HomeMy WebLinkAboutMinutes Council 012466CITY OF PALM BEACH GARDENS MINUTES OF REGULAR MEETING OF CITY COUNCIL HELD ON MONDAY, JANUARY 24, 1966 The regular meeting of the City Council was held at the Meridian Park Clubhouse, Palm Beach Gardens, Florida, on Monday, January 24, 1966, at 5:00 o'clock P.M. MEETING CALLED Mayor Ted Dela Court called the meeting to order. After TO ORDERS QUORUM: calling the roll, the City Clerk announced that a quorum of the City Council was present. Councilman James F. Kelleher was absent. MINUTES OF MEETINGS Councilman Michael E. Jackson questioned the advisability OF CITY COUNCIL: of reading and approving the minutes of previous meetings which had not been signed by all of the Councilmen, with specific ref- erence to the special meetings of the City Council held on December 17, 1965 and December 30, 1965. A motion by Ted Dela Court that all min- utes of meetings held up to and including December 10, 1965 be ac- cepted, was duly made, seconded and unanimously adopted. UTILITY LEASE AND Councilman Horace S. Miller read a letter dated January 17, FRANCHISE AGREEMENT: 1966 addressed to the Mayor and City Council from Bankers Life and Casualty Company, notifying the City that the Utility Lease and Franchise Agreement would be terminated sixty days hence and re- questing the City to enact a franchise ordinance. Councilman Miller then reviewed the history of the agreement between Bankers Life and Casualty Company and the City, and stated that such an ordinance was being prepared for early presentation to the City Council. Minutes of Regular Meeting of City Council of January 24, 1966 Page 2 LETTER FROM KENNETH The City Council was presented with a letter from Mr. P. FOSTER; LETTER FROM MR. JO" D. Kenneth P. Foster dated January 24, 1966, inquiring about annexation MacARTHUR: — to the City of certain property owned by himself and Mr. Stanley N. Howard. This letter, and accompanying survey, are attached hereto as Exhibit "A" and made a part hereof. A letter from Mr. John D. MacArthur, dated January 18, 1966, concerning a proposed girls' school and annexation to the City of the property on which it might be located, was also read to the City Council. Councilman Miller commented on these letters, and stated that the properties in question could be annexed to the City since they were within three miles of existing city limits. Upon motion duly made, seconded and unanimously adopted, these letters were taken under advisement. VARIANCE ON The City Council, acting as the Zoning Board of the City, HEIGHT OF BUILDINGS IN MERIDIAN PARK; again took up the petition of Phillips, Inc. - Builders, a Florida REgUEST MADE; RESOLUTION: corporation, for a variance on the height requirements in MERIDIAN PARK, first discussed at the meeting held on January 10, 1966. It was explained to the Council that any building constructed over two stories would be equipped with elevators. Whereupon, the following resolution was duly made, seconded and unanimously adopted: BE IT RESOLVED by the City Council of Palm Beach Gardens that the Petition of Phillips, Inc. - Builders, a Florida corporation, the owner and contractor of MERIDIAN PARK, a subdivision located within the City of Palm Beach Gardens, Florida, that zoning and building height requirements in MERIDIAN PARK be, and the same hereby are, varied to permit the construction of a three -story multi - residential building, on condition that any building constructed in excess of two stories be equipped with automatic, self- operating elevators. Minutes of Regular Meeting of City Council of January 24, 1966 Page 3 VARIANCE ON SET- The City Council was informed that Mr. and Mrs. Al Zuran BACK IN MERIDIAN PARK; REQUEST and Mr, and Mrs. Howard Varall had petitioned the City Council MADE; ION: acting as the Zoning Board of the City, for a variance on setback requirements in MERIDIAN PARK. Upon motion duly made, seconded and ORMA unanimously adopted, it was RESOLVED, that this Petition be presented at the next earliest City Council meeting and that notice of hearing on this Petition be advertised in such cases provided. PUBLIC WORKS DE- Councilman Miller requested authority to fill a vacancy in PARTMENT; VACANCY: the City's Public Works Department by hiring a qualified person on a three -month probationary basis. He was informed that he already had such authority. SUIT AGAINST There was a discussion concerning the suit which had been CITY OF PALM BEACH GARDENS; instituted against the City of Palm Beach Gardens for an alternative ORDINANCE O -K: writ of mandamus by two homeowners, calling for, inter alia, the voiding of Ordinance O -K. Councilman Miller informed the City Council that Mr. John D. MacArthur had agreed to underwrite the expenses of the City in defending this suit. Likewise, Councilman Miller informed the City Council that selection of legal counsel to represent the City in this action should be left up to Mr. MacArthur, since he would be paying all costs of the defense.
