MINUTES OF REGULAR MEETING OF THE CITY COUNCIL
MONDAY, SEPTEMBER 23, 1963
The regular meeting of the City Council was held at 1001 Park
Avenue, Lake Park, Florida, on Monday, September 23, 1963, at 10:20
o'clock A. M.
QUORUM: The City Clerk announced that a quorum of the City Council was
present.
The Mayor presided at the meeting and announced that we would
dispense with the reading of the minutes of the last meeting.
NEXT After considerable discussion on the subject, the following
REGULAR
MEETING: resolution was duly made, seconded and unanimously adopted:
BE IT RESOLVED, that the next regular meeting of the City
Council will be held in the Court Room of the Police Station
in the City of Palm Beach Gardens on October 14, 1963.
NOTICE OF After considerable discussion, the following resolution was duly
SPECIAL
MEETINGS: made, seconded and unanimously adopted:
BE IT RESOLVED, that a three -day notice of all special
meetings of the City Council be posted on the door of the
Police Station.
BE IT FURTHER RESOLVED in the case of an emergency
meeting, a member of the Board of Directors of the Home
Owners' Association will be so notified.
VOLUNTEER The Mayor stated that he was gratified a Volunteer Fire Depart -

DEPARTMENT: ment has been organized in the City and offered the use of the Police
Station building for such Fire Department meetings. He also stated that
the constitution and by -laws of the Fire Department were being studied and
would be presented to the Council for their approval.

HOSPITAL: A general discussion and explanation was had concerning plans
for the erection of a hospital within the territorial limits of the City.
The Mayor announced it is anticipated that the Council will have more
information at the next meeting.
RATIFICATION The Mayor stated that Plat No. 1, PGA National Golf Club
OF PLAT NO. 1
PGA NATIONAL Estates had been filed with the County. Whereupon, the following
GOLF CLUB
ESTATES: resolution was duly made, seconded and unanimously adopted:
BE IT RESOLVED that Plat No. 1, PGA National
Golf Club Estates as filed with the County and signed
by Norman Rowland, Mayor, and W. L. Cargill, City
Clerk, respectively, on August 16, 1963 be, and it
hereby is, ratified as filed.
APPROVAL OF The City Treasurer has completed the budget for the calendar
1964 BUDGET:
year 1964= a copy of which is attached hereto and made a part hereof as
Exhibit "A ". This budget was presented to the Council for consideration
and approval.
Following such examination and discussion, the following
resolution was duly made, seconded and unanimously adopted:
BE IT RESOLVED that the budget of the City of Palm
Beach Gardens for the calendar year 1964 as pre-
pared by the City Treasurer and as presented to the
City Council be, and the same hereby, is approved
and ratified.

RULES AND REGULATIONS
of the
POLICE DEPA NT
PALM BEACH GARDENS, FLORLDA
1. The Police Force of the City of PALM BEACH GARDENS shall consist of the
Chief of Police and such other police officers as may be appointed by the Council
as provided by the City Charter.
2. The Chief of Police shall be the head of the Police Department, and shall
govern and control said Department, its business and affairs, and exercise all
powers in conformity with City Charter under supervision of Council.
3. It is the duty of the Chief of Police to enforce the rules and regulations
as hereinafter set forth and further rules or regulations recommended by him and
approved by the Council.
4. Whenever any violation of the rules aid regulations of the department by any
of its members shall come to the knowledge of the Chief, he may, if in his judg-
ment the exigencies of the service require, suspend such members from duty after
notice to and approval of the Mayor.
5. The Chief of Police shall be chief enforcement officer, subject to the orders,
rules and regulations of the City Council. He and the members of the Police De-
partment shall be sworn to uphold the laws of the United States, and the State of
Florida, and enforce all Ordinances of the City.
He shall promulgate promptly to the force all orders issued, see that they
are promptly executed, and that all rules and regulations are observed. He shall
maintain and enforce rigid discipline in the force, so as to secure complete effi-
ciency in his department.
6. All orders to the force shall be issued by the Chief, and be communicated to
the members thereof through the commandants, recognized rank when available under
him, or in such manner as circumstances and the efficiency of the service may re-
quire.

