Sanchez, Planning Manager DATE: December 2, 2005 SUBJECT: Banyan Tree PUD —Phase III: Public Art Workshop @ 12/8/05 AIPP Please be advised that there will be a discussion involving the public art for Phase III of the Banyan Tree Planned Unit Development (PUD) at the December 8, 2005, AIPP Advisory Board Meeting. The development plans for Phase III of the Banyan Tree PUD were approved by the City in May of 2005 that included two (2) office buildings totaling 24,700 square feet, a 2,78o square -foot bank, and a 5,000 square -foot restaurant. To date, the office buildings and the bank have been completed; the restaurant is expected to be completed in early 2006. The applicant has presented three (3) different options for a tile- mosaic design to be placed on an 8' -0" tall by 7' -4" wide pre -cast stone monument located within a plaza immediately northwest of the new restaurant building. The art will be produced by artist Paola Lopez. Staff has the following concerns relative to the proposed art and its location: ❖ The proposed art looks very similar to a patented City of Palm Beach Gardens logo that includes a Banyan Tree, which is seen throughout City Hall, on City literature, and on the front page of the City's website. The logo is attached hereto for your reference. ❖ The criteria for Art in Public Places established in Division 6 of the City's Land Development Regulations require, among other things, for public art to be placed in a location that is visible to the maximum number of passersby. The proposed location would be visible only to users of the site. It is important to note that the Art in Public Places for Phase I of the Banyan Tree PUD (Blood Bank) was placed along Northlake Boulevard (three (3) bronze sculptures of children playing instruments). d• The proposed tile- mosaic design on a stone monument has the appearance of constituting an additional monument sign for the Banyan Tree PUD instead of the public art for the site. Staff does not support any artwork that resembles an additional monument sign on site. Staff recommends that a more substantive art medium be utilized to draw the attention of the passersby. Staff strongly recommends that the Board deliberate this artwork relative to staffs concerns and direct the applicant to revisit the proposed artwork and its location. Also attached are comments on the plans from the City's Architectural Consultant, Oliver Glidden Spina & Partners, Inc. (OGSP), of which includes reconsideration of the sphere size. The CD and Final Cost Quote have been reviewed by City staff including the Construction Services Director, Building Official, and Facilities Maintenance Superintendent, all of which had minor comments and requests, which can and will be addressed by the Ms. Ross. The lighting and sculptural design including the "sphere" dimensions have been endorsed by our Art Consultant, Joel Straus. At the next AIPP meeting on December 8, 2005. the Board is requested to address OGSP's comments concerning the "sphere" size. In addition, the original budget allocation was $300,000 for all project expenses. Wendy Ross' preliminary budget as per the Agreement was $250,000. The Final Cost Quote has been submitted at $295,936, which is a $40,904 difference. The difference is mainly due to the increase in stainless steel prices since originally quoted in September 2004. As per Agreement, the City Council has three options: 1. Allow the project to go forward as presented, increase the Artist fee to $295,936, and amend the Agreement accordingly; 2. Require the Artist to redesign the project to reduce Final Cost Quote to the $250,000; or 3. Abandon the project at no cost to the City and terminate the contract for convenience. The AIPP Board is requested to review the attached documents, and make a recommendation for further approval by City Council at their January 5, 2006 meeting. The Board Chairperson or designee is also requested to attend the Council meeting to support the Board's recommendation. Joel Straus will also be in attendance. The sculpture is in 316L stainless to resist rust or corrosion. The upper element is electro- polished which will virtually eliminate any dust or debris collection and also will extend the life of the 316L. The lower elements are open at the bottom so any material that may penetrate will fall to the floor of the tower. All sides are enclosed in stainless mesh that will prevent accumulation of material. Lower supports are coated to prevent any rust or corrosion with an expected life of 20 years. The Colorblast fixtures are rated at IP66 with a temperature range of -4 degrees F to 122 degrees F ( -20C to 50C).
