CITY OF PALM BEACH GARDENS
Meeting of the City Council, acting for itself and as the Zoning
Board of said City.
The meeting was held at 1001 Park Avenue, Lake Fark, Florida, on
the 20th day of January, 1961, at 10:00 o'clock A.M., in accordance with a
Notice of Amendment of Zoning Ordinances and Zoning Map relating to ten
(10) parcels of property of the BANKERS LIFE AND Ci1SUAI TY CO�TvNY, an Illi-
nois corporation authorized to do business in Florida.
The meeting was called to order by the Mayor.
The Clerk declared a quorum of the City Council to be present.
ZONING
AMENDMENT This meeting was called for the purpose of considering and hearing
a petition to arend the zoning ordinance and accompanying zoning map relating
^ to ten parcels of land described in said petition and marked Exhibit "A ",
which were lately annexed to and now come within the territorial limits of
PMV BEACH GARDENS.
The Clerk informed the Council that notice of the time and place of
the hearing had been given in accordance with the statutes in such cases
provided and the Charter of the City. An affidavit of publication of notice
of the hearing is hereto attached; and
The Council heard read for a second and final time, and then discussed
at length the text of the ordinance introduced at the meeting of December 22,
1960. Certain prospective occupiers of commercial property within the City re-
quested consideration of text amendatory to the zoning ordinance on the subject
of the location, license, and regulation of taverns and establishments for the
sale of liquor at retail.
It was thereupon moved, seconded and unanimously resolved that the
amendatory ordinance cf December 22, 1960 be further amended by adding the
following priviso to Section X1, paragraph 31:
"Provided-
(a) No such establishment or use of property shall be
situate within 5e0 feet of an established church or
school, said distance to be measured from the nearest
exit of said tavern or establishment in shortest line
to the nearest public highway or sidewalk; and thence
along legal lines of public travel to the nearest en-
trance of said church or school;
(b) The issuance of a permit or license for the operation
of any such tavern or retail establishment for the sale
of alcholic liquors shall be discretionary with the City
Council; shall be granted only after consideration of a
finding of facts and recommendations by the Board of Zon-
ing Appeals; and the City Council may require such personal
information, recommendations, references and other data as
it shall deem to be appropriate; charging such reasonable
fee as it shall set from time to time by ordinances;
(e) The City Council shall impose such special restrictions as
to the premises occupied by such use, and as to the hours
of operation, as it shall determine to be in the public
interest, which shall be incorporated in rules and regula-
tions promulgated by the City Council or the Board of appeals
from time to time.

The Council after further discussion of the amended ordinance, by
unanimous vote, ratified the zoning ordinance and map as amended, and enacted
the same. , s �
