HomeMy WebLinkAboutMinutes Council 031666CITY OF PALM BEACH GARDENS MINUTES OF SPECIAL MEETING OF CITY COUNCIL HELD ON WEDNESDAY, MARCH 16, 1966 Upon call of the Mayor, a special meeting of the City Council of Palm Beach Gardens was held at 8:30 o'clock P.M., on Wednesday, March 16, 1966, at the Meridian Park Clubhouse, Palm Beach Gardens, Florida. QUORUM: Mayor Ted Dela Court called the meeting to order and the City Clerk called the roll of the City Councilmen. Councilman James F. Kelleher was absent. The Mayor announced that a quorum was present. LETTER OF THANKS Councilman Miller moved, and it was seconded by Councilman TO THE ELECTION BOARD Cargill that a letter of thanks be sent to members of the Election PETITION OF FLORIDA POWER & LIGHT COMPANY FOR REZON- ING OF PROPERTY: L Board who had served so faithfully during the recent general election. The motion was unanimously passed and the Mayor was directed to send said letter of thanks. Councilman Jackson then read a petition from the Florida Power & Light Company requesting rezoning of the following described real property from Zoning Classification "C -2" to Zoning Classification "M," to -wit: The north 230 feet of the south 280 feet of the east 200 feet of the west 250 feet of Section 1, Township 42 South, Range 42 East, in the City of Palm Beach Gardens, Palm Beach County, Florida, Said petition is attached hereto and made a part hereof as Exhibit "A." Minutes of Special Meeting of City Council Held March 16, 1966 Page 2 Councilman Miller recommended that the Council give favorable consideration to the request and explained the location of the proposed change in zoning. It was moved, seconded and unanimously agreed that the City Clerk advertise the proposed change in zoning pursuant to the requirements of law. APPOINTMENT OF Upon motion duly made, seconded and unanimously adopted, POLICE OFFICERS; OATHS OF OFFICE: the appointment of the following men as police officers of Palm Beach Gardens was made, ratified and confirmed: Herman J. Ridgeway, Leon H. Crawford, Fred Slade, George P. Pasaka, Robert J. Kelly, Alfred J. Zuran, James A. Korn, Joe C. Crocker, George S. Okell, Jr., James L. Howell, James Aliff, and John J. Rosati. The oaths of office of each officer is attached hereto. INTERIM LEASE After a general discussion of the subject, it was moved, ',—i AND OPERATING AGREEMENT OF THE seconded and unanimously agreed an interim agreement for the con - UTILITIES SYSTEM: tinuation of the utilities franchise agreement originally entered into on the 1st day of January, 1966, which was terminating by virtue of notice properly given therein, be arranged to continue on with the following changes in the agreement; that there be no provision for termination of the lease and franchise agreement other than the agreement would automatically terminate either upon the effective day of the franchise granted in Ordinance 0 -N, or December 31, 1966, whichever occurred first. PROPOSED ORDINANCE Councilman Jackson for the second and final time read 0 -N; SECOND READING AND PTION: proposed Ordinance O -N, which was first read at the meeting held Minutes of Special Meeting of City Council Held March 16, 1966 TRAFFIC CONTROL LIGHT AT ALTERNATE A -1 -A AND LIGHT- HOUSE DRIVE: LMM Page 3 on March 7, 1966, by title only. This Ordinance is an Ordinance of the City of Palm Beach Gardens, Florida, granting an exclusive franchise to Palm Beach Gardens Utility Company, a Florida cor- poration, to operate and maintain a water supply and distribution system, sewage collection and disposal system, and gas distribution system in the City of Palm Beach Gardens, Florida; setting forth conditions and privileges accompanying the grant of franchise; providing for rates and charges, and for service standards; pro- hibiting the use of individual sewage disposal systems and /or septic tanks within the City limits; providing penalties for the violations of such provisions; and for other purposes. There being no objection thereto, it was moved, seconded and unanimously adopted that the Ordinance be passed, ratified and affirmed to take effect as provided therein. Councilman Miller read a letter from the State Road De- partment concerning the traffic light at Lighthouse Drive and Alternate A -1 -A, a copy of which is attached, made a part hereof, incorporated herein by reference and marked Exhibit "B." Councilman Miller presented three bids for the traffic light and moved the Mayor review in detail and accept the best bid, reporting the decision on the best bid to the Council for ratification. The motion was seconded by Councilman Jackson. The motion was unanimously adopted. Minutes of Special Meeting of City Council Held March 16, 1966 Page 4 LETTERS OF COM- Mayor Dela Court presented letters from various businessmen MENDATION FOR THE CITY'S EFFORTS ON throughout the area which expressed their appreciation for the BEHALF OF THE YMCA: City's efforts on behalf of the YMCA. He said he would file these letters in the City records. ADJOURNMENT: It was moved, seconded and unanimously agreed to adjourn the meeting. L'Amoreaux, Engineer of Traffic and Planning SUBJECT: SPEED ZONE STUDY - SR S -809 - Section 93600 - Palm Beach Gardens - Palm Beach County. I. ORIGIN AND NATURE OF REQUEST: The District Traffic and Planning Department conducted a speed zone study for the purpose of establishing a safe and realistic speed restriction zone on SR S -809. II. FACTS OBTAINED BY FIELD STUDY: A. The studied portion of SR S -809 lies in Section 93600 and extends from SLD MP 50.000 to SLD MP 52.013, a distance of 2.013 miles. B. The roadway width across this section is 24 feet, permitting one lane of travel each way in a north -south direction. C. The roadway is relatively level with no horizontal curves. Sight dis- tance is adequate. D. Roadside culture along the studied roadway is residential and commercial. E. Records of this office show the 1964 ADT along the studied portion of SR S -809 to be 4,663 vehicles. F. Page 2 G. The existing posted speed limit along the studied portion is 35 Records of this office show we have no approval by the State Road Board for this portion of SR S -809. The posted speed north and south of this section is 45 MPH. H. According to the records of the Department of Public Safety, there were two accidents in a 12 -month period ending December 31, 1964, causing an estimated $300 in property damage; no injuries reported. III. ANALYSIS: A. The above results and the speed distribution at each check point indicate that a speed zone restriction is needed and warranted. B. Field examination determined definite points of speed change and driving tests of the recommended speed zone showed them to be reasonable and safe. IV. RECO10=ATIONS: In order to provide reasonable and safe speed restriction zones on SR S -809, it is recommended that the following be approved: Counter Road Location Recommended Regulation P&M Teach X09 Section 93600 - From SLD MP 50.000 to SLD MP 52.013, a distance of 2.013 miles. 45 MPH - Speed Zone �-✓ V. ENGINEERING: To be performed by the State Road Department: A. Erect speed limit signs marking the speed restriction zone as de- scribed above, with appropriate signs at appropriate intermediate locations in accordance with the Manual on Uniform Traffic Control Devices; and remove existing conflicting and or non - standard speed limit signs. B. Erect standard STOP signs on all intersecting streets where such signs are not now in place; and where, in the opinion of the Maintenance Engineer, such signs are warranted. C. Remove any non - standard and /or unauthorized signs at the discretion of the District Maintenance Engineer in accordance with Florida Statutes and the Outdoor Advertising Policies established by the State Road Department. LOCAL REACTION: Three different attempts have been made to contact the Police Commissioner of Palm Beach Gardens for his consideration on the above recommended speed restriction, but on each occasion we have failed to locate him.
