EXECUTIVE SUMMARY
PGA Commons Land Trust is requesting to modify the site plan for the Rocco's Tacos
Restaurant located within Parcel 2 of the PGA Commons Planned Unit Development (PUD).
The modifications include a waiver to allow amber-colored light bulbs within the existing light
baskets and a request to change the color of the existing tiki torches form brown to lime
green. Both elements are located within the outdoor seating area of the restaurant. Staff is
recommending approval of the waiver for the amber light bulbs and denial of the request to
change the color of the tiki torches.
BACKGROUND
On February 11, 1999, the City Council adopted Ordinance 8, 1999 approving the PGA
Commons Parcel 2 PUD to allow 17 townhomes, 6,606 square feet of general office, 7,150
square feet of inedical office, 12,654 square feet of general retail, 3,300 square feet of
restaurant, and eight (8) apartment units located above the commercial uses.
Numerous amendments have been made since the original approval related to the mix of
uses, signage, and site plan. Most recently, two (2) administrative amendments were
approved to allow changes to the Rocco's Tacos tenant space.
In October 2011, an administrative amendment (ADMN-11-07-000412) was approved to
allow modifications to the approved elevations, site plan, and landscape plan for Rocco's
Tacos restaurant in the tenant space previously occupied by Ouzo Blue. These
modifications included the addition of tiki torches, light baskets, fire pit, relocating the
pedestrian sidewalk adjacent to the tenant space, and altering the existing outdoor bar.
The elements of this approval were not implemented and installed in accordance with the
approved plans. The tiki torch poles, which were approved to be black, were painted lime
green (see Past Site Photographs). The window and door frames, which were not modified
with the subject petition, were also painted lime green. The number of light baskets installed
exceeded the total number approved for the site. There were also a number of art pieces,
signs, and outdoor seating furniture installed, which were not approved with the petition. The
City notified the Applicant of the various deviations.
As part of the Applicant's effort to bring the site into compliance with the approved plans, a
subsequent administrative amendment (ADMN-12-01-000448) was approved in January
2012. As part of the petition, the window mullions, door frames, and tiki torch poles were
approved to be painted brown, the approved light baskets were relocated within various
trees on the site (the total number of baskets previously approved was not exceeded),
outdoor wait stations were added, and outdoor artistic pieces were added. The site is
currently in compliance with the approved plans (see Existing Site Photographs).

The subject site is zoned PUD overlay with an underlying zoning of Mixed Use (MXD) and
Residential High (RH) and has Future Land-Use designations of Mixed Use (MXD),
Residential High (RH), and Residential Medium (RM). The site is also located within the PGA
Boulevard Corridor Overlay.

The subject petition does not propose any modifications to the existing concurrency
approvals.
PROJECT DETAILS
Site Details
Parcel 2 of the PGA Commons PUD is approximately nine (9) acres in size. The parcel has
vehicular access from PGA Boulevard and from Hickory Drive (see Location Map). No
changes to the existing access on site are proposed.
Subject Request
The Applicant is requesting a waiver to allow amber-colored light bulbs to be utilized within
the light baskets previously approved for the site, and is proposing to change the color of the
17 existing tiki torches from brown to lime green.
The light baskets were approved by the City and are currently installed within various trees
located in the outdoor seating area (see Approved Light Basket Exhibit). A total of 50 light
baskets were approved to be located within ten (10) trees surrounding the seating area. The
light baskets in the Approved Light Basket Exhibit show the baskets with the amber lights.
The baskets hang from the trees and currently contain clear bulbs in accordance with the
City's Code (see Existing Site Photographs). The Applicant would like to replace the existing
clear bulbs with amber-colored bulbs to create the desired ambiance for the outdoor seating
area.

The 17 existing tiki torches are located within the outdoor seating area of the Rocco's Tacos
restaurant (see Approved Site Plan). Currently, the tiki torch poles are brown and match the
brown colors of the door frames, window mullions, and awning poles as approved by the City
(see Existing Site Photographs). The Applicant is requesting approval to paint the tiki poles a
lime green color to be consistent with the restaurant's trademark (see Trademark Green).
The Applicant had initially painted the tiki torch poles lime green, but was required to repaint
the poles in accordance with the City's approval (see Past Site Photographs).

