CITY OF PALM BEACH GARDENS
DECEMBER 7, 1972

The Regular Meeting of the City Council of Palm Beach Gardens was
called to order by Mayor Wiley at 8:00 P.M. on Thursday, December 7,
1972 in the Assembly Room, 10500 N. Military Trail and opened with
the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Councilman
DeLonga, Councilman Dunbar, Councilman Martino, Vice Mayor Kiedis
and Mayor Wiley. City Manager Robert Carlson and Attorney William
Brant were also present.
MINUTES: The minutes of the Workshop Meeting of November 30, 1972 and of the
Special Meeting of November 30, 1972 were unanimously approved by
the Council.
PRESENTATIONS: Mayor Wiley presented trophies and awards to the winners of the
Miss Palm Beach Gardens and Miss Junior Palm Beach Gardens Contest,
and thanked each one for their interest and participation.
ANNOUNCEMENTS: Mayor Wiley made the following announcements:
The Christmas In Dixie Parade will be held Sunday, December 10, 1972
at 2 :00 P.M.

The Christmas Tree Lighting Ceremony will be held Saturday,
December 16, 1972 at 7 :30 P,M. at the south slope of the City Hall.
The City float won first prize in the Jupiter Parade held Sunday,
December 3, 1972 and $100,00 in prize money.
V The Merit System Board Meeting scheduled for December 11, 1972 has
been cancelled.
The Planning and Zoning Commission Meeting will be held Tuesday,
December 12, 1972 at 8:00 P.M,
—� The Recreation Advisory Board Meeting will be held Tuesday,
December 12, 1972 at 8:00 P.M.

The Beautification and Environmental Committee meeting will be held
Wednesday, December 13, 1972 at 7:30 P.M.
NEWSLETTER: The Newsletter will be mailed to the residents no later than
December 22, 1972.
GENERAL Mayor Wiley announced receipt of the General Interest Program from the
INTEREST
PROGRAM: Department of Adult and Community Education listing the Adult
Education Winter Courses that are available.
REPORTS: The monthly reports from the Recreation, Public Works, Fire, Police,
DEPARTMENT: Vehicular Maintenance and Building Departments were approved by
the Council_
RECREATION: Councilman Martino suggested the Council consider the building of
another volley ball court at Plant Drive field. He also suggested
that more activities be planned for boys in the age group from 13 -18.
Mayor Wiley asked that the Recreation Director include in his report
the number of hours worked by the part time employees.
PUBLIC WORKS: The Public Works Director reported the cost to the City to prepare
the site for the tennis courts was approximately $273.00 and a
total saving of $5000 by using Public Works personnel and equipment.
INSURANCE CLAIM Councilman DeLonga expressed concern regarding an Insurance claim
WINFIELD SPEER:
for Winfield Speer. The Council instructed the City Manager to
investigate the problem and advise them what action should be Laken
on the part of the City.
ANNUAL REPORT: Mayor Wiley reported the City Manager will prepare an Annual Report
to be incorporated in the January or February Newsletter.
JUNIOR POLICE: City Manager noted receipt of reports from the Junior Police of their
POLICE RESERVESmeeting held November 6, 1972 and the Police Reserves who participated
in 14 patrol hours for the month of December.
TRI -CITY Mayor Wiley reported on the Tri -City Meeting held in North Palm

Beach on December 5, 1972. They discussed a Tri -City Animal Control,

a draft of the agreement to be placed on the Workshop Meeting agenda
for December 14, 1972; water and sewage treatment; Police and Fire
Communications - Mayor Wiley will prepare a summary of what has been
done in order to resume activities regarding common fire, police and
emergency facilities, coordination of Planning and Zoning and land use
and canal maintenance between Palm Beach Gardens and North Palm Beach.
The next meeting, which will be hosted by Palm Beach Gardens, will
be held in February or April.
PALM BEACH Mayor Wiley acknowledged receipt of a communication from the Palm
COUNTY MUNICIPAL
LEAGUE: Beach County Municipal League announcing their meeting Friday,
December 8, 1972 at 1:30 P.M. in the West Palm Beach City Commission
Room. The City Manager will attend. The Council instructed Mr.
Carlson, when discussion is held regarding a common fiscal year for
all Municipalities, to advise that the City would like to do its own
tax collecting.
SOUTHEASTERN Letter was acknowledged by Mayor Wiley from the Southeastern Regional
REGIONAL INSURANCE:
SERVICE Insurance Services Office in answer to liter from the City requesting
OFFICE:
an inspection of the City's fire defenses. The City Manager was
instructed to forward a copy of the letter to the Utility Company to
determine what their plans are to provide an elevated storage tank.
DEPARTMENT OF Mayor Wiley read a copy of a letter from the State of Florida,
POLLUTION CONTROL:
NE,partment of Pollution Control to the Palm Beach County Utility
Company dated November 30, 1972 regarding the sewage treatment plant.
Mayor Wiley stated that it was reported in the newspaper that Mr.
Trapnell had made application for a temporary operating permit to
the Board of Pollution Control and had not received confirmation that
it had been received.
KRMPER Letter was received from Kemper Insurance Company terminating the
INSURANCE
M—M AID contract with the City for Employee Group Insurance effective 12:01 A.M.