7. He shall have charge, management, supervision, and control of the Captain,
Lieutenants, Sergeants, and all members of the force, detectives, and jailors
who shall perform such duties connected with the police force, and the discipline
and regulations thereof.
8. He shall cause the Chief Detective, Captain, Lieutenants and Sergeants of
Police to report to him at least once each day, any and all police matters, or
business connected with, or in any manner pertaining to their police duties.
9. The Chief of Police shall require all police information or knowledge of
police affairs, criminal matters, and all matters and things pertaining to the
full and complete knowledge of police affairs be made known to him at all times,
and there shall be no secret police matters, arrangements, correspondence, or
information withheld from him by any person or persons under him or engaged in
the department.
10. The Chief shall keep the City Council acquainted with any and all matters
of police affairs, the working of the department, and all information coming
within his supervision, knowledge, or jurisdiction, when requested by them or
the City Manager.
11. He shall have power in all cases to detail members of the police and de-
tective forces to any part of the city where their services may be required. He
is also empowered to issue orders to the force, not inconsistent with the Charter
and rules and regulations of the Council,
12. He shall require the members of the force to report for target practice at
such times and at such places as may be designated by him, and a record shall be
kept by the respective officers of the scores made by each individual, and the
Chief shall be furnished with a copy thereof.

13. He may, when demanded by citizens or other persons, or whenever good cause
may appear, prefer or cause to be preferred, charges to the Mayor against any
member of the force whom he believes to have been guilty of conduct, justifying
the member's removal from the force, or other punishment in the interest of good
order and discipline. The Chief shall have poker and authority to place charges
with the Mayor against any member of the force who shall be subject to reprimand,
fine, reduction in rank, or dismissal from duty, according to the nature and
aggravation of the case.
14. Nothing contained herein shall nullify any provisions of the City Charter.
CAPTAIN OF POLICE lIND LIEUTENANTS
1. The Captain and Lieutenants shall be subject to the rules prescribed by
the Chief of Police and approved by the Council. They shall obey all orders which
emanate from him in regular order of police business and shall exercise such ad-
ministrative authority and supervision of the deparUw nt work as the Chief of
Police may assign him.
2. It shall be the duty of the Captain and Lieutenants to report every
violation of rules and disobedience of orders to the Cheif.
CAPTAIN
Responsibilities. The Captain of Police shall be the second executive officer
of the Police Department, and he shall be responsible for the proper and efficient
enforceront of all laws, ordinances, and regulations which the police have authority
to enforce. The Captain is also charged with the maintenance and enf orcement of
rigid discipline and the supervision of police work and conditions of the depart-
ment, and he shall exercise such authority thereunder as may be directed by the
Police Chief. He has power to promulgate such orders to members of the Department
to render to him and his orders implicit obedience; but such orders shall be in
conformity to the law and to the Rules and Regulations of the Department as here-
inafter set forth.

Informing Chief. The Captain shall beep the Police Chief fully informed
of important events, criminal conditions, and unusual occurences and shall furnish
in writing such statistics and suggestions as he may deem advisable for the im-
provement of the police service.
CHIEF OF IETECTIVES
The Chief of Detectives shall have supervision over the Detective Division,
including the main office, branch offices, and special bureaus. His command shall
be responsible for the detection and arrest of criminals, investigation and pro-
secution of criminal property, and the compilation and comparison of criminal records.
He shall maintain a spirit of cooperation within the Department and with other law
enforcement agencies.
LIEUTENANT OF TRAEFIC
All units within the Traffic Division at large shall be under the general
supervision of the Lieutenant of Traffic. He shall be responsible for their co-
ordination and efficient operation to promote safety and expedite the flow of
traffic. He shall designate the hours of duty for all units of his command and
shall visit the quarters occupied by units under his command for the purpose of
observing whether or not they are well kept and conducted in accordance with the
rules and regulations. At regular intervals he shall inspect the personnel of
his units with respect to maintenance of proper personal appearance, discipline
and the discharge of duties.
LIEUTENANT
A Lieutenant shall be the officer in charge of a division and responsible
for its efficiency and discipline. He shall prepare the details and assignments
for the division and familiarize himself with all orders and necessary informa-

tion for its attention.

