MINUTES OF REGULAR MEETING OF CITY COUNCIL
ACTING AS ITSELF AND AS THE ZONING BOARD OF THE CITY
HELD ON MONDAY, MAY 24, 1965
The regular meeting of the City Council acting as itself
and as the Zoning Board of the City, was held at the P. G. A.
Clubhouse, Palm Beach Gardens, Florida, on Monday, May 24, 1965,
at 8:00 o'clock P.M.
MEETING CALLED TO
Mayor Ted Dela Court called the meeting to order. The
ORDER; QUORUM:
City Clerk announced that a quorum of the City Council was present.
MINUTES OF REGULAR
The City Clerk read the minutes of the regular meeting
MEETING OF MAY 10,
1965:
of the City Council, acting as itself and as the Zoning Board of
the City, held on May 10, 1965. It was duly noted that Councilman
Horace S. Miller abstained from voting on the resolution expressing
appreciation to him. Except as duly noted, these minutes were
approved as read.
MARCH OF DIMES:
Mayor Dela Court read a letter dated May 20, 1965 from
the March of Dimes. Action on this letter was tabled.
REALTOR WEEK,
Mayor Dela Court read a Proclamation dated May 24, 1965,
MY 23-29, 1965;
PRO TION:
regarding Realtor Week, May 23 -29, 1965. This Proclamation is
attached hereto as Exhibit "A."
RIVIERA BEACH
The City Council heard from Mr. Bob Kelly, who is Secretary

of the Riviera Beach Jaycees, in connection with their annual Fourth

of July Fireworks Display. Upon resolution duly made, seconded

and unanimously adopted, the sum of $200.00 was donated by the
City of Palm Beach Gardens for this program, and the City
Treasurer was authorized to disburse this sum from City funds
for that purpose.
VARIANCE ON SET - The City Council now sat as the Zoning Board of the City
BACK IN MERIDIAN PARK;
REQUEST MADE; RESO- of Palm Beach Gardens. Mayor Dela Court read a letter from Phillips,
LUTION GRUNTING
VARIANCE: Inc. - Builders requesting a variance in Meridian Park from a front
lot line setback of twenty feet, as required under R -3 zoning, to
a setback of ten feet. This letter is attached hereto as Exhibit
"B." Upon motion duly made by Councilman James F. Kelleher and
seconded by Councilman Miller, the following resolution was duly
adopted by a vote of four to one (Councilman Jackson dissenting):
BE IT RESOLVED by the City Council of Palm
Beach Gardens acting as the Zoning Board of the
City that Phillips, Inc. - Builders, a Florida
corporation, the owners of "MERIDIAN PARK," a
subdivision located within the City of Palm Beach
Gardens and subject to zoning under Classification
"R -3" be, and the same hereby is, granted a variance
under the zoning ordinances of the City with respect
to the front lot line setback requirements under
Zoning Classification "R -3 " from twenty feet to
ten feet.
The Council then resumed acting for itself.
CHANGE OF CITY Inasmuch as the P, G. A. Clubhouse will be closed on

PLACE: Monday nights during the summer, the City Council resolved that
meetings commencing with the second Monday in June would be held
in the meeting room at Garden Lanes Bowling Alley.

POLICE DEPARTMENT
REPORT FOR APRIL, Gardens Police Department for April, 1965, which report was accepted

sented the report of the City Building Department for April, 1965,
which report was also accepted by the City Council.

