Petition PUD- 04 -01: Amendment to Burns Road Community Recreation Campus
PUD
Public Hearing Continued & Recommendation to City Council: A request by Mr. Jeff
Renault, P.E. of LBFH, Inc., on behalf of the City of Palm Beach Gardens, for approval
of an amendment to the Burns Road Community Recreation Campus Planned Unit
Development (PUD) to allow for modifications to the previously approved PUD. The
modifications include a 25 -yard by 25 -meter pool, a water activity pool and additions to
the Community Center including a new gymnasium, a new restroom/locker room facility
and storage area. The site is generally located on the south side of Burns Road east of
Military Trail.

Binghamton, New York. In this position he supervised
all aspects of planning for a county of 230,000. -
He was responsible for preparing and directing regional
'701' work, model subdivision codes, zoning review, and providing
planning guidance to the smaller county towns.
1965-1968 Director, Comprehensive Planning Division, City of
Syracuse, New York. He authored portions of
the General Plan -Area Characteristics and
administered urban renewal. As Director, he was
responsible for researching, writing, graphics and
publishing of the General Plan.

I. GENERAL INFORMATION
A. For a complete description of the regulations for a Planned Unit Development Overlay District
(PUD), please see Article IV, Zoning Districts, Section 78 -154, Land Development Regulations.
Also, please see Article III, Application Procedures, Section 78 -46, Land Development
Regulations for complete application procedures and requirements.
B. Following a mandatory Pre- Application meeting (per Section 78 -45), the petitioner may
submit a complete application for review by the Planning and Zoning Division. New
applications are accepted only on 2 "d and 4'h Fridays between 8:00 a.m. and 12:00 noon.
Applications may be submitted earlier; however, staff is not obligated to process the
application until the deadline. The applicant may request, upon approval of the Growth
Management Director, a non - binding, preliminary workshop or conceptual review by the
Planning and Zoning Commission. Site plans, elevations, and other information as deemed
necessary by staff shall be submitted two (2) weeks prior to the scheduled meeting.
C. After staff has determined that the application is sufficient, it shall be scheduled for review by the
Development Review Committee (DRC). After receiving DRC certification, the petition shall be
scheduled for the next available Planning and Zoning Commission meeting, (subject to agenda size)
as determined by the Growth Management Director, provided all advertising requirements have
been satisfied. After receiving a recommendation from the Planning and Zoning Commission, the
petition will be scheduled for a Ciy Council meeting for final disposition. (For complete details, see
Land Development Regulations, Chapter 78, Article III, Development Review Procedures, Division
I.)
D. Number of Plans:
1. At the time of the initial application submittal, nine (9) sets of submittal packages and the
application, and other supporting documentation shall be included. Seven (7) working days prior to
the scheduled Planning and Zoning Commission meeting, fifteen (15) sets of 11" x 17" reduced
copies shall be submitted no later than 12:00 noon. Should there be additional revisions as a
result of the Development Review Committee, Planning and Zoning Commission meeting or

subsequent City Council meetings, then nine (9) full -size sets of revised plans plus fifteen (15)
sets of 11 "x 17" reduced plans shall be submitted no later than 12: 00 noon seven (7) working
days prior to the scheduled Planning and Zoning Commission meeting or the City Council meeting,
as applicable. All plans shall be date stamped by the applicant. Please note that the following
plans shall be signed and sealed prior to the first reading at the City Council level by the
applicable registered professional in the State of Florida: photometric and engineeringplans
by a civil engineer, boundary surveys by a certified surveyor, architectural plans by a
architect, and landscape plans by a landscape architect.
2. As part of any re- submittal of revised plans, the applicant shall replace the revised sheets
within the previously submitted set as required herein; or alternatively, the applicant may re-
submit complete sets of all plans.
3. In addition, initial submittals and re- submittals of all plans, color
perspectives /renderings, and elevations shall be submitted in a .JPG digital format on CD
ROM no later than 12:00 noon seven (7) working days prior to the scheduled Planning
and Zoning Commission and City Council meetings. Further, the final approved plans&
Photographs of all display boards listed in this application shall also be submitted in
.JPG format on CD ROM within 30 days of development order approval.
4. The petitioner should verify that all submittal documents comply with the submittal chart listed
on page 14 of this petition checklist.
H. FEES- At the time of application submittal, the following fees and escrow balances shall be
payable to the City of Palm Beach Gardens:

