HomeMy WebLinkAboutMinutes Council 093068CITY OF PALM BEACH GARDENS REGULAR MEETING OF THE CITY COUNCIL September 30, 1968 REGULAR MEETING The regular meeting of the Council of the City of Palm Beach Gardens was held on September 30, 1968 and called to order by Mayor Bonner at 8:00 P.M. QUORUM Roll was called by the City Clerk with Vice Mayor Earle, Mayor Bonner, Councilman Brown and Walker present. Councilman Jewett arrived at 8:07 P.M. MINUTES Motion by Vice Mayor Earle, seconded by Councilman Brown that the reading of the minutes of the regular meeting of September 16, 1968 be waived and approval would be by each Councilman's signature. Vote was 5 ayes in favor and no nays. ZONING BOARD OF Regular meeting adjourned to hold Zoning Board of Appeals. Mayor APPEALS Bonner called the Zoning Board of Appeals with all Councilmen present. The following requests were considered by the Board: 1. Ord. #26 -1968, Creating Community Unit Plan, R -1 -T, was dis- cussed and Mr. Kelly revealed the layout of the Mobile Park. Councilman Jewett objected and Councilman Brown recommended the Board accept the Community Unit Plan, seconded by Councilman Walker. Voting was 4 ayes and one nay by Councilman Jewett. 2. Proposed change in the Zoning Map attached to Ordinance #21 -1968 was considered. Councilman Brown motioned to change map from C -1 to C -2 on the property as required by Mr. Schwenke; seconded by Vice Mayor Earle. Councilman Jewett stated he was not in favor of changing any zoning at the present time. Councilman Brown stated this was actually not a change but only putting the zoning back to where it had been previously. Voting in Minutes of Regular Meeting, September 30, 1968 Page 2 favor of the change was 4 ayes and one nay by Councilman Jewett. 3. Ordinance #21 -1968 - Zoning Ordinance opened for discussion. Sidewalks for multiple dwellings was brought up and reviewed. Vice Mayor Earle motioned to leave as is, seconded by Council- man Walker. Vote was 4 to 1. Vice Mayor Earle motioned that recommend adoption of the new Zoning Ordinance, seconded by Councilman Brown. Mr. Weaver of RCA stated for the record that Article V on page 42 on restaurants in industrial area with sale of malt beverages was an objection by his Company. Councilman Brown stated he had discussed this and also objected to this "use" provision on page 42. Voting on the recommendation for passage of Ord. #21 -1968 was 4 ayes and 1 nay be Councilman Jewett. 4. Ord. #22 -1968 - Granting conditional use of trailers to RCA for use at Industrial Plant was reviewed by Mayor Bonner and motion to recommend adoption was made by Vice Mayor Earle, seconded by Councilman Walker; voting 5 ayes and no nays. Mayor Bonner stated this concluded the Zoning Board meeting and that the Council had been sitting as the Zoning Board of Appeals in the past but when the new Zoning Ordinance #21 -1968 was passed the Council would appoint a Zoning Board of Appeals to sit for appeals and this would eliminate the Council from sitting as a judge and jury on appeals. ADJOURNMENT OF ZONING Adjournment of the Zoning Board of Appeals was 8:40 P.M. Public BOARD OF APPEALS & CONVENING OF COUNCIL Hearing was held by the Council to discuss the following: FOR PUBLIC HEARINGS 1. Ord. #24 -1968, 1968 -69 Budget, and recommended for passage after Mayor Bonner had presented the overall picture of what the 1968- 1969 Budget proposed, with unanimous approval. Minutes of Regular Meeting, September 30, 1968 Page 3 2. Ord. #26 -1968, Creating Community Unit Plan, R -1 -T, which was `J recommended by the Zoning Board of Appeals for approval. The City Council approved on a vote of 4 ayes and I nay. Councilman Jewett voted nay. 3. Ord. #21 -1968, Zoning Ordinance, had been approved and recommended by the Zoning Board of Appeals. The City Council discussed the Ordinance again and Vice Mayor Earle recommended it for adoption. Mayor Bonner polled the Council and approval was by 4 ayes and 1 nay. Councilman Jewett voted nay. Mr. Weaver of RCA again stated he objected to the establishment of eating places with sale of malt beverages for industrial areas. Councilman Brown agreed. 4. Ord. #22 -1968, Granting conditional usrof trailers to RCA at Industrial Park, was granted approval by the Zoning Board of Appeals and with no further objections, the City Council approved Ord. #22 -1968 on a 5 aye and no nay vote. PUBLIC HEARING MEETING Public Hearing meeting adjourned at 8:55 P.M. Mayor Bonner ADJOURNMENT & CONVENING OF REGULAR MEETING convened the Regular meeting. ORDINANCE #26,1968 Vice Mayor Earle made a motion to read Ord. #26, 1968, creating tQPFl .L-Y UNi'L' PLAN, R -1 -T Community Unit Plan, R -i -T by Title only on second reading seconded by Councilman Brown. Vote was 5 ayes and no nays to read. Mayor Bonner instructed the Clerk to read Ord. #26 -1968 by title only. Motion to adopt as read by Councilman Brown, seconded by Vice