A meeting was held at 1001 kark avenue, Lake F -irk, Florida, at
10:00 o'clock A.M. on the 18th day of April, 1960.

The meeting was called to order by the iayor.
The Clerk declared a quorum of the City Council to be present.
ST:ATCBY SERVICE _T;L) RATES -vITH PALM Bu'CFI CCUNTY UTI7, ITIDS SERVICE: The Mayor
presented to the Council the proposed agreement for utility standby
service and rates with the Falm Beach County Utilities Comrany, a Florida
corporation, and after reading, discussion, and examination thereof, and
there being no objection Hereto, the Council, upon motion duly made and
seconded adopted the following resolution:
REFCLVM: That Herbert B. Thompson, Hayor, and Norman D. Rowland,
City Clerk, execute said agreement on behalf of the
City of Falm Beach Garders.
The meeting was then adjourned.

AGREEMENT FOR r
UTILITY STANDBY SERVICE
PARTIES: The parties to this Agreement are;
PALM BEACH COUNTY UTILITIES COMPANY, a Florida Corporation,
having principal offices at 1001 Park Avenue, Lake Park Florida hereafter
called ItUtility ", and the
City of PALM BEACH GARDENS, a Municipal Corporation, chartered by
the Florida legislature, and having its temporary offices at 800 - 10th St.,
Lake Park, Florida.
GENERAL PURPOSES: Palm Beach County Utilities Company is providing sewer and
water service to the Town of Lake Park under a franchise.
The City of PALM BEACH GARDENS is acquiring a sewage disposal and water
treatment plant located in the City of PALM BEACH GARDENS, and more parti-
cularly in the southeast quarter of Section 12, Township 42South, Range 43 East
Palm Beach County. The territories served, or to be served by the respective
plants are in close proximity. The parties hereto desire to establish standby
services for one another; furnish temporary or emergency service to the
customers of one another; and benefit by the facilities of one another inso-
far as is compatible with primary service each to its own customers.
CHARGES: The parties hereto agree that the cost of any tie -in connections
should be equitably distributed between them, on the basis of computations
and reports prepared by an engineer or engineering firm or firms, to be
mutually agreed upon. I f sex-vices are rendered by one party to customers
of the other, it is agreed that the rate assessed against the customer
shad be determined by the party in whose jurisdiction the customer is
located; but that the accounting shall be on the basis of fair costs to
the company providing the service, plus reasonable allowance for overhead
and any overage or de£iciency,shall be credited or charged, as the case may
be, in whose territory the customer is located.
HILLTOP PARS{: It is agreed by the parties that Hilltop Park is logically the
customer of PALL BEACH GARDENS, since adjacent property, planned
for identical use, lies within the Bills- Goolsby tract recently annexed by 9}
the City of PALM BEACH CAREENS. However, since the water treatment and
sewage disposal plants of PALM BEACH GARDENS, although practically complete,

are not yet operating, it is agreed that PALM REACH COUNTY UTILITIES COMPANY
shall provide the service to Hilltop Park as the agent and representative
of the City of PALM BEACH GARDENS, until PALM BEACH CAREENS, own service can
be extended to that area. The franchise, rates, charges, etc. shall be set
by the City of PALM BEACH GARDENS. PALM BEACH COUNTY UTILITIES COMPANY
shall permit the use of such mains and other facilities as it possesses in
that territory; and shall charge the City of PALM BEACH GARDENS an agreed
equitable wholesale rate, plus a nominal loading for overhead.
KALINA PROPERTY: In similar manner, it is agreed that the Kalina property,
lying inside the boundaries of PALM BEACH GARDENS, as extended,
is a customer for water and sewer service for the City of PALM BEACH GARDENS;
PALM BEACH COUNTY UTILITIES agrees to furnish water and sewage service to
Kalina until such time as the facilities of PALM BEACHL ARIIENS are extended
to service this area. The rates charged shall be set by the City of PALM

BEACH GARDENS. PALM BEACH COUNTY UTILITIES COMPANY shall charge an equitable
wholesale rate to the City of PALM BEACH GARDENS for this service, to be
determined as set forth above.
STANDBY SERVICE: In like manner, the City of PALM BEACH GARDENS agrees that
when its water treatment and sewage disposal plants shall, be
in operation, it will arrange for emergency tie -ins with PALM BEACH COUNTY
UTILITIES COMPANY; and in emergency, it will provide assistance and relief
to PATZI BEACH COUNTY UTILITIES COMPANY if and when called for; and will
participate on an equitable basis in defraying the cost of interchanges to
make such services possible.
AMEN21ENTS AND ?&'iNEMENTS: The parties agree that this undertaking is at
present informal in character; and must be
elaborated and modified as the requirements of their respective communities
shall dictate. Its terms shall be interpreted in the light of the charter
of the City of PALM BEACH GARDENS, and of the franchise from the Town of Lake
Park issued to PALM BEACH COUNTY UTILITIES COMPANY. Specific collateral
agreements, refinerBnts and amendments of this Agreement may be made from
time -to -time by agreement of the parties. Specific schedules and memoranda
covering particular cooperative undertaking may be entered into from time -to-

time, without indicating an abrogation or abandomnent of this basic under-
standing.
HEREUNTO the parties have set their hands and seals this �rday
of April, 1960, at Lake Park, Florida.

Pursuant to your request for spates for water
and sewer eer-i.ce in hilltop Park, the following is submitted:
Water 5,000 gallons per month minimum - $2.50
in excess of 5,000 gallons - .40 per 1,,000
�-� - sewer $2.50 per month
These rates are tentative only, and are subject
to filing requirements of the Florida State Public Utilities
Commission.