plans, and other information, as required by staff, shall be submitted
at least two weeks prior to meeting date for review at a preliminary
workshop.
B. Professional Fees:
In addition to the application fees, thepetitioner shall be responsiblefor all fees incurred
by the City's consulting engineers, at the consultants' hourly rates. A schedule of these
rates is available at the Finance Department (subject to change from time to time). No
building permit shall be issued until all costs to date have been paid. The escrow funds
shall be deposited in an interest- bearing account with any accrued interest to be retained by the
City of Palm Beach Gardens. The escrow account shall be charged only for actual charges
made by the City Engineer and Traffic Consultant, attributable to the Petitioner. Any unused
fields shall be refunded prior to certificate of occupancy. Any expense exceeding the minimum
balance amount in escrow shall be invoiced from the City to the Petitioner. The Petitioner shall
reimburse the City within five (5) days of receipt of invoice. Failure by the Petitioner to make
such reimbursement when due shall abate the pending petition until paid.
Minimum Escrow Balances:

1. Civil Engineering Fees:
Simultaneously with the filing of a petition, the Petitioner shall deposit with the Planning and Zoning
Division, an escrow amount in addition to the required minimum balance as a credit for the services
of the Civil Engineer as follows:
a. Residential property - $30.00 per dwelling unit.
b. Non - Residential Property - $300.00 per acre.
2. Traffic Engineering Fees:
Simultaneously with the filing of a petition, the Petitioner shall deposit with the Planning and
Zoning Division, an escrow amount in addition to the required minimum balance as a credit for the
services of the Civil Engineer as follows:

a. Residential property - a minimum deposit of $1,000.00 - or $20.00 per living unit, whichever
is greater.
b. Non - Residential property - Based on the totaled enclosed gross square footage of the
building(s):
(1) 0- 50,000 sq. ft. -
(2) 50,001- 200,000 sq. ft. -
(3) Over 200,000 sq. ft. -
C. Advertising Costs:
• minimum of five cents ($.05) per sq. ft.
• minimum of ten cents ($.10) per sq. ft.
• minimum of five cents ($.05) per sq. ft.
In addition, the petitioner shall pay all costs of publication of notices required in a newspaper of
general circulation within the City. Publication costs shall include all notices of hearing and the
passage of an ordinance. Payment shall be made to the City within ten (10) days of date of
invoice. No hearing shall be held on a petition unless publication costs to date have been paid
at least twelve (12) hours prior to the time of the hearing.
D. Art in Public Places Fee:
All non-residential developments in the City shall comply with Section 78 -262 of the Land
Development Regulations regarding Art in Public Places prior to issuance of Certificate of
Occupancy. The petitioner shall have the option of complying with the standards of the Art in
Public Places or make a payment into a City fund.
NOTE: All of the above mentioned fees are subject to amendments by City Council.
III. SUBMITTAL DOCUMENTS:
A. Site Plan
1. All full size plans are to be folded to 9" x 12" size by the applicant, grouped by discipline
(i.e. site plan/landscape%ngineering /architecture /signage).
2. The Site Plan shall be as large as possible, with a absolute minimum scale of I "= 60
feet to be placed on a 24' by 36, or as necessary to adequately depict all information
including dimensions, etc.
a. Location of wooded areas, existing or proposed water bodies, and other
environmentally sensitive lands. Existing topography of the site shall be shown by spot

elevations at SD feet on center and at important changes in elevation or contours
with intervals of one (1) foot or less, extending one hundred (100) feet beyond the
tract, when practical. A land surveyor, registered in the State of Florida, must certify the
topographic survey. This topographic survey shall be shown on a separate sheet.
Cthe The location, dimension, bearings of property lines, and all existing structures,
alks, driveways, bicycle & automobile parking spaces on the site, as defined in
Land Devel opment Regulations, as well as those on adjacent
ties within one hundred (100) feet beyond the boundaries of the site.
c. The use, approximate dimensions, including building height to top of roof, and
location of all proposed buildings and other structures. The number of dwelling
units by type and gross floor area of non - residential structures proposed.
d. Number, height, and type of residential units (whether single family, zero-lot -line,
townhouses, apartments, etc.). If applicable, the length and diameter of cul -de-
sac(s)
e. Location and width of all existing and proposed streets (named), intersections,
driveways, walkways, easements, bicycle paths to and from the site, and the location,
materials, walkways, water /sewer lines and other utility locations to and across the
subject site, and off - street parking facilities for the various buildings and uses. Indicate
compliance with separation requirements between buildings and /or foundations
and utility lines.
L Graphically indicate turning radii compliance for emergency vehicle access to the
site and buildings, showing a continuous path of ingress and egress from the site.

