` SPECIAL MEETINr, OF CITY COUNCIL
(EXECUTIVE SESSION)
Upon call of the Mayor, a special meeting of the City Council. of
PALM BEACH GARIENS was held at 8:00 R.' Friday, September 253 1959 at
8.00 - 10th Street, Lake Park, Florida.
CITY FINANCING AND PLANS: The Mayor reported that the City had secured its
Certificate of Exemption under the State Sales
Tax Law.
There ensued a discussion as to the proper extent
of city purchases and the proper interpretation of municipal "institutional
activities" as set forth in the Certificate.
The Mayor and the Clerk reported that they had discussed the City's plans and
future at length with the principal owners of property within the borders of
PALM BEACH r,A1tLWS. They had been assured:
(1) That the City would be provided with all necessary funds and credit
to complete and /or acquire sewer and watel-TTEcilities to service its
citizens.
(2) That ample property for municipal parks, playgrounds and schools
would be dedicated.
(3) That ample long term financing would be provided the City to permit
it to acquire a substantial equity in all or most of the real estate
within its borders.
(4) That the City would be offered long term financing, at favorable
terms, with which to acquire a construction company and to maintain
its operating organizatioh, so that the City's land might be developed.
(5) That opinion of nationally recognized legal counsel had been secured
as to:
(a) The legality of the over -all plan.
(b) The legality of taking exemptions from sales and excise
taxes, state and federal.
The Mayor and Mice Mayor stated that they had been informed that written cor-
roboration of these opinions would be forthcoming shortly.
The Council thereupon expressed its belief that the Mayor and Vice Mayor were
justified in giving the corporate purposes of the City a somewhat liberal
interpretation..

The specific situation as regards Florida. Construction Company was discussed,
in light of statement of intention by its controlling stockholder- (which is
also the owner of the greater part of the property in Palm Beach Gardens) the
Florida Construction Company will be offered to PAIM BEACH GARDENS, at cost
or less, to serve the City as its public works department. The Council author-
ized the City Officers to look into the proposition, and to take such prelimin-
ary steps as they deem advisable.
PURCHASING AGENT: The Council unanimously approved appointment of a Purchasing
Agent; and selected Norman D. Rowland to serve as euch;
with the proviso that each purchase be reported, in writing, to the Mayor and
the City Treasurer, and that a list of purchases in excess of $1000 be sent
each member of the City Council each month.
ACCOUNTING SYSTEM: The Council requested Charles J. Stella, the Tax Assessor,
cause of his special training, to outline at the next
meeting a rough approach to a system of budgetting, bookkeeping and accounting.
The meeting thereupon adjourned.

The undersigned, being a member of the City Council of the
City of PALM BEACH GARIENS, does hereby waive notice of the holding
of the special executive session,meeting of said City Council, held
at 8 :00 PM, 800 - 10th Street, Lake Park on Sept. 25, 1959; and
ratifies the minutes thereof, to which this waiver is attached.