1) The Applicant has requested a waiver from Section 78-182(d)(1)(d)(2), Building and
Accent Lighting, to allow amber-colored light bulbs. Accent lighting includes any
lighting that is used to enhance, highlight, or define specific elements of landscaping,
art, or architecture. The subject light baskets are located within trees which surround
the outdoor seating area. The lights help to define the trees as well as the confines of
the outdoor seating area, which enhances the overall appearance of the restaurant
area. The City's Code requires accent lighting to contain clear bulbs without exterior
frosting, colors, or reflectors. The amber-colored lights give a yellow-orange hue and
present a minimal deviation from clear bulbs. They also help to create an outdoor
restaurant environment that is similar to the lighting inside the restaurant. Staff
supports the requested waiver.
Staff Analvsis
Staff is supportive of the Applicant's requested waiver to allow amber-colored lights in lieu of
clear bulbs within the existing light baskets, but is not supportive of the request to change the
color of the tiki torch poles from brown to lime green.
The proposed amber-colored light bulbs deviate minimally from a clear bulb. The light
produced from a clear bulb at night is very similar to the light produced by an amber bulb at
night. The ambiance of the outdoor seating area is created by the lighting from the light
baskets and the tiki torches. The fire from the tiki torches produces a yellow-orange hue,
which is similar to the hue produced by the proposed amber-color bulbs. Allowing the amber
bulbs would allow for consistency of the lighting on site. The code already allows the
Applicant to utilize colored lights for up to 90 days in a given calendar year for the purpose of
seasonal lighting. The impact the proposed change is minimal and staff is supportive of the
subject waiver request.
Unlike the proposed light bulb color change, the Applicant's request to change the colors of
the tiki torch poles presents a substantial character change to the site. The proposed lime
green color is part of the Applicant's trademarked colors and branding. The existing brown

color of the tiki torches matches the door frames and window mullians of the tenant space.
Changing the color of the torches to lime green would create inconsistency throughout the
exterior fa�ade of the tenant space.
The tiki torches are also visible from PGA Boulevard. Changing to such a bright and
contrasting color will negatively affect the character and aesthetic quality of the corridor.
Within the PGA Corridor, the City strives to do the following (Section 78-221(b)(2)):
1) Create a special identity for PGA Boulevard through the use of planning and design
standards.
2) Ensure high quality, architecturally compatible, consistently landscaped
development along the corridor
3) Regulate uses within the corridor which will create a specific character and
aesthetic quality for the corridor.
4) Ensure that new development or redevelopment projects preserve and enhance
the existing visual character of the corridor.
5) Promote and protect the health, safety and general welfare of the city.
The proposed lime green tiki torches are not in alignment with these standards.
The Applicant has received approval for numerous improvements to the site, which include
the addition of tiki torches, 50 light baskets, fire pit, several art pieces, and outdoor wait
stations. They have also altered the existing outdoor bar. These improvements have
allowed the tenant to create an environment that complements their restaurant theme while
remaining consistent with the aesthetic quality of the corridor. Allowing the tiki torches to be
painted lime green would be detrimental to the character of the site and create an
inconsistent color palette for the e�erior tenant space.
Due to the negative character change that would occur as a result of the proposed color
change, staff is not supportive of this aspect of the Applicant's request.

1. Explain the nature of the request: The applicant is requesting approval to modify the color for the
tiki torches to the establishmenYs trademarked color of "green"; to allow amber tinted light bulbs in the
existing hanging light baskets located outside in the seating areas.

There will be no adverse visual impact to the surrounding area within the PGA Boulevard parkway system. The
modifications will enhance the pedestrian experience by using amber tinted lighting, providing for a
more relaxed and enhanced experience within the parkway and outdoor seating area.
3. Describe how the rezoning request complies with the City's Vision Plan and the following elements
of the City's Comprehensive Plan - Future Land Use, Transportation, Housing, Infrastructure,
Coastal Management, Conservations, Recreation and Open space, Intergovernmental Coordination

This is not a request to rezone the property. Compiiance with the Vision Plan and the Comprehensive Plan
were addressed when the PUD was approved.

The Rocco's Taco's restaurant is located within The Commons "Central" (Parcel 2) on the
south side of PGA Boulevard west of the intersection of PGA Boulevard and Hickory Drive.
The Commons is a Mixed Use Planned Unit Development which includes a mixture of
retail, restaurants and residential uses.
The PGA Commons' unique design and character meets the intent of the Mixed Use
regulations creating a sense of space, pedestrian amenities, neighborhood and community
serving commercial uses and employment opportunities. The brightly colored art, varied
wall and awning colors, colorFul signage and tenant accents unify the project and create
visual interest. The requests proposed in this application will be consistent with and
enhance the overall appeal of the PGA Commons.
Colors
The applicant has made a substantial investment in branding and trademarking the
restaurant chain. The branding of Rocco's includes their logo, sculpture, lighting,
furnishings, and the colors they have used to pull the restaurant theme together.
The applicant has withdrawn their request for all proposed exterior color changes with the
exception of the request to allow the poles of the Tiki torches to be painted green. The
applicant respectfully requests approval to allow the small component of accent color to be
allowed on the Tiki torch poles which they believe would be in character with the color
accents and decorations provided by the property owner and other tenants at The
Commons. The Commons has become known for having a colorFul and eclectic blend of
art and eye catching accents which are designed to bring attention to the various
commercial establishments.
The addition of the trademarked "Green" to the Tiki Torch poles was originated as a
creative use of the color, but in practice the restaurant management, as well as others,
have found that by painting the torch poles a bright color, they are more visible to
pedestrians. The location of the torches have been placed to
avoid contact with the flow of pedestrian traffic, however, due to
the openness of the plaza and the success of the restaurant,