January 1, 1973 stating the reason being the incurred losses exceeds
the earned premiums. The City Manager reported he is awaiting
confirmation of extension of the terminating date to February 1, 1973.
The Council authorized the City Manager to prepare the bid
specifications to be presented at the next Workshop Meeting.
COUNTY
Letter was received by Mayor Wiley from Mr. Moreno, County Sanitation,
SANITATION:

requesting they be allowed to collect garbage in the residential area
starting at 6:00 A.M. instead of 7:00 A.M. Request was denied by
the Council but will be reconsidered when the silent type hydraulic
systems have been installed on their garbage packers.
MR. PETERSON:
Mayor Wiley stated he had received a letter from Mr. Curtis Peterson
who lives on Larch Avenue requesting a solution to cleaning the area
around the lake adjacent to his property. This was referred to Mr.
Devine, Director of Public Works.
AREA PLANNING
Letter was acknowledged by Mayor Wiley from Frank Brutt, Director,
BOARD:
Area Planning Board o$ a Public Hearing, Palm Beach County Area
Planning Board to be held December 21, 1972 at 1:00 P.M, in the
auditorium of the Central and Southern Florida Flood Control District,
West Palm Beach for the purpose of possible changes to the Service
Area boundaries and designation of Agent or Sub -Agent for sewage
treatment. The Palm Beach County Utilities Company is requesting
a designation of Agent or Sub - Agent. Mayor Wiley and the Mayors from
the surrounding communities plan to attend this meeting.
ITEMS FOR DISCUSSION:
PAYMENT TO
Motion made by Councilman Dunbar, seconded by Vice Mayor Kiedis and

piodified on a motion by Councilman DeLonga, seconded by vice Mayor
Kiedis authorizing the final payment to Serraes Construction Company
in the sum of $17,595.60, payment contingent upon verification by

the Auditor. Motion unanimously approved by the Council.

APPROVAL OF Council by unanimous approval confirmed the approval for the payment
BODY FOR 2
TONS of $1445.00 to Rowland Truck Equipment Company for the construction
of a body for the 2 ton Public Works Department Truck. This was on
a cooperative bid with West Palm Beach.
ITEMS BY THE CITY MANAGER:
WALKIE- TALKIE As a result of a recommendation from the Volunteer Fire Department,
RADIOS:
the Police Department and with the concurrence of the City Manager,
the Council authorized the purchase of 4 portable walkie- talkie
radios, the money to come from the Capital Improvements Account of the
Police Department. The City Manager advised that money had been
allocated in the Budget for the purchase of 2 walkie- talkies. The
additional radios will be used for crowd control situations.
ORDINANCES: Ordinance #19, 1972 establishing speed limits on various streets in
ORDINANCE #19 the City was read on second reading, by title only, by the City Clerk
SPEED_LIMITS:
and adopted on a motion by Councilman Martino , seconded by Vice
Mayor Kiedis. Vote on the motion 4 ayes and i nay. Councilman
Martino, Councilman DeLonga, Councilman Dunbar ano Vice Mayor Kiedis
voted aye, Mayor Wiley voted nay. Mayor Wiley state he favored the
Ordinance except for Holly Drive, which is a 2 lane divided parkway
and with the exception of school hours is opened on both sides and
should be 30 miles per hour speed limit.
ORDINANCE #20: Motion was made by Councilman DeLonga, seconded by Councilman Martino
REPEALING
ORDINANCE #14, to table the reading of Ordinance #20, 1972 repealing Ordinance #14,
. 1970, which imposed a moratorium on the issuance of Building Permits
within the City.
Motion was defeated by a vote of 3 nays and 2 ayes. Councilman
DeLonga and Councilman Martino voted aye - Mayor Wiley, Vice Mayor
Kiedis and Councilman Dunbar voted nay.
Councilman DeLonga stated his reasons for tabling the Ordinance were

that the Council has not workshopped the Ordinance, he was not
satisfied with the letter received from the Pollution Control Board,
the Council's action was premature and lifting the moratorium will not
provide the additional capacity that everyone is looking for.
Councilman Martino stated the possibility of a health hazard existing
had not been resolved to his satisfaction.
Vice Mayor Kiedis made a motion to read Ordinance #209 1972 as written.
Motion died for a lack of a second.
Mayor Wiley and Councilman Dunbar agreed the fourth paragraph stating
there presently exists approximately 502000 gallons daily hydraulic
capacity which can be utilized by additional hookups, be stricken from
the Ordinance.
Motion by Councilman Dunbar to read Ordinance #20, 1972 deleting
Paragraph 4, seconded by Vice Mayor Kiedis. Vote on motion -
Councilman DeLonga and Councilman Martino voted nay, Mayor Wiley,
Councilman Dunbar and Vice Mayor Kiedis voted aye. Motion carried
by a vote of three ayes and 2 nays.
The City Clerk read Ordinance #20, 1972 deleting Paragraph 4 on first
reading. Second reading will be at the Regular Meeting, December 21.
ADJOURNMENT. No further business and the meeting adjourned at 9.46 P.M.
