CITY OF PALM BEACH GARDENS
SEPTEMBER 7, 1972
The Regular Meeting of the City Council was held on Thursday,
September 7, 1972 in the Assembly Room at 10500 N. Military Trail,
Palm Beach Gardens, Florida. The meeting was called to order by Mayor
Wiley at 8:00 P.M. and opened with the Pledge of Allegiance to the Flag
ROLL CALL: Roll was called by the City Clerk and present were: Councilman
Dunbar, who arrived late because he was out of Town, Councilman Bonner,
Councilman DeLonga, Vice Mayor Kiedis and Mayor Wiley. City Manager
Robert Carlson and Attorney William Brant were present.
MINUTES: Minutes of the Special Meeting of August 24, 1972 were unanimously
approved on a motion by Councilman Bonner seconded by Vice Mayor Kiedis
Minutes of the Workshop Meeting of August 24, 1972 were unanimously
approved on a motion by Vice t:ayor Kiedis, seconded by Councilman
DeLonga.
REPORTS: The monthly reports from the Recreation, Public Works, Fire, Police,
Vehicular Maintenance and Building Departments were approved by the
Council. The following additional items in connection with the
monthly reports were noted.
Mr. Woody Dukes, Recreation Director was asked by the Council to modify
his report to include the name of the Recreation Intern, Mary Morton,
Mr. Dukes announced that he needed personnel to work in the Teen
Center during the afternoon hours, and that as yet, a new Recreation
Supervisor had not been hired.
Councilman DeLonga speaking in behalf of the North Palm Beach -Palm
Gardens Jaycees asked Mr. Dukes to order a plaque for them, at the
same time he was ordering one for the City, to present to Kim Chace in
recognition of her achievements as an Olympic participant in Munich,
Gernany, The Palm Beach Gardens High School is having a student
assembly next week and have invited the various Cities and the Jaycees
to honor her. The City will also, by proclamation, declare a Kim

WEEK -DAY Mr. Dukes was asked by Councilman DeLonga to determine whether the
NEWSPAPER: Week. -Day Newspaper would print our Newsletter and the list of adult
education courses to be offered at the High School.
LIGHTS AT
Public Works Director Leonard Devine announced the Plant Drive Ball

Park lights were scheduled to be installed the following day and the

lights on the shuffleboard courts would be wired in a week or two.
CLEANING OF
Thanks was conveyed to the Public Works Department by Councilman
BELLEWOOD
CANTAL:
DeLonga from the residents of the Bellewood Canal area for a job well
done on the cleaning of the canal.
CLEANING UP
Councilman DeLonga inquired about the status of cleaning up behind the

Publix Market and was informed by Mr. Devine that Mr. Garnett from
Bankers Life and Casualty Company has agreed to take the matter up with
Mr. MacArthur.
SAFETY
The Council directed the City Manager to have the Public Works Depart -

ment consider placing a safety barricade at either end of the bridge
on Military Trail where the sidewalks were installed, to prevent the
children from riding their bicycles into the canal.
CENTRAL FIRE
Mayor Wiley reported he had talked to Mr. Twitty, Architect for the
STATION DELAY:
Central Fire Station, and had requested in writing from him, an
explanation of why the delay in construction and when the City could
plan on occupying the building. A sample of the color to be used on
the outside will be painted somewhere on the building for the Council's
approval.
HYDRAULIC
Winfield Speers, Vehicular Maintenance Director, stated the hydraulic

lift, that had been authorized by the Council, would be installed when
the fire trucks were moved to the new Central Fire Station.
Building Official Robert Munsell thanked the Council for the flowers he
had received from them while he was in the hospital and also thanked
Chief Summers for taking over his job and assisting during his recovery,
m ent of Housing and Urban Development, stating the City of Palm

PETITIONS AND
CODVIUNICATIONS:
Mayor Wiley acknowledged receipt of the following communications from:
' LIGHTF-K)USE
1. Howard Searcy, City Engineer, in response to a request by the City
DRIVE
ImPROVErENTS:
Council regarding improvements to Lighthouse Drive: - sidewalks vs
widening of the street. Mr. Searcy recommended providing 51 wide
concrete sidewalks on both sides of Lighthouse Drive from the Railroad
to the Thompson River Bridge, at an estimated cost of $18,000 not
including engineering fees.
The Council directed the City Manager to ask Mr. Searcy to attend the
next workshop meeting and present his drawings, (that they had
previously requested him to prepare) showing a 30' wide road. Mr.
Collins and the residents residing in the area of Lighthouse Drive will
be notified of the meeting.
PALM BEACH
2. Palm Beach Cable TV giving a report of 121 complaints for the
CABLE TV:
month of July.
3. A resident complaining about Palm Beach Cable TV which after an
investigation by the City Iianager was found to be a computer mistake.
4. Advanced Communication Systems Marketing, Ltd. of Texas requesting
the City to write a letter of endorsement of Cable TV as they will be
conducting a promotional and educational presentation of their services.
Mayor Wiley stated his reply was that the City has had a franchise with
Palm Beach Cable TV since 1967 and that a letter of endorsement would
be contrary to the policy of the City. The Council concurred with his
answer and agreed they were very dissatisfied with Palm Beach Cable TV.
APPLICATION
5. Mrs. Carol Reid, Secretary to Representative Paul Rogers, in answer

to a request from the City for assistance in determining the status of

the Cities application for participating funds from the HEW program for
the acquisition of land, with a copy of a letter to Mr. Rogers from
Mrs. Pentigrass, Assistant to Congressional Relations of the Depart-
m ent of Housing and Urban Development, stating the City of Palm