SERGUNTS
1. Sergeants, in the absence of other officers, shall have charge of the
force and station house, and exercise all powers and duties, and be held to a
like responsibility.
2. He shall alternate his duties, either spending his hours at the station
house or patroling his district, unless performing other duties as shall from time
to time be ordered by his superior officers.
3. If there should be a temporary vacancy in the position or absence of a
Sergeant, it shall be filled by the officer next in command. Patrolmen detailed
as acting sergeants shall be obeyed and respected as if really of t13 character
to which he is assigned, and shall perform the duties as such.
14hen on duty, a Sergeant shall be responsible for the efficiency and disci-
pline of all members of the Department under his supervision.

A Sergeant shall thoroughly acquaint himself with the qualifications and be-
havior of Patrolmen, and he shall impartially report to the commanding officer of
the division every case of misconduct or neglect of duty on the part of Patrolmen
under his supe3- vision. Failure to so report shall be grounds for charges being
preferred against Sergeant.
A Sergeant shall patrol the city or section assigned to him for the purpose
of assuring proper attention to duties by Patrolmen under his supervision, and,
when necessary, inspect them in the proper performance of their duties. He shall
ascertain the cause for absence of a Patrolman from his post and take appropriate
action in the matter. However, if, after diligent effort, he is unable to locate
Patrolman on patrol or detail, he shall inform the Lieutenant in charge, and be
governed by his instructions.

CITY DETECTIVES
Complete and careful record shall be kept in the Department of the work
of the detective force, and all cases shall be diligently and promptly attended
to and disposed of. The records shall consist of a blotter on which shall be
entered all transactions of the various detectives as may be directed by the
Chief of Police, or officer designated by him.
GENERAL RULES FOR PATROLM2N
1. That the Chief of Police or any police officer shall have power and
authority to immediately arrest, with or without warrant, and take into custody
any person or persons who shall commit, threaten or attempt to commit, in his
presence or within his view, any offense prohibited by ordinance of the city;
and, he shall, without unnecessary delay, upon making such arrest, convey the
offender or offenders before the City Court to be dealt with according to law.
2. That the Chief of Police and members of the Police Force, in addition
to the powers incident to their offices, and as herein described, shall possess
common law and statutory authority of constable, except for the service of civil
process.
3. Every member of the department will be furnished with a copy of the
Rules and Regulations which he will keep in his possession in order to become
perfectly* familiar with his various duties.
4. Each patrolman must by his vigilance render it extremely difficult, if
not impossible, for anyone to commit a crime on his beat, (the absence of crime
will be considered the best proof of the efficiency of the police) and when, in
any precinct or beat, offenses frequently occur, there will be good reason to
suppose that there is negligence or want of ability on the part of the officer
in charge of said precinct or beat. He must acquire such knowledge of the in-
habitants within the boundaries of his beat as to enable him to recognize them,
and he must carefully inspect every, part of his beat.
5. Patrolmn must not walk together or talk with each other when they
i meet on the confines of their beats, unless to communicate information apper-
taining to their police duties, and, in such cases, they must make their communi-
cation as brief as possible, and must not stop at any house, station house, or
any place whatever while patroling tIv it beats, except on police business, or when
otherwise direct by the Chief of Police, or their immediate superior.
6. A policeman must not walk or talk with citizens while on patrol duty,
except on police business, then he will stand and hear what the business iss and
if it requires immediate attention, attend to it, if not, he will direct the
person or persons seeking information to the nearest station house.
7. Officers will not be allowed to stand and converse with females on the
street, unless upon matters appertaining to their duties. Officers in command
are strictly enjoined that it is their duty to report all such cases, and a neglect
to do so will be visited upon themselves.
8. All members of the department shall devote their entire time and atten-
tion to the business of the department, and not follow any other calling. Although
certain hours are allotted to each mans duty on ordinary occasions, yet all the
members must be prepared to go at a moment's notice, whenever their services may
be re que Ste d.
9. Punctual attendance, prompt obedience, and conformity with the rules
and regulations of the Department will be rigidly enforced.
10. Each member shall at all times have with him a small memorandum book,
in which he shall enter the names of persons taken in charge by him, and such
particulars in each as will be needed on the trial of the case, and shall attend
punctually on the hours of such case when the same is set for trial.
11. Each officer when reporting for duty must be neat in his appearance,
with his clothing and boots cleaned and his dress in conformity with the regulations.

