HomeMy WebLinkAboutMinutes Council 050867i u CITY OF PALM BEACH GARDENS REGULAR MEETING OF THE CITY COUNCIL May 8, 1967 REGULAR MEETING The regular meeting of the Council of the City of Palm Beach Gardens was held on May 8, 1967, at 8:00 P.M., at the City Hall, 3704 Burns Road, Palm Beach Gardens, Florida. Mayor Diamond presided. PLEDGE OF ALLEGIANCE Mayor Diamond led in the Pledge of Allegiance to the Flag. gUORUM At the direction of the Mayor, the roll was called. All Councilmen were present except Vice Mayor Hughes. It was explained that Vice Mayor Hughes would be absent for about a 90 day period. MINUTES Mayor Diamond stated that the reading of the minutes of the regular meeting of April 24, 1967 would be waived and approval would be by each Councilmanss signature. Motion by Councilman Earle, seconded by Councilman Brown, that the minutes of the Special Meeting of May 1, 1967, be read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read the minutes of the Special Meeting of May 1, 1967. Motion by Councilman Earle, seconded by Councilman Bonner, that the minutes of the Special Meeting of May 1, 1967 be approved as read by the Clerk. Vote was 4 -0 in favor of the motion. i Minutes of Regular Meeting of May 8, 1967 Page 2 DEPARTMENT REPORTS Mayor Diamond instructed the Clerk to read the department reports for the month of April as follows: Department of Public Safety, Building Department, Fire Department, Public Works Department, and Recreation and Parks Department. After the reading of the department reports, Mayor Diamond raised a question on the Department of Public Safety report, asking the reason for the number of businesses that were left open at night from time to time. He stated he would like for the Chief to investigate this and see if this could be minimized. ORD. #13 -1967 Motion by Councilman Earle, seconded by Councilman AUTHORIZING CONDITIONAL USES FOR CERTAIN Bonner, that Ord. #13 -1967, authorizing conditional GENERAL CONTRACTORS UNDER THE ZONING uses for certain general contractors under the zoning ORDINANCE FIRST READING Ordinance, be placed on first reading and read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Ord. #13 -1967. ORD. #14 -1967 Motion by Councilman Earle, seconded by Councilman REZONING OF PGA AREA FIRST READING Brown, that Ord. #14 -1967, rezoning of the PGA area, be placed on first reading and read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Ord. #14 -1967. After the reading of the Ordinance, Mayor Diamond stated that at the workshop Meeting on May 1, 1967, it was agreed by the Council that the rule concerning discussion of an Ordinance on first reading would be waived on Minutes of Regular Meeting of May 8, 1967 Page 3 Ord. #14 -1967. He then proceeded to turn the meeting over to Mr. Gene Armstrong for comments on the rezoning. After Mr. Armstrong's presentation, there were objections from residents of PGA Plat 1 relative to this rezoning. Mayor Diamond recognized various people for comments. After lengthy discussion on the matter, Mayor Diamond stated that further discussion and consideration would be taken up at the next regular Workshop Meeting on May 15, 1967. ORD. #15 -1967 Motion by Councilman Earle, seconded by Councilman REGULATION OF FIRE PERMITS Brown, that Ord. #15 -1967, regulating fire permits, FIRST READING be read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Ord. #15 -1967. PROCLAMATION BY CONTROL OF FIRES Mayor Diamond instructed the Clerk to read the Proclamation concerning fires during the period of drought and his request to ask all citizens not to start any fires until this condition subsided. ORD. #16 -1967 Motion by Councilman Earle, seconded by Councilman HEIGHT OF BUILDINGS IN C -1 Bonner, that Ord. #16 -1967, changing the height of CLASSIFICATION OF ORD. #1, THE ZdR NG buildings in C -1 classification of Ord. #1, the zoning ORDINANCE FIRST READING Ordinance, be placed on first reading and read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Ord. #16 -1967. Mayor Diamond again allowed discussion on first reading of this ordinance because it was a simultaneous request i Minutes of Regular Meeting of May 8, 1967 Page 4 by Mr. Gene Armstrong along with the request for rezoning of the PGA area. There