CITY OF PALM BEACH GARDENS
O -D; INTENTION
MINUTES OF REGULAR MEETING OF CITY COUNCIL
TO ANNEX
WEDNESDAY, OCTOBER 24, 1962
UPTHEGROVE,
The regular meeting of the City Council was held at 1001 Park Avenue,

Lake Park, Florida, on Wednesday, October 24, 1962, at 10:00 o'clock A.M.
QUORUM:
The City Clerk announced that a quorum of the City Council was present.
PETITION TO
Mr. Norman Rowland, Vice Mayor, acting as Mayor, advised the

Council that Bankers Life and Casualty Company had petitioned the City to

annex three (3) parcels of realty owned by it in Palm Beach County, Florida,

more fully described in Exhibits "A ", "B" and "C" attached hereto and in-

corporated herein by reference, and hereafter respectively referred to as
the Upthegrove, Froehlich and Thompson Tracts. This petition is attached
hereafter as Exhibit "D" and is incorporated herein by reference.
ORDINANCE
The Acting Mayor further advised the Council that at his request

Municipal Counsel had prepared an Ordinance expressing the intention

on the part of the City to annex the Upthegrove, Froehlich and
THOMPSON TRACTS
TO CITY:
Thompson Tracts to the City as soon as possible after thirty (30) days
from enactment of this ordinance, tentatively numbered Ordinance O -D.
Whereupon, and after further discussion, the Clerk read the proposed
ordinance in full for the first time.
PROPOSED Mr. Rowland next advised the City Council that it was most desirable

ORDINANCE at this time to enact an ordinance imposing an excise tax on the sale,

MUNICIPAL consumption, or use of cigarettes within the City, and that such was fully

TAX: authorized under Chapter 210, Florida Statutes, 1962. He said that
municipal counci 1 had prepared an ordinance to this effect.
The City Clerk then read in full this proposed ordinance, tentatively
numbered General Ordinance No. 10, for the first time,
PROPOSED Mr. Rowland next advised the City Council that it was necessary

FLORIDA Florida Model Traffic Ordinance, inasmuch as the municipal speed

TRAFFIC laws and the laws regarding school zones and school zone speed
limits, as set forth therein were inadequate for the needs of the City.
This inadequacy was removed by an ordinance amending General Ordinance 2
that municipal counsel had prepared.
The City Clerk then read in full this proposed Ordinance, amending
General Ordinance 2, for the first time.
RESIGNATION Upon resolution duly made, seconded and unanimously adopted, the

�- The Acting Mayor further advised the Council that the office of City

OF EUGENE F. Judge was now vacant and that Eugene F. Bic, who is duly licensed attorney

JUDGE: of the State of Florida and who is emminently qualified to hold this office,
had been offered the position and had accepted. Whereupon, and after further
discussion, upon Resolution duly made, seconded and unanimously adopted,
Eugene F. Bic was appointed City Judge of Palm Beach Gardens. Mr. Bic °s
oath of office will be attached hereto.
DEDICATION The Vice Mayor advised the Council that Bankers Life and Casualty
OF PLAT,
UNIT NO. 6, Company, an Illinois corporation duly authorized to do business in Florida,

SQUARE: had filed with the City Clerk a Plat of UNIT NO. 6, PALM BEACH SQUARE,
CITY OF PALM BEACH GARDENS wherein certain lands were dedicated to
the City for streets, easements and expressed uses, a copy of which Plat is
incorporated herein by reference.
ACCEPTANCE Upon Resolution, seconded and unanimously adopted, Plat designated
AND
APPROVAL PALM BEACH SQUARE, UNIT NO. 6, CITY OF PALM BEACH
OF PLAT,
UNIT NO. -6: GARDENS, dedication of certain lands in the City of PALM BEACH
GARDENS, as provided therein, was accepted and approved.
ADJOURN-
MENT:
There being no further business to come before the meeting, it was
duly adjourned.

All that part of Section 16, Township 42 South, Range 42 East,
Palm Beach County, Florida, lying North and East of the North-
east right -of -way of the Seaboard Air Line Railroad and North of
the North right -of -way of West Lake Park Road, less the rights-
of-way of State Road No. 710 (Bee -Line Highway) and Central and
Southern Florida Flood Control District Canal C- 18, consisting
of approximately 527 acres, more or less,
commonly known as the UPTHEGROVE TRACT.

42 East, being 345 acres more or less, specifically described as
follows:
(a) The north half of said Section 14, except 10 acres more or
less, consisting of the north half of the southwest quarter of the

the south half of the northwest quarter of the southwest quarter
of the northwest quarter; and
(b) The east quarter of the southeast quarter of said Section 14,
excepting 5 acres more or less, consisting of the east half of

An Ordinance to annex certain lands to, saes incorporate the same withia,
the territorial limits of the CITY OF PALM BEACH CARDXNS.

GARDENS. FLORIDA:
Section 1. Short Title. This Ordistaaa�se shall be known as Annexation -Ill 1-1