FUSARO AS POLICE the appointment of Mr. Frederick Charles Fusaro as police officer

OFFICE: of the City of Palm Beach Gardens was ratified and affirmed. The
oath of office of Mr. Fusaro is attached hereto.
RECREATION DEPART- Councilman Jackson gave a report on a Recreation Department.
MENT; REPORT BY
COUNCILMAN JACKSON: He stated that he would appoint a committee to make a study and
recommendations to the Council. This committee will be composed of
citizens of the City.
RODENT CONTROL; Sealed bids having been received by the City Council
CONTRACT WITH
NOZZLE N, INC.: relative to rodent control, first discussed at the meeting of
April 26, 1965, the City Council was informed that the bid of
Nozzle Nolen, Inc., was the lowest and best bid. Whereupon, the
following resolution was duly made, seconded and unanimously
adopted:
BE IT RESOLVED by the City Council of Palm Beach
Gardens that the bid of Nozzle Nolen, Inc., is hereby
accepted, and
BE IT FURTHER RESOLVED that the execution of a
contract dated May 13, 1965 by the Mayor for and on

behalf of the City with Nozzle Nolen, Inc., be, and the
same is hereby, ratified and affirmed.
PROPOSED NEW
Councilman Jackson reported to the City Council on the
ORDINANCES; POLICE
RESERVE; PUBLIC
status of proposing ordinances covering the Police Reserve and on
HEALTH AND NUISANCE:
Public Health and Nuisance. The City Council authorized the
preparation of ordinances covering these two subjects.
HOSPITAL FUND
The following resolution was duly made, seconded and

in First Marine Bank of Riviera Beach, Riviera Beach, Florida.
FLORIDA:
RESOLVED, that W. L. Cargill is hereby authorized
to open and from time to time to reconcile an account
or accounts for and in the name of the corporation with
the First Marine Bank of Riviera Beach, Riviera Beach,
Florida, and from time to time to deposit funds of the
corporation therein, the same to be subject to with-
drawal by checks, drafts or order signed by any two of
Horace S. Miller, W. L. Cargill, James F. Kelleher and
Ted Dela Court, and that the said Bank may rely upon
the authority herein conferred upon said designated persons
until delivery to it of a certified copy of a resolution
of this Board revoking or modifying the same; and that
such authority shall include checks drawn to the order
of any of said persons.
RENEWAL OF
The Council was reminded that the present utilities lease
UTILITIES LEASE
WITH BANKERS LIFE
between the City of Palm Beach Gardens and Bankers Life and Casualty
AND CASUALTY
COMPANY:
Company expired June 30, 1965, but that there was an option to
extend this lease for an additional period of six months. In his
capacity as Vice President of Bankers Life and Casualty Company
only, Mr. Horace S. Miller requested the City Council to grant this
option for an additional period of six months. Upon motion duly made

by Councilman Kelleher and seconded by Councilman Jackson, it was
unanimously resolved that the utilities lease be renewed for an
additional period of six months from July 1, 1965 to December 31,
1965 (Councilman Miller absent).
ADJOURNMENT: There being no further business to come before the meeting,
upon motion duly made, seconded and unanimously adopted, it was
adjourned.

WHEREAS, this occasion will be utilized to acquaint the public
with the high standard of professional service provided by
Realtors in transactions involving real property; and
WHEREAS, the Realtors of Palm Beach Gardens have assisted
many of our families in locating their desired homes, and
continue to devote their efforts to this end, with resul-
tant benefits to the individuals and the community; and
WHEREAS, Realtors serve this community also by working with
fraternal and service clubs and charity organizations, and
donating their time and professional skills to agencies of
local government; and
WHEREAS, Realtors this year are embarking on a five -point
program aimed at providing adequate housing for the lowest
income families, and through their Build America Better Com-
mittee will continue their aggressive efforts to assist in the
removal of blight and slums where they exist in our cities;
and
WHEREAS, the Code of Ethics to which the Realtors are pledged
places them in the forefront of the professional organizations
in our community; and
WHEREAS, the industrial and commercial progress of this com-
munity is due in large measure to the competence and profes-
sional real estate service of said Realtors,
I, Ted Dela Court, Mayor of Palm Beach Gardens, do hereby
proclaim. May 23 -29 to be Realtor Week and urge my fellow citi-
zens to join with the Northern Palm Beach County Board of Real-
tors in its observance.
