HomeMy WebLinkAboutMinutes Council 121063CITY OF PALM ,BEACH GARDENS MINUTES OF REGULAR MEETING OF CITY COUNCIL TUESDAY, DECEMBER 10, 1963 The regular meeting of the City Council was held at 9076 Keating Drive, Palm Beach Gardens, Florida, on Tuesday, December 10, 1963, at 10:00 A.M. QUORUM: Vice Mayor Horace S. Miller, acting as Chairman, called the meeting to order and announced that a quorum of the City Council was present. MINUTES OF MEET- The minutes of the meetings of the City Council held on October 28, INGS OF OCTOBER 28, NOVEMBER 11, November 11, November 12 and November 26, 1963 were, upon motion NOVEMBER 12, AND NOVEMBER 26, 1963 duly made, seconded and unanimously adopted, approved as written A 1D13Pr)AT `n- PROPOSED ORDINANCE O -E (1); ANNEXATION OF KELLY AND PERLOV PROP- ERTIES TO CITY: and without comment or revision. Vice Mayor Miller advised the Council that on November 12, 1963 it had enacted Ordinance O -E which expressed an intention on the part of the CITY OF PALM BEACH GARDENS to annex two (2) parcels of realty located in Palm Beach County, Florida, and identified as the Perlov and Kelly Tracts, to the City. That Ordinance provided that actual annexation should take place shortly after thirty (30) days from the date of enactment; and the thirty day period had expired. Further, the City Clerk had published notices of the City's intention to annex these two (2) parcels of realty in accordance with law in such cases provided, and had not been served with any objections to such annexation. The City Council was reminded that the Kelly Tract was being brought into the City under zoning classification "C -211, in order that this parcel of u realty ould be used as a mobile home Y park, which use would be most J beneficial and in the best interests of the City. Municipal Counsel had prepared an Ordinance providing for the annexation of both tracts, tentatively numbered ORDINANCE O -E (1). Whereupon and after further discussion, the City Clerk read the proposed Ordinance in full for the first time. SPECIAL MEET- Vice Mayor Miller informed the Council that a special meeting would ING ON DECEMBER 11, be held on the following day, December 11, 1963, at 10 :00 A. M., in the 1963: Municipal Office of the City, 1001 Park Avenue, Lake Park, Florida, for the purpose of enacting the aforementioned ordinance. RIGHT -OF -WAY The Vice Mayor advised the City Council that Royal American DEED FROM ROYAL AMERI- Industries, Inc., a Delaware corporation duly licensed to do business in CAN INDUSTRIES, INC. AND Florida, and Bankers Life and Casualty Company, an Illinois corporation BANKERS LIFE AND duly licensed to do business in Florida, had jointly offered to dedicate a CASUALTY COMPANY: right -of -way for road and utility purposes in Sections 11, 12, 13 and 14, Township 42 South, Range 42 East, Palm Beach County, Florida, and in conjunction with the golf club site of The Professional Golfers` Associa- tion of America. This right -of -way would provide access to the golf club from Monet Road, a County road, and also from Military Trail, also a County road. Therefore, it was highly desirable that the City accept this conveyance. The Council was presented with the proposed right -of -way deed. After further discussion, the following resolution was duly made, seconded and unanimously adopted: BE IT RESOLVED, that the City of PALM BEACH GARDENS, u in common council convened, does hereby accept that certain dedication from Royal American Industries, Inc., and Bankers I- Life and Casualty Company, of two (2) parcels of land eighty (80) feet in width located in Sections 11, 12, 13 and 14, Township 42 South, Range 42 East, City of Palm Beach Gardens, Palm Beach County, Florida, for road purposes and for the construction and maintenance of public utilities; and BE IT FURTHER RESOLVED, that the City acknowledge its acceptance as aforesaid by joining in that right -of -way deed, and that HORACE S. MILLER and WILLIAM L. CARGILL, Vice Mayor and City Clerk respectively be, and the same hereby are, authorized and empowered by and in the name of the City to execute any such acceptance. PALM BEACH Vice Mayor Miller read the report of the Palm Beach Gardens Police GARDENS POLICE REPORT FOR Department for the month of November, 1963. NOVEMBER, 1963: PROGRESS REPORT OF PALM BEACH The Palm Beach Gardens Volunteer Fire Department presented GARDENS the City Council with a progress report. It was accepted by Vice VOLUNTEER FIRE Mayor Miller in behalf of the Council.
