HomeMy WebLinkAboutMinutes Council 052267i CITY OF PALM BEACH GARDENS REGULAR MEETING OF THE CITY COUNCIL May 22, 1967 REGULAR MEETING The regular meeting of the Council of the City of Palm Beach Gardens was held on May 22, 1967, at 8;00 P.M., at the City Hall, 3704 Burns Road, Palm Beach Gardens, Florida. Mayor Diamond presided. PLEDGE OF ALLEGIANCE Mayor Diamond led in the Pledge of Allegiance to the Flag. Ufa ORUM At the direction of the Mayor, the roll was called. All Councilmen were present except Vice Mayor Hughes. MINUTES Mayor Diamond stated that the reading of the minutes of the regular meeting of May 8, 1967 would be waived and approval would be by each Councilman's signature. ADJOURNMENT FOR Motion by Councilman Bonner, seconded by Councilman Earle, PUBLIC HEARING AND CONVENING OF that the regular meeting of the Council be adjourned so as ZONING BOARD OF �� PEALS to convene the Zoning Board of Appeals, and hold a Public Hearing on proposed Ord. #10 -1967, rezoning the northwest corner of PGA Boulevard and Inter - coastal Waterway from R -12 One Family District, to C -2, Commercial District, to allow the construction of a dry storage marina; proposed Ord. #11 -1967, rezoning a parcel of land between Riverside Drive and Ironwood, adjacent to the elementary school from O & R, Office and Research, to R -2, Two Family District, to allow the construction of a nursery school and dwelling; and proposed Ord. #12 -1967, changing front setbacks in M zone, Industrial District, to 25 feet to conform with structures Minutes of Regular Meeting May 22, 1967 Page 2 already in existance. Vote was 4 -0 in favor of the motion. Mayor Diamond opened the floor for discussion. There being no objections to the proposed rezoning, Mayor Diamond asked for a motion to adjourn the meeting. Motion by Council -Rn Bonner, seconded by Councilman Earle, that the meeting of the Zoning Board of Appeals be adjourned at 8:14 P.M. to reconvene the regular meeting to consider the passage of Ord. #10 -1967, Ord. #11 -1967, and Ord. #12 -1967. Vote was 4 -0 in favor of the motion. ORD. #10 -1967 Motion by Councilman Bonner, seconded by Councilman Earle, REUNING OF NORTHWEST CORNER that Ord. #10 -1967, rezoning the northwest corner of PGA DF—PGA BLVD. AND TER- T Boulevard and Inter - coastal Waterway be placed on second WATERWAY - SECOND READING2 BY reading and read by title only. Vote was 4 -0 in favor of the TITLE ONLY motion. Mayor Diamond directed the Clerk to read Ord. #10 -1967 by title only. Motion by Councilman Bonner, seconded by Councilman Brown, that Ord. #10 -1967 be adopted as read by the Clerk by title only. Vote was 4-0 in favor of the motion. ORD. #11 -1967 Motion by Councilman Brown, seconded by Councilman Earle, REZONING OF A PARCEL OF LAND BETWEEN that Ord. #11 -1967, rezoning of a parcel of land between RIVERSIDE DRIVE AND IRONW 2 ADJACENT Riverside Drive and Ironwood, adjacent to the Elementary TO THIS. ELMEN= SCHOOL - SECCND School, from O & R, Office and Research, to R -2, Two Family READING - BY TITLE ONLY District, be placed on second reading and read by title only by the Clerk. Vote was 4-0 in favor of the motion. Mayor Diamond instructed the Clerk to read the Ordinance by title only. Motion by Councilman Earle, seconded by Councilman Brown, that Ord. #11 -1967 be adopted as read by the Clerk by title only. Vote was 4 -0 in favor of the motion. i Minutes of Regular Meeting May 22, 1967 Page 3 ORD. #12 -1967 Motion by Councilman Earle, seconded by Councilman Brown, CHANGING THE FRONT SETBACKS IN M ZONE that Ord. #12 -1967, changing the front setbacks in M Zone, SECUO READMG, BY TITLE UKLY Industrial District, be placed on second reading and read by title only. Vote was 4 -0 in favor of the motion. Mayor Diamond instructed the Clerk to read Ord. #12 -1967 by title only. Motion by Councilman Earle, seconded by Councilman Brown that Ord. #12 -1967 be adopted as read by the Clerk by title only. Vote was 4 -0 in favor of the motion. PROPOSED ORD. #15 -1967 Motion by Councilman Earle, seconded by Councilman Bonner, WHICH BECOMES ORD. #13 -1967 that proposed Ord. #15 -1967, which becomes Ord. #13 -1967, CONTROL OF FIRES, SECCND Y control of fires be placed on second reading, and read by TIT" U14LY title only. Vote was 3 -1 in favor of the motion. Councilman Brown cast a negative vote. Mayor Diamond instructed the Clerk to read Ord. #13 -1967 by title only. After the reading of the Ordinance, there was considerable discussion on the interpretation of the Ordinance. Councilman Bonner stated he felt the Ordinance, in its present form, would prevent residents from having outdoor barbecues without a permit. Motion by Councilman Bonner, seconded by Councilman Earle, that the Ordinance be tabled for further study and brought back to the Council in amended form. Vote was 4 -0 in favor of the motion. LETTER OF Mayor Diamond stated that a letter of resignation from the WESIGNATION FROM NASCN.AND firm of Nason & Gildan, City Attorneys, had been read at the G.ILDAN, CITY, ATTORNEYS last regular meeting, but had been tabled for further study by the Council before they would accept or reject the resignation. He proceeded to read the letter to the audience. Motion by Councilman Earle, seconded by i Minutes of Regular Meeting May 22, 1967 Page 4 Councilman Bonner, that the resignation be accepted with regrets. Vote was 4 -0 in favor of the motion. RES. #27 -1967 