i 12. Policemen on patrol duty will be considered as sentinals on post, and
must conduct tbamselves accordingly.
13. All orders of superior officers must be cheerfully, faithfully, and
promptly obeyed and enforced, and it will be the duty of all superior officers
of the department to report to the Chief any and all violations of the rules and
regulations herein set forth, which may come to their knowledge. Leniency on
the part of a commanding officer shall be inferred as an infraction of discipline,
and he will be punished accordingly.
14. No member of the department while on duty or wearing his uniform, shall
drink arty intoxicating liquors, nor shall he visit any drinking house, saloon, or
house of ill -fame, except in the discharge of his duty, or engage in any game of
cards, billiards, or other games of chance, smoke tobacco on the streets or in
any public place.
15. Any member of the force may be subject to reprimands, suspension from
duty, or dismissal from the force, according to the nature and aggravation of the
offense, for any of the following causes, or for violating any of the rules and
regulations governing the department as hereinafter set forth.
FEPARTKENT RULES
All police officers are required to perform the following acts:
1. To devote his entire time and attention to the business of the Depart-
ment to the exclusion of every other calling or pursuit.
2. To enforce all city laws and ordinances and any other laws required
by statute or ordinance.
3. To obey promptly all rules and orders.
4. To act immediately on notice from superiors that their services are
required.
5. To be quiet, civil, orderly, and courteous in the performance of duty.
6. To send report immediately to the Chief in case of sickness. (Medical
report etc. are Certified.
7. To report defective streets, sidewalks, lights, hydrants, or anything
threatening to public safety or health.
8. To report immediately all cases of destitution observed.
9. To return lost children to their homes when identified; if not identified
they shall be taken immediately to the appropriate office at Police Headquarters
where every effort shall be made to locate the parents.
10. To send home or to a hospital or doctor any injured or ill
member of the Department requiring medical attention.
11. To report doors and windows of stores and empty or vacant dwellings
improperly opened, to owners and report same to Police Department, and he shall
keep a complete list of vacant houses in his notebook.
12. To deliver money or other personal property obtained in police business,
regardless of the amount or what the property may be, to the superior officers
designated. (See Treasurer under Charter. The money shall be then deposited with
the City Treasurer).
13. To transmit important police information to Police Headquarters by
nearest telephone or by radio.
14. To serve warrants promptly.
15. To keep superior officers posted as to residences and places where he
eats his lunch during his tour of duty.
16. To take persons arrested to Police Headquarters.
17. To give name and badge number to all citizens and other persons when
requested.
18. To keep a memorandum and report all police business perforrm d in