g. Approximate location and acreage of any proposed public use such as parks, school
sites, and similar public or semi -public uses.
h. Any proposed shoreline vegetation alteration.
i. Pavement centerline radii/speed limit and ultimate rights -of -way dimensions for roads and
canals (note if existing, proposed, dedicated, reserved, etc.).
j. Entrance alignment across the road and separation from adjacent entrances.

k. Show raised curbing to protect landscaping at divided medians and island.
1. Compliance with 100 -foot stacking distance at entrance if security gate is
proposed.
m. If the Applicant wishes to develop the parcel in phases, a site plan indicating
proposed ultimate development sequence shall be provided. Proposed
development phases shall be numbered in sequence and shall indicate the projected
schedule of development over a period of years. This schedule must be updated
annually on or before the anniversary of its approval until the entire development is
completed. The schedule update shall be submitted in writing to the Planning and Zoning
Division of the Growth Management Department. Ifnot submitted, buildingpermits
may be held.
n. Thermoplastic, white pavers for stop bars in paver brick areas.
o. Length and width of truncated road stubs.
p. Buildings: maximum height (allowed and proposed), phasing, and number of
buildings.
q. Proposed location, size, and type of permanent outdoor signs.
a. Zoning category of the site and all parcels within 150'.
b. Land use of all parcels within 150'.
r. An Information Block providing the following information:

? Scale (graphic and written)
? Name of development and project name

Parking spaces: required and proposed number and dimensions, including handicap
spaces, bike racks, and loading spaces for each use.
t. Locations and sizes of all trash receptacles and trash compactors, including elevations
and materials to be used for all required screening elements and access doors.
B. Site Lighting Plans. For full details, please refer to Section 78 -182 of the Land
Development Regulations. Indicate all exterior lighting, location, height, type, foot- candles,
including cut sheets must be shown as follows:
1. Lighting and photometric plans shall be signed and sealed by a engineer registered in the
State of Florida at the time of City Council's review, (the Planning and Zoning
Commission may require photometrics during their review) for all exterior lighting
elements including, but not limited to, building security lighting, landscape highlighting, parking
garage lighting, porte cochere or canopy lighting, signage back lighting or uplighting, etc.,
as well as the parking lot lighting. Lighting elements/fixtures for both building and site must be
shown on all elevations and perspectives. Please note that photometrics do not have
to be signed and sealed during the initial submittal and DRC.
C. Certified boundary survey. To be dated within 12 months of the application date by a surveyor
registered in the State of Florida at a scale the same as the site plan, containing the following:
1. An accurate legal description of the subject property.
2. A computation of the total acreage of the parcel to the nearest one /tenth of an acre.
3. Compliance with the minimum requirements of Florida Statutes.
D. Area Location Map. (Can be shown on site plan) Vicinity map of the area within one (1) mile,
or a larger area ifsurrounding elements would be impacted by the proposed development. If
possible, the map shall show all of the following:
Traffic circulation systems. (necessary)

2. Major public facilities.
3. Municipal boundary lines. (necessary)
4. Public bus and school bus stops.
E. Landscape Plans. Indicate all existing and proposed landscaping including the location of
landscape buffers or screening walls along external collector and arterial roads, with landscape
plans for entrance features, subdivision streets, buffers and common areas in compliance with the
Land Development Regulations, Division VII, Landscaping.
1. Landscape plans must show plantings at an accurate, as they would reasonably appear at a
maximum of 3-years growth.
2. Plantings that are 8-feet in height or larger to be shown on perspectives at the request of
the Planning & Zoning Commission or City Council.
3. Landscape plans shall utilize the same graphic symbols (octagon, circle, square) on the
plan and the schedule to facilitate review and understanding of the intended design.
4. All berms and walls shall be shown depicting vertical dimensions or height.
5. All existing and proposed easements, water & sewer lines, tracts, encumbrances and
lighting need to be shown on the landscape plan.
6 Plans should reflect existing landscape on all four adjacent sides to the project in order
to determine the transitioning of appearances and plant palettes. A tree survey, a tree
inventory acceptable to the City Forester, or an approved landscape plan may be used to
demonstrate existing vegetation to achieve desired landscape buffering of proposed
developments.
7. All safe -sight triangles.
8. Any additional information deemed necessary by the City Forester in accordance with
section 78 -305.
F. An aerial photograph of the appropriate section, township and range of the City, outlining k
subject property and delineating all contiguous zoning districts at a scale of not less than 1 " 200'
or as determined by staff. Aerials may be obtained from the Palm Beach County Property
Appraisers Office located at 301 N. Olive Avenue, 5rh Floor Governmental Center, WBtftn
Beach, FL 33401.

