MEETING OF THE CITY COUNCIL - MARCH 7th, 1961
A meeting of the City Council was held at 1001 Park Avenue, Lake Park, Florida
on Tuesday, the 7th day of March, 1961 at 10:00 o'clock A. M.
The meeting was called to order by the Mayor.
UQ ORUM: The Clerk declared a quorum of the City Council to be present.
BagLING Aga The Mayor advised the Council that Garden Lanes, Inc., had requested
LICENSES: a license .to sell alcoholic beverages on the premises at 3169 North
Lake Boulevard. After discussion by the Council, the following motion
was made, seconded and adopted; That a license be granted subject to
the following resolution:

This license is granted subject to the following specific conditions set
forth in the resolution of the City Council: _
(1) The premises shall maintain an eating place with a seating capacity in
excess of 200.
(2) You shall secure the appropriate State and County licenses, both for the
eating place and such as are by law required in dealing in alcoholic
beverages.
(3), During the remainder of the calendar year 1961, you shall pay to the
City a license fee of $50.00 per month, each month in advance, the first
such installment to become due when you so notify this City that you
have secured the requisite State and County licenses. This City license
shall become effective only upon the payment of the fee.
(4) This license shall terminate immediately upon failure to pay any fine re-
quired thereunder. It may be terminated, at the option of the City Coun-
cil for breach of statute, cancellation of State or County permit, or
failure to maintain the establishment in accordance with law and good
order.

Charter and give notice of intention thereof, and it being decided
by the Council, and deemed in the best interest of the City of Palm
Beach Gardens to request the Senator and Representatives in the Florida legisla-
tlre from Palm Beach County to sponsor an Act amending Sections 6, and 7 of Article
III, of the Charter of Palm Beach Gardens; and counsel for the City having advised
the Council in relation to the procedure.

Upon motion seconded and duly passed, it was resolved by the Council as

"BE IT RESOLVED, BY THE CITY COUNCIL OF PALM BEACH GARDENS,
FLORIDA:
Section 1. That the Senator and both Representatives
in the Florida Legislature from Palm Beach County be
requested to sponsor the passage of an Act amending
Section 6, of Article III, Chapter 59 -1707, Laws of
Florida, 1959 changing the date of the initial election
to the third Tuesday in March, 1965; amending Section 7,
Article III, Chapter 59 -1707, Laws of Florida, 1959,
changing the date of the first annual election to March
1965, with reference to Councilmen in Groups 2 and 4.
ADOPTED this the 7th day of March, A. D. 1961."
AND IT WAS FURTHER RESOLVED: That notice of intention to apply for
the passage of special or local legislation be published and that
notice be given in accordance with the statutes of the State of
Florida, and the rules of the State legislature in such cases pro-
vided.

TO BE ENTITLED
AN ACT TO AMEND SECTIONS 6 AND 7 OF ARTICLE III, CHAPTER
59 -1707, LAWS OF FLORIDA, 1959, RELATING TO THE CHARTER
OF THE MUNICIPALITY OF PALM BEACH GARDENS, PALM BEACH
COUNTY, FLORIDA, A MUNICIPAL CORPORATION, PROVIDING FOR
AN EXTENSION OF THE ORIGINAL TERM OF OFFICE OF THE MEMBERS
OF THE ORIGINAL CITY COUNCIL AND CHANGING THE DATE OF THE
FIRST ELECTION TO ELECT SUCCESSORS FOR THE EXPIRED TERM OF
THE ORIGINAL CITY COUNCIL, AND PERTAINING TO OTHER MATTERS
RELATING THERETO AND PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA:
Section 1. Section 6 of Article III, Chapter 59 -1707, Laws
of Florida, 1959, is amended to read:
"Section 6. On the third Tuesday_in March, 1965, an
election by the qualified electors of said municipality
shall be held to elect members of the City Council to
succeed the members whose appointments expire in 1965
as provided for herein and thereafter on the third
Tuesday in March of each succeeding year a general
election shall be held to elect successors to the members
of the City Council whose terms of office shall then expire."
Section 2. Section 7 of Article III, Chapter 39 -1707, Laws of
Florida, 1959, is amended to read:
"Section 7. The selection of members of the City Council
shall be by groups to be known as Groups 1, 2, 3, 4 and
5. The Councilmen in Groups 1, 3 and 5 shall be elected
in the even years and Councilmen in Groups 2 and 4 shall
be elected in the odd years. At the first annual election
to be held in March, 1965, Councilmen in Groups 2 and 4
shall be elected to a two -year term, and every two years
thereafter Councilmen shall be elected in said groups for
a two -year term. At the election to be held in March,
1966, Councilmen in Groups 1, 3 and 5 shall be elected
to a two -year term to expire in 1968 when Councilmen in

two years thereafter Councilmen in said groups shall be

elected to two year terms. The term of office of Council -
men shall commence on the first Monday in April and shall

continue for two years thereafter and until their successors are
elected and qualified. Any candidate seeking election as
Councilmen shall file with the City Clerk a written notice to
such effect during the last ten days of February in the year
of the election, and shall pay such filing fee as shall be
set by ordinance. Such notice shall state the number of the
group in which he seeks to be elected, his place of residence,
his age, a description of the real property owned by him in
the City, and any other data required by ordinance. The can-
didate for each group receiving the highest vote cast for
such office shall be deemed elected to such office. In the
event of a tie vote between candidates- receiving the highest
number of votes cast for any office, the names of all such
tied candidates shall be placed on the ballot and be voted

ing Tuesday. Such election shall be held in the same manner

and by the same officers holding the previous election. No

notice need be given of such election or of any other election
hereunder. In the event of such runoff election, there shall

two persons receiving the highest vote cast for such office or
offices."
