SEPTEMBER 13, 1965 The regular meeting of the City Council was held at the Garden Lanes Bowling Alley meeting room, Palm Beach Gardens, Florida, on Monday, September 13, 1965, at 8:00 P.M. MEETING CALLED TO Mayor Ted Dela Court called the meeting to order. After ORDER; QUORUM: calling the roll, the City Clerk announced that a quorum of the City Council was present. Councilman James F. Kelleher was absent. MINUTES OF REGULAR Reading of the minutes of the regular meeting of the City MEETING OF AUGUST 23, 1965: Council held on August 23, 1965, was dispensed. Upon motion duly made, seconded and unanimously adopted, these minutes were approved as written. ,,-� READING OF The City Council deferred action on the reading of reports REPORTS DEFERRED: from City departments until the next meeting. BICYCLE ORDINANCE: Councilman Horace S. Miller discussed a proposed ordinance regulating the use of bicycles. Councilman Michael E. Jackson agreed to study the matter and report to the City Council at a subsequent meeting, PETITION FOR The City Council has received a petition for annexation of ANNEXATION_: certain property located in Section 4, Township 42 South, Range 43 East, Palm Beach County, Florida, to the City, dated August 26, 1965 from Mr. Louis B. Bills. However, action on this petition was deferred until a subsequent meeting. Minutes of Regular Meeting of City Council of September 13, 1965 Page 2 PETITION FOR The City Council has received a letter from John K. Brennan 0 CAR LOT BY JOHN K. Co., dated August 13, 1965, requesting that the Council grant a BRENNAN CO, nonconforming use as to portions of property within the City owned by the petitioner in Section 13, Township 42 South, Range 43 East, which it desires to lease to Mr. Ben Greenberg for the operation of a used car lot. After discussion and upon motion duly made, seconded and unanimously adopted, this petition was granted, and a nonconforming use will be permitted so long as this lease is in force. REZONING OF PROPERTY The City Council was advised tnat BanKers Lire ana uasuaicy ADJACENT TO UTILITY PIANT: Company, an Illinois corporation duly licensed to do business in Florida, and Royal American Industries, Inc., a Delaware corporation duly licensed to do business in Florida, on September 13, 1965, had petitioned the Council to rezone two parcels of realty in Section 12, Township 42 South, Range 42 East, adjacent to the utility plant site in the City. These petitions are attached hereto and made a part hereof as Exhibits "A" and "B." After discussion on the merits of these petitions, the Council was given an Ordinance prepared by municipal counsel effecting these proposed changes to the Zoning Code and the Zoning Map, tentatively numbered Ordinance 1 -L. PROPOSED ORDINANCE Mayor Ted Dela Court then read in full the proposed Ordinance I -L; FIRST READING: 1 -L for the first time; and upon motion duly made, seconded and un- animously adopted, it was resolved that notice of hearing on the proposed Amendment to the Zoning Ordinance be given in accordance with the statutes in such cases provided. Minutes of Regular Meeting of City Council of September 13, 1965 Page 3 COMMUNITY DEVELOPMENT SURVEY: The City Council discussed and took under advisement the proposal by the Junior Chamber of Commerce to conduct a Community Development Survey. PROPOSED GENERAL Councilman Jackson read in full for the first time a proposed ORDINANCE N0. 15 - RECREATION ADVISORY Ordinance creating a Recreation Advisory Board, prepared at the BOARD ORDINANCE: request of the City Council, and tentatively numbered General Ordinance 15. PROPOSED MUNICIPAL Councilman Jackson presented to the City Council a letter BUILDING AND RELATED FACILITIES LETTER from Mr. John B . Marion, dated August 31, 1965, setting forth the FROM MR. J HN MARION: results of a meeting held on August 18, 1965 between himself and several members of the City Council. At this meeting, there was a discussion concerning the needs of the City for a municipal building and related facilities. Councilman Miller was appointed to take this matter under study and to report to the City Council at a subsequent meeting. REVISION OF FEE The City Council was presented with a report from Mr. Robert SCHEDULE FOR BUILD- ING PERMITS: Kessee, City Building Inspector, suggesting that the City increase its fees on building permits. The Council was informed that Palm Beach County, effective October 1, 1965, will increase its schedule of fees, and that the City had generally followed Palm Beach County with respect to the fees charged in this field. Councilmen Jackson and Horace S. Miller were requested to take this matter under study and to report to the Council in four weeks. KHOURY LEAGUE RE- Councilman Jackson informed the City Council that the Khoury QUEST FOR DONATION: League had requested a donation from the City to make up a deficit u Minutes of Regular Meeting of City Council of September 13, 1965 Page 4 incurred as a result of an injury to a player. After further discussion and upon motion duly made and seconded, the following resolution was unanimously adopted: BE IT RESOLVED by the City Council of Palm Beach Gardens that the City donate the sum of $500.00 to the Khoury League, and BE IT FURTHER RESOLVED, that the City Treasurer be, and the same hereby is, authorized and empowered to pay this amount to the Khoury League. INTER -CITY FIRST Mayor Dela Court presented to the City a letter dated AID SgUAD; RE- UEST FOR INCREASED July 29, 1965, from Mr. Karl Taylor, Chairman of the Board of Directors of Inter -City First Aid Squad, requesting that the City increase its contribution this year. This matter was referred to RETENTION OF UtIT FIRM OF SALES & HOUSTON TO REP- RESENT CITY IN COUNTY ZONING LAWSUIT: 1966 CITY BUDGET ADJOURNMENT: the Budget Director for further study. Councilman Miller left the Council table in order to discuss with the Council members, solely in his capacity as Vice President of Bankers Life and Casualty Company, the retention of the West Palm Beach law firm of Sales & Houston to represent the City in a lawsuit to be brought against the Palm Beach County Zoning Board. Vice President Miller informed the Council that Bankers Life and Casualty Company would indemnify the City against any and all legal expense incurred in this suit. Further action on this request was deferred until the next City Council meeting. There was a general discussion concerning the proposed 1966 City Budget.