Beach Gardens did not receive approval during the fiscal year 1972
because it did not rate well enough on the project selection system
relative to other applicants from the State of Florida. The Council
directed the City Manager to write to the Department in Jacksonville
requesting a complete list of all the Cities in the State of Florida
who were funded last year under this program and where we rated and
why we were not rated as well as the other Cities.
ADVISORY BOARD 6. A resident calling to the attention of the Mayor that Mr. Ted

Brown, who is in the Real Estate business, should not be a mev'ser of
the Planning and Zoning Commission because it is a conflict of interest
The Council directed the City Manager to write a letter to the resident
stating the Council is informed of the livelihood of each advisory
board member and that the Boards are staffed in such a way as to gain
the benefit of each members particular knowledge.
FLORIDA
7. Florida League of Cities, Inc. regarding the tax exempt status of
LEAGUE OF
CITIES:
Municipal bonds informing us that the responsiveness of the membership
of the Florida League of Cities measured in the success of defeating
this issue.
SCHWAB AND
8. Schwab and Twitty, Architects, of an application and certificiate
TWITTY:

for payment to Serraes Construction in the amount of $24,102.00. Motion
by Councilman DeLonga, seconded by Councilman. Bonner authorizing the
payment of $24,102.00 to Serraes Construction. Motion unanimously
carried.
TENNIS COURTS
Mayor Wiley announced he and Vice Mayor Kiedis had attended the Gator

Booster Club Kick -Off and were informed by Dr. Fissey that funds were
n ow available to pave the tennis courts at the high school, and asked
that the City initiate plans to provide lights, a project the Council

had previously agreed upon. The Council authorized City Attorney
William Brant to contact Dr. Eissey and draw up an agreement with the
school whereby the School Board would accept the installation of the

lights and also setting forth the hours and conditions that the
residents could use the courts.
RESOLUTIONS:
Discussion was held on Resolution #36, 1972 authorizing the use of one
mobile home trailer at the First Church of God. In answer to a letter
sent to each resident living within 200' of the proposed trailer
location, one communication was received from a Mr. Thompson who lives
on Holly Drive, expressing no objection. Mr. Murray Keller, 3930 Flag
Drive was in the audience and objected only to the fact that the
trailer could be visually seen from his residence. Mr. Davis, Chairman
of the Board of Trustees and spokesman for the Church agreed to provide
a barrier of a fence or shrubbery between the trailer and Mr. Keller's
residence, which was to Mr. Keller's satisfaction.
RESOLUTION #36
Resolution #36, 1972 authorizing the use of one mobile home trailer at
the First Church of God with an amendment to read, " and with suitable
buffering on the north side of the installation" was read by the City
Clerk on a motion by Councilman Dunbar, seconded by Vice Mayor Kiedis.
Resolution #36, 1972 as amended was adopted unanimously on a motion by
Councilman DeLonga seconded by vice Mayor Kiedis.
RESOLUTION #37
Resolution #37, 1972 appointing the Clerks and Inspectors for the
Special Election, October 3, 1972 was read by the City Clerk and
adopted on a motion by Councilman DeLonga, seconded by Councilman
Dunbar. The Council agreed that since this election is combined with
the County Election, no additional monies will be paid by the City to
the clerks and inspectors.
ITEMS BY THE MAYOR AND (D UNCIL:
VICE MAYOR
City Manager Robert Carlson informed Vice Mayor Kiedis he would contact
KIEDIS :
Rubin Construction Company regarding their equipment to clear the 10
acre tract adjacent to the Municipal Complex and he would determine if
the Public works Department had received estimates for resurfacing of
the Avenue of the PGA and Holly Drive.

POLICE Chief of Police herb Pecht was asked by the Council to determine and
ASSISTANCE
AT FOOT- notify Coach Neal if any members of the Police Department or the
BALL GAPS:
Reserves would be willing to give police assistance at the football
games and other activities at the Palm Beach Gardens High School. Vice
Mayor Kiedis will inquire next week of Dr. Eissey and Coach Neal if they
need any additional help to complete the interior improvements to the
concession stand, and if so, the Council may consider using Public Work,
manpower.
COUNCILMAN
The City Manager informed Councilman DeLonga the bids have been

Councilman DeLonga stated he had received complaints from residents

objecting to the junk newspapers infiltrating the City. The City
Manager reported the Week -Day Newspapers had informed the City it was
going to initiate a service to pick up their newspaper along with any
other newspapers thrown in the streets.
`- ADVISORY
Councilman DeLonga informed the Council that the terms of 3 members of
BOARDS:
the Recreation Advisory Board will expire on September 26th and the
term of one member of the Zoning Board of Appeals will expire in
October. The City Clerk was instructed by the Council to advise them
a month in advance when a vacancy will occur on a board and to notify
that particular board and ask for any recommendations they may have.
SEWER PLANT:
The Council directed the City Attorney to draft a letter to the
Governor's office concerning the condition of the sewer treatment
facilities.
Mayor Riley clarified the rule on political activity stating Ordinance
#4, 1972 Code of Ethics rules the City Council shall refrain from
political activity and the Merit System states the employees shall
refrain from political activity, however, these rules do not pertain
to members of the advisory boards.

ADJOURNMENT. No further business and the meeting adjourned on a motion by
Vice Mayor Kiedis, seconded by Councilman Dunbar. Time for the