Mayor Earle. Voting was 4 ayes and 1 nay. Councilman Jewett voted nay. ORDINANCE #21 -1968 Motion by Vice Mayor Earle, seconded by Councilman Walker that ZONING ORDINANCE Ordinance #21 -1968, Zoning Ordinance, be read by title only on second reading. Voting 5 ayes and no nays to read. Mayor Bonner Minutes of Regular Meeting, September 30, 1968 Page 4 instructed the Clerk to read by title only. Motion to adopt Ord. #21 -1968, Zoning Ordinance, by Vice Mayor Earle, seconded by Councilman Walker. Councilman Jewett stated he did think the wording of Ord. #21 -1968 was a good and well thought out Ordinance, but he violently opposed the map, and heartily opposed this zoning. Councilman Brown added the zoning is the same as it had been for 4 years. Vice Mayor Earle agreed there was no change and not rezoning and suggested taking the map for better or worse. Mayor Bonner added the map had been studied in detail by the Zoning Commission. Councilman Brown and Mr. Weaver of RCA expressed their thoughts regarding "Conditional Use" re restaurant and sale of malt beverages in Industrial Area. Councilman Brown stated he was against restaurants and sale of malt beverages, but was in favor of the Zoning Ordinance and would so vote. Councilman Brown motioned to accept the recommendations made by the Zoning Board of Appeals, seconded by Vice Mayor Earle. Voting was 5 ayes and no nays. Typographical errors were corrected and approved on parking spaces from 2 to 1111. Vice Mayor Earle motioned to amend motion to adopt Ord. #21 -1968 with amendments, seconded by Councilman Walker. Vote was 4 ayes and 1 nay with Councilman Jewett voting nay. Mayor Bonner expressed personal thanks to Mr. Weaver and Mr. Kelly for the hours spent on Ordinance #21 -1968 and stated the Zoning Board as a whole were a well qualified group. ORDINANCE #22 -1968 Motion by Councilman Brown, seconded by Vice Mayor Earle, that Ord. CONDITIONAL USE OF TRAILER BY RCA #22 -1968, Conditional Use of Trailer, be read by title only on second reading. Voting was 5 ayes and no nays. On direction of Mayor Bonner, Ord. #22 -1968 was read by the Clerk by title only and adopted by the Council on a motion by Vice Mayor Earle, seconded by Councilman Walker. Voting was 5 ayes and no nays. Minutes of Regular Meeting, September 30, 1968 Page 5 ORDINANCE #24 -1968 Motion by Councilman Brown, seconded by Vice Mayor Earle, that 1968 -69 BUDGET Ord. #24 -1968, 1968 -69 Budget, be read by title only. Vote was 5 ayes and no nays. Ord. #24 -1968 was read by the Clerk by title only as directed by Mayor Bonner, and adopted by the Council on a motion by Vice Mayor Earle, seconded by Councilman Brown. Vote was 5 ayes and no nays. ORDINANCE #25 -1968 Motion by Vice Mayor Earle, seconded by Councilman Brown to read MERIT SYSTEM Ord. #25 -1968, Merit System, by title only on second reading. Vote was 5 ayes and no nays. Ord. #25 -1968, Merit System, was read by the Clerk by title only as directed by Mayor Bonner and adopted by the Council on a motion by Vice Mayor Earle, seconded by Councilman Brown. Vote was 5 ayes and no nays. RESOLUTION #29 -1968 Mayor Bonner introduced and explained Resolution #29,1968, which HOSPITAL PURCHASE AUTHORIZATION would authorize the purchasers of the Hospital to enter into possession of said Hospital for opening and operating on October 1, 1968. He reviewed an addendum attached to Resolution which stipulated the conditions of the sale and terms and conditions. Motion to read Res. #29 -1968, Vendee in Possession of Hospital, by Councilman Jewett, seconded by Councilman Brown. Res. #29 -1968 read by the Clerk as directed by Mayor Bonner and adopted on a motion by Vice Mayor Earle, seconded by Councilman Brown. Voting 5 ayes and no nays. Mr. Samson, President, stated he was in hopes of opening the Hospital by November 1, 1968, and explained there would be approximately 135 on payroll, with open house slated for some time the third week in October. ORDINANCE #27 -1968 Ordinance #27 -1968, Revising 1967 -68 Budget, was read on first reading BUDGET REV. by the Clerk on a motion by Vice Mayor Earle, seconded by Councilman Brown. Vote was 5 ayes and no nays. Minutes of Regular Meeting, September 30, 1968 Page 6 ORDINANCE #28 -1968 Vice Mayor Earle motioned to remove from Agenda, Resolution #28 -1968, RULES & REGULATIONS Rules and Regulations of Merit System, because of the lateness and resolution being a one and half hour reading, seconded by Councilman Brown. Voting was 5 ayes and no nays. Resolution #28- -1968, to be placed on Agenda for next Regular Meeting. ANY OTHER BUSINESS Motion by Vice Mayor Earle to amend beverage hours for Industrial area from 9:00 A.M. to 8:00 P.M., seconded by Councilman Walker. Voting was 5 ayes and no nays to place on m xt agenda. ADJOURNMENT No further business and motion to adjourn by Vice Mayor Earle, seconded by Councilman Brown. Time for the record 9:55 P.M.
