LIGHTING -� Rls: Woody ;•,artens and the Fire Department for the excellent program at the Christmas Tree Lighting Curemony and commented he had observed 1007. cooperation from the residents in the City regarding the energy crisis. REED DRIVE: Councilman DeLonga stated he had received favorable comments from the residents of Reed Drive since the completion of their drainage problem. ITEb6 BY THE CITY MANAGER: CONTINGENCY At the request of the City Manager the Council authorized the payment FUND EXPENDITURE: of $92.52 from the Contingency Fund for a new chair for the receptionist. CHUDNOW The City Manager advised the Council a request for a building permit C_ONST. CO. REQUEST FOR had been received from Chudnow Construction Company, Inc. and the PERMIT: draft of a letter in reply to be sent to Mr. Sleeter was approved by the Council. Regular Meeting, December 20, 1973 Page 5 SECOND The Council expressed no objection to a request by the City manager BUILDING INSPECTOR: to take measures to obtain a well qualified second building inspector in view of the additional load that is anticipated within the next year in that Department. VOLUNTEER The Council was in favor of the City Manager's suggestion that a ASSIST WITH project be initiated to solicit, through the newsletter, help of TECHNICAL PROBLEMS: trained volunteer people living in the City, to assist the City in technical problems. He stated such a program has worked well in other Communities and felt this City has many skilled people willing to serve. VISIT TO Councilman Wiley reported on his visit to the new sewer plant site NEW SEWER PLANT: on Saturday, December 15, 1973 with Mr. Trapnell of the Utility Company, (Mayor Kiedis and Don Sheppard, Engineer, and presented a complete set of plans he had obtained for the Council's review. Another visit by the Council will be arranged for the latter part of January. Councilman Martino suggested that Howard Searcy, Engineer also attend and make a report to the Council on his findings and opinions. Council agreed and arrangements will be made by the City Manager as soon as possible. ITEMS BY THE MAYOR AND COUNCIL: Councilman DeLonga advised the lights at the tennis courts located at the High School were re- aimed. He commented on the article in the Week -Day newspaper regarding the unsightly condition behind Publix Shopping Center and was advised by the City Manager the City is doing everything they can to improve the situation. The City Manager indicated all ordinances are being adhered to in regard to this problem. The City Clerk was instructed to advise interested parties such as Mr. Pappalardo, Mr. Hardwick and the Holiday Inn of the time schedule regarding the public hearing and final passage of the Sign Ordinance. The Building Inspector was directed to inventory all the existing signs in the City against the proposed Sign Ordinance and determine what signs are non - conforming. Regular Meeting, December 20, 1973 ITEMS FOR DISCUSSION: Pag e 6 SALARY FOR 1. Motion was made, seconded and unanimously carried authorizing ANIMAL CONTROL .11 . WARDEN: the payment of the City's share for the salary for the Animal Control Warden according to the determination of the City Manager. 2. Motion was made, seconded and unanimously carried authorizing the payment for In -house schooling for Police Officers from Account ##08 -106, Overtime Account, Police Department. ADJOURNMENT.