were various comments from the audience relative to allowing 5�j stories or 75 feet in the C -1 district. Several people voiced objections to this. Mayor Diamond stated that this would be brought up for further discussion at the next regular Workshop Meeting May 159 1967. RES. #24 -1967 Motion by Councilman Earle, seconded by Councilman AFPOIPTiNG A ZONING Lbblvu AND Bonner, that Res. #24 -1967, appointing a zoning commission SETTING FORTH THEIR DUTIES and setting forth their duties, be read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Res. #24 -1967. Motion by Councilman Brown, seconded by Councilman Bonner, that Res. #24 -1967 be adopted as read by the Clerk. On the discussion of the motion, Mrs. Mildred Peters voiced objection to two members on the zoning commission, Mr. Jerome Kelly and Mr. Lindquist. She stated she felt there were other persons far more capable to serve than these two gentlemen. There being no further dis- cussion, Mayor Diamond called for a vote on the motion. The vote was 4 -0 in favor of the motion. RES. #25 -1967 Motion by Councilman Earle, seconded by Councilman AUTHORIZING THE MAYOR AND CLERK TO SIGN A Brown, that Res. #25 -1967, authorizing the Mayor and CONTRACT TO TRADE TEN - OF LAND AND Clerk to sign a contract to trade ten acres of land and PURCHASE AN ADDITIONAL purchase an additional ten acres of land, be read by the i Minutes of Regular Meeting of May 8, 1967 Page 5 Clerk. Vote was 4 -0 in favor of the motion. Motion by Councilman Earle, seconded by Councilman Bonner that Res. #25 -1967 be adopted as read by the Clerk. On the discussion of the motion, Mayor Diamond informed the audience of the contents of the contract and pointed out the location of the new 20 acre tract. There being no further discussion, Mayor Diamond called for a vote on the motion. Vote was 4 -0 in favor of the motion. RES. #26 -1967 Motion by Councilman Earle, seconded by Councilman RECOGNIZING MAY 20t 19671 AS ARMED'FORCES Bonner, that Res. #26 -1967, recognizing May 20, 1967 MY as Armed Forces Day, be read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Res. #26 -1967. Motion by Councilman Bonner, seconded by Councilman Earle, that Res. #26 -1967 be adopted as read by the Clerk. Vote was 4-0 in favor of the motion. OLD BUSINESS Motion by Councilman Bonner, seconded by Councilman AWARDING LOW BID ON TENNIS COURTS TO Earle, that F.C. Feiss & Company be recognized as the F.C. FEISS & CO. low bidder for the construction of two tennis courts for the City in the amount of $3,750 per court. On the discussion of the motion, it was pointed out that this did not include wiring and fencing, but only the con- struction of the courts, also that F.C. Feiss & Company be instructed at a later date as to when construction would take place. Vote was 4-0 in favor of the motion. Minutes of Regular Meeting of May S, 1967 LETTER FROM THE STATE BOARD OF HEALTH RE: TAMBERLANE REPORT ON THE TRIP TO TALLAHASSEE BY RESIGNATION OF THE FIRM OF MASON & GILDAN, QITY ATTORNEYS Page 6 Mayor Diamond read a letter addressed to the Council from Mr. Lawrence Lukin, P.E. from the local Board of Health stating that the construction of another unit in Tamberlane along the Avenue of the PGA would not fall under the restrictions as set forth in a previous letter from Mr. Miller, Director of the State Board of Health, Jacksonville, Florida. Mayor Diamond instructed the Manager to issue the permit in accordance with this letter. Mayor Diamond informed the Council and audience that he, Mr. Gildan, and Mr. Poston made the trip to Tallahassee and gave a detailed report of the events as they took place with regards to the new City Charter. He con- cluded by saying that had the trip not been made, the proposed Charter would not have been introduced by our local Delegation. Mayor Diamond read a letter from Mr. Will A. Nason tendering the resignation of the firm of Nason & Gildan as the City Attorneys. Mayor Diamond commented that he would like to discuss this matter further before either accepting or rejecting the letter of resignation. ADJOURNMENT Motion by Councilman Earle, seconded by Councilman Brown, that the meeting be adjourned. Vote was 4 -0 in favor of the motion. The meeting was adjourned at 11:45 P.M.
