CITY OF PALM BEACH GARDENS
SEPTEMBER 14, 1972
The Workshop Meeting of the City of Palm Beach Gardens was held on
September 14, 1972 in the Assembly Room at 10500 N. itiiilitary Trail and
was called to order by Mayor Wiley at 8 :00 P.M. The meeting opened with
the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Councilman DeLonga,
Councilman Dunbar, Councilman Bonncr, Vice Mayor Kiedis and mayor Wiley.
City Manager Robert Carlson and Attorney George Baldwin were present.
MINUTES: Minutes of the Regular Meeting of September 7, 1972 were approved as
amended on a motion by Councilman DeLonga, seconded by Vice Nayor Ki e3is.
KIAM CHACE Mayor Wiley announced that he had attended the Special Assembly on
WEEK:
September 11, 1?72 at thePalm Beach Gardens High School to honor Kim
Chace, a participant in the Olympics, and had presented her with a
plaque from the City of Palm Beach Gardens and a Proclamation declaring
the week of September 11, 1972 as Kim Chace Week.
COMMENDATION Mayor Wiley commended the members of the Police Department, Public
Works Department and Volunteer Fire Department for their assistance and
timely action in an emergency when a gasoline tanker truck overturned
on PGA Foulevard.
REPORTS: A discussion was held on the status of the improvements to Lighthouse
LIGHTHOUSE Drive, a project initiated by the Planning and Zoning Commission and

IMPROVEMENTS: implemented by the City Council to correct a hazardous condition for
pedestrian and bicycle traffic on that street. At the request of the
City Council, Howard Searcy, City Engineer, presented aerial photos of
the area with base working drawings. He recommended providing 5' wide
concrete sidewalks on each side of Lighthouse Drive from the Railroad
to the Thompson River Bridge and along MacArthur Boulevard from Light-
house Drive to the Earman River, which would move pedestrians and
bicycles away from the traffic area and aesthically would provide an

attractive finished project. He stated the original instructions from
the Council did not include sidewalks, but the work completed thus far
had enabled him to determine that sidewalks could be put in without any
difficulty and without changing the grades of the driveway ramps. A
group of residents from the Lighthouse Drive area attended the meeting
and requested the speed limit be lowered and sidewalks be provided in
lieu of the widening of the street. Mayor Wiley polled the City Council
for their comments: Councilman DeLonga preferred widening the street to
24t, Councilman Bonner suggested a sidewalk on the south side as a #1
priority but hopefully on both sides, councilman Dunbar suggested
lowering the speed limit for a 3 month period, vice Mayor Kiedis
preferred a 51 sidewalk on the south side and Mayor Wiley proposed a
sidewalk on the south side and also lowering the speed limit.
MOTION: Motion by Councilman Bonner, seconded by Vice Mayor Kiedis to authorize
REDUCE
SPEED LIMIT: the City Attorney to draft an Ordinance for consideration at the next
Workshop Meeting to reduce the speed limit on Lighthouse Drive to 25
miles per hour from the North Palm Reach City limits to Dahlia Avenue.
Motion unanimously carried.
25 MILE HOUR The Mayor directed the Public Works Director to erect signs effecting a
SPEED LIMIT
SIGNS: 25 mile an hour speed limit on MacArthur Boulevard from the bridge to
Lighthouse Drive and on Lighthouse Drive from Dahlia Avenue
to the North Palm Beach City limits, and the Police Department to
enforce same. Attorney Baldwin ruled that the idayor, by executive order,
can increase or decrease the speed limits on the streets within the City.

The Council agreed to expand their workshop discussion to include speed
limitations on all streets in the City.
MOTION FOR Motion made by Vice Mayor Kiedis, seconded by Councilman Bonner to have

sidewalk on the south side of Lighthouse Drive from the Railrad tracks
to the Thompson River Bridge and to widen the road to 30* along the
section between the Railroad tracks and Holly Drive, also to include

sidewalks on both sides of MacArthur Boulevard from the Farman River
to Lighthouse Drive.
U MOTION TO Motion to table the above motion was made by Councilman Dunbar, seconded

by Councilman DeLonga. Vote on motion to table the motion - Councilman
Dunbar and Councilman DeLonga voted aye, Mayor Wiley, Vice Mayor Kiedis
and Councilman Bonner voted nay. Motion was defeated by a vote of 2
ayes and 3 nays.
Vote on the original motion - Councilman Dunbar and Councilman DeLonga
voted nay, Mayor Wiley, Vice Mayor Kiedis and Councilman Bonner voted
aye. Motion carried by a vote of 3 ayes and 2 nays.