The applicant is requesting approval to allow the light baskets which are installed in the
trees, to have amber colored bulbs. The amber bulbs create a pleasant lighting effect for
the outdoor restaurant patrons. The amber light is easier on the eye, is consistent with the
lighting inside the restaurant and does not create lighting as harsh as white light does. The
light baskets generate light similar to the light emitted by the Tiki torches or lights such as
gas street lights. The code allows colored lights for three months in a year, this application
is requesting approval for a waiver from Section 78-182 (c)(6)(d)(1)(d)(ii) to allow the amber
colored light bulbs to remain year round.
The addition of Rocco's Tacos to The Commons has created a synergy that has been
missing in the plaza for quite a while. The success of the restaurant has brought people
from all areas of the county to the PGA Corridor and as a result other businesses have
benefited. The ownership group of Rocco's Tacos has made a major financial commitment
in the construction of the restaurant and is committed to remaining in this location for many
years. Rocco's management is committed to being good neighbors and tenants in the
plaza. They are also committed to the community as an employer and in support of
numerous charitable organizations. The applicant respectfully requests City Council
approval of the above.

1. Section 78-182(c)(6)(d)(1)(d)(ii), to allow amber colored bulbs to remain year
round.
(1) The request is consistentwith the city's comprehensive plan.
The proposed waiver is consistent with the Land Development Regulation that allows for
waivers in a PUD. The proposed waiver is not in violation of any of the policies of the
Comprehensive Plan. The Commons was developed in accordance with an approved
master plan, which was approved in accordance with the City's Comprehensive Plan.
(2) The request is consistent with the purpose and intent of this section.
This request is consistent with the provisions of the code that allow waiver requests from
the lighting code.
(3) The request is in support of and furthers the city's goals, objectives, and policies
to establish development possessing architectural significance, pedestrian
amenities and linkages, employment opportunities, reductions in vehicle trips, and a
sense of place.
The proposed waiver will allow a softer ambient light source which is pleasing to the eye
and consistent with an overall ambiance created by the restaurant. The restaurant is part of
a mixed used development which provides meandering pedestrian sidewalks, open plazas
with outdoor seating, community gathering spaces and mature landscaping. The proposed
lighting will enhance the experience of the pedestrians and diners.
(4) The request demonstrates that granting of the waiver will result in a development
that exceeds one or more of the minimum requirements for PUDs.
The Commons PUD exceeds the landscape and open space
code requirements. The proposed waiver will enhance the
common area and provide a soft ambient light for the plaza.

5) The request for one or more waivers results from innovative design in which
other minimum standards are exceeded.
The proposed waiver is the minimum waiver required to achieve the desired results. The
amber bulbs will create a pleasant atmosphere and a cohesive theme provided by the
restaurant. All other land development regulations have been met or exceeded.
(6) The request demonstrates that granting of the waiver will result in preservation
of valuable natural resources, including environmentally-sensitive lands, drainage
and recharge areas, and coastal areas.
The proposed waiver will not have any impact on any natural resources, drainage or land
area. The proposed light fixtures are installed in the landscape areas which were approved
as part of the PUD. The landscape areas are not impacted by the proposed waiver.
(7) The request clearly demonstrates public benefits to be derived, including but not
limited to such benefits as no-cost dedication of rights-of-way, extensions of
pedestrian linkages outside of the project boundaries, preservation of important
natural resources, and use of desirable architectural, building, and site design
techniques.
The approval of the PCD incorporated the dedication of public rights-of-way, construction of
roadway improvements, and employment opportunities. The proposed waiver is a major
component of a restaurant that has provided a needed synergy for the plaza and multiple
jobs.
(8) Sufficient screening and buffering, if required, are provided to screen adjacent
uses from adverse impacts caused by a vvaiver.
The site is adequately buffered by mature landscaping. Adjacent uses are non-residential
and will not be impacted by the proposed waiver.
(9) The request is not based solely or predominantly on economic reasons.
The proposed lights are a major component of an overall theme for the ambiance of the
restaurant. The lights are currently being used all of the other Rocco's Tacos sites
throughout the county and create an overall lighting theme. The proposed amber bulb is
more subdued and pleasing to the eye than the clear white lights allowed by code.