Motion by Councilman Earle, seconded by Councilman Brown, APPOINTING THE FIRM OF JOHNSCKj JOHNSON, that Res. #27 -1967, appointing the firm of Johnson, Johnson, BR Tt ACKERMAN A'S CITY ATTORNEY5 Brant, and Ackerman as City Attorneys, be read by the Clerk. Vote was 4 -0 in favor of the motion. Mayor Diamond in- structed the Clerk to read Res. #27 -1967. Motion by Councilman Earle, seconded by Counci.lwnLn Brown, that Res. #271967 be adopted as read by the Clerk. On the discussion of the motion, Mayor Diamond recognized Mr. Jewett. He complimented the Council on the selection of City Attorney, Mr. Brant. There being no further discussion, Mayor Diamond called for the vote. Vote was 4 -0 in favor of the motion. RES. #28 -1967 Motion by Councilman Brown, seconded by Councilman Earle, APPOINTING THE FIRM OF ADLEY ASSOCIATES, INC. that Res. #28 -1967, appointing the firm of Adley Associates, AS ZONING CONSULTANTS Vol* THE CITY, AND Inc., as Zoning Consultants for the City, and authorizing XOR AND CITY CLERK TO ENTER the Mayor and City Clerk to enter an agreement marked AN AGREEMENT MARKED EXHIBIT A Exhibit A, be read by the Clerk. Vote was 4 -0 in favor of the motion. Motion by Councilman Earle, seconded by Councilman Bonner, that Res. #28 -1967 be adopted as read by the Clerk. Councilman Bonner asked the amount of compensation Adley Associates, Inc., would receive from the City. The City Manager then read the Agreement, Exhibit A, to the Council and audience advising that compensation would be not more than $2,600 and listing the number of meetings to be held with the Zoning Commission and the number of public Minutes of Regular Meeting of May 22, 1967 Page 5 hearings that would be held. There was lengthy discussion as to whether five meetings with the Zoning Commission and one public hearing would be enough to complete the zoning of the City. The City Manager was advised to contact Mr. Dake, of Adley Associates, to find out what additional costs there would be for other meetings if they were needed. There being no further discussion, Mayor Diamond called for a vote on the motion. Vote was 4 -0 in favor of the motion. OLD BUSINESS Mayor Diamond read a letter from Mr. J. B. Miller of the Florida State Board of Health advising that they would be glad to supply the City Engineer, K. C. Mock & Associates, with information pertaining to the water and sewer plant and suggested that a representative of K.C. Mock & Associates come to Jacksonville for this purpose. The Manager also advised that a letter had been written to the water company asking for their assistance in giving Mr. Searcy the informa- tion he needed, but to date, no answer had been received. Councilman Bonner stated there were many bad problems at the storm drains in the streets in the Plat 3 road construction area that were difficult to see at night. He asked the Manager what was being done to correct this situation. The Manager advised that posts were being installed and painted white and reflectors would be added to them and placed near the drains as a safety precaution. Councilman Earle asked the Manager what the cost had been to the City for removing the footbridge at the Barman River Minutes of Regular Meeting of May 22, 1967 Page 6 �. and Military Trail. He was advised that the cost was $485.00. The Manager was also asked if there were any new develop- ments on the trade of the City's 10 acres of land and the purchase of an additional 10 acres of land. He advised that he had met with the parties concerned and that they would give us an answer on Friday. NEW BUSINESS The Manager informed the Council that the County Zoning Board had received a petition from Lindsey Jarrell for rezoning of a parcel of land East of RCA and located on Alt. AIA from R -1 -A to R -2 to allow multiple unit dwellings. They requested a letter from the City stating the City would not object. On the discussion of the subject, Mayor Diamond instructed the Manager to inform them that the City would not issue such a letter, and further, that the Manager be present at the hearing to discuss with the Zoning Board, the City's position in the matter. Woodrow Dukes, Parks & Recreation Director, reported to the Council on the progress of the committee that is going to undertake the 4th of July celebration in the City. After considerable discussion, the Council advised Mr. Dukes and members of the committee to proceed and complimented them on their efforts to date. Mr. Dukes also informed the Council and audience that Wednesday, May 31st, would be Government Education Day in the City. Students from Howell Watkins Junior High School i Minutes of Regular Meeting of May 22, 1967 Page 7 had been appointed by their student council to hold positions in the City. This would take place between the hours of 10 :00 A.M. and 12 :00 Noon on May 31st. Mr. Dukes stated this was an attempt to educate our future citizens in the operation of public administration. Mayor Diamond gave his approval to this program and asked that it be conducted as scheduled. There was a question from a person in the audience as to whether contractors having the privilege of conditional use in R -1 zoning should be allowed to sell furniture from these premises. Mayor Diamond instructed the Manager to investigate this and report back to the Council. ADJOURNMENT Motion by Councilman Bonner, seconded by Councilman Earle, that the meeting be adjourned.