19. To take notice of all suspicious persons or vehicles at night but

may not arrest on suspicion.
20. To carry at all times a revolver of the caliber and pattern issued
to him by the department and all other specified police equipment unless excused
therefrom.
21. To stand guard in person or by proxy over all wires which have fallen
into the street or that are hanging within reach until the electric or telephone
company have been notified and have taken care of them, and, in the meantime, to
take strict precaution that neither they nor any other person shall touch or come
in contact with them.
22. To reside within the area designated by Council, and to promptly ad-
vise his Chief of change of residence.
23. In the investigation of an alleged crime or suspicious death, a member
of the department shall exercise every precaution to avoid destroying or impairing
the value of the evidence on bodies, effects, and surrounding property, particularly
avoiding the destruction of fingerprints by unintelligent handling. He shall pre-
vent unauthorized persons from entering the scene of the crime until a member of
the Detective Division appears. Pending the arrival of the detective, the rrember
of the department first upon the scene shall make an immediate and thorough in-
vestigation into the circumstances of the crime, obtain the names and addresses
of witnesses and all other important details. Officers shall be held responsible
for the completeness of this investigation. Upon arrival of a member of the
Detective Bureau, all information and evidence will be turned over to the Detective,
who will assume full charge from then on. If the perpetrator is not apprehended,
all evidence shall be furnished to the Detective, who shall assume charge of the
case. If the perpetrator is apprehended, a member of the Detective Division shall
assist. (Notice to Sheriff) (The Sheriff's office shall be given immediate notice).

24. To indentify himself promptly when answering a department telephone
by giving his rank and surname; and the member calling shall then identify him-
self the same way.
25. To summon aid in ordinary cases, a member of the Department will give
three or more blasts upon his whistle. Members of the Department in responding
will give one blast on their whistles.
26. Members of the uniform division and members of the Detective Division
shall co- operate with one another.
27. A member of the Ibpartment shall promptly report to his Chief a loss
of, damage to, or unserviceable condition of,, any department property issued for,
or assigned to, his use.
28. To be responsible for the neatness and cleanliness of his person.
29. All officers having cases in Municipal Court will appear before the
Judge fully and neatly dressed.
30. All officers, with the exception of desk sergeants, call officers,
and clerk, are hereby instructed to remain outside of desk railing or Chief Is
office unless called in for information pertaining to official business.
31. Arresting officers MUST at all times keep themselves posted on the
progress of their cases. Failure to appear in court when case is called, with
all witnesses, and failure to have affidavits and complaints signed and in proper
order, will subject the offending officer to suspension for one week without pay.
32. All officers are instructed to bring prisoners to the station after
arrest and make a thorough search of them, turning all valuables over to the Ser-
geant on duty. A legal search can only be made after a legal arrest.
33. At no time will an officer of this department carry a civilian passen-
ger in a police car unless on official business connected with police work.

Under penalty of suspension, fine, overtime, reprimand or dismissal,

every member of the Police lepartment is forbidden to be guilty of any of one
or more of the following acts or violations of any of the Rules and Regulations
governing the Department of Police:
1. Neglect or disobedience of police rules or orders.
2. Insubordination or disrespect toward superior officers.
30 Conduct unbecoming an officer or contrary to discipline.
4. Intoxication while on or off duty.
5. Cowardice.
6. Loafing.
7. Sleeping on duty.
8. Lying to superior officers.
9. Drinking any beverage containing alcohol while on duty.
10. Smoking or chewing tobacco while on active duty or at any time in
uniform in a public place.
11. Reporting for duty whale still effected from drinking any alcoholic
beverage.
12. Accepting or soliciting bribes, rewards, or favors, in any manner
whatsoever.
13. Giving assistance in civil cases unless granted permission by the
Chief.
14* Neglect to keep police equipment assigned and uniform clean.
1$. Neglect to assist a fellow officer in the performance of duty.
16. Idle conversation while on duty.
17. Making known the proposed action or movements of the force or the
provisions of any orders, to persons outside of the force.