G. Exterior architectural elevations at a scale of 1/8" of all buildings /structures indicating
style of architecture, height in stories, type of materials, exterior colors, design features.
1/16" scale exterior elevations may be used provided the submittal includes at least 1/8"
scale details of all typical design conditions. Indicate size, material, and color of all exterior
surfaces, trim elements, reveals, ornamentals, wall- exhaust fans and downspouts, signage,
and hurricane shutters if employed. For a phased development, this information need not
necessarily be provided for future phases.
H. Perspectives. A minimum of one colored, three - dimensional perspective for each major
building component of the project shall be submitted prior to the first P &Z meeting. The
colored perspective should match the color samples as closely as possible. Perspectives can
illustrate less or smaller landscape materials than those specified in order to illustrate the
design of a building beyond. In no case should the landscaping be altered to depict a more
intense landscape solution than what the Petitioner is proposing. If necessary, landscaping
may be removed to adequately depict the architecture.
I. MateriaU Color Display Boards. Display boards as determined by staff or the Planning &
Zoning Commission as sufficient quantity, showing type of materials, colors, and
photographs of all exterior building materials and fixtures shall be provided. These should
include stucco colors, precast, glass, mullions, roofing materials, paver bricks, light
fixtures, decorative awnings, and other decorative elements. All material /display boards shall
be submitted at the first Planning & Zoning Meeting; and high - resolution photographs of the
boards in .Jpg format shall be submitted at the City Council approval hearing. Please note
that all boards are part of the application, and are returned to the applicant only after prior
archiving.
J. Sign Package: Illustration of architectural elevations of all signs on the site indicating the
location, size, landscaping, design lettering, type of materials, colors, fonts, illumination
sources, and other features. Also, drawings need to show approximate location and size of all signs
on the exterior elevations.
K Roof plans: Showing all proposed mechanical equipment, screening devices & materials.
Heights of all critical screen elements shall be provided. Roof samples and colors shall be
required for all visible roof materials.
L. Floor plans: Showing the locations of all exterior doors, windows, and primary circulation
elements (entrances and exits, stairs, elevators, corridors, etc).
M. Contiguous property: All such property within the application boundaries under ownership or
control of the Applicant shall be shown, described, or noted on a separate submittal plan, if not

adequately shown on the site plan. Evidence of unified control of the entire area within the proposed
PUD shall be required by means of a unity of title or unity of control that is acceptable to the
City Attorney.
N. Preliminary Drainage & Utilities Plans: Conceptual plans for drainage (water quality/quantity) &
utilities shall be provided, including all proposed cross- sections, pass - through drainage, lakes and
maintenance easements, etc. Coordinate landscape locations by applying utility guidelines as an
overlay to the landscape plan. Compatibility ofdepressed dry, storm water retention area(s) and
swales with landscaping.
IV. SUPPORTING DOCUMENTS:
See Development Application for Form.
A. Authority. A statement of the Applicant's interest in the property and:
If in joint and several ownership, a written consent to petition by all owners of record, or
If a contract purchase, written consent of the seller /owner, or
If an authorized agent, a copy of the Agency Agreement or written consent of the owner(s), or
4. If a lessee, a copy of the lease agreement and notarized written consent of the owner(s), or
If a corporation, partnership, or other business entity, the name of the officer or person
responsible for the application and written proof that said representative has authority to
represent the corporation, partnership, or business entity, or in lieu thereof, written proof that
he or she is in fact an officer of the corporation,or
6. If a group of contiguous property owners, all the owners of the property described in the
petition must provide written consent.
B. Warranty deed With an affidavit from the applicant that the deed represents the
current ownership.
Note: If ownership of the property changes at anytime during the approval process and
prior to construction plan approval, the Growth Management Department and the
Finance Department are to be notified immediately in writing.
C. Property Owners List: A complete list of all property owners and mailing addresses for
all property owners within five hundred (500) feet of the subject parcel as recorded in the

