CITY OF PALM BEACH GARDENS
MINUTES OF REGULAR MEETING OF CITY COUNCIL
HELD ON MONDAY, NOVEMBER 22, 1965
The regular meeting of the City Council was held at the
Garden Lanes Bowling Alley Meeting Room, Palm Beach Gardens, Florida,
on Monday, November 22, 1965, at 8:00 o'clock P.M.
Vice Mayor Michael E. Jackson called the meeting to order.
After calling the roll, the City Clerk announced that a quorum of
the City Council was present. Councilman James F. Kelleher was
absent.
MINUTES OF SPECIAL The City Clerk read the minutes of the special meeting of
MEETING OF NOVEMBER
15? 1965: November 15, 1965. Upon motion duly made, seconded and unanimously
1—� adopted, these minutes were approved as read.
PETITIONS FOR Councilmen William L. Cargill and Horace S. Miller informed
ANNEXATION:
the City Council that they had received Petitions, dated November 17,
1965 from Eugene F. Bie, as Trustee, and dated November 18, 1965
from William J. Bosso, each requesting that certain property located
upon and along Lake Park West Road in the vicinity of or adjacent
to proposed Interstate Highway I -95 (proposed State Road 9) be
incorporated within the territorial limits of the City, provided
that it would be immediately zoned under Zoning Classification "C -1"
COMMERCIAL DISTRICT. The City Clerk then read these two Petitions,
which are attached hereto as Exhibits "A" and "B."

PROPOSED ORDINANCE Councilmen Cargill and Miller then stated that municipal

counsel had prepared an Ordinance tentatively designated 0 -J
relative to this Petition. The City Clerk then read proposed
Ordinance 0 -J in full for the first time.
PROPOSED ZONING OR- The City Council then considered proposed Zoning Ordinance
DINANCE 1 -L; REZON-
ING OF CERTAIN LAND I -L, which was first read at the meeting held on September 13, 1965
FROM ZONE "R -1" TO
ZONE "R -3 ": and which concerns the rezoning of two parcels of realty in Section 12,
Township 42 South, Range 42 East, adjacent to the utility plant site
in the City of Palm Beach Gardens, from Zoning Classification "R -1"
to Zoning Classification "R -3." After consideration of the merits of
this rezoning, the City Council then read for the second and final
time Ordinance 1 -L and ordained that this Ordinance be enacted to

PROPOSED ZONING The City Council also considered proposed Zoning Ordinance
ORDINANCE 1 -M; RE-
ZONING OF CERT IN 1 -M, which was first read at the meeting held on September 27, 1965
LAND FROM ZONE "M"
TUTUNTE9 —R-T and which concerns the rezoning of a portion of Section 1, Town-
ship 42 South, Range 43 East, Palm Beach County, Florida, from
Zoning Classification "M" to Zoning Classification "R -1." After
consideration of the merits of this proposed rezoning, the City
Council then read for the second and final time Ordinance 1 -M
and ordained that that Ordinance be enacted to take effect immediately.
KEATING DRIVE There was a general discussion concerning the painting

of signs at the Keating Drive entrance to the City of Palm Beach
Gardens. A motion that a bid submitted by Bill's Sign Shop in

the sum of $69.00 covering such painting was withdrawn after
objection was voiced by Councilmen Cargill and Miller.
PURCHASE OF PUBLIC
Councilman Miller was requested to investigate and

review the necessity for purchasing equipment for the Public
Works Department, and to report to the City Council at a subse-
quent meeting.

The following resolution was duly made, seconded and

BE IT RESOLVED, by the City Council of Palm Beach
Gardens that Councilman Horace S. Miller be, and the
same is hereby, authorized and empowered to purchase,
by and in the name of the City of Palm Beach Gardens,
a new police car at the lowest and best price avail-
able, and
BE IT FURTHER RESOLVED, that the City Treasurer
be, and the same is hereby, authorized and empowered
to pay for said police car from the 1965 City Con-
tingency Fund.

The following resolution was duly made, seconded and

SIREN WARNING
unanimously adopted:
SYSTEM:
BE IT RESOLVED, by the City Council of Palm
Beach Gardens that Councilman Horace S. Miller be,
and the same is hereby authorized and empowered to
purchase and cause the erection of a siren warning
system, by and in the name of the City of Palm
Beach Gardens, and
BE IT FURTHER RESOLVED, that the City Treasurer
be, and the same hereby is, authorized and empowered
to pay for such purchase and installation from the
City Treasury.
RECREATION
The following resolution was duly made, seconded and

NEED FOR
ORDINANCE:
ADJOURNMENT:
WHEREAS, the Recreation Advisory Board has
recommended that the City Council take steps to hire
a full -time professional Recreation Director,
THEREFORE BE IT RESOLVED, that the City Council
of Palm Beach Gardens, Florida,does hereby authorize
the Councilman in charge of recreation and the Recre-
ation Advisory Board to advertise for, investigate and
recommend to the City Council proper candidates for
the position of Recreation Director. This Resolution
is not intended to authorize the Councilman in charge
of recreation or the Recreation Advisory Board to
hire any candidate for the job of Recreation Director.
Any monies spent attendant to the execution of the
matters contained herein shall be disbursed out of the
general fund.

There was a general discussion concerning the relationship
between zoning ordinances, plat restrictions and the City Building
Code. There was also a general discussion concerning the requirements
for moving existing houses into the City of Palm Beach Gardens. After
this discussion, the following resolution was duly made, seconded
and unanimously adopted:
BE IT RESOLVED, by the City Council of Palm Beach
Gardens that an Ordinance be drafted setting forth the
requirements of the City for the moving of existing
houses into the City.
There being no further business to come before the meeting,
upon motion duly made, seconded and unanimously adopted it was adjourned.

PETITION FOR ANNEXATION OF CERTAIN LANDS TO THE TERRITORIAL
LIMITS OF THE CITY OF PALM BEACH GARDENS, FLORIDA
TO: The Mayor and City Council
City of Palm Beach Gardens, Florida
The undersigned, being the owner of the lands described in
Schedule "A" annexed hereto and made a part hereof, hereby petitions, sub-
ject to and on the condition hereinafter stated, that said lands and each of
them be annexed to and incorporated within the territorial limits of the City
of Palm Beach Gardens, pursuant to the provisions of Article V, Section 3,
Paragraph 29 of the Charter of the said City, and respectfully requests that
this petition for annexation be acted on as quickly as possible.
The condition of this petition is that the Ordinance of Annexa-
tion herein petitioned for shall contain a clause or provision, as authorized by
Section 17 of Article III of the Charter of the City of Palm Beach Gardens
(Chapter 59 -1707, Laws of Florida, Special Acts of 1959), providing that the
said Ordinance of Annexation shall not become operative or effective until the
zoning ordinance or law of the said City is effectively modified or amended so
as to classify the said property into the existing "C -2 Commercial District"
of said City, thereby permitting the development and usage of said property
in accordance with said "C -2 Commerical District" regulations.
