REGULAR MEETING OF THE CITY COUNCIL
April 28, 1969
REGULAR MEETING The regular meeting of the Council of the City of Palm
Beach Gardens was held on April 28, 1969 at 8 :00 P.M.,
3 704 Burns Road, Palm Beach Gardens, Florida. Mayor
Jewett presided.
QUORUM Mayor Jewett instructed the City Clerk to call the roll.
Present were: Councilman Bonner, Walker and Prentiss
and Vice Mayor Blanck and Mayor Jewett.
PUBLIC HEARING Mayor Jewett announced the Public Hearing and stated the
purpose of the hearing was to discuss with the Public
creation of a Comprehensive Planned Unit Development in
Section 12 in the N 4. Mr. Pappalardo who will be the
developer and builder along with John Stetson presented
pictures and views of the development. No objections
were raised.
PUBLIC HEARING Public Hearing on annexation of the NE-4 of Section 12,
owned by Mr. Altman was announced by Mayor Jewett and
discussion followed. Mayor Jewett stated this property
was located in the middle of the City and still was not
in the City. No objections and the Public Hearing was
closed. Time 8 :25 P.M.
MINUTES OF REGULAR Motion by Councilman walker, seconded by Vice Mayor Blanck

that the reading of the minutes of April 14, 1969 be

waived and approval be by each Councilman's signature.

ORDINANCE #8, 1969 Motion by Councilman Walker, seconded by Councilman

UF-3UMT7W-1,T-- Bonner to read on Second Reading by Title only Ordinance
#80 1969, annexing land in NE4 of Section 12 into the
limits of the City. Vote was 5 ayes and no nays. Mayor
Jewett- instructed the City Clerk to read Ordinance #8,
1969. Motion by Councilman Walker, seconded by Councilman
Prentiss to adopt as read. Mr. Altman's Attorney reported
that a problem had come up and wanted the Council to be
aware of this, explaining that at the present time there
was a house located on the property to be annexed. The
carport of the house was located on the 50 foot road
easement. He assured the Council Mr. Altman had agreed
to leave the deed in escrow with Attorney Brant with
the provision of no assessment on road for 2 years.
Council discussed the pros and cons also suggesting that
no time limit be stated but tie the removal of the
encrouchment in with building permit to be issued.
Councilman Bonner motioned to table pending on
presentation of an agreement between the City and Mr.
Altman, seconded by Vice Mayor Blanck. Vote 4 ayes and
1 nay. Mayor Jewett voted nay.
ORDINANCE #7, 1969 Motion by Councilman Walker, seconded by Councilman Prentiss

UNIT DEVELOPMENT to read in full Ordiance #7, 1969 as amended. Vote was
5 ayes and O nays. Mayor Jewett instructed the Clerk

to read Ordinance #79 1969. Motion by Councilman
V Walker, seconded by Councilman Bonner to adopt as read.
Mayor Jewett stated all drawings were on hand and would
be kept in file as part of Ordinance #7, 1969. Vote to
adopt 5 ayes and 0 nays.
RESOLUTION #18, 1969 Motion by Councilman Walker, seconded by Councilman Bonner
MEMBER to read Resolution #18, 1969 appointing a member to the
Recreation Advisory Board. The City Clerk was instructed
to read by Mayor Jewett. Motion by Councilman Bonner,
seconded by Councilman Walker to adopt. Vote 5 ayes
and O nays.
RESOLUTICN #19, 1969 Motion by Councilman Walker, seconded by Councilman
AGREEMENT FOR CODI-
FICATION Prentiss to read Resolution #19, 1969, entering into an
agreement for codification of Ordinances. Vote 5 ayes
and O nays. Mayor Jewett instructed the City Clerk to
read Resolution #19, 1969. Motion to adopt by Councilman
Walker, seconded by Vice Mayor Blanck. Vote 5 ayes and
0 nays.
ACCEPTANCE OF AUDIT Motion by Councilman Bonner, seconded by Councilman
ON RESIGNATION OF
B.A. POSTON Walker to accept the audit report as submitted by
Carpenter, Calloway and May on the resignation of
Bryan A. Poston, City Manager. Vote 5 ayes and O nays.
REPORT ON JUDGEMENT Attorney Brant reported on the Judgement in favor of

CAZEF"M POLICE the City and Herbert Pecht vs Jordan stating also that

a counterfile had been posted, which was a normal
�= procedure. The Council accepted with pleasure.
INTERCITY REPORT Mayor Jewett reported on the Inter City for the past
year, and stated he would like to see the Council contribute
more in the future to this worthy and busy organization.
PROCLANATICN LAW DAY Mayor Jewett read his proclamation for Law Day for May 1
and instructed the Clerk to post.
RESOLUTION #21, 1969 Councilman Bonner questioned what was being done in regards
SALE OF $300,000
BONDS to a bonding resolution for the Municipal Complex.
Attorney Brant informed the Council he did have a
resolution which he presented to Mayor Jewett. Motion
by Councilman Bonner, seconded by Councilman Walker to
read Resolution #21, 1969 authorizing sale of $300,000
revenue bonds. Vote 5 ayes and O nays. City Clerk was
instructed to read Resolution #21, 1969. Mayor Jewett
stated he was not opening the floor to the public as
the public had expressed opinions at the Public Hearing.
Motion to adopt by Councilman Walker, seconded by
Councilman Bonner. Discussion was held by the Council
and Mayor Jewett directed the City Clerk to poll the
Council which resulted in 3 ayes and 2 nays. Councilman
Bonner, Councilman Walker and Mayor Jewett voted aye
and Councilman Prentiss and Vice Mayor Blanck voted nay.

OPINION ON City Manager Carlson read the letter giving the City
PENSION PLAN
affirmation that everything was in order on the
Annuity Policy as presented by Attorney Brant as he
had reviewed the policy from Travelers Insurance Company.
ADJOURNMENT Motion by Councilman Walker, seconded by Councilman
Prentiss to adjourn.
