HomeMy WebLinkAboutMinutes Council 051164CITY OF PALM BEACH GARDENS MINUTES OF REGULAR MEETING OF THE CITY COUNCIL HELD ON MONDAY: MAY 112 1964 The regular meeting of the City Council was held at the Howell Watkins Junior High School, Palm Beach Gardens, Florida, on Monday, May 11, 1964, at 8:00 P.M. QUORUM: Mayor Norman D. Rowland called the meeting to order. The City Clerk called the roll of City Commissioners and announced that a quorum of the City Council was present. MINUTES OF The City Clerk read in full the Minutes of the meeting of the MEETING OF APRIL 27, City Council of April 27, 1964. Upon motion duly made, seconded and unanimously adopted these Minutes were approved as written. PALM BEACH The City Clerk read the report of the Palm Beach Gardens Building GARDENS BUILDING DEPT. Department for the month of April, 1964, and also the report of the REPORT FOR APRIL, 1964; Palm Beach Gardens Police Department for the same period. Chief POLICE DE =— REPORT FOR William O'Brien read the report of the Palm Beach Gardens Volunteer Fire AP --I= I9Z , 4; VQLDIQTEER FIRE Department for this same period. The City Council accepted these reports REPORT FOR APRIL, 1964: as read. REZONING OF The City Council was advised that American Airmotive Corporation had PORTION OF PLAT NO. 1, petitioned the Council to rezone certain lots in Plat No. 1, Palm Beach ANT) —SO OF PORTION OF Garden Estates, namely Lots 1 to 7, both inclusive, Block 12, and Lots 1 SECTION 7: �— to 30, both inclusive, Block 1, from Zone "R -1" to Zone "R -2 ". This petition is attached hereto and made a part hereof as Exhibit "A ". In addition, the City Council had received a petition from Royal American Industries, Inc. requesting the reclassification of a portion of Section 7, Township 42 South, Range 43 East, from Zone "R -1" to Zone'R -2 ". This petition is also attached hereto and made a part hereof as Exhibit "B ". Minutes of Meeting of City Council held on May 11,, 1964 Page 2 After discussion on the merits of these petitions, Mayor Norman Rowland stated that municipal counsel had prepared an Ordinance effecting these proposed changes in the Zoning Code and Zoning Map, and called for a first reading of that Ordinance. PROPOSED ORDIN- The City Clerk then read in full the proposed Amendment to the Zoning ANCE "1 -H ";FIRST Ordinance tentatively numbered "1 -H" for the first time; and upon motion duly made, seconded and unanimously passed, it was resolved that notice of hearing on the proposed Amendment to the Zoning Ordinance be given in accordance with the statute in such cases provided. It was further re- solved that a public hearing be held on said Amendment no sooner than four weeks from the date of this meeting, and that this Amendment to the Zoning Ordinance be referred to the Council as a Zoning Board for further examination and study. CORRESPONDENCE: The City Clerk read in full eight letters which had been received by the City Council since its last regular meeting. CITY COUNCIL TO In light of the demands by the Homeowners' Association of Palm Beach RETAIN LEGAL COUNSEL ;AUTHOR- Gardens, Inc. made in letters just read by the City Clerk, the City Council IZAT ION; - MENT: felt it advisable to act upon the following Resolution which was read in full by the City Clerk: WHEREAS, the City Council has recently received certain letters from the Homeowners' Association of Palm Beach Gardens, Inc, re- questing that the City Council supply legally sufficient proof of the authenticity and legality of its actions, and NOW, THEREFORE, BE IT RESOLVED That the City Council of Palm Beach Gardens retain the services of legal counsel to study and make a report of the activity of the City Council apparently under attack and that said report be submitted to the City Council, and BE IT FURTHER RESOLVED That the City Treasurer be, and the same is hereby authorized, to pay any and all reasonable costs and expenses for such Legal services out of the general funds of the City, and BE IT FURTHER RESOLVED That the City Council of Palm Beach Gardens adjourn the present meeting and reconvene, at the call of the Mayor, upon seven (7) days notice by publication in a local newspaper, and Minutes of Meeting of_City Council Page 3 held on May 11, 1964 BE IT FURTHER RESOLVED That any resolutions, agreements, or arrange - ments, or parts thereof, contrary to or inconsistent with this Resolution be, and are hereby repealed forthwith. After a lengthy discussion, and upon motion duly made and seconded the foregoing Resolution was duly adopted, Vice Mayor Miller abstaining. Accordingly, the meeting was duly adjourned.