the City Engineer be authorized to include in his studies a sidewalk
on the north side of Lighthouse Drive as a bid option. notion

TECHNICAL Howard Searcy explained the letter that the City had received from the
COORDINATING
COMMITTEE: Technical Coordinating Committee, West Palm Beach Urban Area Trans_
portation Study. Mr. Searcy is the City's representative on the
Technical Coordinating Committee and stated the Committee is requesting
assistance to update their 1990 plan to make sure as the development of
the Community changes and as population increases, any changes in the
highway network are brought to the attention of this Committee and
included in the plan. The elements under study that affect Palm Beach
Gardens are the ultimate location of I -95 and Military Trail extension.
The City Council authorized Mr. Searcy to meet with the Cityts Planning
and Zoning Commissicnto determine if any changes should be recommended.
APPLICATION Attorney Doyle Rogers, representing Mr. J.D.W. Blyth, addressed the City

PERMIT -MR. Council and asked for a solution to the moratorium ban to enable his

client to build a single family residence in the City. He
specifically asked the Council to make a committment to his client
allowing him to construct a home with a septic tank with the under-
standing that Mr. Blyth would obtain the approval from the State Board

of Health for the septic tank. Mayor Wiley stated the ban is based on
a recommendation to do so by the State Board of Health and that is the
only body that can make the determination from the health standpoint as
to the disposition of the waste water. He advised Mr.'Rogers that the
City is drafting a letter to the Governor to actively pursue a solution
to the problem.
SEPTIC TANKS: Councilman Dunbar and Vice Mayor Kiedis stated they would not be opposed
to Mr. Doyle going to the Health Department and requesting the use of a
septic tank. Councilman DeLonga said in the past the County's ground
rule for granting septic tanks is whervitere is an area of 1 acre or
greater and doubted if they would grant a permit for one. Councilman
Bonner was opposed to the use of a septic tank.
JERRY Jerry Browning, owner of a vacant lot in the City, who also wishes to

build a single family residence, told the City Council he had applied
for a septic tank and had been denied on the basis that the property in
question is presently served by a public water and sewer system. He
suggested the City lift the moratorium which would then force the Public
Service Commission to direct the Utility Company to provide adequate
treatment facilities under their certificate.
TENNIS Mrs. Carol Glantz addressed the Council and stated she represented some

30 women tennis players and requested that the City Council consider
building additional tennis courts. She explained the need for more
facilities based on the fact that there is usually a waiting line and
additional courts would allow more participation by both men and women.
Mr. Dukes, Recreation Director, endorsed the request. The City Council
agreed to consider the request at the budget discussions.
GASERRAMA: Mayor Wiley announced the North Palm Beach -Palm Beach Gardens ,Jaycees are
sponsoring a Gaserrama on Saturday, September 23, 1972 at the Lighthouse
Gulf Service Station, with the proceeds to go to the calm Beach Gardens
Teen Center.

REPORTS BY City Manager, Robert Carlson, reported on the following items:
CITY MANAGER:
PLANT DRIVE 1. The Plant Drive lighting project was moving along on schedule and
LIGHTS:
the target date for completion is September 25th.
SAFETY 2. The safety barriers on the walkway approaches to the bridge on the
BARRIERS:
west side of Military Trail are completed.
SHUFFLEBOARD 3. The lights on the shuffleboard courts and the installation of
additional light standards on the south slope of the Municipal Complex
will be completed by September 25th.
LIGHTS BEHIND 4. The City has officially requested the Florida Power and Light Company

to install street lights in the Publix Market - Garden East Boulevard area
and the sites will be selected as soon as Mr. Carlson and Mr. Allen from
the Florida Power and Light Company can meet.
COST ESTIMATE 5. The cost estimates on resurfacing certain streets in the City was

received from Mr. Devine, Public Works Director, at a cost of $2.25 a
lineal foot for a 241 wide area with 14" topping based on a contract
the County has with Rubin Construction Company that expires on September
30, 1972. Mr. Devine recommended paving from Seagrape Way west to the
Avenue of the PGA and north to PGA Boulevard at a cost of $19,946.00 with
first priority to a portion of the Avenue of the PGA between Seagrape
Way and Holly Drive and from the bridge between Tamberlane and the
Longwood Condominiums at a cost of $7,626.00 and the south side of Holly
Drive from I -95 west to ;dilitary Trail at a cost of $7,118.00
Mr. Bridges, a former employee of Rubin Construction Company told the
Council that another contract, not necessarily with Rubin, would follow
in October and that Rubin Construction Company is obligated to move for
$3000.00 a minimum of 200 tons per day at a cost of $11 or $12 a ton.
He also questioned the need for 150 lbs. for an overlay.
Council agreed to delay discussion on this at a future time but to
definitely include it in next years budget.