18. Making an arrest for harsh language not amounting to a breach or
-J disorderly conduct.
19. Becoming surety for any person arrested for crime
20. Imparting police information to any person except under orders of a
superior in writing.
21. Entering places where liquor is sold except on police business while
on duty.
22. Enabling any person to escape arrest or secure stolen property.
23. Releasing a prisoner from custody after arrest except in conformity with
the law.
24- Using club except in self - defense and maintenance of civil order.
25. Using revolver except in extreme cases when human life is in danger.
26. Using unnecessary harshness or violence towards prisoners.
27. Circulating subscription paper, selling tickets, collecting money, or

entering prize contests except by consent of the Chief of Police.
28. Accepting, receiving, demanding, or requesting any gift, present, money,
or other thing of value, or countenancing or approving either directly or indirectly,
the accepting, receiving, demanding, or requesting of any gift, present, money, or
other thing of value by a subordinate officer, from any person who is known or sus-
pected of being or having been engaged or about to engage in any criminal or un-
lawful activity or enterprise, or having seen or holding private intercourse with
any such person except the same be in line of police duty.
29. Immoral conduct.
30. Violation of any criminal law or city ordinance.
31. Inattention to duty.
32. Incompetency, lack of energy, or incapacity mentally or physically.
33. Leaving district without being properly relieved.
34. Not properly patroling post.
35. Absence without leave; being late in reporting.

36. Using coarse, profane, or obscene language to a superior officer,
or any other member of the Department.
37. Using coarse, profane, or insolent language to a citizen.
38. Neglecting to treat an officer or member of the Department or another
person civilly and respectfully.
39. Making a false official report.
40. Neglect to wear full uniform during your tour of duty or while attend-
ing to any police matter.
41. Neglect to keep uniform coat buttoned.
42. Neglect to wear prescribed uniform shirt and shoes.
43. Neglect to appear neat and tidy.
44. Gossiping about a member of the Department, concerning either personal
character or conduct, to the detriment of such member.

45• Disrespect of, or criticizing the action of a superior officer.
46. Neglect to wear official badge and other emblems in the proper position.
47. Refusing to give number of official badge when requested or to give name.
48. Locking a person up for a violation of the law which you had overlooked
but changed your mind when the citizen asked for your name and badge number.
49. Neglect to turn over all property found, received from others, or
taken from a person arrested, to the appropriate officer designated by the de-
partment.
50. Assigning anticipated salary to any person or persons.
51. Except when necessary in the performance of police duty, a member of
the force shall not carry packages, bundles, umbrellas, canes, or Like impediments,
while in uniform.

52. A member of the force, when traveling in uniform, shall not occupy
a seat in a public conveyance to the exclusion of a paid passenger.
53. A member of the force shall not call upon, nor communicate with, an
official or employee of a railroad, boat or bus company for the purpose of soli-
citing the issue of a transportation pass.
54. Members of the Department shall not litter with refuse any room or
place in any department building. Refuse shall be deposited in the designated
receptacles.
55. A member of the department shall neither interfere with nor attempt
to influence, the lawful business of any person.
56. A member of the force shall not recommend or suggest to prisoners,
or to persons involved in crimes or accidents, the employment or name of any
person as attorney, counsel, or bondsman.
57. A member of the force shall not consent to the payment, by any person,
of money or any other valuable thing to a pawnbroker, nor to any other person, in
order to regain possession of property stolen from him, nor shall he advise such
payment, except by permission of his Chief, or other competent authority.
58. A member of the force shall not incur a liability chargeable against
the City of Palm Beach Gardens, unless with the knowledge and consent of the
Chief of Police.
59. All employees of the Department shall promptly pay their just debts,
and shall not incur liabilities which they are unable or unwilling to discharge.
If an attachment is issued against the salary of any member of the .Department,
it will be prima facie evidence of a violation of this rule, and charges may be
preferred by their Chief. If an attachment is issued against the salary of any
member of the Department, the Chief of Police will assume that the member against
whom the attachment is issued does not wish to comply with the rules and regula-
tions, and charge may be preferred and notice given to Mayor.
