CITY OF PALM EEACH CAREERS
REGULAR MEETING.OF THE CITY COUNCIL OCTOBER 23, 1961
The regular meeting of the City Council was held at 1001 Park Avenue.,
Lake Park, Florida, October 23, 1961, at 2 :30 o1clock P. M.
UORUM2 It was announced by the Clark that a.quorum of the City Council was

APPCQNTMENT The Vice Mayor, acting as Mayor, advised the City Council that, by

MM GROUP 2 virtue of the fact that Charles A. Cunningham had failed to take the
oath of office as a Councilman in Group 2 and had otherwise failed to
qualify for that office and to assume the duties and obligations attendant thereto,
there was a vacancy in the City Council which should be filled immediately. TAhere-
upon, upon Resolution, seconded and unanimously adopted' Leo J. Lehans was appointed
Councilman in Group 2s as set forth in the Charter.
OATH OF OFFr CE The Oath of Office of Leo J. Lehane, as Councilman, is attached hereto.
ACCEPTANCE OF Upon Resolution, seconded and unanimously adopted the Resignation of

Mrs# Ruth Kerr, as City Treasurer effective October 9, 1961, was re-
ceived and accepted.
APPCIENTIVENT Upon Resolution, seconded and unanimously adopted, William. J. Gentle was

amended by the deletion of Herbert B. Thompson and Ruth Kerr therefrom; the sub-
stitution of William L. Cargill and William Jo Gentle thereon.

REZONING PART OF The Vice Mayor, acting as Mayor, advised that Bankers Life and

ONE f �. T" .r.. Casualty Company (an .rllinois corporation authorized to do business
in Florida) which owned certain land in the City of Palm Beach
Gardens north of Holly Drive, had petitioned the City Council, and the Council as
a Zoning Board, to amend the Zoning Ordinance in order to reclassify that land
(described in its petition which is attached hereto) from its present classifica-
tion "0 & R" to zoning classification "Rr -10';
Further that this request has been considered by the office of the
Acting Mayor and municipal counsel and merits the attention and approval of the
City Council; and
4 Further that counsel for the municipality has prepared an ordinance
affecting such an c. amendment to the Zoning Code, which is attached hereto and
incorporated herein.
PROPOSED The City Clark then read in full the proposed Amendment to the Zoning

�Y. Ordinance tentatively numbered "1 -F" for the first time, and upon motion
duly made, seconded and unanimously passed, it was resolved that notice
of hearing on the proposed Amended Zoning Ordinance be given in accordance with
the statute in such cases provided, and that a public hearing be held on said
Amendment on the 6th day of November 1961, at 10;00 o'clock A. M. at 1001 Park
Avenue, Lalm Park, Florida, and that said Amendment to the Zoning Ordinance be
referred to the Council as a Zoning Board for further examination and study

`� under the Federal Insurance Contributions Act, but that coverage

under the Social Security Act could be afforded to municipal employees and
• officials in accordance with the agreement between the municipality and the
Florida Industrial Commission under the authority of Chapter 650, Florida
Statutes as amended;
Further, that it was most desirable at this time for the City of PALM
LEACH CARIENS to enter into such an agreement with the Florida Industrial
Commission in order to afford its employees and officials the retirement ad-
vantages that Old Age and Survivors Insurance as authorized by the Social
Security Act could and would provide, particularly in view of the fact that
the City did not ?at. present, have any form of pension plan and that such a
plan was not economically feasible, and would not be, for an indeterminate
period of time$
Further, that municipal counsel had prepared an ordinance to authorize
the Vice Mayor, acting as Mayor, in behalf of the City of PRIM BEACH GARLENS,
to enter into and execute an agreement with the Florida Industrial Commission
under which the benefits of the system of Old Age and Survivors Insurance as
authorized by the Social Security Act and amendments thereto, and by Chapter
650, Florida Statutes, as amended, would be extended to municipal employees
and officials.
PROPOSED The City Clerk then read the proposed Ordinance tentatively numbered

on the proposed Ordinance be given in accordance with the statute in such

Florida, and that said Ordinance be referred to the Council for further exam-
ination and study.
FIRE PRO- The Vice Mayor, acting as Mayor, advised that studies were being made at

G R the present time with a view to presenting before the City Council a

comprehensive plan of fire protection and garbage collection, but that
the present needs of the City in each respect were being adequately met inasmuch
• as the Old Dixie Volunteer Fire Brigade had agreed to offer the City of PALM
BEACH GARIENS its services and the City has provided temporary facilities for
the collection of garbage•
REPORT OF CITY The City Treasurer was instructed by the City Council to prepare a
financial report of the City's expenditures-for deliverance at a

future meeting and also at that time to present a list of all the bills incurred
by the City up to November It 1961 for the consideration of the Council,
CITY COURT Municipal counsel was instructed to prepare a plan for a permanent City
ISTEX
Court system orgy in the alternative' to devise a method by which exist-
ing facilities in Palm Beach County or neighboring municipalities may be utilized
until a permanent system of the City of PALM BEACH GARIENS could be established.