CLEARING 6. Mr. Carlson reported he was unable to get a confirmation on the

equipment to clear the 10 acres abutting the City Hall for another 5 or
6 weeks, as there is a problem of finding operators for the equipment.
COST 7. Mr. Carlson could not get cost estimates to install the lights at the

in the immediate vicinity of the courts. Council agreed to defer this
to the next meeting and also clarified the .fact they did not intend the
City to brine} the power to the tennis courts but only to provide for the
installation of the lights Ausing the lights the City has on hand. The
Council instructed Attorney Brant to include this in his agreement with
the School Board.
INSPECTION 8. Inspection Report #19 was received from Schwab and Twitty, Architects

& TWITTY: indicating progress to this date.
PETITIONS AND COPLMUNICATIONS:
A.,yor Wiley acknowledged receipt of the following communications:
ENCLOSE 1. Copy of a letter to Paul Twitty from Serraes Construction Company
FOYER AREA
regarding a request from the Council for cost estimates to enclose
the foyer area in the Municipal Complex as protection from the weather.
Approximate cost, $8,000.00, The Council referred this item to
budget discussions to be considered as a capital improvement in next
years budget.
CALLAWAY, 2. Communication from Auditors Callaway, Carpenter, r•1ay and Company

MAY: REPORT: who reviewed the City's financial records, at the termination of
employment of the City Clerk, and found them to be in order.
Gardens
PALM BEACH 3. Palm Beach/Woman's Club requesting that they be allowed to use the
WOMAN'S CLUB: new fire station when it is completed for bingo games and also asked for
consideration to hold a bingo game along with the barbecue at the opening
day ceremonies. This was referred to the Pire Department Committee in
charge of the opening day ceremonies.
VACATION 4. The communication from the Merit System Board recommending a change

Brant to prepare the proper ordinance.
PARK VILLAS 5. Park Villas Association pointing out various violations to the
ASSOC.:
ordinances of the City including trash behind the Publix Markets high
grass on vacant lots, black smoke from incinerators at Publix Market and
the Palm Beach Gardens Community Hospital. City Manager advised these
items had been taken care of and he will notify the Park Villas
Association of same.
ITEMS BY THE MAYOR AND CITY COUNCIL:
APPOINTMENT A memo from the City Attorney clarifying the hiring practices of the

T City was discussed by the Council. The subject of discussion was the
definition of a subordinate officer. Under the present City Charter the
City Council has the power to appoint the City Judge, Attorney, Engineer,
Auditor, City Clerk, Treasurer, Tax Assessor and Collector, and the City
Manager appoints all other subordinate officers subject to the
confirmation of the City Council. It was Mr. Brant's recommendation
that the Department Head and his immediate assistant be classified as
subordinate officers. Councilman Bonner, Councilman Dunbar and Vice
Mayor Kiedis considered it the City Managers total responsibility but
as a policy to keep the Council fully advised. The item was referred
to the next workshop meeting to determine if a resolution was needed
to clarify the definition of subordinate officer.
LITTER AT Mayor ۥ'iley informed the Council he had talked to Angel Naya, President
BALL PARK:
of the Palm Beach Gardens Youth Athletic Association regarding the
litter at Plant Drive Ball Park. Mr. Naya requested that the Public
Works Department not clean up the park on Monday, September 18, 1972.
The players in the Youth Athletic Association and their coaches will
clean the park on Saturday before starting the games.
ELECTION: Mayor Wiley commented on the poor turn out for the Election held

VICE MAYOR Vice Mayor Kiedis reported the glass on the bulletin board at Plant

Drive Ball Park was cracked and suggested replacing it with plastic or

of the teams.
1990 -92 Vice Mayor Kiedis reported that Mr. Charles Hyman and Mr. Dick Brumback
PRINCIPAL
HIGHWAY SYSTEM: from the County Engineerls Office had met with the Planning and Zoning
Commission to explain the County's 1990..92 Principal Highway System Plan
and were anxious to have the City Council cooperate with the County in
their ultimate right -of -way plan with resulting changes in setbacks.
COUNCILMAN In answer to Councilman Bonner's question as to the transformer for the

Monday.
POLITICAL Mayor Wiley announced there would be a political forum in the Council
