Recommendation to City Council: A request by Mr. Mark Fuller on behalf of the Sembler
Company for approval of the proposed Art in Public Places for the commercial portion of the
Legacy Place Planned Community Development (PCD). The approximately 48.4-acre site is
generally located at the southeast corner of the intersection of PGA Boulevard and Victoria
Gardens Avenue.

BACKGROUND
On May 3, 2001, the City Council approved Ordinance 10, 2001 establishing the Legacy Place
Planned Community Development (PCD) consisting of approximately 74 acres of land located at
the southeast corner of the intersection of Alternate AlA and PGA Boulevard. Ordinance 10,
2001 rezoned the Legacy Place PCD from a Planned Development Area (PDA) zoning
designation to a Mixed-Use Planned Community District (MXD/PCD) Overlay zoning
designation and approved the development of 399,000 square feet of retail space, 69,000 square
feet of office space, and 384 apartment units.
Also on May 3, 2001, the City Council approved Resolution 58, 2001 and Resolution 59, 2001
providing for site plan approval for the commercial portion (Parcels A, B, and C) of the Legacy
Place PCD consisting of 399,000 square feet of commercial space and 69,000 square feet of
office space, as well as site plan approval for the residential portion (Parcel D) of the Legacy
Place PCD consisting of 384 residential units, respectively.
On July 1, 2004, the City Council adopted Resolution 129, 2004 approving a site plan
amendment to the commercial portion of the Legacy Place PCD. The subject site is currently
being developed in accordance with the plan approved by said resolution.
In accordance with Section 78-262 of the Land Development Regulations entitled Art in Public
Places, Fee Imposed on Development, all budgets for new construction of private and public
developments shall include one percent (1 %) of the total budget for vertical construction as a fee
for art in public places. The subject fee shall be used by the developer for the provision of
artwork on the project site, or the developer may choose to contribute one percent (1%) of the
total vertical construction costs directly to the City for the provision of art on public property.
Under the provisions of Section 78-261(a)(1) of the City's Land Development Regulations
entitled Deposit of Funds, prior to the issuance of a building permit on site, the petitioner is
required to place $250,000 into an escrow account, which represents one (1 %) percent of the
estimated total cost of vertical construction on site (please see the czttached project budget
breakdown).
PROPOSED ART IN PUBLIC PLACES
The proposed Art in Public Places designed by Mark Fuller is described below (please see
attached images and location maps):
Four Benches
This series of benches was created in homage to Henry Skokowski and references four (4)
environments of his life for which he was passionate. Aluminum castings of his various
footwear make a subtle pun to the addage that no one can fill these shoes.
Turbulent Indigo with a casting of his flip-flops reflects his love of being on, near, and under the
ocean. Multi-task references his office life. The dimpled metal texture is a common design
theme in his offices. His casual work shoes are cast. Busy / Simple portrays the cube; a form he
felt was "the perfect geometry." The hard, crisp cube is pierced with natural �vood tiinbers as
well as a Chinese red cube - a visual play on the eleinents. The red and black are symbolic of his

favorite color combination. Dress shoes sit on top. Heavenly Ride is fashioned to indicate his
love for riding his motorcycle; his preferred mode of transport... as well as his last.
Stack / 45
This installation was also created in homage to Henry Skokowski and is symbolic of his love for
contemporary music of all genres. Music played a large part in his life; to the extent that even
his professional e-mail correspondence was closed with the tag line of "The music will set you
free." This installation is an abstract stack of 45 RPM records splayed on a vertical arc to mimic
a jukebox carousel. A variety of colored spindle inserts will be a familiar key to recognizing the
roots of this construction. The two (2) concentric columns of five (5) horizontal ares reference
his age at passing: 55. The inner ring is the record label; the outer ring is the vinyl. Located in
the main traffic circle of Legacy Place, Stack / 45 was intentionally created as a light and airy
piece to minimize visual obstruction to traffic, as well as vistas to the water.
The Obelisk
This classic form will act as a landmark at the western perimeter of Legacy Place. Anchored
between two (2) bodies of water at the edge of a large open area, it is intended to emanate as a
noble, jewel-like element in the daylight and a colorfully glowing spire at night. It was the
request of the project developer that Mr. Fuller create this piece to specifically reference the
quality and community of Palm Beach Gardens.
ARTIST
Mark Fuller is an environmental graphic designer and creator of art works for a wide variety of
applications. Primarily oriented towards designing elements to enhance a sense of place, Fuller's
experience includes urban street furniture such as seating elements, water features, bollards,
lighting fixtures, banner hardware and graphics, tree grates, and telephone kiosks. Art in Public
Places programs have included kinetic constructions, compression-tension cable structures and
static free-standing elements (please see attached artist resume).
STAFF CONCERNS
Staff has the following concerns/issues with respect to the proposed Art in Public Places:
1. It is staff s opinion that the proposed benches should be designed such that persons will
be deterred from sleeping on them.
2. Staff has concern over the temperature of the metal benches on a hot day.
3. Staff recommends a description that identifies the significance and symbolism of each art
piece be located on or adjacent to each piece.
4. Staff is ambivalent about the symbolism of the proposed Stack / 45 piece.

provision of Art in Public Places. Should the Art in Public Places Advisory Board recommend
approval of the proposed art to the City Council, staff recommends the following conditions of
approval:
1. The applicant shall be responsible for maintenance of the works of art. (Planning &
Zoning)
2. The applicant shall submit photographs of the installed artwork within 60 days of
completion. (Planning and Zoning)

Top of obelisk to have polished stainless steel framed glass pyramid
with floor of dielectric coated film on acrylic lens.
Internal illumination by floor mounted metal halide fixtures.