latest official tax role in the County Courthouse. A notarized affidavit must be famished
regarding the completeness and correctness of the list.
Please note: Prior to a scheduled public hearing, the applicant or the agent shall be responsible
for mailing notices to the owners of all surrounding property within 500 feet by regular mail, when
at the Planning & Zoning Commission stage of review, and certified letters, when at the City
Council stage of review, postmarked at least ten (10) calendar days prior to each public hearing, in
accordance with Section 78 -54 of the Land Development Regulations. The certified letter of
confirmation receipts should be returned to the Growth Management Department with a
notation indicating the petition name and number.
D. An agreement by all owners within the PUD that includes their commitment to:
1. Proceed with the proposed development in accordance with the PUD ordinance and any
conditions and safeguards as may be set by the City Council in the ordinances; and
2. Provide a written statement of a proposal for completion of the development according to
plans approved by the ordinance, and for continuing operation and maintenance to those
areas, functions, and facilities as are not to be provided, operated, or maintained by the city
pursuant to written agreement; and
4. Bind their successors in title to any commitments made to their application including any
changes required of the overall PUD during City review of any sub - component.
5. A legally binding document that stipulates Unity of Control over the entire PUD. Please see
Section 78- 154(f).
V. REPORTS:
1. For residential projects, a school concurreny statement from the School District of Palm Beach
County, Planning Department, Attention: Concurrency Section, 3320 Forest Hill
Boulevard, West Palm Beach, FL 33406 -5813, telephone 561- 434 -8028, indicating the
anticipated impact on schools. Fees are as follows: $20.00 for projects with 200 units or more,
or $10.00 for projects under 200 units. (see attached form)
2. A drainage statement by the applicant's engineer that the site drainage system will be designed
to meet the requirements of the South Florida Water Management District, the City of Palm
Beach Gardens Land Development Regulations, other applicable regulations, and to provide a
legal positive outfall meeting the adopted Level of Service. Additional supporting calculations
for larger projects may also be required.

3. (a) A traffic analysis report or statement from the Palm Beach County Engineering
Department, Traffic Division, that the project, if generating 1,000 or more average daily trips,
conforms to the 1990 Countywide Traffic Performance Code of Palm Beach County, and as
subsequently amended, and that the project - generated trips are reserved. (The City Engineer
obtains this approval after review of report at the Concurrency application stage)
OR
(b) A statement from the City Engineer that the proposed project, if generating less that 1,000
average daily trips, conforms to the 1990 Countywide Traffic Performance Code, and as
subsequently amended, and that the project - generated trips are reserved.
Note: In both of the above cases, the City Engineer will need to issue a statement that the
proposed project also meets the City of Palm Beach Gardens Traffic Performance
Standards.
4. A statement from the Solid Waste Authority, Director of Planning and Environmental
Programs, 7501 North Jog Road, West Palm Beach, Florida 33412, telephone 561 -640-
3400, that the proposed project will be served by the facility. The statement should indicate the
availability of solid waste disposal capacity.
5. A statement and analysis for residential projects from the City's Community Service
Administrator that the proposed project will maintain the Levels of Service for public parks.

6. A notarized Applicant Narrative describing the following:
a. The major planning assumptions and objectives of the development project, including
but not limited to: projected population of the development and proposed ownership
and form of organization to maintain common open space facilities.
b. How the intended plan of development complies with the Comprehensive Plan.
c. The preliminary schedules of development, including the staging and phasing of:
(1) Areas to be developed, in order of priority;
(2) The construction of streets, utilities, and other improvements necessary to
service the proposed development;
(3) Median landscaping and public right -of -way;

(4) The dedication of land to public use; and
(5) Physical recreation facilities.
d. Compliance with all applicable conditions of the Planned Unit Development, as defined
in the Land Development Regulations, Section 78 -154.
e. An "Environmental Assessment" (if deemed necessary by the City Forester)
addressing the requirements of all applicable environmental ordinances, as
defined in Division 5 of the Land Development Regulations.
VI. MISCELLANEOUS
A. The applicant shall place a 3'x3' sign with a 4' pole on the subject property, at least fifteen (15)
calendar days prior to the first public hearing per Section 78 -54 of the Land Development
Regulations, that is readily visible to vehicular and pedestrian traffic, stating the following:

B. The applicant shall remove the sign from the subject property within ten (10) days of
final vote by the City Council.
C. The Applicant shall pay the official application and engineering fees, as required by
the City, at the time of application filing.
D. The applicant shall provide any other reasonable information that maybe required by the
Growth Management Administrator, City Engineer, Planning and Zoning
Commission, City Attorney, and the City Council.
